Because of these fiscal constraints, and in an effort to independently confirm the need for the facility, Secretary Napolitano requested in February of this year that the National Academies of Science perform a Mission Need Assessment of the NBAF Project to help inform a project decision. It was in consideration of the results of that report, provided to DHS in July 2012, and other project information provided by S&T, that Secretary Napolitano and the Secretary of Agriculture, Secretary Vilsack, met with Acting OMB Director Zients on August 22, 2012 to discuss the path forward for the NBAF project. The result of that meeting was support by all parties for the NBAF project to move forward, but follow-on discussions between DHS, OMB and appropriations staff were necessary to solidify the details of the funding framework for the project.

As you are aware, Kansas State University has been preparing the site to be donated for the National Bio and Agro-Defense Facility (NBAF) through a two phase project to remove and relocate existing facilities and utilities. Phase I included the removal of the Animal Resource Facility (ARF) and various utilities, and construction of a Large Animal Research Center to replace the ARF. DHS understands this phase was completed using $12 million of the $105 million in "in~kind" gift contributions offered by the Heartland Bio and Agro Consortium in its proposal to DHS for locating the NBAF to Manhattan, Kansas.

It is our understanding that Phase n is currently under design and will remove and relocate the feed mill from the NBAF site. This work, estimated at $5.4 million, will complete the site clearing and provide a "pad ready" site for the NBAF. DHS recognizes the use of up to $5.4 million of the $105 million in gift contributions offered by the Heartland Bio and Agro Consortium as an in kind contribution in support ofPhase II of the relocation and removal project.

For accounting purposes, DHS will need a comprehensive and timely report from K-State on how the in-kind contribution is expended.

In 2010, the State of Kansas provided $18,261,805 to the Department of Homeland Security (DHS) to complete site preparation activities associated with the National Bio and Agro-Defense Facility (NBAF). Site preparation activities were completed in August 2012, and as of today, there is approximately $1.14 million remaining from the original $18,261,805 gift.

DHS is now preparing to award the contract to construct the NBAF central utility plant (CUP) and other contracts to support construction activities, including construction administration and materials testing. DHS considers this work within the scope of the original gift funding and wishes to apply the $I. I 4 million to these contracts.

RECOMMENDATION

DHS requests the State of Kansas concur our use of this $1.14 million to help fund the CUP construction contract and contracts to support construction activities.

KEY BACKGROUND INFORMATION: • In an unprecedented fiscally tight environment, DHS will continue to assess the best way to

complete the NBAF mission. In accordance with the President's budget for 2013, DHS is requesting that the National Research Council (NRC) convene a committee of experts from the National Academy of Sciences (NAS) to conduct a comprehensive assessment of the requirements for a large animal foreign, emerging, and zoonotic disease research and diagnostic laboratory facility in the United States. The report will be used by DHS to identify the best approach moving forward to address the Nation's need to be on the frontline of livestock animal health research in order to effectively defend against agroterrorism, and foreign, emerging, and zoonotic diseases.

• S&T is reviewing alternative financing options to the direct appropriations currently being requested in the out-years. Efforts are underway to review examples within the Federal Government in the successful use of third party financing.

• li~A contmues to develop the Draft EIS tor the Sale of Plum Island and will publish it for public comment by the end of April2012. The Draft EIS will likely increase public awareness.

• The NRC committee has begun their 4-month review of the updated site specific risk assessment and will issue a report in June 2012.

• The NAS will be performing the NBAF mission need assessment. Final Statement of Task has been completed (currently under review by the USST) and the Kansas delegation has asked for the rationale for going outside ofDHS.

• The updated SSRA is available to public and meeting with NAS is planned for March 16, 2012. The NAS report is expected in June 2012.

National Bio and Agro-Defense Facility (NBAF) Status

TALKING POINTS:

• In light of the unprecedented restrained funding environment, DHS is currently assessing the best way to complete the NBAF mission. Decisions regarding the Central Utility Plant (CUP) and land transfer will be made in the context of the information of the Mission Need Assessment and other factors, including the recent review of the Updated Site-Specific Risk Assessment.

• Construction of an ABSL-4 level facility is critical to protecting the nation's food supply, agriculture, and public safety against threats from terrorism, the introduction of foreign animal diseases or the emergence of new zoonosis requiring BSL-4 biocontainment. Currently the US has no capacity to diagnose or create countermeasures against large animal diseases -- many of which also infect humans -- requiring the highest levels of biosafety containment.

• Kansas has committed to provide $I I OM in cash, plus the land transfer. Additionally, DHS is exploring several options to mitigate the cost of the project. Partnerships with industry are being explored to build and/or operate the BDM (pilot vaccines), which could reduce a small amount of construction costs and to some degree offset future operating costs ofNBAF.

• Until NBAF is built, DHS will continue to maintain the aging and dated infrastructure at Plum Island Animal Disease Center (PIADC). Capital improvements costing approximately $60-90M will be required to keep PIADC operationally safe .

Any net income realized from the sale of Plum Island will be applied to offset costs of building NBAF. It is uncertain whether there will be any net proceeds from the sale due to the need to pay for environmental cleanup of the island and costs related to transitioning from New York to Kansas.

KEY BACKGROUND INFORMATION: • CUP Construction: S&T completed all congressional requirements to begin construction

of the CUP by completing 50% design and submitting the updated risk assessment; members of the Kansas delegation are asking why we have not begun.

• Land Gift: In Oct 2011, the Dept of Justice gave S&T approval to proceed to a closing on the property in Manhattan, KS. Since then, S&T prepared, but has not yet transmitted, final gift acceptance package to USM for consideration. S&T expects to close 30 days after USM approval.

• Third Party Financing (TPF): TPF leverages private sector funds to finance public capital investment instead of congressional appropriations.

CURRENT STATUS: • The NBAF Mission Need Assessment will be performed by the NAS. Plans are in place

to secure a contract and begin the committee selection. It is anticipated a report will be issued June 2012 but this is a very aggressive schedule.

• The updated Site Specific Risk Assessment (SSRA) was completed and made available on the DHS website. Copies of the report were provided to the Appropriations Committee's and NAS per the FY11 CR. A press release was issued on March 2. The NAS committee began their 4-month review and will issue a report in June 2012. DHS

KEY BACKGROUND INFORMATION: • The NBAF Mission Need Assessment will be performed by the National Academy of

Science (NAS). It is anticipated a report will be issued June 30, 2012 which is a very aggressive schedule.

• The updated Site Specific Risk Assessment (SSRA) was completed and made available on the DHS website. Copies of the report were provided to the Appropriations Committee's and NAS per the FY11 CR. A press release was issued on March 2. The NAS committee began their 4-month review and will issue a report in June 2012. DHS met with the NAS on Friday, March 16 to address questions on the updated SSRA.

Some of the groups had researched the project in advance and were able to offer helpful insights which led to strategic discussions on moving forward. The issue of specialized facility vs. general purpose facility was discussed at length. There was also a separate meeting with Kansas representatives including Landon Fulmer and they offered their support as we move forward in the process.
