What is intellectual property?

Intellectual property is created through human intellect or creativity. It gives the owner certain unique rights which

are limited and defined through legislation.

It is protected by both criminal and civil law.

What is Copyright?

• Copyright is the legal framework within which creators of literacy and artistic works, including films, books, sound recordings, information products and computer programs - are entitled to payment for use of their works.

• It is not format based, eg. Print, digital

Types of Copying - con’t

• Incidental: Single & “last minute” copies (1 copy for each student and 2 for each instructor). No need to log this copying.

• Planned Copying: Copies that are distributed at various times in the year, every year, to students. Log this copying.

Types of Copying

• For Sale or Course Pack: The College is selling the copies and/or creating a course pack for students. Log this copying.

Allowed

• Up to 10% (incidental) or up to 15% (for sale, coursepack, planned) of a published work or the following, whichever is greater

• A single entry from an encyclopedia or similar reference work

• An entire newspaper article or page

• An entire article, essay, short story, play or poem from a magazine or book

Allowed• An entire chapter not exceeding 20% of a book

• Alternate format copies, eg. Microfiche, etc.

• Rare & damaged originals (up to 20%)

• A single item of print music from a book or magazine containing other works

• Out-of-print works (must be authorized by Access Copyright)

• A reproduction of an artistic work from a book or magazine containing other works

Prohibited

• Copying beyond the license limits

• Published workbooks, study guides & instructor manuals

• Publications from a list of publishers identified in the Access Copyright License Exclusions List

Prohibited

• Excluded works such as crown publications, letters to the editor and advertisements in newspapers and magazines, newsletters, or works containing a notice expressly prohibiting copying

• Print music published for use by choirs, orchestras, bands, similar groups & individual performers

Exceptions for Textbooks

• No more than 5% of a textbook (or single chapter if less than 5%) can be included in a course pack or planned copying

• No more than 2 extracts from the same author & publisher in a 5 year period is allowed in the course pack or planned copying

• No more than 50% of the course pack or planned copying can be textbook extracts

• Allows for digital delivery of print materials

• Completely separate from an Access Copyright License

• Copying limits echo Access Copyright guidelines

• Used for course delivery for internal or distance learning on a secure user-controlled network such as WebCT

• Bibliographic details of the work to be digitized

• Software and hardware being used, including information on security of service

• Course information: name of the course, length of the course, enrollment, types of material required
