Case Studies on Ethics

A potential client, Maggie Smith, approaches you with drawings and a materials board for her coffee shop. She wants to know whether you can give her an estimate that is less than that of the designer who has prepared the drawings and materials board. What do you think you should do? If you begin work, will it violate the code of ethics? If so, identify the clause.

I would still offer my services to the client; however, I would not guarantee an estimate below that of the other designer. I also would not start work on a project based on other designers’ material boards. All work performed by me would have to be of my own design and materials. I would agree to provide her with an estimate for services to be rendered based on my designs and what I believed to be fair. I would not take the other designers works and estimates into consideration as I believe trying to underbid another design professional based on their materials would be un-ethical. As would using the materials and designs that they worked so hard to put together. Performing work based on another design professionals boards and materials would violate the following ASID Code of Ethics and Professional Conduct: Clause 2.2: “Responsibility to the Public, Members shall not seal or sign drawings, specifications, or other interior design documents except where the member or the member’s firm has prepared, supervised or professionally reviewed and approved such documents, as allowed by applicable laws.” Clause 4.5: “Subject to the provisions of section six, members shall only take credit for work that has actually been created by that Member or the Member's firm, and under the Member's supervision.” Clause 5.1: “Members agree to maintain standards of professional and personal conduct that will reflect in a responsible manner on the Society and the profession.”

Public and Community Service:

The Organization

“The 1%” is an organization that connects Architecture/Design Firms willing to do pro bono work, work that is done for the public good without any compensation, with nonprofits in need of assistance.

Their vision is to impact the world by shining a spotlight on the large effect that donating just 1% of a company’s time would have on the public good.

“If every architecture professional in the U.S. committed 1% of their time to pro bono service, it would add up to 5,000,000 hours annually – the equivalent of a 2,500-person firm, working full-time for the public good.” – The 1%

The Project

(fig. 1)

In 2006 The 1% connected the nonprofit, Hawaii Wildlife Center, with pro bono architects, Ruhl Walker Architects. From 2006 to 2007, Ruhl Architects provided design

Page 19: Written Contract Document Portfolio - WordPress.com · 4/17/2014  · • Maintained and updated various A/P reports i.e; petty cash, expense tracking, purchases, and budget reports

19

services to the nonprofit and then returned from 2008-2011 to handle the construction of the center. The Hawaii Wildlife Center “is dedicated to the conservation and recovery of Hawaii’s wildlife through hands-on treatment, research, training, science education, and cultural programs.” – The 1%. This project not only benefited the city of Halaula, but the state of Hawaii, its wildlife, and the culture. Through the conservation of the state’s wildlife, the people and culture of Hawaii will benefit from the knowledge that the center will pass on and provide to future generations.

(fig.2)

Through a team of 8 architects donating 1000 hours of their time annually, this center was designed from the ground up and then constructed with the help of engineers who also donated their time for this project. Through the pro bono work and effort of these two companies, Hawaii’s wildlife will be protected and people will have a place to study the science of environmental conservation.
