Session Title: Social Security Administration Legislative Update Speaker: Ms. Susan Bussman, Social Security Administration Moderator: W. Grant Wright, Social Security Administrator for the State of New Mexico Ms. Bussman started by giving the attendees a refresher on WEP/GPO. WEP is the Windfall Elimination Provision and GPA is the Government Pension Offset. Both provisions reduce Social Security benefits if a beneficiary receives a pension based on work that was not covered by Social Security. WEP:

Applies to retired and disabled workers who have less than 30 years of coverage and receive a pension based on their own non-covered work

Causes a reduction in the worker’s primary insurance amount

In 2017, a worker’s maximum WEP reduction is $442.50 per month

A worker’s WEP reduction is capped at one-half of his/her monthly pension amount

GPO:

Applies to spouses (including widows/widowers) who receive a government pension based on their own non-covered work

Reduces a spouse’s monthly benefit by two-thirds of the amount of his/her monthly pension

Ms. Bussman mentioned that there is pending legislation, Social Security Fairness Act of 2017 that would, if passed, repeal both WEP and GPO provisions, and would take effect after December 2017. However, the President’s 2018 budget does not include provisions that would change WEP/GPO. In closing, she asked for questions.

Session Title: Mandatory Social Security vs. Section 218 Speaker: Ms. Angie Dowdy, Social Security Administrator for the State of Louisiana Moderator: W. Grant Wright, Social Security Administrator for the State of New Mexico This session was an overview of the history of the Social Security program, focusing on the changes over time and the effect on Section 218 Modifications. Angie hit the highlights of the history and opened the floor to questions. Since there were few questions, this session was short and we took a short break to start the next session ahead of time.

Session Title: Electronic Records/Data Bases Speaker: Vandee DeVore Moderator: Melanie Helmick The presenter showed how she had set up a Microsoft ACCESS data base and provided live views on screen. Various fields and field names were discussed and example reports were previewed. The presenter next provided examples of other various spreadsheets used to track her social security work (ex. dissolutions and name change logs). Lastly, the presenter discussed the need to retain social security related documentation safely and discussed retention time frames. The audience responded well this presentation, new members especially. Shared examples would have been welcomed.

Session Title: CORRECTIONS OF ERRORS / 941-X Speaker: James Driver – IRS, FSLG Moderator: Madison Davis, AR The Presenter discussed errors on previously filed Form 941 and how to correct errors using Form 941-X including:

Wages, Tips, and other compensation;

Income Tax withheld from wages, tips, and other compensation;

Taxable social security wages;

Taxable social security tips;

Taxable Medicare wages and tips;

Taxable wages and tips subject to Additional Medicare Tax withholding;

Qualified small business payroll tax credit for increasing research activities, and

Credits for COBRA premium assistance payments. The presenter noted that when you discover an error on a previously filed Form 941, you must correct errors using Form 941-X, File a separate Form 941-X for each Form 941 that you’re correcting, File Form 941-X separately and do not file Form 941-X with Form 941. Audience response found this presentation enlightening and useful.

Session Title: Newly Created or Reclassified Positions Speaker: Shawn Cole-SSA Leah Golshani- OGC, SSA Moderator: Danielle Huffine, IA The presenters discussed determining coverage for new and reclassified positions. First decision to make is whether it is a newly created position or if the position has just been reclassified. If the position is covered under a retirement system at the time of existence, they are not covered under the Section 218. If the position is created or reclassified after the absolute coverage group gained coverage, they are covered under the Section 218. This information is found in POMS SL 30001.380 The presenters defined retirement systems – POMS SL 30001.320, absolute coverage groups- POMS SL 30001.315, effective dates of coverage – POMS SL 30001.375, majority vote referendum process- POMS SL 30001.323, and the difference between majority vote and divided vote. Shawn and Leah had examples for conference attendees to participate in. They kept the presentation interactive with the examples and the use of music from Mission Impossible and Risky Business.

Session Title: Keys to Success: Collaboration and Communication Speakers: Yana Usik, SSA Kate Dempsey, SSA Fred Sanchez, SSA Moderator: Shirley Sessoms, MS

The speakers’ presentation was focused on communication and collaboration between State and

Federal partners as it relates to Section 218 coverage and changes or circumstances that may

impact the same. It was noted that the communication and collaboration is the key to avoiding

coverage errors.

Also discussed was the risk associated with coverage errors when there is a change in personnel,

staffing levels and state and local coverage rules.

Further, the speakers provided the audience with a listing of the following SSA regional

specialists and discussed the responsibilities of each:

Policy Staff

Operations Staff

The overall message of the presentation, which was well received by the audience is that the

SSA recognizes its responsibility to Federal partners and State Administrators and is committed

Session Title: Closing Agreements and Modifications Speaker: Sergi Aiden (SSA/OGC) and Rhonda Kingsley (IRS) Moderator: Vandee DeVore Sergi Aiden started the presentation. The slides and descriptions were as follows:

Modifications to Original Agreement:

o Extends coverage to new groups

o Identifies new political subdivisions joining a retirement system

o Corrects errors in previous modifications

o To implement changes in federal/state laws

Two Basic Coverage Paths:

o Not under a retirement system (b5) is an absolute coverage group

o Retirement system coverage group

Absolute Coverage Modification Elements:

o Mod number

o Body—accept political subdivision as an additional b5 coverage group

o Political subdivision’s identifying information

o Signatures

o Exclusions

o May need documented legal authority to establish entity’s status as either an

independent legal entity or as a political subdivision

date will be covered under the Modification

covered.

o Designated and Applicable Dates—individuals in employment relationship on this

date are eligible for retroactive purposes. This date must fall between the date the

Mod is mailed or otherwise delivered to SSA and the date it is signed (accepted)

by SSA.

Retirement System Coverage Group Modification Elements:

o Mod number

o Same requirements as the Absolute coverage group mods

o In the body, accept additional retirement system coverage group of the [Name] of

the retirement system

o Certification of Referendum (majority vote and divided vote)

Other Types of Notices and Modifications: o Notice of Dissolution

o Notice of new components

o Amend language to the original agreement

o Coverage of retirement system ineligibles

o Identifying a political subdivision that is joining the system-wide retirement

system group

o Transfer divided vote referendum to “no” votes

o Authorizing the ability to extend coverage to police &/or firefighter positions that

are under a retirement system

o Extend coverage to a previously excluded group or add retroactive coverage

o Medicare only coverage

o Correct errors.

Correcting Errors:

o Errors that do not need a Modification include:

Clerical errors on a submitted Mod that do not affect the coverage

intention

Entity is listed in multiple Modifications

o Errors that DO affect coverage.

Examples of Error Mods:

o It is important to note that each State has the ability to use Error Mods within their

own processes.

o Correct an Effective Date

o Correct an Optional Exclusion

o Remove an Entity

o Contributions without a 218 Agreement

Much discussion came from this line item. Under the current phrasing of

CFR, the only errors in payment allowed are those that occurred prior to

1987. Therefore there is no legal basis, in law or administrative law, for

States to use Error Mods for entities that paid taxes in error after 1987.

A State can always submit a Regular Mod (from this date forward), or a

Retroactive Mod validating payments up to six years from the Designated

date.

Rhonda Kingsley from the IRS then presented on Closing Agreements.

Closing Agreements are required with Retroactive Coverage Modifications where the

payment has not already been made. It ensures that the coverage for the closed years

(after the 3 year statutorily open period) are paid.

Retroactive coverage applies up to the last day of the sixth calendar year preceding the

year coverage is designated.

The IRS has a statute of limitations for the assessment of Social Security and Medicare

taxes.

o The limitation is three years after:

1. April 15 of the year following the calendar year to which the returns relate

or

2. When the returns are actually filed or

3. Whichever is later.

Closing Agreement Requirements—SSA must sign and execute the Section 218

modification before the Closing Agreement process with the IRS begins.

The IRS sees no reason to complete a Closing Agreement when an entity has paid in

error.

Per the IRS Closing Agreement, the entity agrees to:

o A waiver of the statute of limitations for assessment

o An assessment in the amount of the tax to be paid, and

o Make a full payment for the years covered in the Modification.

o File Form W2C with SSA and furnish each covered employee a Form W2C.

o Complete these functions by January 31st of the year following the year in which

the Closing Agreement is executed by the IRS.

Much conversation occurred on the process for Closing Agreements since the validity of the

Modification is contingent upon the entity executing a Closing Agreement with the IRS:

The question was brought up about two separate issues:

o The first issue was that SSA does not have a sample Mod template for State

Administrators to use when using Retroactive coverage, but when the taxes had

already been paid. The IRS agreed there is no need for the Closing Agreement

language. (See above regarding Examples of Error Mods). SSA said they would

take this back to Central Office and discuss it internally.

o The second issue involves the communication back to the State Administrator

when a Closing Agreement has been completed and if there was a cross-check

between the IRS and SSA on an entity contacting the IRS to initiate the process.

While the Modification that the State Administrator has in possession appears to

be valid because all signatures are applied, it is actually contingent upon the

Closing Agreement being completed. The IRS communicates with SSA that the

Closing Agreement requirement has been satisfied, but

1. there is no communication back to the State Administrator that the

contingency clause has been fulfilled. The concern was that State

Administrators would NEVER know if an accepted Mod they hold is valid

without that follow-up.

2. And, there is no cross-check between SSA and the IRS to ensure that an

entity has initiated the process in a timely manner.

SSA again said they would take this issue back and discuss internally.

There are special rules for coverage of police and firefighters positions that fall under retirement systems. State statutes and court decisions do not control whether positions qualify as police officer positions. Police force positions should be reviewed individually to determine if a preponderance of the position’s duties falls within one or more of:

• maintaining order • preventing/detecting crime • enforcing laws

Police office positions are based on the nature of the duties. Positions usually exist in police and fire departments of cities, towns, etc. Two ways to cover police and firefighters

• part of absolute coverage group, or • part of a retirement system coverage group

* police officers, or firefighters, or both, etc. If EMT’s morph into firefighter positions then these are considered new positions. 22 States and Puerto Rico could cover all police and firefighter positions under a retirement before P.L. 103-296. 12 State had police and firefighter modifications based on P.L. 103-296. 16 States have not modified their agreement to permit police and firefighter coverage.

This year’s committee received two potential states for hosting the 2019 conference,

Alabama and Kentucky. Based on the initial information we received, the committee

decided to send RFP’s to Alabama. We only received information back for two hotels and

one was a resort, so we knew that travel to a resort would not be feasible for IRS and SSA.

We then decided to send an RFP to Louisville, KY.

We received 5 RFP’s back and evaluated the hotel information. The hotels were The Brown

Hotel, Embassy Suites Downtown, Galt House Hotel, Holiday Inn Louisville East and

Louisville Marriott East. We narrowed our selection down to The Brown Hotel and the Galt

House for further information. The Brown Hotel seemed to fit our needs better and were

very easy to work with as compared to the Galt House.

We presented our selection to the Executive Committee on May 8 and it was approved

during the Executive Call on May 9. The contract was finalized on July 11.

The 2019 NCSSSA Conference will be held September 7-11, 2019 in Louisville, KY at the

The purpose of the NCSSSA Legislative Committee is to: monitor, maintain, assess, and disseminate proposed legislative, policy, and regulatory changes affecting Social Security and employment tax programs at the federal and state levels of government. Provide analyses and proposed responses to NCSSSA leadership and other appropriate officials. The 2016-2017 Legislative Committee conducted an organizational conference call on November 15, 2016. The Committee was extremely active again this year, having accomplished the following: 1. Held multiple conference calls during the program year. During the first conference

call, it was again decided that the most efficient way to approach Committee responsibilities was to divide the workload and assignments among all Committee members. An agenda was distributed prior to each meeting and summary notes, including action items, were provided after each conference call. Between conference calls numerous email exchanges occurred to ensure issues were addressed as quickly as possible.

2. Continued and/or initiated networking/liaison relationships with over 30 organizations or policy-making bodies at the national level which included the addition of several

Each committee member selected one or more of the above organizations to monitor and highlight any significant information for other committee members so appropriate actions could be taken by the full committee, including any recommendations for actions by the NCSSSA Executive Committee. Between conference calls, informational emails and reports from the above organizations were shared with members of the Legislative Committee, which includes the current NCSSSA leadership team members, thereby ensuring the NCSSSA leaders are kept

apprised of significant national-level issues and developments and have direct input into establishing priorities for the Legislative Committee.

3. Follow-up assignments from 2015-2016. The Legislative Committee had three follow-up assignments that carried over into 2016-2017. Those items were:

A. Continued to monitor IRS’ plans to update the Federal-State Reference Guide (IRS Pub. 963). Due to other demands on IRS staff members’ time the IRS was unable to provide proposed changes to NCSSSA prior to the conclusion of the 2015-2016 program year. The same constraints continued throughout the 2016-2017 program year. When the IRS finally provides a draft for NCSSSA to review, the Legislative Committee will again coordinate feedback from NCSSSA’s members and consolidate that information so the IRS (and SSA) receive consistent and properly vetted suggestions for edits and improvements to the publication.

B. Continued to monitor and solicit feedback from the IRS on the risk areas they have identified. During the 2015-2016 program year no new updates were provided, but the IRS provided a summary of the risk areas during the 2016 Annual Conference in Bozeman, Montana. Information on that session can be found in the 2016 NCSSSA Annual Conference Proceedings Book (available under the link to the main Proceedings Book

page, http://www.ncsssa.org/proceedingsbook.html ).

C. Continued to monitor any developments related to the University of Colorado

at Colorado Springs report entitled “An Analysis of SMART Options: Reinstatement of the Section 218 Option”, dated February 2014. No new developments occurred during NCSSSA program year 2016-2017.

4. Monitored legislative and regulatory activities and publications of interest to NCSSSA members, including:

A. Universal Social Security issues. No new developments occurred during NCSSSA program year 2016-2017. The Legislative Committee will continue to monitor any developments that may occur in the future.

B. The Equal Treatment of Public Servants Act of 2015 (H.R. 711) was introduced by the U.S. House of Representatives’ Ways and Means Committee Chairman at the time (Kevin Brady, R-TX) and Rep. Richard Neal (D-MA). According to the announcement by the bill’s sponsors, H.R. 711 would reform the Social Security Act by replacing an unfair formula for calculating benefits – known as the Windfall Elimination Provision — with a new, fairer formula that treats teachers, police officers, firefighters, and other public servants like the rest of America’s workers (see https://waysandmeans.house.gov/hr711/ ). It has yet to be reintroduced in the current session of Congress which began in January 2017. The

Legislative Committee will continue to monitor any developments that may occur in the future.

C. Social Security Fairness Act of 2017. According to the press release dated April 20, 2017, the Social Security Fairness Act would eliminate provisions of the Social Security Act that significantly reduce benefits for more than two million Americans and 225,000 Ohioans – including many teachers, firefighters, and police officers. The Social Security Fairness Act would repeal these provisions so public sector workers receive full Social Security benefits. The Legislative Committee will continue to monitor any developments that may occur in the future.

D. Medicare Opt-in. See the 2012 Proceedings Book for details on NCSSSA’s recommendations and support for Congressional action regarding the Medicare Opt-in proposal, available at: http://192.168.1.1:8181/http://www.ncsssa.org/ProceedingsBook-2012.pdf. No further action on this proposal is expected to be taken by Congress. The Legislative Committee will continue to monitor any developments that may occur in the future.

E. Latest Annual Reports of the Social Security and Medicare Trustees (2017). Links to 2017 reports: https://www.ssa.gov/news/press/releases/#/post/7-2017-1, https://www.ssa.gov/OACT/TR/2017/, and https://www.cms.gov/Research-Statistics-Data-and-Systems/Statistics-Trends-and-Reports/ReportsTrustFunds/index.html?redirect=/reportstrustfunds/. On July 13, 2017, the Social Security Board of Trustees released its annual report on the long-term financial status of the Social Security and Medicare Trust Funds. The combined asset reserves of the Old-Age and Survivors Insurance, and Disability Insurance (OASDI) Trust Funds are projected to become depleted in 2034, the same as projected last year, with 77 percent of benefits payable at that time. The DI Trust Fund will become depleted in 2028, extended from last year’s estimate of 2023, with 93 percent of benefits still payable. The estimated depletion date for the Medicare (Health Insurance, “HI”) Trust Fund is 2029, one year later than in last year’s report. As in past years, the Trustees have determined that the Medicare Trust Fund is not adequately financed over the next 10 years. The Legislative Committee will continue to monitor any developments that may occur in the future.

F. Continued to monitor developments related to Senator Hatch’s proposal entitled the Secure Annuities for Employee (SAFE) Retirement Act of 2013. See the 2016 Legislative Committee report for further details (available

will continue to monitor any developments that may occur in the future.

G. Reviewed the U.S. Treasury Department’s Notice 2017-28 asking for public comment on recommendations for the IRS’ 2017-2018 priority guidance. NCSSSA submitted the following recommendations: (1) naming the State Social Security Administrators as a group to be allowed to receive information from the IRS because it will improve voluntary compliance by state and local government entities, reduce improper Social Security or Medicare coverage and taxation, and also reduce the tax gap; and (2) clarification as to what constitutes a qualifying Federal Insurance Contributions Act (FICA) public pension replacement plan. NCSSSA’s comments and the Notice are included as Appendix A. All comments, including those filed by NCSSSA are available at: https://www.regulations.gov/document?D=IRS-2017-0008-0001 and https://www.regulations.gov/docket?D=IRS-2017-0008. The Legislative Committee will continue to monitor any developments that may occur in the future.

5. Drafted legislative and regulatory briefing materials, agendas for the meetings with SSA and IRS, and the background document on NCSSSA for the leadership team (President James Sawyer, First Vice-President Dean J. Conder, and Vice-President Designate TJ Reardon). The 2017 Legislative and Regulatory Issues Statement was used by the leadership team during the meetings with NCSSSA’s federal partners as well as with U.S. House Ways and Means Committee staff and with representatives from several of the NCSSSA Public Pension Network partners, while participating in the leadership meetings held in Baltimore, Maryland, and Washington, D.C. in June 2017 (see Appendix B for the final documents that were used during the meetings).

6. At the request of the Ad Hoc Committee on Strategic Planning, the Legislative Committee members prepared a strategic plan during several conference calls. The strategic plan was finalized and sent to NCSSSA President Sawyer and Ad Hoc Committee Chair Shelhammer in March 2017. See Appendix C for the Committee’s strategic plan.

7. NCSSSA drafted letters for President James Sawyer to send to California and Montana encouraging continuing support for the State Social Security Administrators in those two states. Copies of both final letters are included as Appendix D.

8. NCSSSA authorized attendance by Maryann Motza, Legislative Committee Chair,

and TJ Reardon, Vice President Designate, at the National Conference on Public Employee Retirement Systems (NCPERS) 2017 Legislative Conference. The agenda and presentation materials are available at:

10. The U.S. House of Representatives’ Committee on Ways and Means’ Subcommittees on Social Security and Oversight invited NCSSSA (and the SSA and IRS) to testify before Congress on June 29, 2017. The title of the hearing was: Complexities and Challenges of Social Security Coverage and Payroll Tax Compliance for State and Local Governments. Due to problems with active State Social Security Administrators’ attempts to obtain approval to travel to Washington, D.C. with only two weeks’ advance notice, retired Colorado State Social Security Administrator Maryann Motza (as Legislative Committee Chair) was asked to appear on behalf of NCSSSA. Appendix G includes copies of documents that were filed by NCSSSA which are part of the official record. The Legislative Committee will continue to monitor any developments that may occur in the future.

11. Committee members discussed rumors that the Government Accountability Office (GAO) will be conducting another study of state and local governments’ Social Security coverage and management. No confirmation was received during the 2016-2017 program year that a new GAO study is currently planned.

12. Sent an email on August 31, 2017, to the IRS’ Employee Plans section of the Tax Exempt and Government Entities Division containing NCSSSA’s recommendations for the presentation that Employee Plans is developing for its pre-approved plans opinion letter program. A copy of the email is included as Appendix H.

13. Continued active involvement in the Public Pension Network (PPN), which began during 2007-2008, after Ms. Barrie Tabin-Berger, Assistant Director, Federal Liaison Center, Government Finance Officers Association (GFOA), sponsored NCSSSA’s membership. The PPN consists of a group of organizations that lobby Congress and federal agencies regarding many issues with which NCSSSA members are also concerned. Among participating organizations in the Network, in addition to the GFOA, are: National Conference of Public Employees Retirement Systems (NCPERS), National Association of State Retirement Administrators (NASRA), the National Council on Teacher Retirement (NCTR), National Association of

Government Defined Contribution Administrators (NAGDCA), and the National Conference of State Legislatures (NCSL). Involvement in the Public Pension Network has proven to be extremely valuable to NCSSSA in two major ways:

A. Ensures that NCSSSA is apprised immediately of any federal-level

developments (Presidential, Congressional, or regulatory) that impact any aspects of NCSSSA’s areas of interest, e.g., Social Security, Medicare, employment taxes, and public pension system requirement oversight.

B. Provides high-profile exposure for NCSSSA on significant national issues

when NCSSSA signs on to letters expressing concern or support for proposed actions at the Federal level.

NCSSSA was not a signatory on any PPN letters during the 2016-2017 NCSSSA program year. NCSSSA’s Legislative Committee will continue to participate in PPN activities and provide the NCSSSA President with any draft letters so he/she can decide if NCSSSA should be a signatory.

As chairperson of the Legislative Committee, I want to personally thank the other members (listed on page one of this report) for their contributions and continued support of the efforts of the Committee. Their work and dedication to the Committee was invaluable to ensuring NCSSSA members are kept informed in a timely manner of critical national level regulatory and legislative developments that are of importance to State Administrators and public employers/employees throughout the country and that NCSSSA’s voice is heard at the national level on important policy issues. Regional Activities for Year 2017 Region III did not encounter any major issues or concerns throughout calendar year 2017. However, the State Social Security Administrator for MS, Pat Robertson, has announced her retirement from PERS of MS, effective in 2018. The PERS of MS Board has stated that her replacement should be named as early as October 2017. Also, the State of North Carolina has a new working State Social Security Administrator (SSSA), David Starling. Summary of Region III Caucus Meeting at 67th Annual Conference Region III Caucus meeting convened September 10, 2017 at 1:00 p.m. in Salon D, Charleston Marriott Town Center. States present for the meeting were:

SSA representative, Kirk Jockell, was not in attendance due to the effects of Hurricane Irma and the SSSA for the State of Florida was also unable to attend due to the hurricane. The new working SSSA for North Carolina, David Starling, made his first appearance at the conference. The points of discussions were as follows:

Issues and concerns being encountered by each state and its governments’ public pension plans….

o GA and KY addressed and resolved issues concerning charter schools o AL and MS incurred no issues or concerns; however, AL wish to perform some clean-up

with data-keeping, i.e. dissolved entities

Region III made the recommendation to change the scheduled days of the conference to Sunday-Thursday going forward. Also, Region III made the recommendation to move the conference back to July in each calendar year

Minnesota, Ohio, Wisconsin Illinois: State SSA did not report anything of significance from 8/1/2016 through 7/31/2017.

Indiana: State SSA did not report anything of significance from 8/1/2016 through 7/31/2017.

Michigan: Amended master agreement in 2015 to allow police and fire coverage. That affects about

1,300 entities. Just notified those entities, and SSA this year. This result in many referendums in the

future. Currently, there are about 7-8 entities participating in the referendum process. There have also

been several retirement system structural changes that may impact 218 administration.

Minnesota: There were two important SS matters resolved in MN.

Charter Schools

The OGC raised questions as to whether a Minnesota charter school is a political subdivision for

purposes of Section 218 and requested that we obtain an opinion from the Minnesota Attorney

General’s Office regarding the status of charter schools. After reviewing statutory and case law, as well

as letters from the Minnesota Attorney General, OGC concluded there is sufficient support to find that

Minnesota charter schools are instrumentalities of the State. Therefore, the State may continue to

extend Section 218 coverage to employees of Minnesota charter schools who are covered by the

Minnesota Public Employees Retirement Association and the Teachers Retirement Association.

Applicability of Social Security Taxes on Wages of Tribal Police Officers

The Minnesota Public Employees Retirement plan (PERA) is a plan covering a variety of Minnesota’s

public employees serving multiple units of government, including police officers. Minnesota Statutes

allow tribal police officers with State arrest powers to participate in PERA. Various private letter rulings

(PLRs) were issued concerning whether contributions made by the tribal police department as the

employer are considered a contribution of an agency or instrumentality of the State of Minnesota for

purposes of section 414(d) of the Internal Revenue Code. The PLRs concluded that these contributions

will be considered a contribution by an agency or instrumentality of the State of Minnesota for this

purpose.

MN sought clarification from the Social Security Administration and the Internal Revenue Service

concerning the applicability of social security taxes on wages paid to tribal police officers who are

members of the PERA Police and Fire Fund. Both federal agencies concluded that the Minnesota

statutes and PLRs notwithstanding, Section 7871 of the Internal Revenue Code provides certain specific

purposes for which an Indian tribe will be treated as a State. Section 7871 does not include employment

taxes (including section 3121) as one of those purposes. The resulting effect is that tribal police officers

in Minnesota who are members of the PERA Police and Fire Fund are subject to mandatory social

security tax withholding.

Ohio: Receiving inquiries from employees concerned about Medicare coverage for pre-1986 coverage,

and opting in or out of Medicare coverage.

Wisconsin: State SSA did not report anything of significance from 8/1/2016 through 7/31/2017.

Several discussions were handled through email throughout the year. Emails were sent to the state

administrators when information needed to be disseminated from the Regional VP.

Ohio, WI, and Michigan were present at annual meeting, and Kara Gamboa of Michigan was voted

Region IV VP for the upcoming year.

Madison Davis testified before Committee.

Iowa: Mods pending since 2011. Two have been denied because they are considered

Louisiana: Election for State Treasurer (named SSSA) to be held in October 2017. 2% proposed across-the-board raise being considered for State employees.

Missouri:

Continuing issue with the St. Louis Airport Police. Referendum in process. Encouraged NCSSSA to request SSA to amend CFR Subsection M. 40 Mods waiting for approval. Vandee DeVore provided input on the Section 218 Council input request. She

suggested it should be specified that Mods can only be dated as far back as 6 years among other things. A copy of the input received was forwarded to Executive Committee for further discussion.

Nebraska: Business as usual.

New Mexico:

Considerable backlog of S218 Mods at Dallas Regional SSA Office. The oldest pending is dated December 1, 2016.

Oklahoma:

Deputy General Counsel to the Governor (SSSA’s point of contact) left her position and no new appointment made. Legal Assistant in that office is contact until further notice.

Mostly good but a couple of states mentioned slow

response times. The average time is about two months.

Mostly, quick turnaround times for the SSA while IRS is

a little slower.

6. Is there any additional information that you would like to see on the NCSSSA

website?

The website is great! One state requested federal contacts information.

7. Are there any additional topics you would like to have covered in the new webinars

(recorded and made available on the website)? Police/Fire, recent legislative

changes and how it affects the work of NCSSSA.

8. Are there any other topics you would like to see presented at the annual NCSSSA

9. Would it be beneficial to your state to change the annual NCSSSA from the weekend

start to a Monday start? There was one yes, one no and three indifferent votes.

ADMINISTRATOR UPDATES In December 2016 Rita Foltman, the Idaho state administrator, retired. Rita served as NCSSSA president in 2013 – 2014. Her willingness to share her hard earned knowledge in the realm of Section 18 and its interplay with police and fire will always be appreciated. She truly is a subject expert in this area. Replacing Rita is Jackie McCleve. She is a welcome addition to the region as she fills big shoes left in Rita’s retirement. Robert Sharp, California state administrator, has moved to another arena within CalPERS and Irene Ho has recently retired. California continues to be energetically served by Veronica Silva-Gil, Shay Jackson, and their most recent addition of Lolita Lueras. Since January 2015 the position of Nevada state administrator has been vacant. The five other member states’ administrators have remained unchanged during the program year.

REGIONAL STATISTICS AND OBSERVATIONS

Region VII conducted a combined total of 12 referenda during the program year, of which ten were favorable. Of these 12, five referenda were error modifications.

Only Washington State reported any new legislation impacting its Section 218 program noting: “ Definition of firefighter (for purposes of one our retirement systems) changed; expanded entity types other than fire

departments. Did research, consulted/confirmed with SSA and IRS, and came to conclusion/resolution on how to handle the main question of, “does the entity’s absolute coverage obtained back in 1969 extend to these positions now being enrolled in the retirement system in 2017?” Administrators reported the following challenges: “Dwindling resources on the part of federal partners with increasing demand by employers for training.” “Internally: staffing, funding. Externally: our authority.” Emerging trends identified by Region VII include: “Discovering erroneous reporting” “Agencies wanting to contract for Medicare only agreements” “Mandatory employers and rehired annuitant withholding errors” “Taxable fringe benefits withholding errors”
