The City of Miami Beach (the “City”) is seeking to fill a vacancy in the City Commission
seat for Group IV, following the resignation of Commissioner Kristen Rosen Gonzalez,
which resignation is effective January 3, 2019.
At the December 12, 2018 City Commission meeting, the City Commission directed the
City Clerk to issue a Notice of City Commission Vacancy to provide an opportunity for all
interested individuals to submit an application for consideration.
Pursuant to City Charter Section 2.07, “[a]ny vacancy occurring in the City Commission
shall be filled by the vote of the majority of the remaining members of said City Commission
with the appointee serving the remainder of the unexpired term until the next succeeding
general City election . . . .”
In accordance with City Charter Section 6.03, each applicant shall be a “qualified
elector of the City residing within the City at least one year prior qualifying . . . .” In
this case, each applicant must have resided within the City for at least one year prior
to the date of application.
The individual appointed to the City Commission seat for Group IV will serve for the

APPEAL HEARING
FEBRUARY 13, 2019The Miami Beach City Commission, pursuant to Section 118-9 of the Miami
Beach City Code, will hold a hearing on February 13, 2019, at 3:00 p.m., or
as soon thereafter as the matter can be heard, in the Commission Chamber,
3rd Floor, City Hall, 1700 Convention Center Drive, Miami Beach, Florida, to
consider an appeal filed by Continuum on South Beach, The South Tower
Condominium Association, Inc., (the “Appellants”), of a Miami Beach Design
Review Board Order, denying the application for Design Review Board
approval for exterior design modifications to facades of an existing 41-story
building at 100 South Pointe Drive (Continuum South Tower) to remove
existing metal panels along the glass balcony railings on all elevations of
the building and retain all clear glass railings (DRB File No.: 18-0226/City
Commission Appeal File No.: 18-001.)
The review shall be based on the record of the hearing before the Design
Review Board, shall not be a de novo hearing, and no new, additional
testimony shall be taken. A verbatim transcript of the DRB hearing shall be
made a part of the record and filed by the Appellants. The standard for review
will be whether due process was provided at the hearing, whether the correct
law was adhered to, and whether there was competent substantial evidence
to support the decision of the Design Review Board. In order to reverse, or
remand, a five-sevenths (5/7) vote of the City Commission is required for
appeals of the Design Review Board to the City Commission.
This appeal hearing is open to viewing by the public, but it is not a public
hearing, and only the Appellant, the City, and their representatives, as parties
to the appeal, may participate.

inspection during normal business hours in the Planning Department,

seat for Group IV, following the resignation of Commissioner Kristen Rosen Gonzalez,
which resignation is effective January 3, 2019.
At the December 12, 2018 City Commission meeting, the City Commission directed the

FEBRUARY 13, 2019The Miami Beach City Commission, pursuant to Section 118-9 of the Miami
Beach City Code, will hold a hearing on February 13, 2019, at 3:00 p.m., or
as soon thereafter as the matter can be heard, in the Commission Chamber,

consider an appeal filed by Continuum on South Beach, The South Tower
Condominium Association, Inc., (the “Appellants”), of a Miami Beach Design
Review Board Order, denying the application for Design Review Board
approval for exterior design modifications to facades of an existing 41-story
building at 100 South Pointe Drive (Continuum South Tower) to remove
existing metal panels along the glass balcony railings on all elevations of
the building and retain all clear glass railings (DRB File No.: 18-0226/City

The review shall be based on the record of the hearing before the Design
Review Board, shall not be a de novo hearing, and no new, additional
testimony shall be taken. A verbatim transcript of the DRB hearing shall be
made a part of the record and filed by the Appellants. The standard for review
will be whether due process was provided at the hearing, whether the correct
law was adhered to, and whether there was competent substantial evidence
to support the decision of the Design Review Board. In order to reverse, or
remand, a five-sevenths (5/7) vote of the City Commission is required for
appeals of the Design Review Board to the City Commission.
This appeal hearing is open to viewing by the public, but it is not a public
hearing, and only the Appellant, the City, and their representatives, as parties
to the appeal, may participate.
