The meeting opened with the Salute to the Flag and a moment of silence. The President, Brian Molnar, presided. Board members present: Diane Acquisto, Thomas “Skip” Garley, Judy Leidner, Lawrence Miloscia, Brian Small, George Yuhasz, Brian Molnar. Pat Hardiman and Lewis Huber were absent. A Regular Meeting of the Board of Education, Township of Woodbridge, was held on March 19, 2009 at approximately 7:05 p.m. in the Avenel Middle School, Woodbine Avenue, Avenel, New Jersey.

The meeting opened with the Salute to the Flag and a moment of silence. The President, Brian Molnar, presided.

Board members present: Diane Acquisto, Thomas “Skip” Garley, Judy Leidner, Lawrence Miloscia, Brian Small, George Yuhasz, Brian Molnar. Pat Hardiman and Lewis Huber were absent.

Board personnel present: John Crowe, Dennis DeMarino, Viola Lordi, Lois Rotella, Angela Korodan, Rita Miller, Anthony D’Orsi, Jonathan Triebwasser, Barbara DeRollo.

Newspaper Reporters Present: None

Business Administrator/Board Secretary, Dennis DeMarino, read the following statement regarding the Open Public Meetings Law:

"The New Jersey Open Public Meetings Law was enacted to insure the right of the public to have advance notice of and to attend the meetings of public bodies at which any business affecting their interest is discussed or acted upon. In accordance with the provisions of this act, the Board of Education had caused notice of these meetings to be published by having the date, time and place, thereof, posted as follows:

April 28, 2008: Faxed to Home News Tribune and Star Ledger, Hand delivered to Municipal Clerk, and Posted in Avenel Middle School and the Board of Education Administration Building."

Mr. Molnar asked Mr. DeMarino to repeat the date of the notice. On a motion by Ms. Acquisto, seconded by Mr. Yuhasz and carried, the following Minutes were approved:

Dr. Crowe gave his monthly update relating to the 2009-10 budget. He explained the tentative budget was adopted on March 16th and advised the public hearing and final adoption will be on March 30, 2009. Dr. Crowe stressed the difficult economic times. He stated the Board and Administration was pleased that State Aid rose by 5% although it is misleading. Dr. Crowe explained last year the State of New Jersey identified Woodbridge as a town that was below adequacy in per pupil spending and in State Aid. He further explained the State made a commitment to see that our State Aid would be commensurate with other non Abbott districts similar to Woodbridge. Dr. Crowe stated other non Abbot districts, very similar to Woodbridge, receive over 40% of their funding from the State; Woodbridge receives about 14%. Dr. Crowe stated it was assumed last year that the State would continue to increase the state funding for Woodbridge at a rate of 20% in order to reach adequacy. Dr. Crowe stressed that raising the State Aid by only 5% was in essence a cut. Dr. Crowe stated the crafted budget, despite the difficult economic times and the obstacles the district faces, meets the requirements of a thorough and efficient education but also our own requirement of a thorough, efficient and robust education. Dr. Crowe acknowledged it was a difficult budget and people were hurt.

Mr. Molnar then called for Committee reports.

The Superintendent of Schools presented the following recommendations:

1. That the Board of Education approve the attached resolution commending six students for receiving the 2008-2009 Student Recognition Award from the Middlesex County School Boards Association and the Middlesex County Association of School Administrators.

2. That the Board of Education approve the attached resolution commending the students of Oak Ridge Heights School #21 for their participation in “Jump Rope for Heart,“ a fund raising effort to benefit the American Heart Association.

3. That the Board of Education grant permission to allow the Woodbridge High School Future Problem Solving Team to participate in the Future Problem Solving State Championship in Somerset, NJ, from March 27, 2009, through and including March 28, 2009, at no cost to the school district provided that all policies and regulations governing overnight trips are adhered to prior to and during the trip.

4. That the Board of Education grant permission to allow the Colonia High School and Woodbridge High School Science Research Teams to participate in the Monmouth Junior Science Symposium at Monmouth University in West Long Branch, NJ, from April 1, through and including April 2, 2009, at no cost to the school district, provided that all policies and regulations governing overnight trips are adhered to prior to and during the trip.

5. That a note be made in the minutes that the overnight trip for John F. Kennedy Memorial High School Concert/Chamber/Show Choirs and Marching Band to participate in the Music in the Park Festival in Pigeon Forge, TN, from April 29, 2009, through and including May 3, 2009, has been cancelled. Therefore, approval for the students to travel to Tennessee is hereby rescinded. (December 18, 2008 Superintendent’s Agenda, Item #3.)

6. That the Board of Education grant permission to allow the John F. Kennedy Memorial High School Concert, Chamber and Show Choirs to participate in the Music in the Parks Festival in Hershey, PA, from May 1, through and including May 3, 2009, at no cost to the school district, provided that all policies and regulations governing overnight trips are adhered to prior to and during the trip.

7. That the Board of Education approve the previously submitted list of Professional Development conferences for staff members, dated March 19, 2009.

8. That the Board of Education approve payment to Hybridge Learning Group to provide ABA services as per a student’s IEP at $80/hour, not to exceed $1,600.00 and $100.00 for 1 hour of program supervision. (Payment will be from the Consultant Account.)

9. That the Board of Education approve payment to Hybridge Learning Group to provide parent training as per a student’s IEP at $80/hour, not to exceed $2,560.00. (Payment will be from the Consultant Account.)

10. That the Board of Education approve payment to A Step Ahead Program to provide 12 hours of parent training at a rate of $150/hour, total not to exceed $1,800.00 for a special education student. (Payment will be from the Consultant Account.)

11. That the Board of Education, as required by state law (partially reimbursable in state aid), approve the enrollment of the following disabled students in a special school program for 2008-2009, in accordance with their Individual Educational Programs (IEPs) as shown below:

Ms. Acquisto moved for the adoption of the Superintendent recommendations, seconded by Ms. Leidner. There were no comments or questions from the Board or public. With all Board members present voting in favor, the foregoing was adopted.

Dr. Crowe presented the Superintendent’s resolutions.

Dr. Crowe read a short biography about, and introduced Jessica Phan, a John F. Kennedy Memorial High School student, who provided information about current activities at the school.

The Policy and Planning Committee, on the recommendation of the Superintendent of Schools, presented the following:

1. That the Board of Education adopt the attached resolution commending Bhagyoday Printers, Inc., for their generous sponsorship of the lawn sign at Kennedy Park School #24.

2. That the Board of Education adopt the attached resolution commending Colonia Natural Pharmacy for their generous sponsorship of the lawn sign at Kennedy Park School #24.

3. That the Board of Education adopt the attached resolution proclaiming April 2009 as “Alcohol Awareness Month.”

4. That the Board of Education adopt the attached resolution proclaiming April 2009 as “Mathematics Awareness Month.”

5. That the Board of Education adopt the attached resolution proclaiming April 2009 as “National Autism Awareness Month.”

6. That the Board of Education adopt the attached resolution proclaiming April 2009 as “School Library Media Month” and the week of April 12-18, 2009, as “National Library Week.”

7. That the Board of Education adopt the attached resolution proclaiming the week of April 19-25, 2009, as “Public School Volunteer Week.”

8. That the Board of Education suspend Bylaw #030, which requires a 30-day interval between policy readings, to permit the second reading of the Policies identified in Items #9 and #10 below. (First readings: February 19, 2009, Policy and Planning agenda, Items #7 and #8.)

9. That the Board of Education adopt the following revised Policies:

10. That the Board of Education adopt the following new policies:

Mr. Miloscia moved for the adoption of the Policy and Planning recommendations, seconded by Mr. Garley. There were no comments or questions from the Board or public. With all Board members present voting in favor, the foregoing was adopted. The Athletics and Extra-Curricular Committee, on the recommendation of the Superintendent of Schools and the Assistant Superintendent for Curriculum and Instruction, presented the following:

1. That the Board of Education grant retroactive permission for our qualifying high school swimmer, Claire Oh and coach, Beth Hercek from Colonia High School to participate in the N.J.S.I.A.A. swimming championships to be held on March 7th through 8th, 2009, at the Gloucester County Institute of Technology, Sewell, New Jersey, at a cost not to exceed $350.00. (Payment will be from Colonia High School's Athletic Dues and Entry Fees account)

2. That the Board of Education rejects the contract PD10-02 for Athletic Reconditioning supplies for the 2009-2010 school year under N.J.A.S. 18A:18A-22D, specifications for services require substantial revisions. (Bids read 2/20/09 – 4 bids received, 1 bid rejected)

Mr. Small moved for the adoption of the Athletics and Extracurricular recommendations, seconded by Ms. Acquisto. There were no comments or questions from the Board or public. With all Board members present voting in favor, the foregoing was adopted.

The Finance and Insurance Committee, on recommendation of the Superintendent of Schools and the Business Administrator/Board Secretary, presented the following:

1. That the Board of Education approves payment of the bills in the amount of $17,180,892.45 and the Food Service Department bills in the amount of $358,456.49.

2. That the amount of district taxes needed to meet the obligations of this Board for the next thirty day period, beginning April 1, 2009 is:

Requisition for Taxes for the General Fund in the amount of $11,887,704.00 and for the Debt Service in the amount of $364,937.00; totaling $12,252,641.00,

and that the Township Council is hereby requested to place in the hands of the Treasurer of School Monies that amount by April 10, 2009.

3. That the Board of Education accept the Report of the Secretary for the month of February 2009.

4. That the Board of Education accept the attached Business Administrator/Board Secretary's Monthly Interest and Investment Report for the month of February 2009.

5. That the bookkeeping transfers pertaining to the 2008-09 budgetary accounts be approved as per the attached list.

6. That the Board of Education accept the previously submitted Report of the Treasurer for the month of January 2009, as it agrees with the Report of the Secretary. The February 2009, Treasurer’s Report has not been received.

7. That the members of the Board of Education certify that to the best of their knowledge no major account or fund has been overexpended in violation of N.J.A.C. 6A:23-2.11(a), and that sufficient funds are available to meet the district's financial obligations for the remainder of the fiscal year.

8. That the Board of Education readopt the 2008-09 School Year Budget changing the total from $186,871,351.66 to $186,885,898.07 to reflect the following:

Welfare Grant $1,455.98

9. That the Business Administrator/Board Secretary be authorized to accept the highest bids received for items advertised for public sale and to complete the transaction to the best interest of the Board of Education.

10. That the Business Administrator/Board Secretary be authorized and directed to dispose of items for public sale as advertised, for which no bids were received, to the best interest of the Board of Education.

11. That the Board of Education approve the following authorized check signers for all “Student Activity Accounts”.

BE IT RESOLVED that, upon the recommendation of the Superintendent of Schools, the Woodbridge Township Board of Education hereby approves the Settlement Agreement in the matter entitled P.F. and C.F. o/b/o G.F. v. Woodbridge Township Board of Education, Agency Reference No. 2009-14288, OAL Docket No. EDS 1163-2009N, and authorizes the Board President, the Board Business Administrator/Board Secretary and the Board attorney to take all necessary and appropriate steps to implement the aforesaid Settlement Agreement.

Ms. Leidner moved for the adoption of the Finance and Insurance recommendations, seconded by Mr. Garley. There were no comments or questions from the Board of public. With all Board members present voting in favor, the foregoing was adopted. The Transportation and Cafeteria Committee, on the recommendation of the Superintendent of Schools and the Business Administrator/Board Secretary, presented the following:

1. That the Board of Education approve Rt. 4401 with the Middletown Board of Education to transport one student from the Lincroft Group Home, Lincroft, NJ to CPC Adolescent, Morganville, NJ at a rate of $22.55 per diem for the 2008-2009 school year, including extended school year.

2. That the Board of Education approve the following temporary Fall Out of District route for the 2008-2009 school year to the vendor with the lowest quote, whose quote also met specifications, as follows:

The Buildings and Grounds Committee, on the recommendation of the Superintendent of Schools and the Business Administrator/Board Secretary, presented the following:

1. That the Board of Education adopt the following resolution:

WHEREAS, the Senior Olympics Organization of New Jersey is desirous to hold their annual games in Woodbridge Township; and

WHEREAS, both parties agree the stadium, including surrounding track, at Woodbridge High School would be a suitable and agreeable location for the 2009 Senior Olympic Games.

NOW, THEREFORE, BE IT RESOLVED, by the Board of Education, Township of Woodbridge, County of Middlesex, New Jersey as follows:

a. That the 2009 Senior Olympics Games shall be held on September 11, 12, 13, 2009 at the football stadium, including surrounding track, at Woodbridge High School.

b. The Senior Olympics Organization shall provide General Liability Insurance naming the Board of Education as additional insured, insuring the Board against any liability resulting from any accidents that may occur during the 2009 games. The policy shall have limits not less than $1,000,000 Combined Bodily Injury and Property Damage Liability, $2,000,000 General Aggregate. The policy shall be written on an “occurrence basis.”

c. The Senior Olympics Organization shall indemnify and hold harmless the Board, together with the Board’s officers, agents and employees, from and against any and all demands, claims, damages, losses, liabilities, judgments, penalties, fines, and settlement amounts, whether for personal injury, death, or property damage, arising out of or in any way connected to the use of Board of Education property.

d. The Senior Olympics Organization shall be granted use of the Woodbridge High School Stadium at no cost to the organization, for rental and custodial fees.

e. This resolution is contingent upon the Senior Olympics Organization’s entering into a written agreement with the Board, as recommended by the Board’s Attorney, incorporating the foregoing. The Board President and the Business Administrator/Board Secretary are hereby authorized to execute said agreement on behalf of the Board.

2. That the Board of Education approve the award of the Roofing Replacement – Phase II Bid, Woodbine Avenue School #23, to the second lowest bidder whose proposal also met specifications as follows. 40% of this project to be funded by the School Development Authority ($54,940.00). (Bids read 3/11/09, 10 bids received, 1 bid rejected.)

Mr. Yuhasz moved for the adoption of the Buildings and Grounds recommendations, seconded by Mr. Small. There were no comments or questions from the Board or public. With all Board members present voting in favor, the foregoing was adopted.

The Curriculum Committee, on the recommendation of the Superintendent of Schools and the Assistant Superintendent for Curriculum and Instruction, presented the following:

1. That the Board of Education approve payment, at a cost not to exceed $2,200.00, to the Wilson Language Training Corporation for three sessions of professional development training for Title I teachers at Menlo Park Terrace School #19 during the 2008-2009 school year. This contract is awarded without competitive bidding as a “Professional Service” under the provisions of the Public School Contract Law (N.J.S.A. 18A:18A-5, et seq.). (Payment will be upon voucher submitted from Title I funded account)

2. That the Board of Education approve the award of PD10-01 Texas Instrument Calculators or Equivalent 2009-10 School Year to the low bidder whose proposals also met specifications as follows; (bids read 2/11/09 – 2 bids received, none rejected):

That the Board of Education approve payment, not to exceed $6,000.00, to POAC (Parents of Autistic Children) to provide in-service training to teachers, speech/language specialists and paraprofessionals during the 2008-09 school year. This contract is awarded without competitive bidding as a “Professional Service” under the provisions of the Public School Contract Law (N.J.S.A. 18A :18A-5, et seq.). (Payment will be upon voucher submitted from the IDEIA Grant.)

6. That the Board of Education approve the Woodbridge Township School District’s participation in the Green School Program, created by the Alliance to Save Energy, and implemented in New Jersey by Global Learning, Inc. This program helps school districts to reduce electric and gas usage, thereby saving large amounts in energy costs and preventing the release large amounts of greenhouse gas.

Ms. Acquisto moved for the adoption of the Curriculum recommendations, seconded by Mr. Yuhasz. There were no comments or questions from the Board or public. With all Board members present voting in favor, the foregoing was adopted. Board Attorney, Viola Lordi, had nothing to bring before the Board for open session. Under "Old Business," Ms. Leidner read the new state regulations which the Board had to comply with when formulating the budget. She expressed her displeasure with them. She recommended the Board reevaluate the cafeteria cuts based on the amount of revenue being brought in. Ms. Leidner stressed that although the Board is required to follow the regulations, they are not happy with them. Mr. Molnar stated as part of the Negotiations Committee, it was difficult to go to these hard working people and ask them to take the deal that they were offered. Mr. Molnar stated the Board wanted to keep the workers in-house. Mr. Molnar asked Mr. DeMarino to update the Board on the progress of obtaining solar panels. Mr. DeMarino stated he met with Board Counsel who put him in touch with very knowledgeable attorneys to assist him in the process He stated he is hoping in the near future, possibly by summer, the district can proceed. Mr. Molnar stated after the Board reorganizes he feels the Board will need to adopt an energy policy which can be pushed district wide. Mr. Molnar stated the district needs to cut back on energy usage. Dr. Crowe stated he and Ms. Rotella have met with several groups that will help the district put forward a plan of this nature. Mr. DeMarino announced that on March 5th an additional $534,319.00 in bond reimbursement money was received. Mr. DeMarino stated the district is still owed approximately 6.5 million dollars. There was no “New Business," to be brought before the Board. The Board President opened the meeting to the public. During this portion, J. Sullivan, Transportation Department, stated she has heard rumors that Jonathan Triebwasser may be in jeopardy of losing his job. Ms. Sullivan stated Mr. Triebwasser is a fair and equitable supervisor who has an open-door policy. She stated he is professional and dependable. Ms. Sullivan stressed Mr. Triebwasser’s loyalty to his staff and position. B. Geoffroy, President, W.T.E.A., thanked the Board and Administration for working with the W.T.E.A. during the budget process. Mr. Geoffroy stated he recognizes this task was especially difficult this year since there are new state regulations that the district must follow. Mr. Geoffroy stated the mutual efforts have been successful in several ways. Mr. Geoffroy stated the Board has avoided the privatization of the food service program which has saved approximately 50 jobs. Mr. Geoffroy stated the proposed budget includes dozens of other positions and some very important services which at one point were facing possible elimination. Mr. Geoffroy acknowledged there are no simple solutions for the financial problems the district has faced. He stated the W.T.E.A. will continue their mutual efforts to do what’s best for the community, the children and the faculty and staff. D. Sepolovo, Colonia, expressed concerns over the elimination of the elementary librarians. Mr. Garley stated one of the hardest issues the Board faced was the adjustments to the cafeteria workers. Mr. Garley stated it is so important for the cafeteria workers to keep moving forward. Mr. Garley stated the Board is very proud of what the cafeteria workers have accepted and is hopeful that one day, the salaries will be increased to where they were. Mr. Molnar thanked everyone for voicing their concerns and asking their questions.

Mr. Small then presented to the Board for its consideration, a resolution for a Closed Session to discuss subjects exempted from the public portion of the meeting. The discussion to be held in Closed Session will be about personnel matters which include: resignations; retirements, leaves of absences; level movements; transfers and appointments of certified and non-certified staff; appointments for extra-curricular activities, coaches, professional development activities, home instructors; secretarial staff for setup of In-District Extended School Year Program; and appointments of substitutes as follows: teachers, school aides, and secretarial. There will also be discussion on employee discipline and discussion on a possible departmental reorganization. Any information regarding the Closed Session discussion will be released to the public when the reasons for discussing these matters in Closed Session no longer exist.
