    iVIEMORANDUM OF AGREEMENT

    This Memorandum of Agreement (lvl0A) constitutes an agreement between United Slate'SImmigration and Customs Enforcement (ICE), a component of the Department of Homeland

    Security (DHS), and the Whitfield County Sheriff's Office, hereinafter referred to as the "LawEnforcement Agency" (LEA), pursuant to which ICE "uthol'izes up 10 a maximum of sixnominated, traincd. and cerll iled LEA personnel to perfoml certain immigration enforcementfunctions as specified herein. It is the intent of the parties that these delegated authorities willenable the LEA to identify and process immigration violators in the Whitfield County SheriffsOffice jail facilities. ICE and LEA points of contact for purposes of this MOA me identified inAppendix A.

    l. PURPOSE

    The purpose of his MOA is to set forth the tenns ancl conditions pursuant [0 which selected LEt\personnel (pm1icipating LEA personnel) will be nominated, trained, and thereafter performcertain functions of an immigration ofiicer within the Whitfield County, Georgia. Nothingcontained herein shall otherwise limit the jurisdidion ancl powers normally possessed byparticipating LEA personnel as members of the LEA. However, the exercise of ihe immigrationcnJ()rcemcnt authority granted under this MOA to participating LEA personnel shall occur onlyas provided in this

    IV. ASSIGNMENTS

    Participating LEA personnel performing immigration-related duties pursuant to this MOA willbe LEA omeers assigned to the Whitfield County Shedffs Office Detention Center.

    VI. DETENTJON AND TRANSPORTATION ISSUES

    The LEA is expected to pursue to completion prosecution of the state or local charges thatcaused the individuaI to be taken into custody. ICE will assume custody of individuals who have

    been convicted of a State or local oJIense only after such individuals have concluded service ofany sentence of incarceration. ICE will also assume custody of aliens with prior criminalcOllvictions and when immigration detention is required by statute. The ICE Detention andRemoval Field Office Director or his designee will assess on a case-by-case basis the appropriateremoval vehicle t il he employed andlor whether to assume custody of individuals that do notmeet the above criteria based on special interests or other extenuating circumstances afterproccSSitlg by th e LEA. The immigration laws provide fCE Detention and Removal Operations[DRO) with th e discretion 10 manage limited ICE detention resources, and ICE Field OfficeDirectors may exercise this discretion, in appropriate cases, by declining to detain aliens whosedetention is not mandated by Federal statute.

    If ICE determines that it is necessary. the LEA will enter into an In(cl'-C,overnment,ll ServiceAgreement (IGS1\) with IC E pursuant to which, the LEA will provide, li)r it r e i l 1 1 b u r ~ a b ! efee.detention of incarcerated aliens in LEA facilities, upon the completion or their sentences. TileLEA facility will be expected to meet the ICE detention standards I ~ ) l 'either a less than 72-houror over 72-hour facility as determined by ICE, and consistent with the anticipated detentionperiod.

    If ICE determines that it is necessary, the LEA will provide ICE, at no cost, with an office withineach participaiing LEA facility for ICE supervisory employees to work.

    The !xtrtics understand that the LEA will nul continue to detain an alien after that alien is eligiblefor release from the LEA's custody in accordance with applicable law and LE;\ policy. exceptfor a period of up to 48-l1ours, excluding Satmdays, Sundays. and any holiday. pursuant to anICE detainer issued in acc(lrdance with 8 C.F.R. 287.7, absent an IGSA in place as describedabove.

    IX. CERTIFICA TrON AND .AUTHORIZA nO N

    The ICE Training Division will certify in writing to thc ICE Special Agent in Charge undior theICE Field Office Director in Atlanta the names of those LEA personnel who s u c c e s ~ f u l l ycomplete training and pass all required \Csting. Upon receipt of Traiuing Division certification,the ICE Speci,ll Agent in Charge tmdior the ICE Field Office Director in1\tlanta will provide theparticipating LEA personnel with a signed authorization to perform specified functions of animmigration officer for an initial period of onc year from the date ofthc authorization. ICE willalso provide a copy o f the authorization to the LEA. The ICE supervisory o!'llecr, or designatedteam leader, will evaluate the aClivilies offIll personnel certified under this MOA.

    AUlhorizalion of participating LEA personnel to act pursuant to this MO A may be revoked atany time by ICE or the LEA Sneh revocation will require immediate notificatioll to the otherparty to this 2,;

    Subject to the availability of funds. ICE agrees to be responsible for the purchase. inslaliuliDn.and maintenance of technology (comptHcrllAFlS/PholO and similar hardware/software)necessary to support the invcstigative functions of paI1icipating LEA personnel at each LEA[acili!Y with an active 287(g) program. The usc of this equipment is to be limited to the

    performance of responsibilities authorized by this MOl\. under section 287(g)of

    the IN.A byparticipating LEA personnel. IC E also agrees to provide the necessary technological support and,o!lwure updates luI' lise by participating LEA personnel to accomplish the delegated functions.Such hardwarc.so[p;vare. and olher technology purchased or provided by ICE. shall remain theproperty of ICE and shall be remrned to ICE upon termination of this agreement. or whendeemed necessary by the IC E Special Agent in Charge and/or the ICE Field Office Director inAtlanta.

    The LEA is responsible to provide atl adlllinistrative stlpplies, i.e. paper. toner. pellS, pencils andother similar items necessary for 110nnal office operations. The LEA is also responsible providenecessary secur ity equipment. i.e. handcui1S. leg restraints ~ l I 1 dflexi cuffs etc.

    Xl. ICE SUPERVISION

    Immigration cnIOrCemCJl( actIvItIes conducted by the participaling LEA perSOJlllel will besupervised and directed by ICE supervisory officers or the designated team leader in WhitlicldCounty. Georgia. Participating LEA personnel are not authorized to perform immigration officerfunctions. except when working under the supervision of an IC E officer, or when acting pursuantto the guidance provided by an IC E agent.

    PaI1icipating LEA personnel shall give timely notice to the rCE :;upervisory officer within 24hours of allY detainer issued under the authorities set ft)f[h in this :'vIOA, The actions ofparticipating LE A personnel will be reviewed by le E supervisory officers on an ongoing basis toensure compliance with the requirements of the immigration laws and procedures and to assess

    the need lor individual additional training or guidance.

    For purposes of this lvIOI\., ICE onicors will supervise participating LEA personnel only as toimmigration enlorcement illl1ctiollS. The LEA relains supervision of all other aspects of theemployment or and pedbnnance of dll\ics by participating LE A personnel.

    In the absence of a written agreement 10 the contrary. the policies and procedures to be utilizedby Ihe participating LEA personnel in exercising these authorities shall be DHS and ICE policiesand procedures, incitlding the ICE Use of Force Policy. However, when engaged in immigrationenlurccll1cm activities. no participating LE A personnel will be expected or required to violate orotherwise tail to maintain the LEA', rules. standards. 01:policies. or be required to fail to abideby reslI'ictions or limilations as may otherwise be imposed by law.

    If a wnflicl ,uises between im order or direction of an ICC supervisory- officer or a DIlS or ICEpolicy and tht, LEA'$ rules, standards, or policies, the conniet shall be promptly reported to IIICICE Special Agent in Charge andlor the ICE Field Office Director in Atlanta, or designees, andthe Whitfield County Sheriff, or designee, wben circumstances safcly allow the concern to be

    raised. The ICE Special Agent in Charge and/or the ICE Field Office Director in Atlanta and theWhitfield County Shcriffsha ll attempt to resolve the eonflict.

    XIl. REPORTING REQUiREMENTS

    The LEA wil! bc responsible fi)r t[(lcking and maintaining accurate data und otatisticalinfonnaticlil for theil' 287(g) program, including ,IllY specific tracking data requested by ICE.Upon ICE's request, such data and information Shllll be provided to ICE for comparison andveriJicalioll with ICE's own data and statistical information, as well as for ICE's statisticalreporting requirements and to help ICE assess the progress and success of the LEA's 287(g)program.

    XllI. LlABfLITY AND RESPONSIBILITY

    If any participating LEA personnel are the subject of n complaint of any sort that may result inthat individual receiving employer discipline 01' becoming the subject o f a criminal investigation()r civil lawsuit, the LEA shall, to the extent allowed by State law, immediately notify rCE oftlleexistence and nilture o f the complaint. The resolution of the complaint shall also be promptlyreported to rCE. Complaints regarding the exercise of immigration enforcement authority byparticipating LEA personnel shall be handled as described below.

    Exccpt as ()[herwise noted in this ]vIOA or allowed by Federlillaw, tbe LEA wilt be responsibleand bear the costs of participating LEA personnel with regard to their propeliy or per;;onnelexpenses incurred by reason of death, i!\inry, or incidents giving rise to liability.

    Participating LEA personnel will only be treated as Federal employees for pl1l1lo,es of theFederal Tort Claims Act 28 U.S.C. 2671-2680, and worker's compensation claims, 5 e.s.c. 810] c( seq., when performing a function as authorized by this MOt\. 8 U.S.C. 1357(g)(7). Itis the understanding of' the parties to this MOA thtll participating LEA pcrsonnel will el\ioy theS11l11C defenses and immunities available to ICE officers from persona.1 liability arising from tOr ilawsuits based on actions conducted in compliance with this MOA. 8 U S c . 1357(g)(8).

    Punicipating LEA personnci named as defendants in litigation arising from activities carried outunder this ]v!OA ma y request representatioll by the U.S. Department of Justice. Such requestsm\lst be made in writing directed to the Altomey General of the United States. and will behandled in coordioation with the ICE Special Agent in Charge and/or the IC E Ficld Office

    Director in Allanta. Requests for representation must be presented to the ICE Office of the ChiefCOllllsel at the 180 Spr ing Street , 3'd Floor, Atlaillu. Georgia 30303. Any request i()rrepresentation and related correspondence must be clearly marked "Subject to Al{o!'llcy-ClientPrivilege." The Office of the Chief Counsel will forward the individual's request, together witha memorandum outlining the factual basis underlying the ol'ent(s) at issue in the lawsuit. to theICE Oflice of the Principal Legal Advisor, whieh will lorward the request, the fhctualmemorandum. and an advisory statement opining whether such representation would be in theinterest of the United Statos, to the Director of tho COllstitutional and Specialized Torts Staff,Civil Division, Department of Justice, ICE will not be liable for deH::nding 01' indemnifying actsof inlentionall11isconduct on (he part of participating LEA personnel.

    The LEA agrees to cooperate with any Federal investigation related (0 this MOA to the full

    extent of its available powers. It is understood that intonnation provided by any LEA personnelunder threat of disciplinary action in an administrative investigation cannot be used against thatindividual in subsequent criminal proceedings, consistent with Garritv v. New Jersey, 385 U.S,493 (1967).

    XVi. STEERING COtvlMITTEE

    The ICE Special Agent in Charge andlor the ICE Field Oftlcc Director in Atlanta and lhe\Vhitfiekl County Sheriff shall establish a steering committee tl m will meet periodically to

    review and assess the immigration enlorcemenl activities conducted by the participating LEApersonnel ,tl1d to ensure compliance with the terms of this MOA. The steering commiltee willmeet periodically in metro Atlanta at locations to be agreed upon by the parties, or vialeleconference. Steering committee parlicipants will be supplied with spcdl1e infOlTI1ation oncase reviews, individual participants' evaltmlions, complaints Wed, media coverage, and, to theeXlent practicable, statistical information on increased immigration enforcement activity inWhitfield Counly, Georgia. An initial review meeting will be beld no later than nine months anerccrtiiicalion oflhe initial class of'participating LEA personnel under Section IX, above.

    XVU. COMMUNITY OUTREACH

    The LEA may, at its discretion, engage in community outreach with individuals and

    organizations expressing an interest in this MOA. ICE may participate in sllch outreach upon theLEA's requesl.

    XVHI. RELATJONS WITH THE NEWS MEOlA

    The LEA may, at its discretion, communicate the substance of this agreement to organizationsand groups e;:pressing an interest in the law enforcement activities to be engaged in under thisMOA. This lv!OA also describes the complaint procedures available to members of the pnblicregarding actions taken by participllling LEA personnel pursuant to this agrcemclH.

    The LEA hereby agrees to coordinate with ICE regarding intormation lO be released to the mediaregarding actions taken under this ;\'1OA. The points of conulct lo r ICE ,Ind the LEA for this

    purpose are idcntltlcd in Appendix C.

    XIX. MODIFICATION OF TIllS MOA

    COMPLAINT PROCEDURE

    T11is MOA is an agreemell! between DlIS/ICE and the Whitlleld County Sheriffs Oftice,hereinafter referred to as the "Law Enforcement Agency" (LEA), pursua m to which selectedLEA personnel are authol'izcd to perform immigration enforcement dmies ill specific situationsunder Federa! authority. As such, the tmining, supervision, and performance o f participatingLE.'\ personnel pursuant to the MOA, as well as the protections for individuals' civil andcl)nstitulional rights , arc to be monitored. Part of that monitoring will be accomplished throughthese complaint reporting and resolution procedures, which the parties to the MO A have agreedto follow.

    The MOA sets !orth the process for designation, tnull1ng, and certification of certain LEApersonnel to perf{.JrIn cerwin immigration enforcement functions specified herein. Comptaims

    filed against those personnel in the course of their non-immigration ducics \vill remain thedomain of the LEA and be hancHed in accordance with the LEA's Manual of Policy andProcedures, or equivalent rules, regulations or procedures. The LEA will also handle complaintsfiled against personnel who ma y exercise immigration authority, but who are not designated andcertified under tbis MOA. The number and type of the latter complaints will be monitored by theSteering Committee established under Section XVI oftha MOA.

    III order to simplify the process for the public, complaints against participating LEA persollncirdating to their immigration enforcement can be reported in a number of ways. The ICEHeadquarters Office o f Protessional Responsibility (OPR) lind the LEA's Administrativeinvestigations Unit will coordinate complaint receipt and investigation.

    The ICE OPR will forward complaints to the Department o f Homeland Security's Ollke ofInspector General (DHS OrG) as appropriate for review, and ensure nOlification as necessary tothe U.S. Department o f Justice Civil Rights Division (DO'[ CRD). The ICE OPR will coordinatecomplaints related to participating personnel with the LEA's Administrative Investigations llnitas detailed below. Should circumstances warrant investigation of a complairn by the DHS OIGor the DO.I CRD, this will nO! preclude the DHS OlG, DOJ CR!), or ICE OP R II'om conductingthe investigation in coordination with the LEA's Administrative Investigations Unit, whenappropriate.

    C. Time Paramders for Resolution of Complaints

    It is expected that any complaint received will be resolved within 90 days, .However.this will depend upon the nature and complexity o!'the subS1ance of the complaiul itself.
