    General Conditions

    1. The approved entitlement is for a Minor Design review to construct a new parking area with pedestrian pathways, lighting, and landscaping on a vacant parcel located at the northwest corner of Bear Hollow Drive and Zinfandel Drive (APN 072-2360-001-0000), as described in the administrative approval level dated February 17, 2015 (Attachment 1) with the conditions herein, for project number DD8562.

    2. This project shall also comply with the Villages of Zinfandel Special Planning Area Development Agreement Ordinance 38-2004 including the adopted conditions of approval and mitigation measures.

    3. The Applicant shall hold harmless the City, its Council Members, officers, agents, employees, and representatives from liability for any award, damages, costs and fees incurred by the City and/or awarded to any plaintiff in an action challenging the validity of this permit or any environmental or other documentation related to approval of this permit. Applicant further agrees to provide a defense for the City in any such action.

    4. Any future alteration to the site plan, change in use, intensification of the site, or modification to the parking and landscaped area must be reviewed by the City to ensure compliance with all local, state, and federal regulations. Minor modifications that are found to be in substantial conformance with the approved plans such as colors, plant materials, or minor lot line adjustments, may be approved administratively. Major modifications shall be approved by the applicable decision making body.

    8. The perimeter wall adjacent to residential uses shall be maintained during site demolition or grading work in the area of the fence/wall. If the fence at an abutting residential property is planned for removal, or if an existing residential property does not have a fence, the replacement perimeter fence/wall shall be completed within two weeks from removal of the original fence, unless otherwise approved by the Planning Department. This is a requirement under the Villages of Zinfandel Special Planning area approval.

    10. Construction of the undeveloped portion of parcel (072-02360-001) will require a separate submittal for review and approval.     11. The removal and replanting of landscape not listed on the approved plan set must be consistent with RCMC 23.716.080 through 23.716.090 and reviewed by the Planning Department prior to the removal. All landscape care, maintenance, and tree pruning must adhere to RCMC 23.716.100 through 23.716.110.

    16. Property Owner/Applicant shall participate in or provide a funding mechanism for maintenance services for the projects stormwater drainage and flood protection system. This may be accomplished through annexation to the Citys Stormwater Utility Fee District, or other financial mechanism as may be proposed and provided by the Property Owner for the same purpose of providing a financial mechanism to fund the operation and maintenance of the Projects stormwater drainage and flood protection system.     19. The removal of Heritage trees shall be mitigated by planting (specify ratio/tree), unless specified otherwise in a submitted arborist report to be approved by the Planning Department. The size, species, and location of all replacement trees shall be identified on the Final Landscape plan, consistent with the Design Review approval.

    20. All landscape strips, medians, etc. that contains trees shall be installed with continuous root barriers. A planter at least five feet wide, excluding curbing, shall be provided. The planter shall be increased to a minimum of six feet wide when canopy trees are used. Planting materials shall be designed to ensure that planting within the clear vision triangle at driveway and street intersections will not exceed 30 inches in height at full maturity and consistent with the Village of Zinfandel Special Planning Area standards.

    21. A final landscape and irrigation plan shall be submitted in conjunction with site improvement plans and reviewed and approved by the Planning Department prior to issuance of building permits and/or any installation of landscape materials for projects as identified in RCMC 23.716.020 (Applicability). The final landscape planting and irrigation plan shall be prepared by a registered licensed landscape architect. Final plans would show exact locations and irrigation for trees, shrubs, and ground cover consistent with plants listed in RCMC 22.180.080. The landscaping plans shall demonstrate conformance with the Water Use and Conservation provisions as the designer shall certify that installed landscaping conforms to City water conserving landscape requirements. Applicant shall provide CRPD with all plans including but not limited to, landscape layout, grading & drainage, irrigation and planting, related to improvements along the existing trail for its review and approval by park planning staff.

    General Information and Compliance Items: The following items are noted for the applicants information. These items are required by other local agencies, the City, state or federal agencies, and are not conditions of approval of the project.

    1. The installation of on-site or off-site fire protection equipment, including fire hydrants and water mains, shall meet the standards of the Metro Fire District and the water purveyor having jurisdiction. (Metro Fire)

    2. The installation of addresses, landscaping, tree wells and/or traffic islands are subject to the standards outlined by the Metro Fire District.

    3. Gas service may be available to this project if desired. The developer should contact PG & Es Service Planning Department as soon as possible to coordinate construction so as not to delay the project. (PG&E)

    4. On-site source and control measures are required for this project in accordance with the latest version of the City/County Guidance Manual (Guidance Manual of On-Site Storm Water Quality Control Measures). In all cases, source control measures on the improvement plans will include provision of a permanent storm drain message No Dumping Flows to Creek or other approved message shall be stamped in concrete at each inlet. Other on-site source and treatment control measure(s) should also be used in accordance with specific residential activities referenced in the Guidance Manual. The
