Sir, This has reference to your application No. Nil dated 25.09.2014 and subsequent letter dated 23.12.2014 seeking prior Environmental Clearance on the above-mentioned project. 2. The Ministry of Environment, Forests & Climate Change has considered the application. It is noted that the proposal is for grant of Environmental Clearance for Construction of residential building on plot bearing C.T.S. No. 1269[pt] of village Kirol at Chittaranjan Nagar Rajawadi, Ghatkopar (East), Mumbai, Maharashtra by MIs Tanishq Builders & C.A. to Chittaranjan Nagar Vidya CBS. Ltd. The proposal was considered in the 141 st EAC meeting held on 26 th - 28 th November, 2014. The proponent has informed that: 1. The proposal involves Construction of residential building on plot bearing C.T.S. No. 1269[pt] of village Kirol at Chittaranjan Nagar Rajawadi, Ghatkopar (East), Mumbai, Maharashtra located on 19°04'47.10"N Latitude and 72°53'56. 19"E Longitude. 11. The proposed project is accessible by 9.1m wide Chittaranjan Road and 6.1 m wide road connecting to R N Gandhi Road. The proposed site is located about 0.16 km away from Vidyavihar Railway Station. iii. Proposed project consists of one residential building with 5 wings. Total 382 nos. of tenements shall be developed. The Plot area of proposed site is 7,806.72 m", FSI area is 26,347.01 sqm, Non FSI area 15,846.20 sqm and total construction area is 42,193.21 sqm. Maximum height of the building is 48.15 m. iv. Total water requirement during construction phase is 36 KLD which will be met through private water tankers. This has reference to your application No. Nil dated 25.09.2014 andsubsequent letter dated 23.12.2014 seeking prior Environmental Clearance onthe above-mentioned project.

2. The Ministry of Environment, Forests & Climate Change has consideredthe application. It is noted that the proposal is for grant of EnvironmentalClearance for Construction of residential building on plot bearing C.T.S.No. 1269[pt] of village Kirol at Chittaranjan Nagar Rajawadi, Ghatkopar(East), Mumbai, Maharashtra by MIs Tanishq Builders & C.A. toChittaranjan Nagar Vidya CBS. Ltd. The proposal was considered in the 141st

EAC meeting held on 26th - 28th November, 2014. The proponent has informedthat:

1. The proposal involves Construction of residential building on plot bearingC.T.S. No. 1269[pt] of village Kirol at Chittaranjan Nagar Rajawadi,Ghatkopar (East), Mumbai, Maharashtra located on 19°04'47.10"NLatitude and 72°53'56. 19"E Longitude.

11. The proposed project is accessible by 9.1m wide Chittaranjan Road and6.1 m wide road connecting to R N Gandhi Road. The proposed site islocated about 0.16 km away from Vidyavihar Railway Station.

iii. Proposed project consists of one residential building with 5 wings. Total382 nos. of tenements shall be developed. The Plot area of proposed site is7,806.72 m", FSI area is 26,347.01 sqm, Non FSI area 15,846.20 sqm andtotal construction area is 42,193.21 sqm. Maximum height of the buildingis 48.15 m.

iv. Total water requirement during construction phase is 36 KLDwhich willbe met through private water tankers. During Operation phase, the totalwater requirement R estimated to be 192 KLDwhich will be met through

Municipal Corporation of Greater Mumbai and treated waste water. Freshwater requirement will be about 128 KLD during Non-Monsoon Seasonand 78 KLDin Monsoon Season. The Waste water generation is estimatedto be 173 KLDwhich will be treated in the STP. Sewage Treatment Plantof total capacity 180 KLDwill be provided. About 67 KLDof treated wastewater will be reused (64 KLDfor flushing and 3 KLDfor gardening).

v. Construction waste is proposed to be reused in pavement. Duringoperational phase, the Solid waste generation is estimated to be 710kg/ day. It will be segregated into biodegradable (waste vegetables andfoods etc.) and recyclable (paper, cartons, thermocol, plastics, glass etc.)components and collected in separate bins.

vi. Parking facility for 360 numbers for four wheelers proposed to beprovided against the requirement of 328 numbers (according to localnorms). _

vii.The total energy consumption is estimated to be 2.6 MW which will bemet from Reliance.

viii. DG sets of 750 kVAcapacity for power back up are proposed.ix. Rain Water harvesting potential is estimated to be 42.8 KLD. 4 RWH

tanks of total 100 KLD capacity for harvesting after filtration areproposed.

x. Energy conservation measures with 21.30 % of power saving areproposed.

xi. Trees cutting: 17 numbers of trees to be cut and 60 numbers of treesaplings to be planted.

xii.The total cost of the project is Rs. 93 Crores.X111. Wildlife issues: There are no National Parks, Wildlife Sanctuary,

Biosphere Reserves found in the 10 km buffer zone.XlV. Forest land: No Forest land involvement in the project.xv. There is no court cases/violation pending with the project proponent.XVI. The Project Proponent vide letter no. Nil dated 23.12.2014 has given

undertaking that he is in possession of the land and all the valid buildingand town planning permission for the entire project.

3. The proposal was considered by the Expert Appraisal Committee (EAC)and recommended in its 141st EAC meeting held on 26th - 28th November, 2014for granting Environmental Clearance. The Ministry of Environment, Forests &Climate Change hereby accords Environmental Clearance for the above-mentioned Construction of residential building on plot bearing C.T.S. No.1269[pt] of village Kirol at Chittaranjan Nagar Rajawadi, Ghatkopar (East),Mumbai, Maharashtra by M/ s Tanishq Builders & C.A. to ChittaranjanNagar Vidya CHS. Ltd. under the provisions of the Environment ImpactAssessment Notification, 2006 and amendments thereto and Circulars issuedthereon and subject to the compliance of the following specific conditions, inaddition to the general conditions mentioned below:

PARTA - SPECIFICCONDITIONS

I. Construction Phase

(i) The Project Proponent shall obtain all necessary clearance/permission from all relevant agencies including town planningauthority before commencement of work.

(ii) "Consent for Establishment" shall be obtained from State PollutionControl Board under Air (Prevention and Control of Pollution) Act,1981 and Water (Prevention and Control of Pollution) Act, 1974.

(iii) The project will comprise of one residential building with 5 wings.Total 382 nos. of tenements shall be developed. The plot area ofproposed site is 7,806.72 m2, FSI area shall be 26,347.01 sqm, NonFSI area shall be 15,846.20 sqm and total construction area shallbe 42,193.21 sqm. Maximum height of the building shall be 48.15m.

(iv) Total water requirement during construction phase is 36 KLDwhichshall be met through private water tankers. During Operationphase, the total water requirement is 192 KLD which shall be metthrough Municipal Corporation of Greater Mumbai and treatedwaste water. Fresh water requirement is 128 KLD during Non-Monsoon Season and 78 KLDin Monsoon Season. The Waste watergeneration is 173 KLD which shall be treated in the STP. SewageTreatment Plant of total capacity 180 KLDshall be provided.

(v) Construction waste shall be reused in pavement. Duringoperational phase, the Solid waste generation is 710 kg/ day whichshall be segregated into biodegradable (waste vegetables and foodsetc.) and recyclable (paper, cartons, thermocol, plastics, glass etc.)components and collected in separate bins.

(vi) Parking facility for 360 numbers for four wheelers shall be providedagainst the requirement of 328 numbers (according to local norms).

(vii) The total energy consumption is 2.6 MW which shall be met fromReliance.

(viii) DG set of 750 kVA capacity for power back up shall be provided.D.G sets shall be at least 6 m away from the boundary.

(ix) Rain Water harvesting potential is 42.8 KLD. 4 RWH tanks of total100 KLDcapacity for harvesting after filtration shall be provided.

(x) 17 numbers of trees shall be cut and 60 numbers of tree saplingsshall be planted.

(xi) The Project Proponent shall comply with the conditions of NOC/Clearance obtained from fire department.

(xii) All the construction shall be in accordance with the local buildingbyelaws. Project Proponent shall obtain all necessary clearances.

(xiii) The Project Proponent shall put in place a credible enforcementmechanism for compliance of energy conservation measures with itsallottees, in perpetuity.

(xiv) Suitable toilet fixtures for water conservation shall be provided.

(xv) Proponent shall obtain permission for ground water withdrawal fromState Ground Water Authority, if applicable.

(xvi) The rainwater harnesting plan should be incorporated by the CGWA.EC_Tanishq_Builders ~ Page 3 of 8

(xvii) Provision shall be made for the housing of construction labourwithin the site with all necessary infrastructure and facilities suchas fuel for cooking, mobile toilets, mobile STP, safe drinking water,medical health care, creche etc. The housing may be in the form oftemporary structures to be removed after the completion of theproject.

(xviii)A First Aid Room will be provided in the project both duringconstruction and operation of the project.

(xix) All the topsoil excavated during construction activities should bestored for use in horticulture/landscape development within theproject site.

(xx) Disposal of muck during construction phase should not create anyadverse effect on the neighbouring communities and be disposedtaking the necessary precautions for general safety and healthaspects of people, only in approved sites with the approval ofcompetent authority.

(xxi) Soil and ground water samples will be tested to ascertain that thereis no threat to ground water quality by leaching of heavy metals andother toxic contaminants.

(xxii) Construction spoils, including bituminous material and otherhazardous materials, must not be allowed to contaminatewatercourses and the dump sites for such material must be securedso that they should not leach into the ground water.

(xxiii)Any hazardous waste generated during construction phase, shouldbe disposed off as per applicable rules and norms with necessaryapprovals of the State Pollution Control Board.

(xxiv)The diesel generator sets to be used during construction phaseshould be low sulphur diesel type and should conform toEnvironment (Protection) Rules prescribed for air and noise emissionstandards.

(xxv) The diesel required for operating DG sets shall be stored III

underground tanks and clearance from Chief Controller ofExplosives shall be ta.ken, as applicable.

(xxvi)Vehicles hired for bringing construction material to the site shouldbe in good condition and should have a pollution check certificateand should conform to applicable air and noise emission standardsand should be operated only during non-peak hours.

(xxvii)Ambient noise levels should conform to residential standards bothduring day and night as per Noise Pollution (Control and Regulation)Rules, 2000. Incremental pollution loads on the ambient air andnoise quality should be closely monitored during constructionphase. Adequate measures should be made to reduce ambient airand noise level during construction phase, so as to conform to thestipulated standards by CPCB/ SPCB.

(xxviii) Fly ash should be used as building material in the construction asper the provisions of Fly Ash Notification of September, 1999 andamended as on 27th August, 2003.

(xxix)Ready mixed concrete must be used in building construction.

(xxx) Storm water control and its re-use as per CGWB and BIS standardsfor various applications.

(xxxi) Water demand during construction should be reduced by use of pre-mixed concrete, curing agents and other best practices referred.

(xxxii) Permission to draw ground water shall be obtained from thecompetent Authority prior to construction/ operation of the project.

(xxxiii) Separation of grey and black water should be done by the use ofdual plumbing line for separation of grey and black water.

(xxxiv) Fixtures for showers, toilet flushing and drinking should be of lowflow either by use of aerators or pressure reducing devices or sensorbased control.

(xxxv) Use of glass may be reduced by up-to 40% to reduce the electricityconsumption and load on air-conditioning. If necessary, use highquality double glass with special reflective coating in windows.

(xxxvi) Regular supervision of the above and other measures for monitoringshould be in place all through the construction phase, so as to avoiddisturbance to the surroundings.

(xxxvii)Under the provisions of Environment (Protection) Act, 1986, legalaction shall be initiated against the project proponent if it was foundthat construction of the project has been started without obtainingenvironmental clearance.

II. Operation Phase

(i) The treated wastewater of about 67 KLD shall be recycled andreused for flushing of toilets (64 KLD) and gardening (3 KLD) toreduce the demand of fresh water, as committed.

(ii) Solid waste management shall be collected, treated disposed inaccordance with the Municipal Solid Waste (Management &Handling) Rules, 2000. No municipal waste should be disposed offoutside the premises.

(iii) The Operation and Maintenance of STP shall be made in the MoUwith STP supplier. Project Proponent shall ensure regular operationand maintenance of the STP.

(iv) Parking facility with 6 m driveway shall be provided as committed.

(v) The installation of the Sewage Treatment Plant (STP) should becertified by an independent expert and a report in this regardshould be submitted to the Ministry before the project iscommissioned for operation. Treated affluent emanating from STPshall be recycl~/ reused to the maximum extent possible.

Treatment of 100% grey water by decentralized treatment should bedone. Discharge of unused treated affluent shall conform to thenorms and standards of the State Pollution Control Board.Necessary measures should be made to mitigate the odour problemfrom STP.

(vi) The solid waste generated should be properly collected andsegregated. Wet garbage should be composted and dry/inert solidwaste should be disposed off to the approved sites for land fillingafter recovering recyclable material.

(vii) Diesel power generating sets proposed as source of back-up powerfor elevators and common area illumination during operation phaseshould be of enclosed type and conform to rules made under theEnvironment (Protection) Act, 1986. The height of stack of DG setsshould be equal to the height needed for the combined capacity ofall proposed DG sets. Use low sulphur diesel. The location of theDG sets may be decided with in consultation with State PollutionControl Board.

(viii) Noise should be controlled to ensure that it does not exceed theprescribed standards. During night time the noise levels measuredat the boundary of the building shall be restricted to thepermissible levels to comply with the prevalent regulations.

(ix) The green belt of the adequate width and density preferably withlocal species along the periphery of the plot shall be raised so as toprovide protection against particulates and noise.

(x) Rain water harvesting for roof run- off and surface run- off, as plansubmitted should be implemented. Before recharging the surfacerun off, pre-treatment must be done to remove suspended matter,oil and grease. The borewell for rainwater recharging should be keptat least 5 mts. above the highest ground water table.

(xi) Energy conservation measures like installation of CFLs/TFLs for thelighting the areas outside the building should be integral part of theproject design and should be in place before project commissioning.Use CFLs and TFLs should be properly collected and disposed off/sent for recycling as per the prevailing guidelines/rules of theregulatory authority to avoid mercury contamination. Use of solarpanels may be done to the extent possible.

PART - B. GENERAL CONDITIONS

(i) A copy of the environmental clearance letter shall also be displayedon the website of the concerned State Pollution Control Board. TheEC letter shall also be displayed at the Regional Office, DistrictIndustries centre and Collector's Office/ Tehsildar's office for 30days.

(ii) The funds earmarked for environmental protection measures shallbe kept in separate account and shall not be diverted for otherpurpose. Year-wise expenditure shall be reported to this Ministryand its concerned Regional Office.

4. Officials from the Regional Office of MoEF&CC, Nagpur who would bemonitoring the implementation of environmental safeguards should be given fullcooperation, facilities and documents/data by the project proponents duringtheir inspection. A complete set of all the documents submitted to MoEF&CCshould be forwarded to the CCF, Regional office of MoEF&CC,Nagpur.

5. In the case of any change(s) in the scope of the project, the project wouldrequire a fresh appraisal by this Ministry.

6. The Ministry reserves the right to add additional safeguard measuressubsequently, if found necessary, and to take action including revoking of theenvironment clearance under the provisions of the Environmental (Protection)Act, 1986, to ensure effective implementation of the suggested safeguardmeasures in a time bound and satisfactory manner.

7. All other statutory clearances such as the approvals for storage of dieselfrom Chief Controller of Explosives, Fire Department, Civil Aviation Department,Forest Conservation Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall beobtained, as applicable by project proponents from the respective competentauthorities.

8. These stipulations would be enforced among others under the provisionsof Water (Prevention and Control of Pollution) Act, 1974, the Air (Prevention andcontrol of Pollution) act 1981, the Environment (Protection) Act, 1986, the PublicLiability (Insurance) Act, 1991 and EIA Notification, 2006.

9. The project proponent should advertise in at least two local Newspaperswidely circulated in the region, one of which shall be in the vernacular languageinforming that the project has been accorded Environmental Clearance andcopies of clearance letters are available with the State Pollution Control Boardand may also be seen on the website of the Ministry of Environment, Forests &Climate Change at http://www.envfor.nic.in. The advertisement should be madewithin Seven days from the date of receipt of the Clearance letter and a copy ofthe same should be forwarded to the Regional Office of this Ministry at Nagpur.

10. This Clearance is subject to final order of the Hon'ble Supreme Court ofIndia in the matter of Goa Foundation v/ s. Union of India in Writ Petition (Civil)No.460 of 2004 as may be applicable to this project.

11. Any appeal against this clearance shall lie with the National GreenTribunal, if preferred, within a period of 30 days as prescribed under Section 16of the National Green Tribunal Act, 2010.

12. A copy of the clearance letter shall be sent by the proponent to concernedPanchayat, Zilla Parisad/Municipal Corporation, Urban Local Body and theLocal NGO, if any, from whom suggestions/ representations, if any, werereceived while processing the proposal. The clearance letter shall also be put onthe website of the company by the proponent.

13. The proponent shall upload the status of compliance of the stipulated ECconditions, including results of monitored data on their website and shall updatethe same periodically. It shaPlsimultaneously be sent to the Regional Office of

MoEF&CC, the respective Zonal Office of CPCB and the SPCB. The criteriapollutant levels namely; SPM, RSPM, S02, NOx (ambient levels as well as stackemissions) or critical sectoral parameters, indicated for the project shall bemonitored and displayed at a convenient location near the main gate of thecompany in the public domain.

14. The environmental statement for each financial year ending 31st March inForm-Vas is mandated to be submitted by the project proponent to theconcerned State Pollution Control Board as prescribed under the Environment(Protection) Rules, 1986, as amended subsequently, shall also be put on thewebsite of the company along with the status of compliance of EC conditions andshall also be sent to the respective Regional Offices of MoEF&CCbye-mail.
