ASSISTANCE TO THE REPUBLIC np THE CONGO (CAPITAL, LEOPOLWILLE)

Report by the Director-General

1 . Introduction

1.1 On l8 July the Director-General received a cable from the Secretary-General

of the United Nations informing him that the health situation in the Republic of

the Congo (capital, Leopoldville) was rapidly deteriorating and that the Secretary-

General "should be most grateful for anything that WHO can do to help in this

emergency"; on 20 July the Director-General received two further cables from the

Secretary-General in which the latter gave the Director-General further information

on the health situation as reported by the personal representative of the

Secretary-General and "strongly u r g e ^ / that everything possible be done by WHO,

acting with international Red Cross, to initiate immediate crash programme to meet

minimum public health needs". In response to these requests, the Director-General

promised the fullest possible assistance. The Regional Director for Africa and

members of his staff were in consultation with the representative of the Secretary-

General in Leopoldville regarding the emerging health needs of the Congo from

17 July onwards. ."“

1.2 The Security Council of the United Nations on 22 July i960 adopted a

resolution (S/4405 - attached as Annex 1) regarding the Republic of the Congo

(capital, Leopoldville) in which, inter alia, the Council invited "the specialized

agencies of the United Nations to render to the Qeoretary-Generai such assistance

as. he may require".

security as the Security Council may request"• Pursuant to the request of the

Secretary-General to provide assistance as a matter of urgency in co-ordinating the

re-establishment and maintenance of minimum health services in the Republic of the

Congo, the Director-General has taken action to provide assistance by the World Health

Organization to the greatest extent possible•

1•斗 The Director-General wishes to inform the Board of the role which WHO, at the

request of the United Nations> has played to date in this undertaking and to present

for the consideration of the Board certain issues with respect to WHO'S future

responsibilities in this area. The further developments which take place between

the issue of the document and the opening of the Board's twenty-sixth session will be

reported by addendum to this document.

2• Action taken to inform the Board and request its assistance

2.1 The Director-General informed the members of the Executive Board on 22 July of

the situation, and in a letter dated 28 July he invited the members of the Board to

approve the establishment of a "Special Account for Assistance to the Congo" as a

sub-account of the Voluntary Fund for Health Promotion established by the Thirteenth 2

World. Health Assembly in resolution Copies of both letters are attached

(Annexes 2 and У).

2.2 All members of the Board have, by correspondence^ expressed their approval of

the establishment of the sub-account as well as delegating authority to the Chairman

of the Board to accept contributions to the Account. This Special Account for

Assistance to the Congo is intended to facilitate the acceptance of any offers of

assistance which might be made by the Members of the Organization•

5 , Assistance In the field of health

The Director-General> immediately upon receipt of the request for assistance,

detached from their regular duties and sent to Leopoldville a number of staff

members qualified in various aspects of public health and on 22 July Dr Kaul,

Assistant Director-General# arrived in Leopoldville as the personal representative

of the Director-General. Additional staff were temporarily assigned to the Congo

as the needs emerged and recruitment of other staff was begun during the last days

of July.

The Director-General also appealed to the League of Red Cross Societies and

the International Committee of the Red Cross to undertake the recruitment of

emergency medical care teams from the national Red Cross Societies• Appeals have

been despatched jointly by the two Red Cross organizations, beginning on 2J> July,

to 55 such societies, most of which responded promptly and affirmatively.

D In addition, certain governments despatched emergency medical care teams to

the Congo by direct arrangement with the Government of the Republic of the Congo.

3.4 By agreement with the United Nations, the Red Cross organizations and the

Ministry of Health of the Republic of the Congo, WHO was given the co-ordinating

responsibility, through the Ministry of Health, for all international personnel

concerned with the health of the civilian population, irrespective of origin. This

responsibility includes inter alia reception, briefing, assignment, etc.

5.5 The staff involved in the assistance provided or planned to be provided in the

field of health, by WHO, by the Red Cross organizations and by certain governments on

a "bilateral" basis, as at 1 September, is shown in Annex 4 .

3.6 Questions as to future relationships, requirements and financing are still

under consideration, as indicated in the letter from the Secretary-General of 10 August

and its attachment (Annex 5)•

Having considered the first report by the Secretary-General on the

impleraentation of Security Council resolution S/bji87 of ДЛ July i960 (document

S / ^ 8 9 ) ,

Appreciating the work of the Secretary-General and the support so readily

and so speedily given to him by all Member States invited by him to give

assistance,

Noting that as stated by the Secretary-General the arrival of the troops

of the United Nations force In Leopoldville has already had a salutary effect,

Recognizing that an urgent need still exists to continue and to increase

such èfforts,

Considering that the complete restoration of law and order in the Republic

of the Congo would effectively contribute to the maintenance of international

peace and security,

Recognizing that the Security Council recommended the admission of the

Republic of the Congo to membership in the United Nations as a unit, • . •

Calls upon the Government of Belgium to implement speedily the

Security Council resolution of 14 July i960， on the withdrawal of their troops

and authorizes the Secretary-General to take all necessary action to this

effect;

2. Requests all States to refrain from any action which might tend to

impede the restoration of law and order and the exercise by the Government of

the Congo of its authority and also to refrain from any action which might

undermine the territorial integrity and the political independence of the

Republic of the Congo；

Cormnends the Secretary^General for the prompt action he has taken to

carry out resolution S/4387 of the Security Council and his first report;

4 . Invites the specialized agencies of the United Nations to render to

the Secretary-General such assistance as he may require;

5 . Requests the Secretary-General to report further to the Security

Council as appropriate•

I have been informed by the Secretary-General that the Security Council of the

United Nations last night unanimously adopted the enclosed resolution relating to

the situation in the Congo.1

The Agreement between the Itoited Nations and the World Health Organization

includes, inter alia, the following:

"Article VII - Assistance to the Security Council"

"The World Health Organization agrees to co-operate with the Council in

furnishing such information and rendering such assistance for the maintenance

or restoration of international peace and security as the Security Council may

request."

The Secretary-General has stated: "I look forward to co-operation with you

for the aims of the decision and will inform you about such initiatives from your

side as may seem indicated in support of the Itoited Nations action."

The Secretary-General of the United Nations had previously informed me that

the health situation in the Congo was rapidly deteriorating and that re-establish-

ment of the minimum health services was a matter of urgency; he requested the

assistance of the World Health Organization in meeting this emergency. I had

assured the Secretary-General that the World Health Organization is prepared to

provide fullest possible assistance.

Earlier this week, we arranged for some public health staff to be sent to

Leopoldville and Dr Kaul, Assistant Director-General, arrived in Leopoldville this

morning as my personal representative there. We are also working closely with the

International Committee of the Red Cross and the League of Red Cross Societies.

We are now attempting to clarify exactly what is required, so that we can take

action to meet this emergency. I am informing all members of the Executive Board

of this situation, and will inforra you further should it become necessary to request

the Board to take any action.

TO MEMBERS OP THE EXECUTIVE BOARD

Please refer to my letter to you of 22 July i960 concerning the emergency assistance which the World Health Organization has been requested to provide in the Congo. Since that letter was dispatched I hare received some clarification of the requirements for meeting the emergency, and it is apparent that teams to provide medical care are urgently needed, and possibly some supplies and equipment may be needed later. The Red Cross, Red Lion and Sun and Red Crescent Societies in a number of countries have offered teams in response to an appeal from the International Committee of the Red Cross and the League of Red Cross Societies; WHO has been asked by the Minister of Health of the Congo to be responsible for co-ordinating all public health and medical care assistance.

I have also been informed that considerably more assistance in the form of teams is likely to be needed, which the World Health Organization will be requested to arrange• I have reason to believe that at least some governments are prepared to offer the World Health Organization funds, as well as personnel and supplies and equipment to meet these needs » In order to be in a position readily to accept offers of such assistance, it is desirable that the Executive Board establish a Special Account for Assistance to the Congo, which it is authorized to do by the terms of the resolution of the Thirteenth World Health Assembly, "Amalgamation of Special Accounts into a Single Fund" (Resolution paragraphs 1, (2) ( e ) -

copy attached)^ By the terms of the same resolution, the Executive Board is authorized to accept contributions to any of the sub-accounts • • • and to delegate this authority to the Chairman of the Executive Board between sessions of the Board, provided the Director-General has determined that the contribution can be utilized in the programme。” In this situation, only specified personnel, supplies and equipment and convertible currencies would be immediately usable•

It is formally proposed that the Executive Board agree (1) to establish the Special Account for Assistance to the Congo, and (2) to delegate authority to the Chairman of the Executive Board to accept contributions to this Special Account. In view of the urgency of the situation, will you please inform me by cable of your approval or otherwise of this proposal•

Memorandum by the Secretary-General on the organization of the United Nations Civilian Operation ” ~ ~ ~ — " i n the Republic of the Congo

When the Security Council adopted its resolutions on the United Nations operation

in the Congo, it conceived the civilian part of the operation and the military part as

interrelated and mutually supporting elements of the assistance. The essential and

long-term contribution would be in the civilian field, but it required the establish-

ment of order and security. For that reason, the United Nations Force was organized

and sent to the Congo pending the reorganization of the national army and police at

the same time as steps were taken for the building up of a large-scale civilian

assistance activity. The Security Council reflected the latter element of its

approach and the basic unity of the operation in its resolution of 22 July i960 when

it invited "the specialized agencies of the №iited Nations to render to the Secretary-

General such assistance as he may require".

The basic and necessary unity of the civilian and military operations and the

ensuing necessity for a centralized organization and leadership within the United

Nations family naturally in no way detracts from the authority and competence of the

specialized agencies. It does, however, introduce a factor which the specialized

agencies may be expected to take into account in their own planning; at the same time

the resolution, quoted above, adds a new obligation for the specialized agencies to

render assistance to the №iited Nations as requested; this follows from the fact

that the Security Council decision under Chapter VII of the Charter is mandatory in

relation to governments, and therefore necessarily mandatory also in relation to

governmental organizations.

As regards the development of the civilian activities, they can be based on the

traditional pattern and methods of technical assistance and the Operational and

Executive Personnel programme (ОРЕХ)身 but they must go further• The United Nations

must in the situation now facing the Congo go beyond the time-honoured forms for

technical assistance in order to do what is necessary, but it has to do it in forms

which do not in any way infringe upon the sovereignty of the country or hamper the

speedy development of the national administration•

The formula suggested, approved by the Government of the Republic of the Congo

and, in part, already implemented, is the following• A distinction is made between,

on the one side, technical assistance proper, which is in principle on a technical

and advisory level, with the experts having the normal relationship to the national

Government and national administration, and, on the other side, activities on a level

of higher administrative responsibility, for which the experts employed must receive

a new and so far untried status•

This latter group, if introduced into ministries and administrations in a way-

accepted for regular technical assistance, might lead to misunderstandings or to a

slowing down of the growth of the national administration and false assumptions of

responsibilities. The experts, chosen for the task and forming the group, will be

attached to the Chief of the United Nations Civilian Operation, Dr Sture Linner (who

is also TA Resident Representative)# as his consultants, with each one having his own

and specific administrative responsibility for all activities within the range of his

expertise•

Thus, the Chief of the civilian activities - who in rank and authority will be

the opposite number to the Supreme Commander of the United Nations Force as Chief of

the military activities - will have at his disposal, and be the Chairman of, a

"Consultative Group" composed of the senior experts with the responsibilities outlined

above in relation to the technical assistance operations in the various fields which

are covered by their respective activities.

The members of the Consultative Group, the status of which has just been

defined, would carry the title of Consultants to the Chief of the Civilian Operation•

They would, however.» in accordance with a promise given to the Government, be

available at the call of the Government to give advice on various problems and provide

the Government with such studies as it may request for the planning of its activities

and its decisionsa

Thus,, the Consultants, without being accredited to the ministries and having

formally functions only within the United Nations orbit, would de facto be able to

serve, with senior responsibility^ at the request of the Government, the various

ministries and departments• But - and that has to be repeated - they will fulfil

the latter function on an ad hoc basis and at the specific request of the Governments

It will be observed that in this list certain areas are within the responsibility

of one or more specialized agencies• Thus, agriculture corresponds to the field of

the Pood and Agriculture Organization of the United Nations (PAO), communications

corresponds to the field of the International Telecommunication Union (ITU), the №ii灣

veral Postal Union (UTU), the International Civil Aviation Organization (ICAO) and the

World Meteorological Organization (WMO) and education to the field of the United

Nations Educational, Scientific and Cultural Organization (UNESCO). Health

corresponds to the field of the World Health Organization (WHO) and finally, labour

market corresponds to tiie field of activity of the International Labour Organisation

(XLO). In addition, finance, in part, is a field in which consultations are carried

on with the International Bank for Reconstruction and Development (IBRD) and the

International Monetary Fund (IMP)• In the other cases, the activities are exclusively

within the field of the United Nations itself.

In order to organize this administrative system in a way which fully reflects

the constitutional situation and, thus, avoids any interference with the activities

of the specialized agencies or infringement upon their competence, while reflecting

their added responsibilities, the following line has been chosen.

The specialized agency concerned appoints a local representative of such

seniority as to correspond to the duties which he will have in the field, taking fully

into account, on the one side, the scope of the operation, on the other side his

senior responsibilities as adviser to the Government at its request. Naturally, the

local representative appointed by the specialized agency remains in the regular

relationship to his agency and under its authority. Such representatives have already

been appointed in several cases and that has in all cases been done in consultation

with the United Nations. The Secretary-General, in turn, appoints the local

representative of the specialized agency as consultant and member of the Consultative

Group, thus adding to the representative's normal responsibilities, providing for full

integration with the other activities and reflecting in an adequate form the basic

unity of the total operation. In cases where several agencies are concerned, the

appointments have been made by the United Nations in close consultation with the agencies

The activities of the specialized agencies will profit from the fact that they

can act under the security provided by the United Nations Force and use the services

provided by the United Nations administration and the United Nations communication

system and, finally, seek guidance from the head of the whole United Nations operation

in the Congo, who has the position of political adviser and personal representative

of the Secretary-General； naturally such consultation should take place through the

Chief of the Civilian Operation. These advantages obviously add a further reason for

the administrative arrangements to which reference has just been made.

The Secretary-General has been approached by the Government of the Republic of

the Congo with a request for assistance at the earliest possible moment for the

establishment of plans for its administrative and economic activities. Special stress

has been put on the problem of unemployment. The Secretary-General has, likewise,

been approached by a number of Member Governments with requests for early indication

of the needs for technical assistance experts in the various fields with specification

as to number and qualifications. These requests indicate a first major task of the

Consultative Group, under the chairmanship of the Chief of the civilian activities.

It is to be hoped that the Group can start its work early next week.

The Secretary-General is reluctant to embark on a diffuse programme whose

effectiveness would be doubtful until the Consultative Group has had an opportunity

to advise on what is wanted. A number of appointments were necessary to cope with

the emergency and these have been, or are being, made. These apart, it is desirable

to follow as orderly a course as possible and the Consultative Group will give its

first attention to setting up necessary surveys and working teams to report to it.

A H posts approved by the Secretary-General will be financed from United Nations

funds, This would, of course, not preclude the specialized agencies from financing

activities under their regular programmes. It is assumed) however, that such

projects would first be the subject of consultation with the Chief of the United

Nations Civilian Operation in the Congo and would be co-ordinated with the total

programme outlined by the Government of the Republic of the Congo.

Ordinarily, the procedure will be that, subject to due approval by, or consulta-

tion with, the Government of the Republic of the Congo, the Secretary-General will

sanction a number of posts in specified areas of activity; the specialized agencies

will then proceed to recruit, contract with and pay personnel against reimbursement by

the United Nations. Until the situation is clearer, the United Nations policy is to

grant initial contracts for outside experts only on a short-term basis, namely six

months as a maximum. Conditions of service will be in accordance with the rules

applicable to technical assistance personnel.

•Rie United Nations will reimburse the specialized agencies on the basis of

their "extra costs" in respeot of all seconded agency staff and technical assistance

experts employed by the agencies in posts approved by the United Nations to

participate in the United Nations Congo operation on the following basis:

1 . The United Nations will reimburse the agencies for salaries and related

costs in respect of any temporary assistance staff required to be employed as

replacements for the agencies' regular staff assigned to the Congo.

2 . The United Nations will reimburse the agencies for salaries and related

costs in respect of all agreed technical assistance experts employed specifically

to participate in the United Nations Congo operation.

3. The United Nations will reimburse the agencies for transportation and

travel subsistence costs incurred in connexion with travel to and from the

Republic of the Congo for their seconded regular staff and technical assistance

experts, but not for any dependants of such personnel.

4 . The United Nations will reimburse the agencies for any extra costs they may

incur in connexion with death, disability or illness to their staff members and

technical assistance employed in the Congo operation.

United Nations financial responsibility must be limited to the costs in connexion

with posts for which it has given advance agreement. United Nations agreement will

stipulate the number of posts authorized and may indicate the approximate grade and

level contemplated.

The Chief Administrative Office of the United Nations Force in the Congo (ONUC)

will provide all administrative services for such personnel, including payment of emolu-

ments and allowances payable in the Republic of the Congo.

ASSISTANCE TO THE REPUBLIC OF THE CONGO (LEOPOLDVILLE)

Report by the Director-General

The following additional developments have taken place with regard to assistance

to the Republic of the Congo (Leopoldville) since the issuance of document EB2ó/s.

The Director-General replied on JO September to the letter from the Secretary-

General of 10 August, which together with its attachment was annexed to document

EB26/9 as Annex 5. The letter of the Director-General is attached as Annex 1 of

this document.

It had been the expectation that by mid-autumn the Republic of the Congo would

be in a position to recruit directly, with the assistance of WHO, the foreign health

personnel necessary to maintain the health services of the country. In view of the

continuing instability in the political situation, this.expectation was not realized,

and since the medical care teams provided to the Congo by the Red Cross and certain

governments directly were recruited on an emergency limited-term basis, further

action was required to assure the continuance of health services in the country.

At the request of WHO, the international Red Cross and the League of Red Cross

Societies on 7 October appealed to the national societies having teams in the Congo

either to extend the terms of these teams for an additional several months or to

agree to replace them by other teams. To date, most of the national societies have

responded affirmatively. Pending the time when the Government of the Congo will be

prepared to issue contracts itself for personnel, the United Nations authorized WHO

to recruit directly, under normal WHO employment conditions, but chargeable to the

United Nations Congo Fund, health personnel to be seconded to the Government of the

Republie of the Congo as operational personnel to assist in the maintenance of the

health services of the country. In addition a few supporting administrative staff

will be needed. The numbers and types of personnel to be recruited are as follows:

Dear Mr Hammarskjold,

This will acknowledge your letter of 10 August i960, by which you transmitted to me a memorandum (Document s/4417, Add.5) regarding your basic approach to the civilian activities in the Congo. I have delayed ray reply until I had the advantage of a further first-hand look at the situation in the Congo.

I note from your letter that it is your intention fully to safeguard the interests

and constitutional rights of the specialized agencies, and I am, of course, in full

agreement that this is essential.

I have further noticed from the minutes of the Security Council that the subject matter of document s / ^ 1 7 , Add.5, while being presented to the Council, is expected to be dealt with by the General Assembly. I take it for granted, for that as well as other reasons, that it is still open for discussion and for revision as necessary in the light of developments. I am not as yet in a position to comment specifically on the various points, because the situation in the Congo is still so fluid and comment would therefore be premature. However, I can inform you that I have no reason to disagree with your proposal that the United Nations reimburse the specialized agencies on the basis of the "extra costs" to the agencies.

I would like to make clear the basis on which 工 have been able to respond to your requests for assistance. Prom the outset, it should be understood that under its Constitution the World Health Organization has the responsibility to render assistance to the Congo, upon request of the Congo, and the World Health Assembly has laid down specific conditions under which such assistance shall be provided. I note that activities of this nature are referred to in general terms in your document. The additional factor, under which WHO is able to provide assistance to the Congo, is the 22 July resolution of the Security Council which, by its paragraph 4, has the effect of invoking Article VII of the Agreement between the United Nations and the World Health Organization. Article VII of the Agreement explicitly lays down the responsibility of the World Health Organization to "cooperate with the Council in . . . rendering such assistance for the maintenance or restoration of international peace and security as the Security Council may request". That Article of the Agreement has been щ authority for responding to the invitation in the resolution of the Security Council of 22 July i960 and to your own requests. Thus, it is not necessary for WHO to rely on any implicit authority, as suggested in the last sentence of the second paragraph of your document, since explicit authority exists.

Article XVI of the Agreement between the United Nations and the World Health Organization further provides that "In the event of the World Health Organization being faced with the necessity of incurring substantial extra expense as a result of any request which the United Nations may make for • • • assistance in accordance with Articles • • • VII • • • consultation shall take place with a view to determining the roost equitable manner in which such expense shall be borne". I arranged for Mr Milton P . Siegel, Assistant Director-General, to go to New York early in August for the purpose of initiating the consultations required by that Article of the Agreement, and he has reported fully to me on the preliminary consultations which he had with members of your staff

I am sure you recognize that we have done our utmost adequately to meet your request to assume responsibility for providing or obtaining the urgent and extensive help needed in the Congo emergency in the field of health. I would wish to assure you that we shall continue to do everything within the power of the World Health Organization to provide the assistance requested, and that we shall, of course

request reimbursement only for clearly identifiable additional costs to WHO of these operations. There are certain of the functions which we are performing in these emergency circumstances which are of the same nature as we normally provide to governments, and I would not expect to request reimbursement for the cost thereof.

With regard to the next stage of operations, that of the period after the emergency has been dealt with, I suggest that we might well discuss these longer-terra aspects at the next ACC meeting•

ASSISTANCE TO THE REPUBLIC OF THE CONGO (LEOPOLDVILLE)

1. Pursuant to the arrangements outlined in Annex 5 to document SB26/9 under

which the United Nations has undertaken to reimburse the "extra costs'1

incurred

by specialized agencies participating in the United Nations Congo operation, the

Director-General has submitted to the United Nations detailed estimates of the

extra costs to WHO for the remainder of i960 and for 196l.

2. In the following statement of the estimated expenditure for which

reimbursement by the United Nations is being requested by WHO, the amounts shown

include provision for temporary staff, short-term consultants, other short-term

assignments, supplies and equipment and common services costs, as well as for

full-time posts as indicated:

1. Advisory staff

2. Personnel seconded to the Government (including supporting staff)

Red Cross Teams (Travel and subsistence costs)

Medioal Education and Training programmes

3. In accordance with the arrangements concluded with the United Nations,

monthly invoices of disbursements are being submitted by WHO for reimbursement•

4. Apart from the above reimbursable expenditure, the costs of the following

5. By agreement with the Government of France, the personnel assigned to the

rural health teams is being seconded to WHO. The Government of France has

undertaken to meet the salaries of the personnel as a contribution to the

"Special Account for Assistance to the Congo" (see report under provisional agenda

item 7.2.3).

6. The estimates shown herein are based on the known requirements at the time of

preparation of this document, and may be subject to rapid changes in the light

of developments. They do not take into account some possible requirements of

additional personnel to be seconded to the Government and of supplies and

equipment.

7 . As regards the estimated expenditure in 1961 under the WHO Regular budget

as shown in paragraph 4 above, the Director-General is proposing that it be

met by Supplementary Estimates for 1961 (see document EB26/5 Add.4).
