The Shaker Heights Board of Education met in regular session on Tuesday, June 24, 2014, at 6:00 p.m. in the small auditorium of Shaker Heights High School, 15911 Aldersyde Drive, Shaker Heights, Ohio 44120. 1. OPENING OF MEETING CALL TO ORDER At 6:01 p.m. President William L. Clawson II, who presided over the meeting, called the meeting to order. 1.1 PLEDGE OF ALLEGIANCE Superintendent Dr. Gregory C. Anyone who wishes to speak at the time designated by the President should raise his or her hand and, when called upon, stand and state his or her name and address for the record. Because comments sometimes concern complex topics requiring research, an immediate response should not be expected. Board and staff members may be contacted for follow-up. Twelve individuals including former students, current and former staff and community members stood and spoke in support of Ms. Cheryel Jennings, Security Monitor at the High School, who is scheduled for termination on tonight’s Board agenda. There being no further comments, the meeting continued. 1.4 APPROVAL OF BOARD MEETING MINUTES At the recommendation of Board President Clawson, and upon receiving a motion and a second, the Board of Education will vote on approving the unofficial minutes for the May 13, 2014 Regular Board Meeting and the May 28, 2014 Special Board Meeting as presented in the attachments below. 1.5 RECOGNITION/HONORS OF STAFF AND STUDENTS At this time Superintendent Hutchings acknowledged staff and/or students for special recognition and/or honors as follows:

Five Shaker Heights High School students finished in the top 10 in their divisions at this year’s National History Day competition in College Park, Md.

Fifteen Shaker Heights High School students earned medals for their top scores on the National Roman Civilization Exam, a test of the history and culture of the ancient Romans from 753 BC to the end of the reign of Constantine the Great.

Four of our High School students won honors in various photo contests, including the Shaker Heights Landmark Commission’s second annual Preservation Month Photo Contest.

Thirty-four Shaker students have been awarded for their outstanding performance on the National French Exam sponsored by the American Association of Teachers of French.

A Shaker Heights Middle School eighth-grader, who won the school’s Geography Bee for the second time, competed at the state-level National Geographic Bee this year.

Another Middle School eighth-grader placed 13th in the state out of more than 700 student writers who competed at the Power of the Pen state tournament at the College of Wooster.

Two of our recent graduates earned certification in the Ohio Peace Officers Training Academy.

A High School student is one of 32 students from around the country selected to participate in Economics for Leaders this summer, a program sponsored by the Foundation for Teaching Economics.

Eight Shaker Heights High School students placed first or second in the Chinese Essay Contest sponsored by the Confucius Institute at Cleveland State University and the Ohio Association of Teachers of Chinese.

2. APPROVAL OF ALL ACTION ITEMS AND REPORTS – PERSONNEL 2.1 APPROVAL OF ALL CERTIFIED AND CLASSIFIED PERSONNEL ITEMS At the recommendation of Superintendent Gregory C. Hutchings, Jr., and upon receiving a motion and a second, the Board of Education will vote on approving all personnel items. Note-section Categories 3. Personnel and 4. Addendum-Personnel of the agenda may be acted on in one motion. Note-all personnel actions are for the 2014-2015 school year unless otherwise noted.

Before the vote, the Superintendent and Board members deleted the scheduled action for termination of Ms. Cheryel Jennings from Section 3.13, and referred it for

14-06-64 2.2 PUBLIC MEETING ON THE ISSUE OF REEMPLOYMENT Reemployment guidelines have been established by Ohio law in House Bill No. 95. Under this bill, when a board of education wants to consider reemploying a retiree in the same position held prior to retirement, a prescribed process must be followed. First, a public notice announcing a public meeting considering the reemployment must be placed at least sixty days prior to the reemployment action. The Treasurer has certified that such notice was placed in the May 15, 2014 edition of the Sun Press. Second, such public meeting must take place between 15 and 30 days before the reemployment action (expected to be on July 15, 2014). As announced in that notice, the meeting this evening satisfies the second requirement for any member of the public to provide input on the reemployment of:

Dr. Robert Schneider, Teacher at the High School, and Mr. John Sweeney, Teacher at Mercer Elementary School.

At this time, the public is invited to provide input on the issue of their reemployment. One audience member teacher Robert White inquired as to whether or not the new OTES evaluations were considered in these decisions, to which the Superintendent answered in the affirmative. 8. ACTION ITEMS AND REPORTS - TREASURER - FINANCE & BUDGET 8.1 MONTHLY FINANCIAL REPORT At the recommendation of Treasurer Bryan C. Christman, and upon receiving a motion and a second, the Board of Education will vote on approving the monthly financial report consisting of the financial statements for the month and year-to-date ended May 31, 2014 (attached Exhibit T-1 in Subject Section 8.2), the Interim Investments (attached Exhibit T-2 in Subject Section 8.3), and the Transfers & Advances Between Funds listed in Subject Section 8.4. Note-Subject Sections 8.2, 8.3 and 8.4 of the agenda may be acted on in one motion. 8.2 FINANCIAL STATEMENTS It is recommended that the attached monthly financial statements for the month and year-to-date ended May 31, 2014 (Exhibit T-1) be accepted and placed on file for audit. President Clawson asked Mr. Christman to review the highlights of the financial statements. He commented on items as delineated in the financial & miscellaneous

briefs and as follows:

MAY 2014 FINANCIAL OVERVIEW The revenue activity for the month and for the fiscal year-to-date (YTD) May 2014 has been very similar to the same reporting period for the prior year with the following exceptions:

As discussed last month, although State Foundation YTD receipts are $569,583 or 4.6% above budget for YTD due to the State’s uneven adjusting of the fiscal 2014 payments to reflect the new biennial budget formula, our projections through the end of the fiscal year indicate State Foundation collections will approximate $14.1 million, for a $463,000 or 3.4% favorable variance from the budgeted $13.6 million. The $463,000 variance includes a $160,000 favorable adjustment to the Fiscal 2013 Final #2 settlement as a result of an increase in the State’s per pupil final allocation. Because the District is subject to the “gain cap” (which means that the District funding in Fiscal 2014 is as per calculated under the new formula, subject to a limit of 6.25% gain or increase above the prior year funding amount), the Fiscal 2013 Final #2 increase triggered the Fiscal 2014 funding to increase $141,000 under the gain cap calculation. Excluding the prior year adjustment and its impact to the current year, the remaining variance of $162,000 represents a 1.2% variance from budget (only 0.22% when you net the $132,000 increase in Scholarship Transfers this year vs. last, which are recorded as out-of-district tuition expenses). The District gain cap, the amount of money not being paid to the District under the provisions of the “gain cap” limitation for this year, approximates $1.7 million.

As previously reported, the real estate tax collections for the second half of calendar 2013 were $179,000 below budget for the first half of the fiscal year. Regular tax collections during the second half of the fiscal year (first half of calendar 2014) were $1,020,000 higher than budgeted, but the supplemental delinquency collection was $532,000 less than last year and budget thereby resulting in a projected net $309,000 favorable variance for the fiscal year.

As reported last month we know that the Homestead Exemption & Rollback (HERB) payment will be lower than expected resulting in an unfavorable budget variance for the year approximating $159,000. Accordingly, the projected total real estate tax/HERB variance for the year nets to a favorable $150,000 ($309,000 favorable real estate less the $159,000 unfavorable HERB variance), or about 0.2% variance from budget.

The expenditure activity for the month and for the fiscal YTD May 2014 continues to be better than expected as purchased services are $1.1 million below budget YTD, with total expenditures $2.5 million below budget YTD. A portion of these variances are considered timing, however, we are estimating an overall $1.7 million favorable variance (excluding the $2 million transfer to the Capital Fund approved at the March 11th Board meeting) in expenses projected through the fiscal yearend including $340,000 for salaries & wages; $217,000 for health insurance expenses (in accordance with the slight overall decrease of 1.9% vs. the budgeted 7% increase in health insurance renewal rates effective January 1st); $350,000 for repairs & maintenance; $175,000 for capital outlay; $500,000 for all other purchased services; and $200,000 for textbooks, materials & supplies. In May, the District received $1.2 million of the total $1.4 million (estimated as $1.3 million net of settlement expenses) payment in final settlement of the OfficeMax 2004 & 2005 delinquent tangible personal property tax. In late March and early May we received from the State the $714,000 for the final settlement of the Fiscal 2010 and Fiscal 2011 Medicaid reimbursement program cost reports. Such receipts have resulted in additional favorable variances to the budgeted revenues. As mentioned above, $2 million of these two windfall receipts will be

transferred to the District’s Capital Fund in June as approved by the Board at the March 11th Board meeting. In summary, at this time it is expected that the District’s finances projected through fiscal yearend will exceed expectations and result in favorable revenue and expenditure variances as compared to the annual appropriation (see the actual/projected financial statement in Section 4 of this financial report). Special Education Catastrophic Aid Reimbursement Submission: The District recently prepared and submitted a request for reimbursement of special education catastrophic costs for fiscal 2013 totaling $1,823,427, which represented a $6,925 or 0.4% decrease from the fiscal 2012 reimbursement calculation amount of $1,830,352. The fiscal 2013 submission consisted of 1 more individual claim (87 in fiscal 2013 as compared to 86 in fiscal 2012). Although when originally instituted by the Ohio Legislature the catastrophic aid reimbursement submissions were paid at 100%, the State has in recent memory reimbursed less than 20%. Last year the reimbursement rate was only 19.6% for the fiscal 2012 calculation amount, thus we received only $358,645 of the $1,830,352 submission. Although the State has significantly increased their allocation to fund this item over the prior year, the final % payment will depend on the number and volume of dollars submitted by districts statewide. The budgeted receipt for this item is $359,000 or just about 20% of our submission amount. We anticipate receiving the reimbursement prior to the end of the fiscal year. Worker’s Compensation Legal Case: The 8th District Court of Appeals has recently affirmed a March 2013 Cuyahoga County Court of Common Pleas ruling in a legal case known as San Allen vs. Ohio BWC (reference the March 2013 Financial Briefs) that ordered the Ohio BWC to refund $859 million to about 264,000 employers who did not participate in special rated groups, after charging them excessive insurance premiums over the eight-year period 2001-2008. The original estimated refunds which did not include interest ranged from a few cents to $2 million per employer. Since the District paid “minimum” premiums approximating 30% each year in accordance with the “retrospective rating” program, we should in theory be included in any such group eligible for a refund for at least that portion of our total BWC payments. Whether or not actual claims payments or if “retrospective rating” employers will participate in any refund pool is yet to be determined. The Ohio BWC has requested that the Court of Appeals “stay the execution” of the judgment pending their appeal to the Ohio Supreme Court. Mr. Christman also reported on the following legislative items:

Mid-Biennium Review (MBR) House Bill No. 483: The legislative vehicle

for the general policy and spending provisions was signed by the Governor on June 16th. He line-item vetoed three items that included various tax breaks. The bill includes accelerating the planned 1% State income tax reduction retroactive to January 1, 2014.

8.7 ADOPTION OF THE SHAKER HEIGHTS PUBLIC LIBRARY TAX BUDGET It is recommended that the Board of Education adopt the 2015 Shaker Heights Public Library Tax Budget (Exhibit T-5 attached below) as approved by the Library Board of Trustees on June 9, 2014 and that the Treasurer be directed to file the tax budget with the Cuyahoga County Budget Commission. 9. REPORTS - STRATEGIC PLAN 9.1 STRATEGIC PLAN - UPDATE This month's Strategic Plan update was incorporated into the Board's approval of the Strategic Plan earlier in the meeting. 10. SUPERINTENDENT'S REPORT 10.1 SUPERINTENDENT'S REPORT Dr. Hutchings introduced the following new hires: Tiffany L. Preston has joined the staff as Executive Assistant to Superintendent Gregory C. Hutchings, Jr. She replaces Carole West, who retired after 13 years of service. She will manage the day-to-day operations of the Superintendent’s office, maintain schedules, and coordinate special projects. Preston comes to the District from a similar role at the Cleveland Institute of Music, where she provided administrative support to the president and vice president for nearly four years. Stephen M. Wilkins, formerly chief operations officer of a large school district outside Atlanta, is now Assistant Superintendent of Business and Operations for the Shaker Heights City School District. He will be responsible for oversight of facilities, maintenance and custodial services, human resources, transportation, and food service. A graduate of the United States Military Academy at West Point, Wilkins spent 27 years in the Army, serving for several years in operations management at the Pentagon. John J. Rizzo, previously Information and Communication Technology Coordinator for the Mayfield City Schools, is the new Director of Technology and Media Services for the Shaker Heights City School District. In this role, he will set the direction and priorities for technology and library media services for the District, with a focus on supporting the curriculum and integrating technology into instruction. He will also provide oversight for technology-based business functions throughout the District. Lynne S. Kulich, former Coordinator of Instruction for the Massillon City School District, is now Director of Curriculum for the Shaker Heights City School District. In this new position, she will oversee the development of a unified curriculum that provides continuity of instruction, aligns with the new state academic content standards, and leverages the benefits of the International Baccalaureate

Programme for all students in grades Pre-K-12. David Glasner, who served as principal of the Urban Assembly Academy of Government and Law, a public high school in New York, takes on the role of Shaker Heights Middle School principal. Glasner holds a BA and an MA in history from the University of Pennsylvania and a master’s degree in secondary school social studies education from Teachers College, Columbia University, as well as administrative certification from the College of Saint Rose. Dr. Hutchings also reported the following: A special thanks to everyone who helped with the High School commencement. Dr. Hutchings introduced Ouimet Smith, Registrar, who gave an update on the MSAN conference he and others attended. The State is working on putting in place a new assessment test for future graduates. The Class of 2018 will not be required to take the OGT test as there will be a new assessment in place. 11. EXECUTIVE SESSION 12.1 EXECUTIVE SESSION At the recommendation of Board President Clawson, and upon receiving a motion and a second, the Board of Education will vote on recessing the meeting and entering into executive session to discuss employee personnel matters under Ohio Revised Code Section 121.22(G)(1); to discuss matters relative to the preparation for collective bargaining negotiations under ORC Section 121.22(G)(4); and to discuss matters required to be kept confidential by federal law or regulations or state statutes under ORC Section 121.22(G)(5).
