ADDENDUM TO THE STEP II CONSENT AGREEMENT BETWEEN MANEESH LAL MEHRA, M.D., AND THE STATE MEDICAL BOARD OF OHIO 20-CRF-0018 This Addendum [Addendum] to the Step II Consent Agreement between Maneesh Lal Mehra, M.D., and the State Medical Board of Ohio that was effective on July 8, 2015 [July 2015 Step II Consent Agreement], is entered into by and between Maneesh Lal Mehra, M.D. [Or. ADDENDUM TO THE STEP II CONSENT AGREEMENT

AND THE STATE MEDICAL BOARD OF OHIO

20-CRF-0018

This Addendum [Addendum] to the Step II Consent Agreement between Maneesh Lal Mehra, M.D., and the State Medical Board of Ohio that was effective on July 8, 2015 [July 2015 Step II Consent Agreement], is entered into by and between Maneesh Lal Mehra, M.D. [Or. Mehra], and the State Medical Board of Ohio (Board], a state agency charged with enforcing Chapter 4731., Ohio Revised Code.

Dr. Mehra enters into this Addendum being fully informed of his rights under Chapter 119., Ohio Revised Code, including the righl to representation by counsel and the right to a formal adjudicative hearing on the issues considered herein.

BASIS FOR ACTION

This Addendum is entered into on the basis of the following stipulations, admissions and understandings:

A. The Board is empowered by Section 4731.22(8), Ohio Revised Code, to limit, revoke, suspend a certificate, refuse to register or reinstate an applicant. or reprimand or place on probation the holder of a certificate for a violation of Section 4731.22(8)(15), Ohio Revised Code, for •[v]iolation of the conditions of limitation placed by the board upon a license or certificate to practice," as that clause is used in Section 4731.22(8)(15), Ohio Revised Code.

B. The Board enters into this Consent Agreement in lieu of formal proceedings based upon the violation of Section 4731.22(8)(15), Ohio Revised Code, as set forth in the Notice of Opportunity for Hearing issued to Or. Mehra by the Board on or about February 12, 2020, Case number 20-CRF-0018, a copy of which is attached hereto and incorporated herein. The Board expressly reseNes the right to institute formal proceedings based upon any other violations of Chapter 4731. of the Revised Code, whether occurring before or after the effective date of this Addendum.

C. Dr. Mehra's certificate to practice medicine and surgery, license number 35.094934, is currently subject to certain terms, limitations, and conditions pursuant to the aforementioned July 2015 Step II Consent Agreement.

D. Dr. Mehra states that he is not licensed to practice in any other state or jurisdiction.

E. Dr. Mehra admits the factual and legal allegations as set forth in the aforementioned February 12, 2020 Notice of Opportunity for Hearing.

AGREED CONDITIONS

Wherefore. in consideration of the foregoing and mutual promises hereinafter set forth, and in lieu of any fonnal proceedings at this time, Dr. Mehra knowingly and voluntarily agrees with the Board to the following tenns, conditions and limitations:

1. Within thirty days of the effective date of this Addendum, Dr. Mehra shall remit payment in full of a monetary fine of one thousand dollars ($1,000.00). Such payment shall be made in full via credit card In the manner specified by the Board through its online portal, or by other manner as specified by the Board. Further, Dr. Mehra acknowledges and agrees that his failure to timely remit full payment shall constitute a violation of this agreement and agrees to pay all reasonable costs associated with the collection of any payment.

2. Dr. Mehra shall continue to be subject to the tenns, conditions, and limitations set forth in the aforementioned July 2015 Step II Consent Agreement, as subsequently modified by the Board on or about August 12, 2015; October 14, 2015; September 14, 2016; May 10, 2017; November 8, 2017; and August 14, 2019.

REQUIRED REPORTING BY LICENSEE

3. Within thirty days of the effective date of this Addendum, Dr. Mehra shall provide a copy of this Addendum to all employers or entities with which he is under contract to provide health care services (including but not limited to third party payors) or is receiving training, and the Chief of Staff at each hospital where he has privileges or appointments. Further, Dr. Mehra shall promptly provide a copy of this Addendum to all employers or entities with which he contracts to provide health care services, or applies for or receives training, and the Chief of Staff at each hospital where he applies for or obtains privileges or appointments. In the event that Dr. Mehra provides any health care services or health care direction or medical oversight to any emergency medical services organization or emergency medical services provider, within thirty days of the effective date of this Addendum Dr. Mehra shall provide a copy of this Consent Agreement to the Ohio Department of Public Safety, Division of Emergency Medical Services. Further, within thirty days of the date of each such notification, Dr. Mehra shall provide documentation acceptable to the Secretary and Supervising Member of the Board demonstrating that the required notification has occurred.

4. Within thirty days of the effective date of this Addendum, Dr. Mehra shall provide a copy of this Addendum by certified mail to the proper licensing authority of any state or jurisdiction in which he currently holds any professional license, as well as any federal agency or entity, including but not limited to the Drug Enforcement Agency, through which he currently holds any license or certificate .. Or. Mehra further agrees to provide a copy of this Addendum by certified mall at time of application to the proper licensing authority of any state in which he applies for any professional license or for reinstatement of any professional license. Additionally, within thirty days of the effective date of this Addendum, Dr. Mehra shall provide a copy of this

Addendum to any specialty or subspecialty board of the American Board of Medical Specialties or the American Osteopathic Association Bureau of Osteopathic Specialists under which he currently holds or has previously held certification. Further, within thirty days of the date of each such notification, Or. Mehra shall provide documentation acceptable to the Secretary and Supervising Member of the Board demonstrating that the required notification has occurred.

5. Dr. Mehra shall promptly provide a copy of this Addendum to all persons and entities that provide Dr. Mehra chemical dependency treatment or monitoring. Further, within thirty days of the date of each such notification, Dr. Mehra shall provide documentation acceptable to the Secretary and Supervising Member of the Board demonstrating that the required notification has occurred.

DURATION/MODIFICATION OF TERMS

The terms, limitations, and conditions of this Addendum may be amended or terminated in writing in accordance with the terms set forth in the July 2015 Consent Agreement.

ACKNOWLEDGMENTS/LIABILITY RELEASE

By executing his signature on this Addendum, Dr. Mehra agrees that in the event the Board, in its discretion, does not ratify this Addendum, this settlement offer is withdrawn and shall be of no evidentiary value and shall not be relied upon or introduced in any disciplinary action or appeal by either party. Dr. Mehra and the Board further agree that if this Addendum is not approved, it shall not constitute an admission against interest in this proceeding and shall not prejudice the ability of the Board to adjudicate this matter.

This Addendum represents the sole and entire agreement of the parties hereto in Case number 20-CRF-0018. No party to this agreement has been induced to enter into the Addendum by any representations or inducements except those expressly set forth in this written agreement. Further, all parties agree that to the extent any language in the agreement will be interpreted in a subsequent dispute, no ambiguous language shall be construed against the party drafting this Addendum.

Dr. Mehra acknowledges that he has had an opportunity to ask questions concerning the terms of this Addendum and that all questions asked have been answered In a satisfactory manner.

Any action initiated by the Board based on alleged violations of this Addendum shall comply with the Administrative Procedure Act, Chapter 119., Ohio Revised Code.

Dr. Mehra hereby releases the Board, its members, employees, agents, officers and representatives jointly and severally from any and all liability arising from the within matter.

This Addendum shall be considered a public record as that term is used in Section 149.43, Ohio Revised Code. Further, this information may be reported to appropriate organizations, data banks and governmental bodies. Dr. Mehra acknowledges that his social security number will be used if this information is so reported and agrees to provide his social security number to the Board for such purposes.

In accordance with Chapter 119., Ohio Revised Code, you are hereby notified that the State Medical Board of Ohio [Board] intends to determine whether or not to limit, revoke, permanently revoke, suspend, refuse to grant or register or renew or reinstate your license or certificate to practice medicine and surgery, or to reprimand you or place you on probation for one or more of the following reasons:

(1) On or about July 8, 2015, you entered into a Step II Consent Agreement [July 2015 Consent Agreement] with the Board that reinstated your license to practice medicine and surgery and place you on probation for a period of at least five years [Probationary Period]. Under the terms of the July 2015 Consent Agreement, you were to comply with certain terms and conditions during the Probationary Period. You have failed to comply with all of the terms of the Probationary Period .

(2) Examples of your failure to comply with the terms and conditions of the Probationary Period include, but are not limited to the following:

(a) Paragraph 15 of the July 2015 Consent Agreement provides as follows:

Dr. Mehra shall maintain participation in an alcohol and drug rehabilitation program, such as A.A. , N.A., C.A., or Caduceus, no less than three times per week. Substitution of any other specific program must receive prior Board approval.

Dr. Mehra shall submit acceptable documentary evidence of continuing compliance with this program, including submission to the Board of meeting attendance logs [Attendance Logs], which must be received in the Board's offices no later than the due date for Dr. Mehra's quarterly declarations.

On or about September 14, 2016, the Board modified this condition of probation, decreasing your required participation to two meetings per week with a minimum of ten meetings per month.

Despite these provisions, you failed to submit such attendance logs at any time from January 1, 2019, through June 30, 2019 and for December 1, 2019, through December 31, 2019.

(b) Paragraph 14 of the July 2015 Consent Agreement provides as follows:

Before engaging in any medical practice, Dr. Mehra shall submit to the Board in writing the name and curriculum vitae of a monitoring physician for prior written approval by the Secretary or Supervising Member of the Board.

* * *

In the event that the designated monitoring physician becomes unable or unwilling to serve in this capacity, Dr. Mehra must immediately so notify the Board in writing. In addition, Dr. Mehra shall make arrangements acceptable to the Board for another monitoring physician within thirty days after the previously designated monitoring physician becomes unable or unwilling to serve, unless otherwise determined by the Board.

Although you previously had an approved monitoring physician, that physician became unwilling to serve. You have failed to obtain a new monitoring physician, although you have continued to practice medicine.

(c) Paragraph 1 0 of the July 2015 Consent Agreement provides as follows:

Dr. Mehra shall submit to random urine screenings for drugs and alcohol at least two times per month, or as otherwise directed by the Board. Dr. Mehra shall ensure that all screening reports are forwarded directly to the Board on a quarterly basis.

* * * Dr. Mehra shall submit, at his expense and on the day selected, urine specimens for drug and/or alcohol analysis. * * * Refusal to submit such specimen, or failure to submit such specimen on the day he is selected or in such manner as the Board may request, shall constitute a violation of this Consent Agreement.

* * * Dr. Mehra shall ensure that the urine screening process performed through the Board-approved drug testing facility and/or collection site requires a daily call-in procedure; that the urine specimens are obtained on a random basis; and that the giving of the specimen is witnessed by a rel iable person.

You failed to call in or timely call in or, if selected to test, failed to provide a urine specimen for testing on the following dates: April 10, 2019; May 3, 2019; July 8, 2019; July 16, 2019; July 31 , 2019; and October 9, 2019.

(d) Paragraph 18 of the July 2015 Consent Agreement provides as follows:

Within thirty days of the effective date of this Consent Agreement, Dr. Mehra shall submit to the Board for its prior approval the name and qualifications of a psychiatrist of his choice. Upon approval by the Board, Dr. Mehra shall undergo and continue psychiatric treatment at least once every three months or as otherwise directed by the Board. Dr. Mehra shall comply with his psychiatric treatment plan, including taking medications as prescribed and/or ordered for his psychiatric disorder. Dr. Mehra shall ensure that psychiatric reports are forwarded by his treating psychiatrist to the Board on a quarterly basis, or as otherwise directed by the Board.

You failed to submit or caused to be submitted the psychiatric report due on October 1, 2019.

Your acts, conduct, and/or omissions as alleged in paragraphs (1) through (2) above, individually and/or collectively, constitute "[v] iolation of the conditions of limitation placed by the board upon a license or certificate to practice," as that clause is used in Section 4731.22(B)(15), Ohio Revised Code.

Furthermore, for any violations that occurred on or after September 29, 2015, the board may impose a civil penalty in an amount that shall not exceed twenty thousand dollars, pursuant to Section 4731.225, Ohio Revised Code. The civil penalty may be in addition to any other action the board may take under section 4731.22, Ohio Revised Code.

Pursuant to Chapter 119., Ohio Revised Code, you are hereby advised that you are entitled to a hearing in this matter. If you wish to request such hearing, the request must be made in writing and must be received in the offices of the State Medical Board within thirty days of the time of mailing of this notice.

You are further advised that, if you timely request a hearing, you are entitled to appear at such hearing in person, or by your attorney, or by such other representative as is permitted to practice before this agency, or you may present your position, arguments, or contentions in writing , and that at the hearing you may present evidence and examine witnesses appearing for or against you.

In the event that there is no request for such hearing received within thirty days of the time of mailing of this notice, the State Medical Board may, in your absence and upon consideration of this matter, determine whether or not to limit, revoke, permanently revoke, suspend, refuse to grant or register or renew or reinstate your certificate or license to practice medicine and surgery or to reprimand you or place you on probation .

Please note that, whether or not you request a hearing, Section 4731.22(L) , Ohio Revised Code, provides that "[w]hen the board refuses to grant or issue a license or certificate to practice to an applicant, revokes an individual's license or certificate to practice, refuses to renew an individual's license or certificate to practice, or refuses to reinstate an individual's license or certificate to practice, the board may specify that its action is permanent. An individual subject to a permanent action taken by the board is forever thereafter ineligible to hold a license or certificate to practice and the board shall not accept an application for reinstatement of the license or certificate or for issuance of a new license or certificate."
