Open Doors

Q1: Can the chosen respondent charge a fee for training drivers on its Central Dispatch technology? Can this fee be added to Exhibit 3 “Cost Proposal” of the RFP?

R: No, the fee cannot be charged to cab drivers. It may be charged as part of the fee that you charge to the wheelchair accessible vehicle (WAV) taxicab medallion owners to be a part of the WAV Centralized Dispatch. That fee should be identified in the cost proposal.

Q2: What is the Chosen Respondent’s responsibility for reporting non-compliant driver’s licenses or bad vehicles?

R: The Chosen Respondent would compile and submit to BACP a regular weekly or monthly reporting identifying public chauffeurs and WAV taxicab medallion licensees that are compliant and non-compliant.

Q3: MCC 9-112-570 mentions the Commissioner may assess the cost of the Central Dispatch System. What does this mean?

R: That means that we can go through the RFP process and analyze the cost proposals, as BACP is doing now. This means that the Commissioner may by rule mandate the amount that each wheelchair accessible vehicle must pay to the operator of the central dispatch system.

Q4: Follow-up: Are we going to give a range of an acceptable cost, or are we judging that from the proposals submitted?

R: BACP will judge that based on the proposals submitted.

Q5: Do persons with disabilities satisfy the requirement of 25% minorities working on this contract?

R: No, companies owned or employing persons with disabilities do not satisfy this requirement . “Minorities” are being defined as persons that are Asian American, Hispanic, African American or Black or other groups, or other individuals, found by the

Affirmative Action Advisory Board to be socially and economically disadvantaged and to have suffered actual racial or ethnic discrimination and decreased opportunities to compete in Chicago area markets or to do business with the City. Q6: Is the BEDP included in that?

R: No. Specifically in this RFP, BACP is looking for MBE.

Q7: Can you provide us with any data on the volume regarding the current WAV Central Dispatch?

R: BACP will make the reports public in the addendum regarding the number of WAV dispatches per month as provided to BACP by the current operator.

Q8: Will the City consider allowing the Chosen Respondent to defer the start of contract until September 2013?

R: No, BACP is looking to start this RFP as soon as possible; so, any proposals requesting a delay may be seen as weaker than the others. The proposal will not be considered non-responsive if you do propose a delayed response.

Q9: How many WAV calls for service do not get picked up?

R: A report will be made available in the addendum as provided to BACP by the current operator.

Flash Cabs

Q10: Please address the one million dollar liability insurance requirement in the RFP, Exhibit 5.

R: The intent of Section 3 (Automobile Liability) in Exhibit 5 of the RFP was to require the Centralized Dispatch Chosen Respondent/Vendor to have that level of insurance on any cars they might use themselves in the performance of Centralized Dispatch duties under this RFP and a resulting agreement. This would not apply to the WAV taxicabs that subscribe to the Centralized Dispatch system which are not owned or managed by the Centralized Dispatch vendor.

Q11: What is the City’s interpretation of “all services performed under the agreement” referenced in Exhibit 6, paragraph 25 “Chicago "Living Wage" Ordinance” subsection (a)(iii)?

R: R: Refer to Section 25 of Exhibit 6, which describes the circumstances under which the Living Wage ordinance applies. If a Respondent is uncertain as to whether they fall within the parameters of the ordinance, they should consult their own legal counsel.

Justin Rakeshaw—SCR Medical Transportation

Q12: Are proposers to develop a means to provide the hardware and technology needed to effectively dispatch trips across several providers, or leverage existing technology?

R: It’s up to the proposer as to how to use any technology that they want to use. The City is not identifying any specific technology that must be used.

Refer to MCC 9-112 and the Taxicab Medallion License Holder Rules and Regulations. The law states that all WAV Taxicabs must be on a centralized dispatch system.

Q13: Will the City allow a livery vehicle to become a provider if the trip and cost are pre-arranged in accordance with the City regulations as long as it is wheelchair accessible?

R: No. This is a WAV Taxicab Centralized Dispatch system.

Q14: Is the dispatch provider responsible for training drivers for safety and customer service concerns?

R: The training plan must be detailed in the request for proposal. Refer to page 61, paragraph 6.

Checker Taxi

Q15: Does the City have an estimate of the potential fare volume.

R: No, BACP does not have an estimate of the potential volume of passengers. With an aging general population, BACP does speculate a greater potential for WAV Taxicab passenger uses in the long term.

Q16. Can the fees charged be a variable rate based on total fares, as well as per vehicle?

R. Yes, there is nothing that prohibits a Respondent from identifying in its written proposal a formula for determining monthly fees based on the volume of the total number of WAV taxicabs fare requests and the total volume of City of Chicago licensed WAV taxicabs.

Q17: Will wheelchair drivers be certified beyond regular drivers, as they have received additional WAV training?

R: The WAV Taxicab Centralized Dispatch can bestow upon trained WAV taxicab drivers a certification.

MTM Ride Right

Q18: Is there currently a central call center operating now?

R: Yes, it is operated by the Flash Taxicab Company.

Q19: Where would the City prefer this location?

R: BACP does not have a specification as to a location

Q20: Will company that is chosen for this RFP have to provide company owned vehicle--or is all sub-contracted out now?

R: No, the WAV Taxicab Centralized Dispatch does not have to provide the vehicles. Any and all City of Chicago licensed WAV taxicabs would subscribe to the WAV Taxicab Centralized Dispatch. The City’s intent is that eventually all taxicabs will be WAV’s.

Flash Cabs

Q21: If Flash doesn’t maintain contract, will the phone number currently in existence roll over?

R: No, the current phone number is a private number registered to Flash Taxicab Company.

Q22: 30 minute requirement is not only a violation of rules and regulations but also within scope of services 3(c) on p.60?

R: The Chosen Respondent’s compliance obligations will be based on the laws that regulate the taxicab industry and be identified in the agreement.

Q23: What liability will the trainers be exposed to if there is an accident and the passenger is not properly secured?

R: Such liability will be determined by the applicable laws.

Taxi Affiliation Services

Q24: From what I understand, the current company is ticketed for non-service if no vehicle is available to supply service. Will the new company be responsible for non-service requirements?

R: The Chosen Respondent’s compliance obligations will be based on the laws that regulate the taxicab industry and be identified in the agreement.

Q25: The RFP states written approval is required from City on employee terminations or change of positions. What is the time frame for approval? R: There is no specific time frame in the RFP in reference to the following section on page 39 of the RFP:

Key Personnel

Contractor must not reassign or replace Key Personnel without the written consent of the City. "Key Personnel" means those job titles and the persons assigned to those positions in accordance with the provisions of this section. The Department may at any time in writing notify Contractor that the City will no longer accept performance of Services under this Agreement by one or more Key Personnel listed. Upon that notice Contractor must immediately suspend the key person or persons from performing Services under this Agreement and must replace him or them in accordance with the terms of this Agreement.

Q26: Regarding Exhibit 3: Please advise on the number of units and monthly rate that the incumbent is currently collecting from wheelchair accessible taxicabs that use centralized dispatch.

R: Existing WAV Taxicab Centralized Dispatch assesses a $275.00 monthly fee to current City of Chicago licensed WAV taxicabs. As of December 5, 2012, there are 174 City of Chicago licensed WAV taxicabs. The City’s intent is that eventually all taxicabs will be WAV’s.

Q27: Regarding the proposed percentage charge on total revenue to be paid to the City, does the City have an expectation on what that percentage should be?

R: No.

Q28: How many staff does the incumbent currently use to provide this service?

R: BACP does not have this information.

Q29: Is the incumbent providing the service 24/7?

R: Yes.

Q30: How many trips are currently dispatched monthly?

R: Refer to report attached to Addendum, which was provided to BACP by the current operator.

Q31: Regarding City and County licensing requirements, would it be permissible for these items to be in an “applied for” status at the time of proposal submission? R: Refer to Section 4.2.C. (iv) of the RFP, which requires Respondents to this RFP to provide copies of all appropriate licenses at the time they submit their proposals. To the extent that further or different licensing may be required of the Chosen Respondent, the Chosen Respondent must be able to obtain such license.

Q32: Would the City prefer to see the successful proposer be a non-taxicab entity, thereby providing greater independence to the program?

R: No opinion.

Q33: What marketing activities and costs are expected to be covered by the Contractor?

R: All marketing activities and costs are expected to be covered by the Contractor. The City may provide some marketing but such efforts by the City would be incidental.

Q34: Are we expected to do media placement, i.e., radio, billboard, web, etc.? What is the extent or expectation of the marketing activities? R: Refer to Exhibit 7, paragraph 2: “Communication with the Public”.

Q35: Do the taxis provide their own GPS and radio systems?

R: Yes, City of Chicago taxicabs have technical requirements for both GPS and dispatch systems. Refer to Municipal Code of Chicago Chapter 9-112 and the Taxicab Medallion License Holder Rules and Regulations.

Q36: What hardware will the Contractor be required to supply?

R: The hardware the Chosen Respondent would need to perform the services listed and identified in the RFP.

Q37: How do you decide allocate trips to specific providers? Can the taxis refuse to do a trip?

R: The first part of this question is not clear. No, taxicabs or public chauffeurs may not refuse to provide service. The Chosen Respondent will be required to report non­compliant chauffeurs and/or vehicles.

Q38: How many calls does the incumbent receive per month?

R: Refer to report attached to Addendum, which was provided to BACP by the current operator..

Q39: Does the Contractor need a website to accept on-line trip requests?

R: Responders to the RFP should include whatever means they plan to use to accept and fulfill requests for WAV taxicab service.

Q40: It doesn’t appear that living wage provisions apply to the contract. Is that correct?

R: Refer to Section 25 of Exhibit 6, which describes the circumstances under which the Living Wage ordinance applies. If a Respondent is uncertain as to whether they fall within the parameters of the ordinance, they should consult their own legal counsel.

Q41: Does a company need a Medallion to perform trips or can a medical transportation company do them as well?

R: The subscribers of the WAV Taxicab Centralized Dispatch must be City of Chicago licensed WAV taxicabs, and the service must only dispatch City of Chicago licensed WAV taxicabs.

Q42: Will taxis continue to be mandated to be part of this program or can they chose not to participate?

R: This RFP is for a WAV Taxicabs Centralized Dispatch System – all City of Chicago licensed WAV taxicabs must subscribe to the Centralized Dispatch.

Q43: What responsibility does the call center operator have with regard to the fares that the clients pay the cab companies?

R: Question is not clear.

Q44: What is the current assessment on the taxicabs, including any monthly or per trip fees, for wheelchair accessible dispatch service?

Q45: What is the present fee charged by the contractor for the assessable taxicab service, if different?

R: See above response.

Q46: What is the present percentage of total revenue paid to the City by the present contractor?

R: None.

Q47: If any of the above fees have changed during the last three years, please provide details on the level of the changes, and the rationale and timing?

R: No changes to the monthly fee listed above have occurred.

Q48: The training requirement says we are to provide training in how to “operate and drive.” Please verify you only mean operate accessibility equipment and not operating the vehicle generally? A driving course should be completed at some other phase for all taxicab drivers, and moreover there is too much variability in equipment to provide a cost effective training program in each vehicle – this should be up to vehicle owners and manufacturers.

R: Only licensed City of Chicago public chauffeurs may drive a City of Chicago WAV taxicab. Licensed City of Chicago public chauffeurs are required to know how to operate a taxicab vehicle.

Q49: Is it the City’s view that, as referenced on page 35, there are valuable papers that must be insured against? If so can you verified the limits of liability for this coverage that you are requiring?

R: The intent of Section 3 (Automobile Liability) in Exhibit 5 of the RFP was to require the Centralized Dispatch Chosen Respondent/Vendor to have that level of insurance on any cars they might use themselves in the performance of Centralized Dispatch duties under this RFP and a resulting agreement. This would not apply to the WAV taxicabs that subscribe to the Centralized Dispatch system which are not owned or managed by the Centralized Dispatch vendor.

Q50: One of the more difficult areas the potential compliance is tying into the payment processing equipment and this may not be allowed by the terms and conditions of the credit card processors. For example, what is the purpose of the wheelchair dispatcher being able to be involved in any fashion with non-cash payment processing and the taxicab? This looks like this may be an area that needs to be struck.

R: There is no reference to credit card processing systems in the RFP.

Q51: If the vehicle onboard systems need upgrading to allow contractor to interface, may we assume that the cab companies or vehicle operators will be paying for upgrades to their equipment needed?

R: No. The RFP should specify all proposed costs and expenses WAV taxicab medallion license holders may be assessed.

Q52: Page 61, E makes reference to WAV taxicabs not executing calls, and particularly rule TX 7.05 (D). In order to determine if a cab was not properly logged into the system or taking another trip when not logged into the system are giving another trip priority will the cab companies be required to cooperate with the assessable vehicle dispatch company to ensure compliance and investigations these incidents?

R: Yes.

Q53: Given the consideration that every medallion licensee with a licensed WAV taxicab must equip the WAV taxicab with two-way dispatch equipment which shall allow the dispatching of the vehicle by a coordinated or centralized dispatch or centralized dispatch system approved by the Commissioner for dispatch of WAV taxicabs, as well as the requirement of a GPS system, that every medallion licensee with a licensed WAV taxicab must equip the WAV taxicab with dispatch equipment incorporating a satellite-based computerized navigation system which provides information to the dispatcher of the exact street location of each vehicle within a 200 foot tolerance, taking these requirements into consideration what specific equipment is expected to be required and or installed as to prevent duplication.

R: Respondents to the RFP may include such specifics in their proposals.

Q54: The section on company profile says also subcontractors for significant work which we follow until the bottom of page 9 for the two forms which appear to be for the prime contractor or joint ventures, or “business entity partner” is indicated in the language under A and B. Is that correct?

R: See RFP.

Q55: Page 10 indicates copies of any licenses or certifications required. Please verify that respondents to not need to supply a license for City broker and dispatching services until after award?

R: Refer to Section 4.2.C.(iv) of the RFP, which requires Respondents to this RFP to provide copies of all appropriate licenses at the time they submit their proposals. To the extent that further or different licensing may be required of the Chosen Respondent, the Chosen Respondent must be able to obtain such license.

Q56: The RFP has at Page 11 three sections on the qualifications and experience of key personnel, including the responsibilities to be assigned; recent projects resumes, etc. This is repeated in the third paragraph under dedicated resources on page 12. Is there a single place in the RFP that you would like to see resumes, such as an exhibit, and also may we refer to one section or the other for redundant information such as the biographies of key personnel?

R: Information needs to be attached. BACP offers no opinion as to the location of information within a Respondents submittal.

R: The City has no projections. See report of historical data attached to Addendum, which was provided to BACP by the current operator.

Q59: The RFP contains a schedule which shows the due date and indicates the time is of essence elsewhere that we do not see in here the predicted award date notification to the contractor and assigning contract along with the start date of the contract. Please furnish the expiration to the current contractor’s contract

R: There is no current existing contract.
