NOTICE OF REMOVAL OF STATE CIVIL ACTION UNDER 28 U.S.C. §§1367(a) AND 1452(a) AND RULE 9027(a) OF THE FEDERAL RULES OF

BANKRUPTCY PROCEDURE

TO: THE CLERK OF THE BANKRUPTCY COURT:

PLEASE TAKE NOTICE that the Group of Tort Claimants previously identified as the

Tort Claimants or the Medical Malpractice Claimants (hereinafter the “Tort Claimants”), the

Removing Party, hereby removes to the above-entitled Court the State Civil Action (as defined

below) based on the following:

1. This Notice of Removal is filed pursuant to 28 U.S.C. §§ 1367(a) and 1452(a) and

Rule 9027(a) of the Federal Rules of Bankruptcy Procedure (“Federal Bankruptcy Rules”).

2. On September 30, 2010, Gilbert C. Marquez and Marie Marquez (the “Plaintiffs”)

commenced action against Christian R. Schlicht, D.O. et al. for Medical Negligence, Negligent

and Reckless Hiring and Credentialing, Violation of the Unfair Trade Practices Act, Alter Ego,

Respondeat Superior, Conspiracy, Fraud, Battery, and Damages in the State of New Mexico,

County of Otero, Twelfth Judicial District court, Case No. CV-2010-00849 entitled Gilbert C.

Marquez and Marie Marquez v. Christian R. Schlicht, D.O.; Otero County Hospital Association,

d/b/a Gerald Champion Regional Medical Center; Quorum Health Resources, LLC; Triad

Healthcare Corporation; Triad Hospitals, Inc.; CHS/Community Health Systems, Inc.;

Community Health Systems Professional Services Corporation; White Sands Health Care

Systems LLC; Frank Bryant, M.D. (the “State Civil Action”). The Plaintiffs’ complaint

(“Complaint”) seeks damages as a direct and proximate result of the negligence of Defendants.

A copy of the Complaint is attached to Tort Claimants’ separately filed Appendix of State Civil

Action Proceedings to Notice of Removal of State Court Action under 28 U.S.C. §§ 1367(a) and

1452(a) and Rule 9027(a) of the Federal Rules of Bankruptcy Procedure at Tab 1.

3. On August 8, 2011, a voluntary Petition under Chapter 11 of the United States

Bankruptcy Code was filed by Otero County Hospital Association, Inc. in the United States

Bankruptcy Court, District of New Mexico, Case No. 11-13686-j11 (the “Bankruptcy Case”).

4. The State Civil Action is part of the same case or controversy as the Bankruptcy

Case. The State Civil Action and the Bankruptcy Case arise from a common nucleus of

operative facts and resolution of the State Civil Action will affect the amount of property of the

bankruptcy estate pursuant to 11 U.S.C. § 541.

5. The Tort Claimants hereby remove the entire State Civil Action to the United

States Bankruptcy Court for the District of New Mexico (the “Bankruptcy Court”), pursuant to

28 U.S.C. §§ 1367(a) and 1452(a) and Rule 9027(a) of the Federal Rules of Bankruptcy

Procedure.

6. The Bankruptcy court has jurisdiction over the removed State Civil Action

pursuant to 28 U.S.C. §§ 157 and 1334. Venue is proper before The Bankruptcy Court pursuant

to 28 U.S.C. §§ 1408 and 1409.

7. This Notice of Removal is timely filed pursuant to the Federal Rules of

Bankruptcy Rule 9027(a)(2) as extended by Court Order.

8. Upon removal, litigation of the State Civil Action is a core proceeding pursuant to

28 U.S.C. § 157(b)(2)(A)(B) and (O).

9. The Tort Claimants expressly reserve all procedural and substantive rights, claims

and defenses.

10. Copies of all process and pleadings in the State Civil Action are attached to the

Appendix filed herewith.
