Recruitment - Proposed mode of Recruitment as per Committee's Report and DirectRecruitment to the Post of Assistant Engineers, Technical Assistants and Field Assistant(Trainee) and other approved 750 posts - sponsored by Employment Exchange,Apprentices in TNEB/TANGEDCO/TANTRANSCO and open market candidates -Orders Issued.

READ:-

Extract from the minutes of the 59th Meeting of the Boardof TANGEDCO held on 30.11.2015 - Item No. 49.

-----PROCEEDINGS:

Government of Tamil Nadu has issued G.O.Ms. No.44 Labour and Employment(T2) Department dated 11.03.2015 for implementation of the Judgment of the Hon'bleHigh Court in W.A.No. 1027 of 2013 and M.P.No.1 of 2013 while filling up the poststhrough Employment Exchange. In the G.O., in para 3, it is stated that the Hon'bleHigh Court of Madras in its order dated 02.08.2012 in W.P.No. 26162 of 2010 andM.P.No.1 of 2010 has quashed the selection process for appointment to the postsonly from candidates sponsored through Employment Exchanges and has orderedthat the State Government should take immediate steps to fill up the posts by invitingapplications from all eligible persons along with names sponsored by the EmploymentExchange by advertising in newspapers and other media to enable all the eligiblepersons to compete for the posts. The observation of the Hon'ble High Court in thesaid orders is as follows:-

"A writ in the nature of mandamus is issued directing the respondents toadvertise the posts in all leading newspapers and other media to enable all the eligiblepersons to compete for the post. The advertisement should show the number ofposts to be filled up, the qualification for the post. The age limit and relaxation in ageif any. The post reserved for different categories.

The respondents should also constitute selection committee, who shall adoptsthe criteria of selection before commencement of selection process laying down marksfor qualification, experience, interview etc., depending on the post to be filed up.

In view of the different Government orders placed on record, it is directed thatthe State Government should take immediate steps to fill up the posts by invitingapplications from all eligible persons, along with names sponsored by the EmploymentExchange after laying down criteria for selection, so as to select best available talent."

2) To implement the said G.O. in TANGEDCO, a Committee consisting of thefollowing officers has been formed under the Chairmanship of Director/ Distributionto study & report to the Board for taking a decision to implement on the mode ofrecruitment.

3) The above Committee submitted the reports regarding the proposed modeof recruitment. The Board after careful examination of the proposals for directrecruitment of various posts for Technical and Non-Technical, accorded approval for:-

a) Mode of Recruitment and Selection:

i) All posts should be filled up by issuing advertisement in at least 2 newspaperout of which one must be in vernacular language having wide circulation apart fromcalling for list from the Employment Exchange.

FEES :

Examination Fees : Rs. 500/- (Rupees Five hundred only)

(OC,BCO,BCM,MBC)

Examination Fees : Rs. 250/- (Rupees Two hundred and fifty only)

(SC/SCA/ST)

and

ii) The Selection will be made based on the following norms :

(ii a) Marks obtained in the competitive writtenexamination to be worked out for - 85%

(ii b) For viva-voce interview in Technical (or)Non- Technical (or) General Subject and managerial skills. - 15%

iii) The selection of all categories shall be made based on the merit of the abovemarks and as per Communal Roaster, If other things being equal, preference shouldbe given to the apprentices candidates who have completed Apprenticeship in ErstwhileTNEB, TANGEDCO/TANTRANSCO.

b) For direct recruitment of 300 Nos. of Assistant Engineer/Electrical, 25 Nos.of Assistant Engineer/Mechanical, 50 Nos. of Assistant Engineer/Civil, 500 TechnicalAssistant/Electrical, 25 Technical Assistant/Mechanical and 900 Field Assistant (Trainee)(Total 1800 Nos.)

c) For direct recruitment the candidates for 750 posts as detailed below:

PROCEEDINGS:

Orders were issued in the references first and second cited, allowing oneincrement equal to 3% of basic pay including Grade Pay on movement to SelectionGrade with effect from 1.12.2007. Subsequently, in the reference third and fourthcited, orders were issued during the Revision of Wages 2011 for grant of an additionalincrement to the employees @ 3% of pay plus Grade Pay on the date of movementto Selection Grade based on the orders of the Government of Tamil Nadu.

2. As per the existing orders, the employees of TANGEDCO are entitled torectification of pay anomaly, on par with their juniors promoted after movement toSelection Grade by grant of one increment @ 3%. In the reference fifth cited, ordershave been issued by the Government among other things for rectification of payanomaly to the seniors on par with their juniors who were promoted after movementto Selection Grade by obtaining an additional increment @ 3% (i.e., 3+3 = 6%). Ithas been represented to allow similar benefit in TANGEDCO by way of rectification ofpay anomaly. The request was examined.

3. After careful consideration, it is hereby ordered that the employees whohave been appointed/promoted to higher posts without moving to Selection Grade inthe lower post and thereby happen to draw less pay than their juniors who areappointed/ promoted to the higher posts after moving to the Selection Grade of thelower post, in the revised scales of pay, the pay of such seniors should be fixed in thehigher post equal to the pay of the Junior in the higher post with effect from the dateof drawal of higher pay by the Junior in the higher post subject to fulfillment of thefollowing conditions:-

i. Both the junior and senior employee should belong to the same cadre andthe post in which they have been promoted or appointed, should be identical and inthe same cadre.

ii. The scales of pay of the lower and higher posts in which they are entitled todraw pay should be identical.

iii. The pay anomaly should be arising directly as a result of fixation of pay in thepromotional post after fixation of pay in the Selection Grade of the lower post. Forexample, if even in the lower post the junior employee draws from time to time, ahigher rate of pay than the senior by virtue of grant of advance increment, theprovisions contained in this order should not be invoked to step up the pay of thesenior employee; and

iv. The orders re-fixing the pay of the seniors in accordance with the provisionsof this order should be issued under Regulation 48 of the Tamil Nadu Electricity BoardService Regulations. The next increment of the senior employee will be drawn oncompletion of the requisite qualifying service with effect from the date of re-fixationof the pay.

4. The above rectification of pay anomaly shall be made applicable to the seniorson par with their junior(s) who were moved to selection grade on or after01.12.2007 notionally with monetary benefit from the date of issue of orders.

-----PROCEEDINGS:

(1) Based on the 12(3) settlement dt.10.08.2007, signed before theCommissioner of Labour, the TNEB issued orders for revival of the post of Mazdoorand for absorption of contract labourers who have worked continuously in DistributionCircles, General Construction Circles and Wind Energy Development Circles asMazdoor, Helper cum Meter Reader and Assessor Grade - II in a phased manner videreference (1) read above. As per these orders, the contract labourers whosequalification was below 10th standard and 'nil' qualification have been appointed tothe post of Mazdoor.

(2) Further, based on the various demands from the unions, TANGEDCOconsidered the promotion of the Mazdoors absorbed vide 12(3) settlement in its22nd Board meeting held on 06.03.2012 and approved the proposal for the relaxationof rules relating to qualification of NTC/ NAC for promotion to the post of Helper in aphased manner and accordingly 6,593 Mazdoors were promoted as Helper (FieldAssistant) in the first phase, 4,660 Mazdoors were promoted as Helpers (FieldAssistant) in the second phase and 5,906 Mazdoors were promoted as Helpers(Field Assistant) in the last phase vide references (5), (6) and (7) read above.

(3) The Three Rural Electric Cooperative Societies viz. Kumbakonam,Vandavasi and Thirumayam was taken over by the Board vide B.P. No.19 dated13.07.2005 (Kumbakonam RECS), B.P. No.31 dated 20.09.2005 (Vandavasi RECS)and B.P. No.19 dated 13.07.2005 (Thirumayam RECS). The contract labourers whoworked in the above three societies (Vandavasi–52, Kumbakonam–129, Thirumayam–7) were engaged as Contract Labourers on daily wages. As per the reports of theSE/ Thiruvannamalai, Thanjavur and Pudukottai EDCs. and based on (Per) F.B.TANGEDCO Proceedings No.3 (Adm. Br.) dated 19.02.2011 vide reference (3) readabove, orders were issued to absorb the said 188 labourers as Temporary CasualLabourers for 1 year and after completion of 1 year service 113 were later absorbedas Mazdoor, 47 as Assessor Grade-II and 20 as Helper cum Meter Reader based ontheir qualification on par with labourers covered under 12(3) settlement.

(4) Further, during Jan’2012 orders were issued vide (Per) B.P (FB) No.2(Adm. Br.) dated 06.01.2012 vide reference (4) read above, for absorption of 232Temporary Casual Labourers and Contract Labourers who worked in (15 circles) PSC/ RCC Yard, Stores and Civil Wings as Mazdoor (204), Assessor Grade-II (25) andHelper cum Meter Reader (3) based on their qualification on par with labourers coveredunder 12(3) settlement.

(5) In the 59th Board meeting of TANGEDCO Ltd., held on 30.11.2015, theBoard has considered the representation of the unions to consider the promotion tothe above Mazdoors sympathetically and approved the proposal for the relaxation ofrules relating to qualification of NTC/ NAC in favour of the 317 (204 + 113) Mazdoorsabsorbed from the RCC / PSC Yard, Stores, Civil Wings and the then 3 Rural Electric

Co-operative Society (Thiruvannamalai, Pudukottai and Thanjavur EDCs.) and forconsidering them for promotion to the post of Helper (Field Assistant).

(6) Accordingly, the TANGEDCO hereby directs that the 317 Mazdoorsabsorbed from the RCC / PSC Yard, Stores, Civil Wings and the then 3 Rural ElectricCo-operative Societies (Thiruvannamalai, Pudukottai and Thanjavur EDCs.) asmentioned in the Annexure shall be promoted as Helper (Field Assistant) in the timescale of pay of Rs.5,400 - 20,200 + 1,900 G.P if they are or otherwise suitable.Consequent on promotion of the above Mazdoors the post of 317 Mazdoors shall beabolished.

(7) The Superintending Engineers are informed that the promotion of theMazdoors as Helpers (Field Assistant) as mentioned in the Annexure are to be issuedimmediately. Further the Superintending Engineers are informed to adhere to thefollowing points while issuing orders to the above Mazdoors as Helpers (FieldAssistants):

(i) The Mazdoors who are not willing for promotion as Helpers may be permittedto relinquish their rights for promotion (Temporary or Permanent) and continue inservice as Mazdoors till their age of 60 years.

(ii) The Mazdoors who have completed 58 years of age need not be promotedas Helper and they should be allowed to continue as Mazdoor up to the age of 60years.

(iii) That no reversion shall be accepted to the old post of Mazdoor if thepromotees have joined as Helper.

3. The Tamil Nadu Cable TV Corporation Ltd., has approached the TANGEDCOand expressed their desire to undertake the collection of current consumption chargesthrough online mode similar to the Banks’ Counter collection through the counters ofCommon Service Centres at various State Government offices in Tamil Nadu.

4. Taking into consideration the functional necessity to strengthen the collectionmechanism and also the magnitude of TANGEDCO’s transactions, the C.M.D/TANGEDCO has approved on 15.6.2015 to include the Tamil Nadu Cable TVCorporation as a Non-banking collection agency along with the existing collectionBanks. Initially 23 C.S.Cs of the Tamil Nadu Cable TV Corporation Ltd. were givenaccess for collection of Low Tension Current Consumption charges on pilot basis.Additional 258 locations have been identified by Tamil Nadu Cable TV Corporation Ltd.In all, 281 Common Service Centres of Tamil Nadu Cable TV Corporation Ltd. havebeen white listed by TANGEDCO to enable collection of Current Consumption Billsfrom L.T Consumers of TANGEDCO from 01.11.2015 vide Lr.No.CFC/REV/FC/REV/DFC/REV/TACTV-CSC/D.642/15, Dt. 27.10.2015.

5. The Board of Directors of TANGEDCO in its 59th meeting held on 30.11.2015has approved to include the Tamil Nadu Cable TV Corporation Ltd. as one of itsCollection agencies, for the collection of L.T. bills through the Common Service Centres(C.S.Cs) of Tamil Nadu Cable TV Corporation Ltd., through the “Common Portal” ofTamil Nadu - e-Governance Agency, all over Tamil Nadu. The Board of Directors of TANGEDCO Ltd has approved and passed thefollowing Resolutions in connection with mobilisation of funds through private placementof Bonds to the tune of Rs.50.00 crore with option to retain oversubscription up toRs.50.00 crore against the Government Guarantee in TANGEDCO BondSeries 2/2015-2016.

a. Resolved that the TANGEDCO is hereby authorized to mobilise funds throughPrivate Placement of bonds - 6th tranche, TANGEDCO Bond Series-2/2015-2016, tothe tune of Rs.50.00 crore with option to retain oversubscription up to Rs.50.00crore against the Government Guarantee at the coupon rate of 10.00% p.a. (payablesemi-annually).

b. Resolved further that M/s. Real Growth Securities Pvt Ltd, New Delhi, ishereby appointed as merchant banker for mobilisation of funds of Rs. 50.00 crorewith option to oversubscription upto Rs.50.00 crore against the GovernmentGuarantee at the coupon rate of 10.00 % p.a. 2. TERMS AND CONDITIONS

The terms and conditions for the above term loan of Rs.12309.31 Lakhs(Rs.4966.58 + Rs.3516.38 + Rs. 3826.05) for as stipulated by the REC Ltd., NewDelhi, in their letters dt 09.10.2015 is follows:

Amount : Rs. 12309.31 Lakhs (Rupees Twelve thousand three hundred and nine lakhs and thirty

one thousand only)

Rate of interest : The interest shall be charged on the loan at the rate prevailing on the date of each

disbursement as per REC's latest loan policy circular.

Tenure : 13 years including 3 years moratorium for repayment of principal.

Repayment : 10 years after the moratorium period of 3 years in ten annual equal instalments.

Validity of sanction : Within 6 months from the date of sanction.

Security : Mortgage/Hypothecation of future assets so created out of loan amount sanctioned for

(TANTRANSCO) the project subject to the value being 110% of the loan amount so sanctioned. The

security by way of creation of charges on FUTURE ASSETS ONLY shall be accepted

subject to the loan amount being restricted to 90 % of the project cost.

2. After careful consideration, the TANTRANSCO have approved and to acceptthe Rs.12309.31 Lakhs (Rs.4966.58 Lakhs + Rs.3516.68 Lakhs + Rs. 3826.05Lakhs) for 3 Nos. Transmission Schemes under P:SI (Transmission) categorysanctioned by Rural Electrification Corporation Ltd., (REC Ltd.,) New Delhi and acceptingall the terms and conditions mentioned in REC sanctioned letter dated 09.10.2015.

The following resolutions may also be passed as requested by Rural ElectrificationCorporation.

RESOLUTIONS

I. RESOLVED that the Tamil Nadu Transmission Corporation Ltd.,(TANTRANSCO) do accept the Term Loan of Rs.12309.31 Lakhs(Rs.4966.58 + Rs.3516.68 + Rs. 3826.05) for 3 Nos. IV. RESOLVED FURTHER that the common seal of the Company be affixedon the security documents and any other related documents as may be required byREC in the presence of Director (Finance) and Managing Director or Director/Transmission project and the Company Secretary shall sign the same in token thereof.

M/s Lanco Infra Tech Limited, Gurgaon (LITL) the EPC contractor for the "1x660MW Supercritical ETPS Expansion Project" have requested TANGEDCO for openingLetter of credit (LC) in favour of the Off shore supplier for making payment directly tothe Off shore supplier in respect of foreign supplies (Non Indian origin) covered in theSupply P.O to ensure payment security for the Off shore supplier. The request of theEPC contractor needs modification/amendment in the payment terms of the SupplyP.O. The Board after careful examination of the above has approved the proposal asbelow.

"The Board was appraised that the proposed amendment in the payment termsby way of opining of Letter of credit (LC) in favour of the Off shore supplier of the EPCcontractor in respect of the foreign supplies is to enable them to supply the materialand start the erection works at the earliest.

The payment to the Off shore supplier shall be as per the approved Billingbreakup based on the invoice of the EPC contractor. The total payment shall notexceed the EPC value accepted in the contract. There will be no additional financialimplication/ loss to the Board in opening the Letter of credit directly in favour of theoff shore supplier. The Board after careful examination of the above, approved theproposal." Accordingly the following proposal placed before the Board is herebyapproved:-

i) To consider the request of M/s Lanco Infra Tech Limited, Gurgaon the EPCcontractor for "1x660 MW Supercritical Ennore Thermal Power Station Expansionproject" for making payment through Letter of credit (LC) directly in favour of theirOff shore supplier in respect of the imported supplies (Non Indian origin) to be suppliedunder the contract for the Main equipments and Mandatory spares.

The Tender for the EPC Contract for BTG Package for the establishment of2X800 MW Supercritical Coal based Uppur Thermal Power Project at RamanathapuramDistrict has been called for vide Specification No.SE/E/T&H(P)/OT No.01/2015-16.M/s. BHEL, New Delhi and M/s. Doosan Power Systems India Pvt. Ltd., Mumbai havesubmitted tenders and the same were opened on 19.10.2015.

On initial scrutiny of the bids, it was observed that there was some discrepancyin authentication in the offer submitted by M/s. Doosan Power Systems India Pvt.Ltd., Mumbai.

The subject was placed before the TANGEDCO Board for deliberations anddiscussions whether the Bid submitted by M/s. Doosan Power Systems India Pvt.Ltd., Mumbai be further be taken up for processing. The TANGEDCO Board in its 59th

meeting held on 30.11.2015 examined the proposal and decided to get legal opinionfrom the Advocate General before deciding further on the issue.

Based on the above, the Advocate General, Government of Tamil Nadu wasrequested to offer his considered opinion as to whether the TANGEDCO may considerthe offer of M/s. Doosan Power Systems India Pvt. Ltd., Mumbai, notwithstanding

the discrepancies in authenticating various vital documents of the offer or the offermay be rejected in terms of rule 28 (3) of the Tamil Nadu Transparency in TenderRules and Tender Specification.

Advocate General of Tamil Nadu vide letter dated 17.12.2015, while furnishinghis opinion has stated that

"Under the provision of the Rules, the Tender Accepting Authority may rejectthe tender where the crucial documents have not been signed. Clause 15 is specificthat the bids not confirming to the requirements of signing of the pages are liable forrejection. This is coupled with the fact that Section 27 is specific that such bid will berejected which makes it clear that the unsigned bid is not a bid in the eye of law. Thenon-signing of the bid proposal is a material defect within the meaning of Clause 25.5and the said infirmity goes to the root of the matter. The question can be consideredfrom another point of view also in that it is well open to the bidder to state in anysubsequent legal proceedings that the bid given by him is not a bid in the eyes of lawsince the bid proposal has not been signed on each page."

The Advocate General of Tamil Nadu is of the view that, since M/s. DoosanPower Systems India Pvt. Ltd., Mumbai, has not signed the pages of the bid proposal,the Bid is liable to be rejected.

Taking into account the opinion of the Advocate General of Tamil Nadu, theTamil Nadu Generation and Distribution Corporation Board accorded approval for thefollowing :

1. To reject the Bid submitted by M/s. Doosan Power Systems India Pvt. Ltd.,Mumbai, against Specification No.SE/E/T&H(P)/OT No.01/2015-16 for the tenderfor Design, Manufacture, Supply Erection, Testing and Commissioning of Boiler, Turbineand Generator (BTG) Package and allied Civil work related to BTG on Engineering,Procurement and Construction (EPC) basis for the establishment of 2 x 800 MWUppur Thermal Power Project at Ramanathapuram, in accordance with the TamilNadu Tender Transparency Rules 2000, Rule 28(2) (b)(i) and Rule 28(3) since thebidder has not signed the pages of the Bid proposal.

M/s. Suzlon Energy Limited, Chennai on reimbursement basis for use at 230 KVSankaneri SS. Accordingly, M/s. Suzlon Energy Ltd has supplied the 230 KV CT andthe same was erected and commissioned at Sankaneri 230 KV SS on 15.09.2014.

In the mean while, one more similar 230 KV 1000-500/1A CT in 230/110 KVAuto Transformer - II failed in the Sankaneri SS on 05.02.2015 due to internal fault.M/s. Suzlon Energy Limited reported that they had procured 2 Nos 230 KV CTsoriginally, out of which, 1 No.230 KV CT had been spared to TANGEDCO already andnow they are willing to spare the other CT also on reimbursement basis.

CMD/TANGEDCO has accorded approval to procure the additional 1 No 230 KV5 core special type current transformer for replacement of the failed CT at 230 KVSankaneri SS on reimbursement basis, so as to avoid blocking of wind powergeneration. M/s. Suzlon Energy Limited shall furnish undertaking in lieu of Bankguarantee for the 2 Nos. 230 KV CTS to be supplied by them, as per TANGEDCOnorms of warranty/guarantee period.

The reimbursement cost of 2 Nos. 230 KV CTs is Rs. 4,77,149/- all inclusive.The cost has been arrived at as per the conditions stipulated in CMD ProceedingsNo.248, dt. 17.06.2014 cited under reference (3).
