Constraint of financial resources is one of them since our primary Respondent ie LIC/Govt combined is the greatest Money-tycoon in the Financial Market with enormous capability to drag poor pensioners from one court to another forgetting their social responsibility on their own pensioners who once sacrificed their lives to build LIC at its present magnitude. But thanks to our pensioner friends who have contributed as much as they can from their tiny pensions to make 'Drops of money makes an ocean'. And we have to face other impediments also. Besides external oppositions, we have to face internal oppositions sailing in the same boat claiming fatherhood of the victory. Thinking our pensioners are not so intelligent, some misleading statements/preaching were in the picture. But thanks to the pensioners again who have not been misled, gave their full-hearted support for the main cause of all the pensioners as a group and also remained united to win the battle. EDITORIAL : LEGAL BATTLE NEARING AN END, PERHAPS !

The great legal battle, The Kurukhestra war or by any other name of one’s choice, has

reached the near exit point of the arena. Now, it is the period of our waiting for justice

to be delivered followed by approval by the Apex Court of India. It is the sincere prayer

of the LIC pensioners after marathon legal race that there should be no further legal

exercise beyond the Supreme Court approval in their favour being aware of the saying

“IF WISHES WERE HORSES, THE BEGGARS COULD RIDE”. Whatever may be the

outcome, the end appears to be in sight except the poor pensioners who left this world

during last one decade hoping against hope to have justice in their favour for a worthy

living in this high rise market.

During this legal battle, we have earned a lot of experiences in different spheres.

Constraint of financial resources is one of them since our primary Respondent ie

LIC/Govt combined is the greatest Money-tycoon in the Financial Market with

enormous capability to drag poor pensioners from one court to another forgetting their

social responsibility on their own pensioners who once sacrificed their lives to build LIC

at its present magnitude. But thanks to our pensioner friends who have contributed as

much as they can from their tiny pensions to make 'Drops of money makes an ocean'.

And we have to face other impediments also. Besides external oppositions, we have

to face internal oppositions sailing in the same boat claiming fatherhood of the victory.

Thinking our pensioners are not so intelligent, some misleading statements/preaching

were in the picture. But thanks to the pensioners again who have not been misled,

gave their full-hearted support for the main cause of all the pensioners as a group and

also remained united to win the battle. So, the END is near at the door.

Our cause is genuine, our belief is genuine and so the expectation of favourable result

is genuine.

HEARING CONTINUED ON 14, 15, 16, 20 AND 21 ST FEB 2017 IN DELHI HC :

All the days belong to petitioners to counter the submissions of GOI/LIC against uniform DA and

pension upgradation where AIRIEF, Hyderabad Association, AIIPA and Federation Counsels

participated to place their arguments. LIC/Govt made feeble counter on 21st

before concluding the

hearing. Bench adviced to submit written submissions within 10 days and the judgement is reserved

for delivery.

At last it is 'curtains at intermission' in the drama of court proceedings which LI C pensioners were

witnessing for nearly a year now. On the last day of the arguments I.e today our Sr counsel Shri.

Rakesh Khanna dealt with in detail on expense ratio, bonus to policy holders, dividends to govt etc

amidst occasional interventions by LIC's sr counsel. Shri Nidesh Gupta continued with his points on

surplus, life fund etc .The court thereafter reserved orders giving in the meantime ten day's time for

those wanting to make written submissions.

So far as our fedn is concerned we have already submitted copious points to our counsels for

incorporation in written arguments. Preperation of the relevant materials called for considerable

labour on our part and I take this opportunity of thanking our legal committee members viz. M/s R

Rajagopalan , V K Jain , Basudeb Das and M Arunachalam who had contributed immensely in giving

shape to points for written submissions. Our counsel has assured that our w/s will be submitted at

earliest without waiting for ten days.

The end of arguments marks an important stage providing great relief from anxiety and tension for

leaders and pensioners alike. Every one of the parties played their part well though unwarranted

comments and criticism of others from certain odd quarters continued throughout the agonising

period. We rightly decided to refrain from acrimonies. After all we would not like to compete with

loud mouthed demagogy of others.

Let me conclude saying that the feedback we have from our counsels make us feel optimistic about

the outcome of our pioneering efforts. Let us therefore wait for a little more time

ARTICLES OF PARAMOUNT IMPORTANCE FOR OUR COURT CASES :

FREQUENTLY IN DISCUSSION OF OUR COURT CASES, LAWYERS REFER TO DIFFERENT ARTICLES OF OUR

CONSTITUTION WHICH ARE RELEVANT FOR OUR PROTECTION FROM RULES/REGULATIONS FRAMED BY

GOVT/LIC DETRIMENTAL TO THE PENSIONERS :

ART 13. Laws inconistent with or in derogation of fundamental rights – (2) The state shall not make any law

which takes away or abridges the rights conferred by this Part ( PART III FUNDAMENTAL RIGHTS) and any

law made in contravention of this cause shall, to the extent of the contrAvention, be void.

ART 14. Equality before law - The state shall not deny to any person equality before the law or the

equalprotection of the laws within the territory of india.

ART 16. Equality of opportunity in matters of public employment – (1) There shall be equality of opportunity for

all citizens in matters relating to employment or appointment to any office under the state. (2) No citizen

300A (Chapter IV Right to property) Persons not to be deprived of property save by authority of law – No person

shall be deprived of his property save by authority of law.

IT IS OFF AND ASKED BY PENSIONER FRIENDS WHY SUPREME COURT REFERRED OUR PENSION CASE TO DELHI HC

AND WHAT WILL HAPPEN AFTER DELHI HC VERDICT? THE FOLLOWING CONSTITUTIONAL PROVISION

MAY ENLIGHTEN US IN THIS REGARD :

ART 139A. Transfer of certain cases – (1) Where cases involving the same or substantially the same questions of

law are pending before the Supreme Court and one or more or one or more High Courts or before two or

more High Courts and Supreme Court is satisfied on its own motion or on an application made by the

Attorney-General of India or by a party to any such case that such questions are substantial questions of

general importance, the Supreme Court may withdraw the case or cases pending before the High Court or

the High Courts and dispose of all the cases itself :

Provided that the Supreme Court may after determining the said questions of law return any case so

withdrawn together with a copy of its judgement on such questions to the High Court from which the case

has been withdrawn, and the High Court shall on receipt thereof, proceed to dispose of the case in

conformity with such judgement.

(2) The Supreme Court may, if it deems it expedient so to do for the ends of justice, transfer any case or

other proceedings pending before any High Court to any other High Court.

REMARKABLE SUPREME COURT JUDGEMENTS :

Curb false insurance claims: SC to Govts The Times of India 31st January, 2017

Holding that instances of fake insurance claims have risen sharply, the Supreme Court has issued notices to all

states and insurance companies to suggest steps to rule out such cases. Hearing a plea regarding false insurance

claims in Uttar Pradesh earlier this month, the SC expanded the ambit and has sought response from states and

other stake-holders to evolve a mechanism to curb such practice. Lucknow bench of Allahabad high court in

October 2015 turned down petitioners review petiotion as it was also found as a suspected case of fraud. The HC

has set up a special investigation team (SIT) after ICICI Lombard, a private insurance firm, had filed a civil revision

petition in the court against the fraud played by claimants against it. The company had submitted a list of 64 bogus

pending claims of Rs 8.57 crore approximately filed in different tribunals across districts including in Ghaziabad,

Meerut, Lucknow, Moradabad, Gorakhpur, Allahabad, Raibareli and Aligarh.

No compromise in Rape cases [State of MP vs. Madanlal]

After a couple of High Courts allowed mediation to take place between the Rape Victim and the Accused, the

Supreme Court in a strong worded judgment held that in a case of rape or attempt of rape,the conception of

compromise under no circumstances can really be thought of. The Supreme Court accordingly ruled out mediation

in such cases. Apex Court bench of Justices Dipak Misra and Prafulla C. Pant observed “any kind of liberal approach

or or thought of mediation in this regard is thoroughly and completely sans legal permissibility.”

Unwed mother can become sole guardian of a child [ABC vs. State (NCT of Delhi)]

In a landmark judgment, a Supreme Court bench headed by Justice Vikramajit Sen held that an unwed mother in

India can apply to become the sole guardian of a child, without giving notice to the father of the child and without

disclosing his identity. The Court also directed that if a single parent/unwed mother applies for the issuance of a

Birth Certificate for a child born from her womb, the Authorities concerned may only require her to furnish an

affidavit to this effect, and must thereupon issue the Birth Certificate, unless there is a Court direction to the

contrary. Complete Departmental inquiries within six months [Prem Nath Bali vs. Registrar, High Court of Delhi]

In a ruling which will have significant impact in service law, the Supreme Court of India has asked every employer,

State and Private, to conclude departmental inquiry proceedings within six months. The court opined that every

employer (whether State or private) must make sincere endeavour to conclude the departmental inquiry

proceedings once initiated against the delinquent employee within a reasonable time by giving priority to such

proceedings and as far as possible it should be concluded within six months as an outer limit.

RBI also under RTI [Reserve Bank of India vs. Jayantilal Mistry]

Coming down heavily on the Reserve Bank of India (RBI for short) for depriving information under the RTI Act, 2005

in the name of fiduciary relationship between itself and the banks, the Supreme Court has in a landmark decision

declared that RBI does not place itself in a fiduciary relationship with the Financial institutions because, the reports

of the inspections, statements of the bank, information related to the business obtained by the RBI are not under

the pretext of confidence or trust.

Acid Attack Victims in disability list [Parivartan Kendra vs. Union of India]

The Supreme Court has directed all the States and Union Territories to consider the plight of Acid Attack victims

and take appropriate steps with regard to inclusion of their names under the disability list. Apex court bench of

Justices M.Y. Eqbal and C. Nagappan said that State shall upon itself take full responsibility for the treatment and

rehabilitation of the victims of acid attack as per the Guidelines provided in Laxmi vs. Union of India.

BANK’S CASE :

Federation' Case No.1875/2013 before Hon'ble Delhi High Court came up for hearing today the 7th February,

2017. The GOI Advocate agreed to give clearance to State Bank of India within two weeks with respect to GOI

appointed Committee recommendations. Our demand of 50% Pension - of last drawn 12 months average salary

will be examined by the Court. Case will further be heard on 11th April, 2017.…SBI Pensioners' Association

ASSOCIATION NEWS:

Every month till the last, this column reported the disappointments in the minds of the Pensioners

over the long series of adjournments both at Supreme Court and Delhi High Court thereafter. The time

extension, first up to 31St

January’17 and again up to 30th

April’17 rubbed salt to the injury. It is a

matter of great pleasure for us that this time we have been able to write something different.

The first effective hearing took place on 14th

of February’17 and continued up to 20th

February’17 with

gap on Feb’17 ( 18th

was Saturday and 19th

was Sunday). The arguments were grueling by all the

Counsels of the petitioners. Many a times, the counsels for LIC were defensive but cunningly tried to

shift the focus from the terms of reference by the Supreme Court of India to the paying capacity of LIC

in the event of judiciary acceding to the WPs of the petitioners. Certain basic things, like

Valuation/Surplus/Bonus, were discussed. LIC repeatedly tried to establish that revision pf pension

will tax on bonus to policy holders. The Counsels for the petitioners effectively tried to establish that

LIC was misleading the Bench all along by citing figures from the different reports of LIC.

The Supreme Court remanded the case to Delhi HC to examine if Rule 3A of Appendix IV of LIC

Pension Rules, 1995 is in conflict with Articles 14, 19 and 21 of the Constitution of India. The reason

for LIC’s attempt to shift the focus may be to confuse the Bench or they have taken the shelter of

paying capacity anticipating probable defeat. We believe ALL’S WELL THAT ENDS WELL.

We have started 15 minutes’ extempore speech by one pensioner

on each Wednesday meet on subject of common interest chosen by

the speaker besides daily chit-chat and it has generated great

enthuasiasm among the pensioners after the new initiative of blood

Re: Supreme Court decision on SLP filed by some Retirees in the matter of 100 % DA

We understand that Supreme Court has recently dismissed SLP filed by some retirees in the matter of 100 per

cent Dearness Relief to the Pre-November 2002 retirees. We further understand that detailed judgment in the

matter will be delivered by the Court shortly. 2. As all you are aware but still we would like to clarify further for

the sake of clarity and to remove any confusion among the membership that decision to initiate legal action in

this matter including filing of SLP in the Supreme Court was purely decision of the concerned petitioners on the

individual basis and AIBRF as an organisation was not party to the decision taken in this regard. 3. As you know

that AIBRF has been pursuing demand of 100 per cent DA and other issues at the organisational level for last

several years and shall continue to do so in future. 4. Since the above decision will affect large number of our

membership, we shall give our detailed comments after studying the detailed decision when delivered. In the

light of this development, Office Bearer team shall meet shortly and formulate future strategy taking all aspect

in to consideration. 5. In the meantime, we request all our office bearers, Central Committee Members, state

body chiefs, affiliates and membership not to circulate any message received from unconfirmed sources

Re: 100 Per cent DA to the Pre - November, 2002 Retirees

We wish to invite your kind attention on Record Note dated. 25.05.15, a settlement signed between Indian Bank

Association and constituents of UFBU on the pending issues of bank retirees /pensioners.

2. We find that when issue of 100 per cent DA to pre- November 2002 was raised by the UFBU, IBA response as

recorded in the document was under :

“ Firstly, the matter is sub-judice as certain cases on this issue are pending for a decision with the Supreme

Court. As such IBA cannot take the decision on this issue at this stage. From humanitarian point of view, IBA may

examine feasibility of providing 100 per cent dearness relief neutralization to pre- November 2002 based on

detailed costing exercise.”

3. You must be aware that Supreme Court has disposed of all the pending SLPs in this matter on 01.02.2017.

Copy of the Judgement is enclosed for your ready reference. In view of this, no case is pending in this matter in

the Supreme Court as on today. Further, another WP on this subject has also been disposed of by Division

Bench of Kolkata High Court. We hope United Bank of India/ IBA will not prefer appeal in the Supreme Court

against it. 4. In view of the above, all the hurdles have now been cleared which was preventing IBA to take

decision in this matter in 2015 as stated above. Therefore IBA should not have any legal hurdle in sanctioning

this long pending issue of retirees now. 5. We therefore request you to take up the issue with IBA at the

earliest for immediate negotiated settlement to provide much needed relief to more than 60000 surviving

retirees from this group who are mostly 70 plus age. 6. AIBRF delegation would like to meet and palace relevant

points for your kind consideration. We await early appointment from you.

NEWS IN BRIEF :

Hemant Bhargava was today, the 10 th Feb’17 appointed as Managing Director of State-owned Life Insurance

Corporation of India. He is at present LIC's Zonal Manager, Delhi. The Appointment Committee of Cabinet has

approved Bhargava's appointment to the post till his superannuation, i.e., July 31, 2019, an order issued by

Personnel Ministry said.

Indian Space Research Organisation (ISRO) scripted history today by successfully launching a record 104

satellites, including India's earth observation satellite, on a single rocket from the spaceport in Sriharikota. This

is the highest number of satellites ever launched in a single mission. The space agency's trusted workhorse

Polar Satellite Launch Vehicle PSLV-C37, on its 39th mission, took off in the morning on 15.02.17 from

Sriharikota space centre with the 104 satellites, of which 101 belongs to international customers. The first to be

let off was India's high resolution Cartosat-2 series satellite made especially to monitor activities of India's

hostile neighbours at a resolution of less than a metre keeping a bird's eye view on both Pakistan and China .

The Cabinet gave its approval to Varishtha Pension Bima Yojana (VPBY), 2017 last week. The scheme

will be implemented through Life Insurance Corporation of India (LIC), and aims to provide social

security to senior citizens. It will give an assured pension, offering an 8% per annum guaranteed rate

of return for 10 years, with an option for pension on a monthly, quarterly, half-yearly or annual basis. Stepping up the war against black money, the Income Tax Department can now scrutinise income tax returns of

the previous 10 years if any search leads to undisclosed deposits or property of over Rs 50 lakh.

The present ceiling for scrutiny of past returns of income is six years, Finance Minister Arun Jaitley has proposed

to increase this period to 10 years in the Budget for 2017-18 tabled in Parliament on Wednesday, 1 Feb’17.

"What we have said now is (that) if during a search we find there is any asset or income worth over Rs 50 lakh

which is not disclosed and is older than four years, then we can go back to 10 years,'' CBDT Chairman Sushil

"The Reserve Bank will shortly issue Rs 100 denomination banknotes in the Mahatma Gandhi Series-2005, with

the inset letter R in both the number panels, bearing the signature of Dr Urjit R Patel, Governor, Reserve Bank of

India," RBI said in a notification. The year of printing '2017' will be on the reverse of the banknote. RBI said the

design of these banknotes to be issued now are similar in all respects to the Rs 100 banknotes in Mahatma

Gandhi Series- 2005 issued earlier. Among the features of the banknotes, there would be ascending size of

You may soon be able to get a permanent account number (PAN) in a few minutes and also pay income tax

through your smartphone. As part of its drive to make life easy for taxpayers, the Central Board of Direct Taxes

is working on issuing PAN on a real-time basis using Aadhar's e-KYC facility, which allows an individual to verify

his or her details such as address using biometric identification features such as thumb impression. " If a SIM can

be issued through e-KYC, then the same can be done for issuing PAN," sai an officer adding that the process may

be crunched to five to six minutes from two to three weeks at present. While the number will be issued , the

card will be delivered later.

Centre has made obtaining an Aadhaar number mandatory for 2.5 crore members of the Employees’ Pension

Scheme of 1995, one of the benefits available to Employees’ Provident Fund subscribers. The Labour Ministry

said in a notification that those without an Aadhaar number will have to make an application to get enrolled by

January 31, 2017. The subsidy, equivalent to 1.16 per cent of the employee’s salary upto ₹6,500, paid by the

Centre towards the EPS, will no longer be credited till the Aadhaar number is shared with the authorities.

(a) whether the Government proposes to implement any scheme of monthly interest of 8 per cent on fixed deposit

scheme for 10 years for 7.5 lakh rupees for senior citizens under the income tax net; and

(b) if so, the details thereof and if not, the reasons therefor?

ANSWER

(a) & (b) Sir, the Varishtha Pension Bima Yojana (VPBY), 2017, a Government supported scheme, is being

implemented through LIC, to provide social security during old age and protect elderly persons aged 60 years and

above. The scheme protects investors against a future fall in the interest income due to uncertain market

conditions. The scheme provides an assured pension based on a guaranteed rate of return of 8% per annum for

ten years, with an option to opt for pension on a monthly / quarterly / half-yearly and annual basis. The differential

return, i.e. the difference between the return generated by LIC and the assured return of 8% per annum would be

borne by Government of India as subsidy on an annual basis.

Jeevan Pramaan: Digital Life Certificate for Pensioners

Pension is an essential source of income after retirement for senior citizens. It supports them

financially during emergency and helps them look after their needs at this stage of life. One of the

main requisites for the pensioners post their retirement, was to provide life certificates to the

authorised pension disbursing agencies like the bank, following which their pension got credited to

their account.

For obtaining a life certificate, a pensioner earlier needed to present himself/herself before the

Pension Disbursing Agency or had the life certificate issued by authority where they served and had it

delivered to the disbursing agency. This very requirement of personally being present in front of

disbursing agency or getting a life certificate often became a major hurdle in the process of seamless

transfer of pension amount to the pensioner. It was noted that it causes a lot of hardship and

unnecessary inconvenience particularly for the aged and infirm pensioners who cannot always be in a

position to present them in front of the particular authority to secure their life certificate. In addition

to this a lot of government employees post their retirement choose to move to different location

Digital Life Certificate- External website that opens in a new window for Pensioners scheme of the

Government of India known as Jeevan Pramaan- External website that opens in a new window seeks

to ease this very problem by digitizing the whole process of securing the life certificate. It aims to

streamline the process of getting this certificate and making it hassle free and much easier for the

pensioners. With this initiative the pensioners requirement to physically present himself or herself in

front of disbursing agency or the certification authority will become a thing of the past benefiting the

pensioners in a huge way and cutting down on unnecessary logistical hurdles.

Jeevan Pramaan- External website that opens in a new window is a biometric enabled digital service

for pensioners. Pensioners of Central Government, State Government or any other Government

organization can take benefit of this facility.

Justice Dipak Misra, a senior judge of the Supreme Court of India, a former Chief Justice of the Patna

and Delhi High Courts, who is in line to become the Chief Justice of India in 2017, succeeding Justice J.

S. Khehar. According to his official profile, Justice Dipak Misra (born on 3rd October, 1953, Ret Age 65

yrs) enrolled as an Advocate on 14th February, 1977 and Practiced in Constitutional, Civil, Criminal,

Revenue, Service and Sales Tax matters in the Orissa High Court and the Service Tribunal. He was

appointed as an Additional Judge of the Orissa High Court on 17th January, 1996 and transferred to

the Madhya Pradesh High Court on 03rd March, 1997. Justice Misra became permanent Judge on 19th

December, 1997. Justice Misra assumed charge of the office of Chief Justice, Patna High Court on 23rd

December, 2009 and charge of the office of the Chief Justice of Delhi High Court on 24th May, 2010. As

Chief Justice of the Delhi High Court, he helped decide over 5000 cases and helped clear the backlog of

cases by making the Mediation Centre and Lok Adalats more effective. He was elevated as a Judge of

Supreme Court of India on 10th October 2011.

SPIRITIUAL :

One of our very senior octogenarian member, Sri Benoyendra Dutta, visited Bangladesh in

March’2015 to see his ancestral home in Mymensingh district of Bangladesh.The name of the

village is Nauhata. He was moved by the very warm reception accorded to him and the members

of his family by the present resident of his village. While coming back to Dhaka for the flight back

to Kolkata, he was having a break at Mirpur. To his surprise, he discovered his own school Mirpur

Siddhanta English High school.there. Out of his own inquisitiveness, he entered the school and

found that the day was a holiday. But the Head master and some other teachers of the school

were present in preparation of some Board examination to be held shortly. He introduced himself

as an ex-student of the school leaving in 1950 after matriculation examination. The School is a

residential school and Sri Dutta was a student from 1945 to 1950.

The Headmaster and all the teachers were surprised and all of them embraced him warmly and

offered sweets and snacks. All of them were very happy to have the ex-student of the school

unexpectedly. All of them extended their verbal invitation to Sri Dutta for his presence in the

centenary celebration of the school in 2016.

The formal invitation came to sri Dutta together with Air-tickets from the President of the School,

Mr. Mujib Warrier Masum, seeking his presence in the celebration on 22nd and 23rd December’16

at the School compound at Mirpur, very close to Dhaka, as a special guest. Sri Dutta did not

hesitate to join the celebration. He joined and has been moved by hospitality shown to him by all

11. How much should we eat - eat more if you are more hungry, let your stomach be your guide and

vice versa

12. We can eat rice and chapati together or only rice if you wish. It depends on your hunger. Eat RICE

in ALL THREE MEALS without any fear.

13. Food shouldn't make you scared like eating rice and ghee. Food should make you FEEL GOOD

15. No bread, biscuits, cakes, pizza, pasta
