Govt to use own ‘vacant land’ for projects

Since coming to power in the state a year ago, the Samajwadi party government has been avoiding major land acquisition and has even failed to come out with a fresh land acquisition policy as promised in the poll manifesto. But now the government has come out with a “unique” solution to make land available for development projects.the government has ordered a survey of “vacant land” lying with different departments — like housing, industry and mandi parishad — across the state and has asked them to make the “ideal use” of them for development projects.

the Uttar pradesh State Industrial Development corporation (UpSIDc) has been given the additional task to conduct a survey to identify which of these lands can be given as a “sweetener” to private developers for developing infrastructure projects like roads and expressways under the public-private partnership model.

As a first step, all departments on the instructions of chief Secretary Jawed Usmani have sent district-wise data of vacant lands available with them. After a preliminary survey, vacant land at about 1,551 places across the state has been identified, which runs into thousands of acres. these lands mainly belong to horticulture, agriculture, tourism, animal husbandry, small scale industry, irrigation and transport departments.

“After land acquisition related unrest in western Up in 2010 and 2011, the Samajwadi party had promised to provide six times the circle rate as compensation for acquiring land.

however, despite best of efforts, it has become difficult to come out with a formula under which farmers are given six times the circle rate and at the same time keeping the project financially viable. thus, for the time being, this seems like a better idea to keep development projects going,” said a senior officer.

According to sources, quick allocation

of land for central Institute of hotel Management, catering technology and Applied Nutrition in Amethi — the lok Sabha constituency of congress vice-president Rahul Gandhi — was the result of this exercise. congress leaders were surprised when the state government gave the land in less than 15 days of Union cabinet clearing the project. About 2.5 acres available with Rahi Guest house of tourism Department in Jagdishpur was identified from the list of vacant

lands.

After compilation of the initial data, now housing and Urban planning Department, Industrial Development Department, UpSIDc, Mandi parishad as well as all district magistrates and commissioners have been asked to conduct their own surveys for finding out the “ideal use of land available with government department and

institutions for developing public infrastructure.”

On identification of land for specific industrial, housing or other use, each of these cases would be taken up by the state cabinet for transfer of land from one department to another.

the fall of rupee value against US dollar has one more section of the society to cheer about, this time, the NRIs. their target now is the sagging Indian property market and their mantra is “invest now and reap benefits soon.”

the record decline in the rupee value and the sluggish realty market have proved to be a double delight for the overseas Indians who are in beeline to invest in the burgeoning property market in India. Kannan Natarajan, a resident of Dubai, has zeroed in on a property in chennai at a rate nearly 35% lower than the peak value. “this is the right time to buy property,” he says adding, “Many of my friends have also decided to buy property in India. We are expecting an annual 10% to 15% appreciation.”

Since August, the Indian currency has fallen by around 20 per cent against the US dollar. According to real estate companies, brokers, analysts and consultants, this has triggered a substantial rise in the volume of property-related enquiries from NRIs. the actual deal numbers have also gone up considerably. Many NRI buyers are even buying multiple units for investment purposes.

Sathish Sharma, co-founder of Anandam Foundation, a leading realtor who have many projects in west chennai coming up, said, “We are getting good response from Indian buyers from abroad. In fact, due

As compared to last six months, the property value has now gone done from 10-30 per cent across India and as rupee depreciated to record low, properties are now available at much cheaper rate for NRIs, who are making a kill now.”At the recent property exhibition in

Dubai, many people booked flats on the spot, and several showed keen interest in flying to Mumbai to check out property and finalise decisions.

“In the last three months, we have sold more than 100 units to NRIs, a clear increase of more than 20 per cent over the previous quarter,” said R K Arora, chairman and managing director of real estate developer, Supertech, told Business Standard.

“NRIs are mainly interested in Navi Mumbai and Bangalore properties. this time, there was a slightly lower demand for the Delhi market. Going by this response, we have decided to organise and participate in exhibitions in Singapore and other international places that have a large Indian population,” said Reddy, a leading builder in Delhi.

Niranjan hiranandani, managing director of the hiranandani Group, told DNA that, “the decline in the rupee value against the dollar/dinar in the international market has helped to attract more and more NRI buyers. If the cost of the flat is Rs1 crore as per the Indian market, the NRI has to pay only Rs 85 lakh— 15% less, thanks to the record decline in the rupee value.”

Sukhraj Nahar, managing director of the Nahar Group concurred. “Many NRIs have shown interest in buying property. they will come to India around the end of December and in January 2012 to see and finalise the properties. Our city developer body is also organising a property exhibition in Dubai to attract more NRI buyers,” he said.

At least 25 per cent of the bookings in the project has been from NRIs, compared with just 10 per cent in our earlier projects, said Director Nayan Raheja of Raheja Developers, adding, “I attribute this trend to the decline of the rupee against the dollar. Now, to leverage on the trend, we are marketing ourselves in the US and canada, as this is just the right time to invest in India.”

NOtIFIcAtION NO. 51/2013“6DDc. conditions that a recognised association is required to fulfill to be notified as a recognised association for the purposes of clause (e) of the proviso to clause (5) of section 43. -For the purposes of clause (e) of the proviso to clause (5) of section 43, a recognised association shall fulfill the following conditions in respect of trading in derivatives, namely: -

(i) the recognised association shall have the approval of the Forward Markets commission established under the Forward contracts (Reg-ulation) Act, 1952 (74 of 1952) in respect of trading in derivatives and shall function in accordance with the guidelines or conditions laid down by the Forward Markets commission;

(ii) the recognised association shall ensure that the particulars of the client (including unique client identity number and pAN) are duly recorded and stored in its databases;(iii) the recognised association shall maintain a complete audit trail of all transactions (in respect of derivative market) for a period of seven years on its system;

(iv) the recognised association shall ensure that transactions (in respect of derivative market) once registered in the system are not erased;

(v) the recognised association shall ensure that the transactions (in respect of derivative market) once registered in the system are modified only in cases of genuine error and maintain data regarding all transac-tions (in respect of derivative market) registered in the system which have been modified and submit a monthly statement in Form No. 3Bc to the Director General of Income – tax (In-

telligence and criminal Investigation), New Delhi within fifteen days from the last day of each month to which such statement relates.

6DDD. Notification of a recognised association for the purposes of clause (e) of the proviso to clause (5) of section 43.-(1) An application for no-tification of a recognised association (as per clause (j) of section 2 of the Forward contracts (Regulation) Act, 1952) as a recognised association for the purposes of clause (e) of the pro-viso to clause (5) of section 43 may be made to the Member (legislation ), central Board of Direct taxes, North Block, New Delhi.

(2) the application referred to in sub – rule (1) shall be accompanied with the following documents, namely : -

(i) approval granted by Forward Markets commission for trading in derivatives;

(ii) up – to – date rules, bye – laws and trading regulations of the rec-ognised association;

(iii) con-firmation regarding fulfilling the con-ditions re-ferred to in clause (ii) to clause (v) of rule 6DDc ;

(iv) such other informa-tion as t he recognised

association may like to place before the central Government.

(3) the central Government may call for such other information from the applicant as it deems necessary for taking a decision on the application.

(4) the central Government, after ex-amining the information furnished by the recognised association under sub – rule (2) or sub – rule (3), shall notify the recognised association as a rec-ognised association for the purposes of clause (e) of the proviso to clause (5) of section 43 or issue an order rejecting the application before the expiry of four months from the end of the month in which the application is received.

(5) the notification referred to in sub – rule (4) shall be effective until the approval granted by the Forward Markets commission is withdrawn or expired, or the notification is rescind-ed by the central Government. ”
