Check List: The following must be submitted for your application to be considered.o Application: (all 7 pages) filled out completely, initialed and signed.

o Photo/drawing: A photograph and drawing of your booth design & setup showing which side you will

vend from and which way y~u will need to pull into location.( This is very important to your location placement for trailers, not so much so for tents. )

o Sales tax: Copy of Sales Tax Certificate, if applicable.Vendors without a CA sales tax number are required to file a special event sales tax return. Sales tax is due

August 5th 2013 and will be late after August 20th 2013 Sales tax returns will be inserted in your check-in packetand a list of vendors will be provided to the local Sales Tax Office.

Downtown Vendor ApplicationGeneral Rules and Regulations

Please read carefully and initial that you have read and

agree to abide by all Rules & RegulationsVendor displays must stay within designated square footage of space requested. This includes

display racks, tables, awnings, trailer tongue, tie downs, etc. If you need additional space infront of or behind your space for display racks please add footage to your size request. Youwill be charged for any extra footage outside of your designated space per square foot.

Vendor spaces that are between two buildings must allow foot traffic on both sides. Sidewalksmust be kept open.

ALL Vendors must check in for further instructions and receive your vendor packet beforesetting up. All monies due must be paid in full and a copy of your insurance certificate onfile prior to receiving your vendor packet.

24-Hour security is provided from Thursday evening through Sunday afternoon within thedesignated event area. However, The City of Hollister and Worldwide Dynamics, are notresponsible for any theft, vandalism, damage or loss of business caused by others.

Vendor setup is after 11:59 pm on Wednesday and all day Thursday, once the streets areclosed. Your display must be set up by 8:00am Friday morning and all vehicles must be outof the vending area by 8:00am each morning.

All vendors must leave location clean of trash, zip ties and debris. Each location will beinspected and noted on what condition your space was left in.

All bagged trash and broken down cardboard boxes must be placed next to trash receptacles.No vendor may assign, sublet or apportion all or any part of the privileges or of the space

assigned to them, nor permit any other party to exhibit herein, other than the business towhich the space is assigned and insured.

Vendors are expected ~oremain open during official event hours. Entertainment is scheduleduntil 9:00 pm nightly at all stages.

Absolutely no tent stakes allowed anywhere (streets, pavement or grass.) Please instruct yourtent rental company of this important rule.

If you hire an outside tent company to set up your tent, they must contact Mark Cresswell forsetup and breakdown instructions._

Any tent over 120 square feet shall be flame retardant. All vendors must have in their tent atleast (1) 2A10BC SIb fire extinguisher with a current inspection tag by a licensed fireextinguisher company and "No Smoking" sign(s) displayed. Any tent over 400 square feetis required to have (2) 2A10BC SIb fire extinguishers with a current inspection tag by thelicensed fire extinguisher company and "No Smoking" sign(s) displayed.

GENERAL RULES AND REGULATIONS

You are solely responsible for obtaining all state required licenses and permits necessary tooperate your business at The Hollister Rally.

Merchandise displaying any wording reference to The Hollister Rally, Hollister BikeRally, Hollister Motorcycle Rally, Independence Day Rally, Hollister California 2013or Hollister with motorcycle related artwork will not be allowed. WorldwideDynamics reserves the exclusive right to the sales of "The Hollister Rally T-shirts,Pins, Patches and Novelties;"

No wording of Official Event Merchandise will be allowed on any signage. WorldwideDynamics Inc. reserves all rights to any and all official event merchandise.

Violation of the above policies may result in immediate ejection from the event and loss ofbooth fee.

No merchandise considered obscene or drug paraphernalia will be allowed as determinedby Worldwide Dynamics Inc's sole discretion.

No water, food or beverages will be allowed to be sold from your booth. This alsoincludes giving it away for free.

We do not offer any exclusive merchandise category.

City of Hollister requires that all vendors must be completely out of the event area by 11:59pmSunday T" July, Please plan accordingly.

PARKINGVendor Parking: Vendors must park in designated areas (location map provided at check-in).

Vendor parking pass must be displayed on the driver's side of the windshield. WorldwideDynamics and the City of Hollister are not responsible for towed vehicles outside ofdesignated areas and for improper display of parking pass. You will receive (2) two parkingpasses.A cell phone number must be provided to place on parking passes.Storage trailers, vehicles and RVs are not allowed to be parked behind booths due to firecodes and access issues and must park in designated areas only or nearby campgroundslisted on our website.

By initialing vendor agrees that he/she has read and understands the "Rules andRegulations" of the event provided with this application and will be able to comply asdescribed. The undersigned understands noncompliance will result in immediate removalfrom the event.

Hold Harmless and Indemnification

I hereby agree to INDEMNIFY, RELEASE, and HOLD HARMLESS Worldwide Dynamics Inc and the Cityof Hollister and the Officers, Directors, Sponsors, Agents, Leagues, and Employees of these entities from andagainst any and all rights, actions, causes of action, suits,.1osses, damages, judgments, claims, claims ofliabilities, cost and expenses of any kind as well as attorney's fees and court costs at trial and on appeal, ofwhatsoever kind or nature to which these entities and individuals may be subjected to as a result of any death,personal injury or damage to property arising in any manner from my direct or indirect participation in the2013 Hollister Rally including any such rights, actions, causes of action, suits, losses, damages, judgments,claims, and claims of liabilities arising out of or resulting from the negligence of these entities or any of.theiragents, servants, employees or any independent contractors acting on their behalf. I further agree that thisHold Harmless Agreement shall apply in the event I am disabled, injured, or incur disease of a temporary orpermanent nature while participating in, or die as a result of participating in, this activity regardless of thecause, including negligence of the above entities, their agents, servants, employees or independent contractors

MiscellaneousThis Agreement has been delivered in the County of San Benito, State of California and shall be construed inaccordance with the laws of California and venue for any action arising from this agreement shall be SanBenito County, California. This Agreement may not be modified or amended nor shall any provision of it bewaived except by a writing signed by the parties, and in the case of the City of Hollister, approved by theHollister City Commission at a public meeting.

In signing this application, the undersigned parties hereby represent and warrant that they are duly authorizedrepresentatives of the person or entity for which they sign and legally entitled to enter binding contracts on itsbehalf; that they have read this entire document; that they understand the terms and provisions of thisdocument; that they know this document will affect their legal rights and/or those of the person or entity theyrepresent; and that they have signed this document knowingly and voluntarily.

I understand that I will not be allocated space until all of the above documentation is on file in the WorldwideDynamics office and my fees are paid in FULL. All fees are non-refundable once location has been assigned.I certify that I have fully read and understand the contents of this application and that I fully agree to all of itsterms and conditions.
