Annex 1 – Mandatory conditions MC1 Mandatory conditions

where licence authorises supply of alcohol

1. No supply of alcohol may be made under the premises licence – (a) At a time when there is no designated premises supervisor

in respect of the premises licence, or (b) At a time when the designated premises supervisor does

not hold a personal licence or his personal licence is suspended.

2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

MC2 Mandatory condition: exhibition of films

1. Admission of children must be restricted in accordance with any recommendation made by the British Board of Film Classification unless where the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question. 2. Admission of children must be restricted in accordance with any recommendation made by this licensing authority. 3. In this condition –

“children” means persons aged under 18; and “film classification body” means the persons designated as the authority under section 4 of the Video Recording Act 1984 (c.39) (authority to determine suitability of video works for classification)..

MC5 Mandatory condition:

drinks promotion 1. The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotion in relation to the premises where the promotion is carried on for the purpose of encouraging the sale or supply of alcohol on the premises.. The definition of an irresponsible promotion can be found in The Licensing Act 2003 (Mandatory Licensing Conditions) (Amendment) Order 2014 (SI 2014/2440)

MC7 Mandatory condition: free drinking water

The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

MC8 Mandatory condition: proof of age

1. The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol. 2. The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy. 3. The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either

(i) a holographic mark, or (ii) an ultraviolet feature.

MC9 Mandatory condition: measures of alcohol

The responsible person must ensure that- (a) Where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

(i) Beer or cider ½ pint; (ii) Gin, rum, vodka or whisky: 25ml or 35ml; and (iii) Still wine in a glass 125ml; and

(b) These measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and (c) Where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

MC10 Mandatory condition: cost of alcohol - permitted price

1. The relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less that the permitted price. The definition of the permitted price can be found in The Licensing Act 2003 (Mandatory Licensing Conditions) Order 2014 (SI 2014/1252)

Annex 2 – Conditions consistent with the operating Schedule General LM3 Licensing Act 2003.

Section 177a The provision of entertainment consisting of the performance of live music and recorded music is not to be regarded as the provision of regulated entertainment provided: � Music takes place on premises which are authorised by a premises

licence or club premises certificate to be used for the supply of alcohol for consumption on the premises,

� At the time of the music, the premises are open for the purposes of being used for the supply of alcohol for consumption on the premises,

� If the music is amplified, it takes place in the presence of an audience of no more than 500 patrons, and

� The music takes place between 8am and 11pm on the same day Any condition of the premises licence or club premises certificate detailed below which relates to live music, recorded music or both does not have effect in relation to the music.

Crime & Disorder CD36 Alcohol, restrictions on

sale There shall be no sale or supply of alcohol other than to persons admitted to the Cinema by ticket or payment.

CD2

CCTV Numbers location and maintenance

1. A closed circuit television (CCTV) system shall be installed at the premises. The numbers and position of all cameras shall be agreed with the Metropolitan Police. The position of all cameras shall be noted on a plan of the licensed premises which shall be kept with the licence and provided to the licensing authority. 2. The CCTV system installed at the premises shall be maintained in effective working order, and shall be in operation at all times the premises are open to the public.

3. All recordings made by the CCTV system shall be retained and stored in a suitable and secure manner for a minimum of 31 days, and shall be made available on request to the Metropolitan Police, the Licensing Authority or other Responsible Authorities

4. At all times the premises is open to the public a minimum of one member of staff on duty will be able to operate the CCTV system

CD32 Refusals Book An incident/refusals book shall be available for inspection by an

authorised officer of the Licensing Authority, Trading Standards officers or the Police.

CD42 Challenge 25 Policy 1. Evidence of age in the form of photographic identification (ID) shall be requested from any person appearing to those selling or supplying alcohol to be under the age of 25 and who is attempting to buy alcohol.

2. Examples of appropriate ID include a passport, photographic driving licence, Military ID and the Proof of Age Standards Scheme (PASS) approved age cards. 3. Notices shall be strategically and prominently placed at points of sale advising customers that they may be asked to provide evidence of age.

CD9

Responsibility of Licensee

1. No soliciting for custom, including the distribution of leaflets, shall take place from the premises, immediately outside the Premises or in the vicinity of the premises. 2. Where a licence has been granted to a company, the licensee must appoint a duty manager or duty managers who shall be in charge of and upon the premises at all material times. In such cases, the licensee shall notify the Licensing Authority of the names of those persons appointed duty managers. In addition, a copy of the written authorisation must be kept on the premises and be readily available for inspection by any police officer or authorised officer.

CD13

Security, staffing Before appointing any person to staff the premises, whether on a permanent, temporary, agency or self-employed basis, the licensee shall require the individual to disclose any unspent criminal convictions.

Public Safety PS1

Accommodation Limit

1. The maximum number of persons to be accommodated on the premises at any one time shall not exceed 2886

2. The Licensee shall not sell more than 1500 seats for performances

commencing after 23.00 hours

PS5 Attendants 1. During the whole time members of the public are present on the premises there shall be a sufficient number of competent adult staff. These staff shall have been nominated by the Licence holder as to their duties in the event of an emergency. The instruction given to staff shall include training on the avoidance of panic and the safe evacuation of the premises.

2. Such staff shall not be engaged in any duties, which:

i. Would hinder the prompt discharge of their duties in the event of any emergency.

ii. Entail their absence from that floor, tier, or auditorium where they are on duty.

3. Such staff shall not be engaged in any sale duties, which involve

the use of trays or similar equipment when the normal lighting id dimmed or extinguished.

PS8

Charge of Licensed Premises

1. The duty manager shall be familiar with all licence conditions. 2. The duty manager shall not engage in any duties, which will

prevent general supervision of the premises. .

PS14

Disabled Persons 1 That adequate arrangements are put in place to enable the safe evacuation of disabled people in the event of an emergency.

2 A system shall be in place to ensure that disabled people on the premises are made aware of the safe evacuation arrangements in the event of an emergency.

PS17

Maintenance and Testing

The approved arrangements at the premises, including means of escape testing provisions, fire warning and fire fighting equipment, the electrical installation and mechanical equipment, shall at all material times be maintained in good condition and full working order.

PS18

Overcrowding 1. The licensee shall maintain a register indicating the numbers of staff who are on duty at all material times in the area where entertainment is provided. This register shall be produced immediately on the request of a police officer or an authorised officer.

2. The licensee shall ensure that the accommodation limit specified

on the licence is not exceeded and shall at all material times be aware of the number of patrons on the premises. This information shall immediately be provided on request to a police officer or authorised officers when they have reasonable cause for suspecting the accommodation limit may be exceeded.

PS175 Safety Checks Safety checks shall be carried out before the admission of the public

and details of such checks kept in a logbook. PS37

Means of Escape

1. The means of escape provided for the premises shall be maintained unobstructed, free of trip hazards, be immediately available and clearly identified in accordance with the approved arrangements. 2. All exit doors shall be available at all material times without the use of a key, code, card or similar means.

PS43

Staff Training 1. Staff with specific responsibilities in the event of emergency, together with deputies, shall receive training and written instruction appropriate to their role. The duty manager shall, once they are satisfied as to the competence of each member of staff, enter this in a logbook that shall be available for inspection by Police or authorised officers. 2. All staff shall initially be trained in the action to be taken in the event of an emergency and thereafter, at least once every 6 months.

Attendants – Numbers in Cinemas

Staff shall remain in their allocated zone and where there is more than one auditorium within the zone shall patrol throughout the zone and need not remain within a particular auditorium.

PS113

Category Notices

Immediately before each exhibition at the premises of a film (other than a current news reel) passed by the British Board of Film Classification there shall be exhibited on the screen for at least 10 seconds in such a manner as to be easily read by all persons in the auditorium a reproduction of the certificate of the Board or, as regards a trailer advertising a film, of the statement approved by the Board indicating the category of the film.

Category Notices 1. For a film passed by the Licensing Authority notices shall be conspicuously displayed both inside and outside the premises so that persons entering the premises can readily read them. The notices shall be in the following form without the addition of any other words: - (............…………………) (Here insert title of film) has been passed by WANDSWORTH BOROUGH COUNCIL LICENSING AUTHORITY as (Here insert the definition of the category and the category assigned) 2. PS115

Drinks Except with the written consent of the Licensing Authority, no drinks shall be sold or consumed on the premises except in suitable plastic or paper containers.

Flammable Films No flammable films may be upon the premises without the consent of the Licensing Authority.

PS122

Objections to the Exhibition of a Film

1. No film shall be exhibited at the premises that is likely: - a) To encourage or to incite crime b) To lead to disorder c) To stir up hatred against any section of the public on grounds of

colour, race or ethnic or national origin, disability, religious beliefs, sexual orientation or gender

d) To promote violence, sexual humiliation or degradation 2. No film shall be exhibited at the premises the effect of which is, if taken as a whole, such as to hold up to ridicule or contempt (I) people of a particular gender, sexual orientation, colour, race or ethnic or racial origin or (ii) people with disabilities or particular religious beliefs unless such film is depicting an historical event or should be exhibited in the public interest 3. No film shall be exhibited at the premises the effect of which contains a grossly indecent performance thereby outraging the standards of public decency 4. If the licensee is notified by the Licensing Authority in writing that it objects to the exhibition of a film on any grounds, such film shall not be exhibited.

PS126

Restricted 18 films

Films in the RESTRICTED (18) category may be shown at the premises only with the Licensing Authority’s consent. Any application to permit such films to be shown at the premises shall be advertised in accordance with the Licensing Authority's rules governing applications for premises licences.

PS127

Unclassified films

1. Not less than twenty-eight days' notice in writing shall be given to the Licensing Authority of any proposal to exhibit any other film that has not been classified by the British Board of Film Classification or the Licensing Authority. Such a film may only be exhibited if the Licensing Authority's consent has been obtained and is in accordance with the terms of any such consent. 2. When the programme includes a film in the 12, 15 or 18 category no person appearing to be under the age of 12, 15 or 18 as appropriate shall be admitted to any part of the programme. The licensee shall display in a conspicuous position at each entrance to the premises a notice in clear letters in the following terms:

PERSONS UNDER THE AGE OF (insert 12,15, or 18 as appropriate) CANNOT BE ADMITTED TO ANY PART OF THE PROGRAMME.

3. Where films of different categories are shown the notice shall refer to the oldest age restriction. 4. This rule shall not apply to members of staff of 17 years of age provided the prior written consent of the person's parents or legal guardian has first been obtained. This consent shall be available for inspection by authorised officer’s at all reasonable times.

Public Nuisance PN1

Conduct of Premises

1. Clear legible notices are to be displayed at all exits from the premises requesting patrons to respect the needs of local residents and to leave the premises and area quietly.

Hours of Closing, British Summer Time

On the morning that Greenwich Mean Time changes to British Summer Time one hour will be added to the terminal hour of licences having a terminal hour of later than 2am.

Protection of children from harm CH2

Entertainment for Children

During the whole time that performances are specially presented for children a member of staff shall be stationed in the vicinity of each exit from any level occupied by children.
