IChemE Forms of ContractPerformance-based contract forms for the process industries

The IChemE forms of contract are drafted for the design and construction of a process plant or other output-based plant/project.

They specifically address the liabilities and testing regimes appropriate for a performance plant, providing a contractually structured approach to testing the plant at every critical stage.

The IChemE contract philosophy encourages fairness and teamwork between the parties, and is directed towards the avoidance of disputes.

Two suites of contracts are available: UK forms and international forms.

WELCOME

YCF Directory 7

Welcome to our 2012/2013 directory, a year of celebration for the UK and one that YCF are refl ecting in our series of ‘Celebrating Success’ events within our membership.

This past year for YCF has been a diffi cult one as we evolve from a Yorkshire Forward supported Sector Cluster to one that is for our industry and supported solely by our industry based membership. So on behalf of our board and the team at YCF I would like to say THANK YOU for all your support and for your patience as we go through this transition.

There are exciting times ahead for YCF. Not only are we expanding our membership geographically, but also the services we offer. We have listened to our membership and to the industry therefore I am very please to share with you the initiatives we are leading at the moment:

● The development of a Yorkshire Maintenance Engineering Apprenticeship and potentially a Centre of Excellence for Science and Engineering Apprentices and Skills in Yorkshire.

● A partnership with the Health and Safety Laboratories to bring the practicalities of implementing the new SEVESO III Directive to your business.

● The formation of new cross sectorial networks and refl ection of this in our membership base

● The vision for YCF to be the ‘bridge’ for our members.

Our event programme is in the process of being fi nalised for 2013 with content developed by our network groups, ensuring the subjects we present to you are timely and relevant to our membership base. We are also developing steering groups and committees for each of our network groups to ensure the outcomes of the meeting are realised and deliver tangible benefi ts to our members.

YCF needs your continued support, as without our members, we can not exist. With your assistance, we can and will achieve our vision to be the bridge between industry and everything else. Watch this space - YCF is a solid network and will be for the foreseeable future.

As always, please feel free to contact myself or my colleague Lisa Buck, with any enquiry you may have.

YCF REACH/CLP NETWORK

How will you comply?

REACH and CLP Regulations apply to your business if you manufacture, import, use or distribute chemical substances or mixtures into the EU market and beyond.

REACH and CLP both have global implications and affect the whole of the chemical supply chain in the EU, with a resultant impact on companies’ time and resources.

REACH (Registration, Evaluation, Authorisation and restriction of Chemicals.) is a major piece of regulation which came into force across the EU in 2007; and a major part of REACH is the requirement for manufacturers or importers of substances to register them, supported by a standard set of data on that substance.

Globally Harmonised System (GHS) for classifi cation and labelling of chemicals is being implemented in the EU as the new Classifi cation, Labelling and Packaging (CLP) Regulation (EC) No. 1272/2008. This will eventually replace the CHIP and ADR Regulations.

The YCF REACH / CLP Network a well established group that assists companies to comply and conform to the REACH regulations, with a regular meetings, presentations and workshops and access to the relevant competent authorities.

We are the most active REACH and CLP support group in the UK, others may imitate but come and be part of the original and best.

Advanced Extraction Technology Ltd.

Sub-critical Water Extraction (SWE) is based on the phenomenon that the polarity of water, maintained in the liquid phase by application of pressure, decreases signifi cantly as the temperature is increased above the normal boiling point.

Thus the process represents a “green” alternative to ethanol and alcohol water mixtures in chemical processing.

The principal focus of the company is the application of SWE to the extraction of valuable natural products, especially phytochemicals.

However other applications of sub-critical water within the chemical industry are possible, including accelerated hydrolysis and pre-treatment of biomass to improve biofuel production.

The company undertakes both joint ventures and contract research for third parties.

CHILWORTH TECHNOLOGY

INDEPENDENT PROCESS SAFETYSERVICES FROM CHILWORTHProcess safety deals with the hazards associated with the storage and processing of hazardous materials that, if inappropriately handled or processed, could cause inter-alia fi res, explosions and/or toxic chemical release. Accidents or incidents of these types have the potential for multiple fatalities and injuries both on and off-site, accompanied by major environmental damage.

The resulting economic impact, combined with the social impact arising from such an event, can threaten a company’s reputation and commercial viability. Prevention of incidents and mitigating the effects of accidents, can only be achieved if a company has an effective process safety management (PSM) system and the culture to support it.

People – at all levels from the CEO to shopfl oor workers – are essential components of any approach to process safety, and it is these human factors that have a strong infl uence on process safety management. The impact of people’s behaviour and communications – whether positive or negative – on the process safety management system is known as the process safety culture. In order to maintain a high standard of process safety management, it is vital that an organisation has a good process safety culture.

Based in the UK, Chilworth is part of DEKRA, one of the largest specialised process safety organisations in the world, providing independent consulting, training and testing and offering global expertise with a local presence in explosion and process safety.

With an internationally recognised reputation in process safety, Chilworth has completed projects in a wide variety of countries around the world. Using highly qualifi ed staff, we join with our business partners in the successful development and delivery of sustained improvement in process safety performance, emulating and leading best practice.

As an expert process safety company, Chilworth provided one of only two technical process safety experts to the Baker Panel investigating the Texas City refi nery blast. Chilworth, therefore, has both experience and expertise to provide effective process safety support through fi rst hand knowledge of the technologies and processes involved.

Working with a number of multi-site blue chip clients in a variety of processing industries, we operate in the petrochemical, chemical, pharmaceutical, food, drink, paper and packaging, plastics and rubber, agrochemical and power generation sectors. With consultants operating from locations in Europe, Asia and North America, Chilworth is ideally placed to provide a harmonised global approach to process safety for our UK and multi-national customer base.

Chilworth, therefore, offers a comprehensive range of services including:

● Consultancy and Training

MARKETING IN THE CHEMICAL INDUSTRYThe chemical industry has, over the years, demonstrated many of the best aspects of professional marketing - even when industry members did not use that term, or fully recognise that they were engaged in marketing activities.

The most effective marketing people in our industry use just a few tools, but use them well. Here are some examples:

MARKET KNOWLEDGEAs a matter of course, most companies monitor their key customers’ public data, including company announcements, publications, patents etc, and have always done so. The company annual report is surprisingly little used by many sales people. However, most companies could, and should, do more. Other, often underused, information resources include:

● Job vacancies and job moves

● Conference attendance

● Sponsorship of university research

● Google and Google Alerts

● Web-sites beyond the fi rst page

● Formal and informal networks

● Customer Surveys

It is sensible to build in a formal customer survey process every few years, choosing a method (email, phone, face-to-face) which suits the customers. The knowledge gained can be extraordinarily powerful, driving strategy in technical, commercial and manufacturing functions.

MARKETING TOOLS AND TECHNIQUESPractitioners now recognise the importance of business-to-business (b2b) marketing, and produce guidance, case studies and examples directed towards b2b marketing rather than business-to-consumer (b2c) marketing. The fi rst relevant books on b2b marketing are being written, and the Chartered Institute of Marketing provides basic guidance on techniques to improve the professionalism of b2b activities.

Spending time thinking about markets and customers is every bit as important as the technical and production aspects of our business. The resources – staff with marketing skills, consultants and written guidance – are available, and can deliver real business benefi ts to the chemical industry.

TRADEBE MANAGING WASTE PROVIDING SOLUTIONS

TRADEBE is the UK’s largest hazardous waste management company with 18 sites in the UK, annually processing in excess of 400,000 tonnes of waste each year.

TRADEBE provides specialist hazardous and non-hazardous waste management, recycling, recovery and disposal services throughout the United Kingdom, for both bulk and packaged waste.

Working through a national network of treatment facilities and transfer stations, TRADEBE offers a customised “one stop shop” solution to waste management from Recycling through to High Temperature Incineration. Our objective is to deliver cost effective, fl exible and technology driven solutions to evolving hazardous and non hazardous waste processing requirements.

TRADEBE actively promote the European Waste Hierarchy and fi rmly believe that when we are able to offer a better environmental solution that we can also offer better pricing. Even turning waste costs into waste revenues!

An example of this is where a fi ne chemical manufacturer approached TRADEBE looking for a

disposal solution for a 3000 tonne waste stream. Closely working with the customer’s production and process engineering team, TRADEBE were able to offer a recycling route for the waste stream which meant that approximately 75% of the waste material was able to be returned to the customer for re-use on their processes. This meant that the saving is not just £210,000 which was the potential disposal cost but also a further £200,000 in raw material costs.

Contact TRADEBE today to realise your potential savings and improve on your current waste disposal services. Please call 0845 603 2893, e-mail to [email protected] or visit the website www.TRADEBE.co.uk

Profits From Patents – Reduce UK Corporation Tax to 10%The Government plans to give companies that make use of the patent system the opportunity to significantly reduce their tax burden.

From April 2013 onwards, profits placed in the “Patent Box” may, according to draft legislation, be subject to a special rate of corporation tax which is to fall to 10%. If your products are patented, if they incorporate patented items, if they are manufactured by patented methods, or if your company uses patented technology in some other manner, then you may be able to benefit.

Worldwide profits can qualify for the Patent Box based on a UK patent alone, without the need to get involved in expensive overseas patent filing. Whether or not your company has chosen to patent in the past, if you are engaged in any form of technical innovation then you should be considering now whether patenting activities could lower your corporation tax.
