56th Annual Howell Melon Festival Arts & Crafts Vendor Application The Howell Melon Festival held in Downtown Howell since 1960, is a great family-friendly Howell tradition, celebrating the famed, delicious cantaloupe grown only in Howell, MI. The 56 th Annual Howell Melon Festival, which draws over 50,000 visitors, will take place on August 19, 20, and 21, 2016 and is hosted by the Howell Area Parks & Recreation Authority and the City of Howell. Our Festival area allows the entire stretch of Grand River Avenue in downtown Howell to be closed and walkable for the weekend event. New and traditional attractions are featured, including the Howell Melon Run, Melon Ice Cream, a classic car show, live entertainment , Doc May’s Memorial Melon Ride, carnival-type rides with kids and teen areas, delicious food and beverages, along with sidewalk, art, and non-profit vendors! Participants are reminded that the Howell Melon Festival is a family-friendly event and items sold, displays, and entertainment/activities should support a family-friendly environment. At the sole discretion of the Howell Melon Festival Committee, sales, displays, or activities that are deemed inappropriate and offensive will be asked to remove said items, cease such activities, and in extreme cases, be asked to leave the event if actions or sales continue. In this instance, no refunds will be granted. While we try to limit the number of same-business vendors in the festival, we will not regulate the legalities of franchise agreements of having two of the same business vendors on-site (example: Origami Owl, Scentsy, Avon, Face-Painters, etc.). Unless you are a registered food business (pre-packaged candy, beef jerky, salsa, pies, etc.) No booth may sell or provide any homemade food or beverages (including water) as this is limited to our food vendors. Fees Absolutely no application will be accepted without full payment and security deposit checks included. Only one vendor is allowed per booth space. Please indicate the number of 10’x10’ units you will require for your needs on your application and adjust your total fee accordingly. All booths are located on Grand River.

10’x10’ Space - $150 Prior to June 1, 2016 $200 After June 1, 2016 $50 Fee available to DDA District Merchants only

Security DepositA separate security deposit check of $50 along with a self addressed stamped envelope must be provided to cover any special clean-up caused by vendors as identified by a Howell Melon Festival Committee representative. In addition, this deposit will not be returned if you tear down earlier than Sunday, August 21 at 5:00pm. If no issues take place, your check will be returned to you on or before September 30, 2016.

Refunds There will be no refunds of booth fees after notification of acceptance. All refund requests prior to this date must be in writing. A $50 fee will be assessed for any returned checks. Any violations of the rules and regulations or other applicable city/state/county ordinances will result in immediate dismissal from the Howell Melon Festival, in which case no refunds will be issued. No refunds will be given due to the cancellation of the event by an Act of God, Local Authorities, or a weather related incident.

Liability Insurance As a part of our festival insurance requirement, all vendors on-site during the Howell Melon Festival shall provide liability insurance for bodily injury and property damage for an amount no less than $1,000,000 combined single limit for the duration of the 2016 Howell Melon Festival (August 19-21, 2016). Your coverage should also include product liability. The Howell Area Parks & Recreation Authority and the City of Howell must be named as additional insured on the policy. Your proof of insurance must be submitted with the application to be accepted. Contact your insurance provider for more information.

Sales Tax and Licensing RequirementsA valid sales tax license must be included with your application. Vendors shall pay all applicable sales tax or any other tax required by the city, state, or federal taxing authority. Street vendors will be responsible for all licensing applicable in Livingston County and the State of Michigan. We provide all vendor names and contact information after the event as required by the State of Michigan.

Location Assignment & Set-upTo capitalize on the closure of Grand River Avenue for the Howell Melon Festival, the street vendor area will be located in the center of Grand River Avenue between Chestnut and Barnard Streets. Based on received applications, the Howell Melon Festival committee will assign your location in the best interest of the festival. Once assigned, movement or relocation will not be permitted. You will be notified of your location the last week of July. You must set-up within the allotted set-up time period (6:00am-9:00am on Saturday, August 20) and all vehicles must be removed from the area by 8:00am. No vehicular access to the Festival footprint will be permitted until 5:00pm on Sunday or until police deem it safe to enter. All streets will be opened to vehicular traffic by 7:00pm on Sunday, August 21. Latecomers will not be accommodated and no refunds will be issued. All vendors are required to cover their booth space with a minimum 10’x10’ pop-up tent. Vendors are expected to provide their own tents, tables, chairs, and display boards. Do not tape, tack, or otherwise affix any materials or signs to walls, trees, lamp posts, or other surfaces on public or private property. All inventory and boxes must be contained in your booth area - you may not set-up on the grass, sidewalks, or street outside your booth. Canopies MUST be anchored by tent weights. No ground stakes are permitted. Vendors are responsible for transporting and placing their own booths and units. Labor to erect booths is not provided.

Sidewalk Vending for Business on Grand River and Michigan AvenueNo sidewalk vending will be allowed for sales or promotions by anyone except the businesses that are physically located on the Festival grounds and immediately adjacent to their stores. No outside groups will be allowed to set up on the sidewalks in front of storefronts. To allow for the smooth flow of traffic along sidewalks all businesses must keep merchandise sales close to their building (within 10 feet from their store).

Sound No loud audio system may be used. Please be considerate of your neighbors.

ElectricityGenerators are not allowed and no electricity is available to street vendors.

Water HookupNo water hookup is available to street vendors.

Cleanliness and Trash Removal Vendors will keep their location and surrounding area clean and free from litter. All garbage must be disposed of at the end of the Festival at designated locations.

Security Police, EMS, and professional security will monitor and be present throughout the event. The Howell Melon Festival will employ a professional security firm to be on-site Saturday night. The Howell Melon Festival, its sponsors, members, and participants assume no liability for loss or damage to a vendors cash, wares, or property. Every precaution will be taken to guard against loss or damage.

Non-Transferable This agreement is non-transferable and may not be assigned to another party.

Alcohol, Foul Language, and Threats to Safety Consumption, promotion, sales, or possession of alcoholic beverages are not allowed in the Festival footprint unless approved by the Howell Melon Festival Committee. The Howell Melon Festival will not tolerate any foul language, threats to the safety and welfare of attendees, or violations of any stated rules or actions deemed inappropriate by the Howell Melon Festival Committee. Any violations of this will be cause for immediate removal from the premises and denial of future participation in the event.

Parking for Personal Vehicles Vendors must park their personal vehicles in designated areas only. A parking map will be provided in the information package sent in July.

Use of Name“Howell Melon Festival” is trademarked and MAY NOT be used to personalize any items sold at the Howell Melon Festival unless the Festival Committee has negotiated, approved, and issued an exclusive Special Activities Contract with you and arrangements have been made for the Festival to receive full commissions or royalties on the sale of that merchandise. DO NOT attempt to use the name or any variation thereof on shirts, clothing, food products, or merchandise of any kind. The Howell Melon Festival will prosecute violators to the fullest extent of the law. This application is not a Special Activities Contract.

Hold Harmless Agreement In consideration of the Howell Area Parks & Recreation Authority, the City of Howell and the Howell Melon Festival allow the undersigned to utilize the City of Howell’s sidewalks/streets to sell their product during the special event occurring August 19-21, 2016. The undersigned agrees to hold harmless and indemnify the Howell Area Parks & Recreation Authority, the City of Howell, and Howell Melon Festival Committee and volunteers, City officials, and City employees from all liability and responsibility for injury (including death) to person(s) for any damage to any City of Howell property or property of others arising out of or resulting directly or indirectly from the utilization of said City sidewalk/streets in the City of Howell during the above special event dates. The undersigned further does hereby remise, release, and forever discharge the City of Howell, its officers, agents, and employees from any and all claims, demands, actions, causes of action, damages and liabilities, resulting or arising out of, either directly or indirectly, from the utilization of said City sidewalks/streets in the City of Howell during the above special event dates. Enclosed are the application and payment for fees. I understand that completing this form does not constitute acceptance into the Howell Melon Festival. I understand that if I am asked to leave said Festival, there will be no reimbursement of paid fees.
