I. ELIGIBILITY FOR SMALL BROADCASTER RATES AND TERMS
The Licensee identified above hereby declares that it is eligible for the rates and terms for the statutory licenses for the making of ephemeral phonorecords and digital audio transmissions of sound recordings by Small Broadcasters published at 37 CFR 380 Subpart B. Services submitting this form untimely are not eligible for this category.
The Licensee also acknowledges that it is required to submit monthly Statement of Account forms, calculating year-to-date liability, within 45 days of the end of such month. This monthly Statement of Account form should be accompanied by any additional payment as indicated.
Small Broadcasters must (1) have streamed less than 27,777 ATH in 2013, and (2) intend to stream less than 27,777 ATH in 2014. Small Broadcasters pay an annual $100 reporting waiver fee, which waives the obligation to provide Reports of Use for 2014 activity.

Licensees which do NOT own and operate FCC-licensed AM and/or FM stations must instead operate under the Commercial Webcaster rates and terms as described at 37 CFR 380 Subpart A. Services may also be eligible for alternate sets of rates and terms available pursuant to the Webcaster Settlement Acts of 2008 and 2009.

II. STATIONS/CHANNELS WITH INITIAL STREAMING DATE BETWEEN FEBRUARY 1 AND DECEMBER 31 Services with initial streaming after January 31, 2014 should:
1) Accompany a minimum fee Statement of Account representing the new stations/channels with the first monthly Statement of Account also representing the new stations/channels,
2) Use the amount calculated on the annual minimum fee for the “previously calculated 2014 minimum fee” amount on the first monthly Statement of Account,
3) Leave line 7 blank, and enter $100 in line 8. 4) Accompany that first monthly Statement of Account with any payment indicated.
*New service must submit THIS form signed with payment within 45 days of initial streaming month. *New services beginning streaming on or after February 1 must initially elect within 30 days after they begin streaming.
