Dr Norman Mark Hornstein, graduate of the Middlesex Hospital, Univer-sity of London in 1941, appeared before the Board of Medical Examiners with thercqucst that he be granted license to practice medicine in the State of NorthCarolina in order that he might be able t;o practica on the Outer Banks, vrh rethere is no physician at the present time

The following is letter under data of July 12th, 1948 from I' PEDavis, Superintendent of the Dare County Bo-rd of Public Wielfare, to Hon.R. Bruce Etheridge:

"You knc;, what a struggle we have had over thc past several yeers in an effort;to get a doctor to looate at Buxton for service to t;he people on the South Banks.

"About tvro years ago a young doctor from Yonkers, N; Y. , by the rema of NormanHornstain visited at Buxton on a vacation. I believe he had his family with

him. He became verv much interested in the possibilities of such a loc..-ition,especially in view of the fact that the Coast Guard Infirmary and equ'pment wasavailable for tha use of any doctor who locates there. He came by my office andtalked vrith me and I was very favorably impressed with the man. He is young,active and well trained. Since then we have had intermittent correspondence,

"The difficulty in the vrhole case novr is that Dr. Norman Hornstein was educat-ed in a foreign medical college and the State Board of Medical Examiners ofNorth Carolina are not willing to acoept; persons educated in foreign schools ~

Hovravar, we now learn that tne college in which Dr ~ Hornstein was educated isreoognizad as a grade A institution by the American Medical Association. Dr.Hornstein was re jected by the Board of Medical Examiners of North Carolina hbouta year ago. Hc plans now to go for another examination on July 22nd, althoughhc is no sure he can appear in person. I am going to insist tha t he make apersonal appearanoe because I feel that this vrill aid a great' deal to hischances of getting a license in this sta".e. He has been practicing in the

State of New York and was in the armed forces service as a doctor duringWorld War II."The purpose of this letter is to ask you to talk vvith the Board of MedicalExaminers there -in Raleigh and go over thiscase oarefully with the Secretaryor Chairman and see if there is not a chance of getting lioense, even tem-porary or special, so that Dr. Hornstein oan come ard serve these needypeople before winter. The folks on Che Banks and I will certainly appre-ciate your assistance. It will demand a personal contact from you, I am sure. "

The fo3.lowing is a letter under date of July 14th, 1948 from Hon.R; Bruce Etheridge, North Carolina Department of Conservati on and Development:

"I am enolosing a letter from my friend, Ike Davis of Manteo, N. C ~ , which isself-explanatory. Please read same and make any suggestions Chat in youropinion might be helpful. As you probably know, Buxton is on the Outer Banks,and we have always exper ienced much difficulty in keeping a dootor in thatarea. In Mr. Davis' letter it appears that Dr. Hornstein seems to be in-terested and willing to looate there, provided the barriers which would pre-vent him from looating there could be remedied. I shall appreoiate anythingthat you could advise us Co do. "

Dr. Hornstein stated that it was his desire Co establish permanentresidenoe on the Outer Banks.

After considerable discussion the following resolution was made

by Dr. R. B. MoKnight:

'RESOLVED: That after reviewing the case of Dr. Norman Mark Horn-stein, he be given limited medical license to practice on the Outer Banks ofNorth Carolina, provided his credentials are in order. This motion was dulyseconded and passed by a vote of five Co one, Dr. Thomas Les3. ie Lee opposingthe same.

The board suggested Co Dr. Hornstein that he attemot no ma jor sur-gery other than an emergencv and that he refer his surgioa3. cases to nearbyqualified hospitals ~

Dr. Paul G. Parker reported Co the board that he understood DrWiley Royster Young was pract icing medicine and doing all right; th". t he hadnot seen him to da te ~

The following letter under date of July 1st, 1948 from Dr. J, H.McNeill, Counoilor of the Eighth Distriot, was reported to the board:

"I have the unpleasant duty of informing you that a couple of our doctorsin this district are getting into trouble with narcotics and alcohol. Dr.Carl V. Tyner of Leaksville reported to me yesterday at the eighth Districtmeeting, that Drs. John S ~ Stone and Phil Ray of' Leaksville are overindulg-

ing alcohol and both are narcotic addicts. It seems Chat the doctors inLeaksville consider both men to be dangerous to their patients. I willappreciate it if you will Cake the necessary steps to help Chem and to pro-tect their patients. "

The board instructed Che secretary to request investigation bythe Narcotic Bureau of Dr. John S. Stone and Dr. Samuel Philip Ray, bothof Leaksville, and that the Board of Censors of Rookingham County MedicalSociety also make an investig'. Cion and report Co the Board of Medical Exam-iners ~

Dr. Thomas Leslie Lee moved that if in the opinion of the exam-iner, urinary e..amination be made on an alleged na rcotio addict, that theBoard of Medioal Examiners defray expenses of said examination. This motionwas duly seoonded and passed unanimously.

IN RE: Dr. John Samuel Hooker: Di' John Samuel Hooker, whosemedical license was revoked on June 20th, 1945, made application by letterunder date of July 12th, 1948, for a hearing before the Board of MedicalExaminers for the purpose of obtaining reinstatement of his lioense.

Dr. Hooker appeared before the board and requested reinstatement ofhis medioal lioense. Dr. H. F. Eason, Superintendent of the Eastern NorthCarolina Sanatorium, appeared on behalf of Dr. Hooker.

Dr. Eason stated that Dr. Hooker began work in the Negro Divisionof the Eastern North Carolina Sanatorium in May, 1947; that he has workedclosely with Dr. Hooker and his work has been entirely sat isfactory from astandpoint of assooiation with the sta.."f and in the care of patienty; thathe has been authorized to give him a raise in salary if the action of theboard were favorable. He said Dr. Hooker had bought a home in Wilson; thathe had been a gentleman, a good citizen and a wonderful assistance in thehospital. Dr. Eason said he would not hesitate to recommend that Dr. Hookerbe given another chanoe and thought he was ready "or it.

The following resolution was made by Dr. M. D. Bonner:practice

RESOLVED: That the medioal license of John Samuel Hooker, M. D. Co/'in the State of North Carolina is here'oy reinstated in full. FURTHER RESOLVED,that Dr. Hooker remain on probation and if at anytime his oonduct is unbecom-ing that of a physician in the j dgment of this board, his license will auto-natically be revoked. This motion was seconded and passed unanimously.

The following letter from Dr, James M, Northington was presented tothe board:

"The enclosed letter which has just oome in oocasions this last appeal. Ihope you will bear with me. Magnolis pop. some 750, is in Duplin County. In1942 when the last Am. Med. Directory was published it had four doctors. Forsome 18 mos. it has had none ~ For same reason this Miss Cox wrote me askingthat I try to get them a doctor. I replied, first with the idea of interest-ing someone else; then, vihen I learned that my own troubles were not over, witha view to going there myself, provided your board would acoept that solution.You see the situation. This is my last appeal. Muoh as I am assured ofthe favorable issue of an appeal Co. the oourts, I can not bear for the sakeof my family to go through with the newspaper publicity incident to such acause. I am in no way disposed to show laok of consideration for the authorityof the Board of Examiners. "In regard to the request made by the Charlotte Mental Hygiene Clinio to yourboard for t;he temporary licensing of Dr. Vernon John Kinross-Wright, I amwriting in order to def'ine somewhat briefly the relationship which thisagency has with the Charlott;e Mental Hygiene Clinio,

"During the present f'isoal year this agency has been acting ss the designatedViental Hygiene Authority in oonneot;ion with money being expended by theUSPHS. R plan was worked out; and put into operation t;o supplement looal childguidance and mental hygiene clinics or aotually to oarry mental hygiene olinicsby the usa of ore-third looal and two-thirds Federal t'unds. It was thoughtthat in this way the best use could be made of tne money and that the organiza-tions already in operation oould be helped further, rather than trying to setup new olinics whioh would be in oompat;it. ion vrith the est'ablished ones andthat this would be stimulating to the looal areas to make available funds formental hygiene aotivitias and these, when turned over to the State, would pro-vide the necessary matching funds. In accordance with this plan, we have forsome time been willing to supplement tha aotivities of the Mental HygieneClinio of Charlotte by the use of Federal funds for salaries of persons to beemployed subsequent; to t;he date at which the funds beoame available to us.We have already been aotively supplementing these funds by having on our pay-roll, as par-t;ime or full-t;ime, soma four persons inoluding the psychometrist,two out-patient psyohiatrists and a consultant psychiatrist, and we are alsoanticipat;ing adding a secret" ry beoause of the increased activities of theclinic. The program there, however, has been somevrhat hampered by shortagesof personnel, as has been true with the other mental hygiene clinios ~

"This agency f'eels a definite responsibility for the clinics being startedthroughout the state, not only beoause of the investment of money in thesebut also baoause the public is at the present time actively interested inthe establishment; of mental hygiene clinios and vre hope not to ba as disappoint-ing to tham as the shortages of trained personnel would at times suggest.

"Personnel being employed in this clinic by us are administratively responsi-ble not only to the local authority, either t?".e Board of Trustees or t;he Pre-sident of the clinic, but also to this agency which aotually pays them direotlyand which has to ar" ange for their employment; by clearing this with the Bud-get Bureau and IiIerit System. This personnel has to meet Merit System require-ments snd discharge of these is subject to rules set up by that sgenoy of theState. Such personnel are SSate employees in t;he true sense of tha word andif full-time, for instance, would be given t;he same benefits, vaoat;ion, siokleave, retirement and etc. and, as I understand the relationship, can be dis-ohargad by this agency by proper procedure I hope that your board will con-sider the lioensing of Dr. Kinross-Wright in the same light as the employmentof dootors in the State Hospitals, as they are both working directly underthis agency and any safeguard which you may wish in this respeot will, ofcourse, be oarried out. "

Dr. M. D. Bonner moved that Dr. V~aterhouse be allowed to consultDr. Combs or Dr. Menefee in regard to her physioal condition as to whetheror not she be considered infectious. This motion was duly seconded and passedunanimously.

Dr. Thomas L'eslie lee moved tnat all previous motions regardingaverages on written examination be rescinded and that an average of 75/. bere„uired as a oassing grade. This motion was duly seconded and passed un-a nimous ly.

IN RE: Dr. Robert S. Carroll: Acoording to the Minutes of July20th, 1926, the medioal lioense of Dr. Carroll was revoked. On January 13th,1928 the following judgment was rendered -'n the Buncombe County Superior Court:

"That above entitled cause coming on to be heard and having been heard at thepresent term of the Court~ befoxe His Honor Judge Vfalter E ~ Moore, Judge Pre-s iding and a jury, and the following issues to wit: "Has Dr ~ Robert S ~ Carrollbeen guilty of grossly immoral conduct with patients or nurses in the HighlandHospital;n Asheville, North Carolina, or elsewhere, as alleged in the recordin this cause. " Having been submitted to the jury and the jury having answer-ed said issue "NO".

"It is now upon motion of Counsel for Dr. Robert S. Carroll, to wit: Mark Vf.Brown, R. R. ~7illiams, and Martin and Martin, ordered and adjudged by theCourt tnat the order of the State Board of Medioal Examiners, dated the 20thday of July, 1926, and appealed from in this cause, rescinding the lioenseto Dr. Robert S. Carroll, to practice medicine and surgery in the State ofNorth Carolina, be and said order is hereby rescinded and reversed, and itis ordered oy the Court tnat said Robert S. Carroll, be and he is herebya llowed to retain his said license and said lioense shall remain in fullforoe and effeot. And it is further ordered by the Court that said RobertS. Carroll have and recover of the complainants in this cause the oost ofthis prooeeding.

The Book of Licensure of the North C arolina Board of Medical Exam-iners shows that the medioal license of Dr. Robert, S ~ Carroll was revoked,but it does not show that said medioal license was reinstated by' the oourtThe Board of Medioal Examiners directed the secretary to insert in its Bookof Lioensure that medical license of Dr. Robert S ~ Carroll was restored bythe Superior Court of Buncombe Count y, North Carolina, January 13th, 1928.

Dr. Charles Davis Belcher, Jr. , applicant for lioensure by en-dorsement, appeared with incomplete credentials and was interviewed by theBoard of Medical Examiners.

Dr. Ch. . ries V~'. Armstrong moved that Dr. elcher be granted s licenseupon completion of his credentials, if the same are approved by the secretary.This motion was duly seconded and unanimous ly passed.
