One week into the 2015 Supreme Court Term, Nina Totenberg, NPR’s legal correspondent and one of America’s foremost reporters on the Supreme Court, will discuss the Court’s makeup and personalities, analyze the Court’s recent decisions, and provide a must-hear outlook for the 2015–2016 SCOTUS term.

The Future Is Now: How the Strategic Goals of Corporate and

Insurance Legal Departments Will Impact the Practice of Law

and Role of Defense CounselIn 2014, the U.S. legal market totaled $275 billion. Remarkably, over half of this market is comprised of less than 50,000 publicly and pri-vately held businesses that spend $1 million or more per year on legal services. Indeed, less than 500 corporations comprise more than 10 percent of the entire legal market. During this session we will hear what is on the minds of the chief legal operations officers for three Fortune 500 legal departments from three different industries (technology, insurance, agricultural processing). Topics include legal department goals, strategic initiatives, outside counsel manage-ment, the growth of inside counsel, and use of data and technology to increase quality and control cost. Panelists will provide guidance on what outside counsel should be doing to get ahead of the curve.

The Persuasive Power of Storytelling: Structuring Your Argument for a Jury of Non-LawyersHow do you, as a lawyer, make sure that your listener sees the same picture, and comes to the same conclusions, that you do about the information you’re presenting? From the structure of your story to the details you choose to use, the picture you paint in your opening statement can burn your theory into the minds of your listeners, or it can leave them flat. This workshop will help you use the tools that professional actors and directors use to control the picture being formed in the mind of the listener. You’ll learn about the most com-mon storytelling mistakes advocates make in the courtroom, and the simple changes you can make to lead your listeners to one, inev-itable conclusion.

Deep Cover? Developing Issues in Confidentiality, the Attorney–Client Privilege, and Work-Product Protections for Outside Corporate Counsel and In-Firm LawyersPresented by the Lawyers’ Professionalism and Ethics Committee

Few legal issues touch every trial lawyer more than discovery pro-tections afforded by the attorney– client privilege and the work- product doctrine. And these issues are necessarily intertwined with the ethical rules pertaining to confidentiality. In the last few years, new procedural and evidence rules on privilege waiver have emerged, courts have issued pivotal rulings on the privilege’s scope, in-house and outside corporate counsel face tougher privilege scru-tiny, and government- enforcement agencies have increased their demand for protected material. This panel of distinguished lawyers and thinkers will examine the state of confidentiality, attorney– client privilege, and work- product protections, and discuss topics such as the emerging in-firm privilege, privilege logs and privilege waiver, establishing and maintaining the privilege during internal investi-gations, the business– legal communications issues for corporate lawyers, and related ethical issues. Since its opening in 1935, the majestic Mel-lon Auditorium has been witness to history. On October 29, 1940, President Franklin D.
