Entry is Non-Exclusive. Visitor’s entry onto the terminal is non-exclusive. 2. Access is at TraPac’s Discretion. Access to the terminal is at TraPac’s sole discretion and may be revoked or terminated at any time. 3. Working Marine Terminal. The terminal is a working marine terminal and the activities on the terminal may create a dangerous and hazardous environment. Visitor may not interfere with any operations being conducted on the terminal and may not create any danger or safety hazard on the terminal. 4. Safety. It is Visitor’s sole responsibility to evaluate the risks inherent in visiting the terminal and Visitor must fully consider those risks. Visitor is solely responsi- ble for his/her safety while visiting the terminal, as well as the safety of any property brought onto the terminal by Visitor. Visitor agrees to comply with all TraPac safety rules. 5. Duty to Inspect. TraPac makes no representations or warranties whatsoever with respect to the terminal premises or Visitor’s access or use thereof. If Visitor believes there is any problem as to safety or suitability, and/or if any such problem develops during Visitor’s access or use, Visitor must immediately notify TraPac. If the condition cannot be changed by mutual agreement to assure safety and suitability to Visitor’s satisfaction, Visitor shall promptly exit the terminal premises. Once Visitor begins any access or use of the terminal whatsoever, or continues to conduct operations at the terminal, TraPac will presume that the terminal was inspected and accepted by Visitor as both safe and suitable for his/her entry and use. 6. Compliance. Visitor shall conform with all local, port, municipal, county, state and federal laws and regulations, including without limitation those promulgated by the EPA, OSHA, WISHA, DOT, FMCSA, DHS and/or USCB, and shall be responsi- ble for any violation of the same. 7. Notice. Visitor shall notify TraPac immediately of any bodily and/or personal injury, illness and/or death, or of any property damage, related in any way to its access to or use of the terminal premises and shall cooperate fully with any investigation relating thereto. 8. Preconditions to Entry. Compliance with TraPac’s safety rules set forth herein is a precondition to entry. 9. Hazardous Substances. Visitor shall not generate, transport, handle, store, dispose of or treat solid wastes, hazardous wastes or hazardous substances on the terminal. 10. Clean-up. Visitor must remove all of its materials, supplies, tools, equipment, personal property, employees, agents, contractors and invitees from the terminal premises, and shall otherwise keep all areas used by Visitor clean and free of debris. 11. Security. TraPac does not provide any security for the materials, supplies, tools, equipment or personal property of Visitor, including any materials, supplies, tools or equipment brought onto the terminal by Visitor. Visitor shall by solely responsible for the security of all such items. TraPac’s terminals are surrounded by secure access gates around our landside operations so that we can regulate entry in and out of the property. Additionally, we have a security staff that patrols all zones of the terminals on the ground and via a state-of-the-art camera system 24 hours a day, 7 days a week. Following these rules and precautions will help keep everyone at the terminal safe: Unlock/lock twistlocks in designated areas only. Observe posted speed limits and stop signs. No cell phone use while driving. Terminal equipment has the right of way at stop signs. No parking outside of designated parking areas. No idling. All drivers must have in their possession a valid driver’s license , TWIC, current vehicle registration and proof of insurance ready for examination upon demand by security and/or law enforcement. All vehicles and equipment are subject to inspection. Drive with landing gear up. Always have EIR ticket with you. No unauthorized passengers or pets are allowed. Failure to follow instructions will result in expulsion from the terminal.

Providing a safe environment has been one of the core tenants of TraPac’s operating philosophy since we were founded more than 30 years ago. In order to ensure safety for all, please follow these rules and precautions during your visit to the Los Angeles terminal.

All entrants must have a valid TWIC, or be escorted by someone with a TWIC that has received proper restricted access escort training, and a pre-approved reason to enter.

Wear high visibility outerwear, safety shoes, and hard hat while on terminal (e.g. ANSI standard high visibility vest, ASTM steel toed boots, and ANSI Z89.1 hard hats).

If remaining in vehicle at all time wearing high visibility outwear is required.

Do not enter restricted areas without authorization.

Wear a seat belt while in vehicle.

Remain in vehicle except in authorized areas(i.e. trouble booth, parking lots and kiosks).

All work requires permission.

Do not walk or drive under a suspended load.

No smoking except in designated areas, no alcohol, no drugs, and no littering.
