Please review the next day’s agenda and notes the night before so you have an idea what is about to happen next. We will gather each morning in the hotel lobby to leave for our day of meetings. However, there may be times when the morning meeting time changes, and there are days where the transfer time between meetings will be tight. Please also be alert for unexpected changes as circumstances dictate during the week. In any case, it is important that we arrive at meeting locations with enough time remaining to exchange business cards and still be sitting down to start the meeting on time. If for any reason, you will not be attending a particular session, please alert me at once. Your assistance is greatly appreciated.

Todd Dickinson presented legislative updates. The audience raised questions about sanctions against lawyers who raised frivolous infringement suits and state preemption issue.
APRAM – Tuesday, March 11, 2014
Europe Committee plans to work with APRAM, hopefully in conjunction with the AIPLA Trademark Treaties Committee, to form positions regarding legislation on Transit Issues.
APRAM said they will provide the Europe Committee with a translation of their position paper on the Geographical Indication project. APRAM also wants to align with AIPLA on other policy issues.
APRAM also proposed to involve the French Trademark Office for next year’s annual trip.

President Battistelli presented a report on activities at the EPO.
The number of EPO patents granted has increased by 2.8% to 266,000 applications.
Global activity ranking of EPO filings by country:#1 US represents 25% of filers#2 Japan represents 20% of filers with an increase of 1%#3 Germany; reduction in pharma and biotech of 5%#4 China, which accounts for 8% of total filings; 60% more filings than France#5 South Korea
Strategy to deal with increase in filings: improving efficiency and quality. This strategy involves stabilizing the EPO employees at the 2010 level, which is a level of 7,000 full-time equivalent employees. Two drivers to meet this goal: (1) increase productivity (office wide unit cost index); and (2) redeployment of people (IFRS has increased to 200 million euros)

- Alan Kasper asked whether machine translations would be available for file wrappers to assist with PPH. Battistelli said this service is already available, but it is an approximation and not precise. The machine translation helps to select the pertinent documents to be used for the file wrapper for information but without any legal value.
- There has been an increase in website visits for machine translation. The most popular translation has been from Germany. The most frequent users are now USPTO examiners
2) CPC Classification:
- China, Brazil, Korea, etc. have decided to join the CPC classification system, which is a step forward in technical harmonization among IP offices
3) UPC and Unitary Patent:
- The Unitary Patent Agreement is almost completed
- The EPO is working on determining the level of fees. There is no hurry because the first Unitary Patent can only be delivered after the Unitary Court is created
- Germany will launch certification process this spring and finalize at the end of 2014
- Ratified by 13 member states
- Austria, Malta, France and the UK are in process to ratify.
- John Pegram asked about unitary patent fees as companies need to forecast their budgets. Battistelli said the EPO is working on fees and confident the model will be a success, cost-effective, and attractive to business. A constraint is cost, such as translations and financial compensation. The EPO is working on reducing financial compensation for translations. After the EPO has an idea of its costs, the EPO will consider the revenue side. The first Unitary

Patent may not be available until early 2016. If the EPO can fix fees by early 2015, Battistelli believes that this is well in advance and will allow users to plan budgets. The Unitary Patent Court will probably not be created before the beginning of 2016.
IP5:
First element of Global Dossier is the online electronic file wrapper. Through the EPO site there will be access to the corresponding applications in the various offices. The EPO plans to launch the online electronic file wrapper in June 2014.

Wayne Sobon suggested that AIPLA and EPI work together on webcasts to update AIPLA members of progress on the Unitary Patent and the Unitary Patent Court. EPI said that EPI can let users inform AIPLA members of trends, though EPI cannot present position papers.

Global Dossier (Niclas Morey):
EPO's Global Dossier version will be live on June 5, 2014 in Korea. Other jurisdictions will follow.
Two components:
1) Passive component
- file wrapper
- user goes to their own patent office (e.g., in Europe, go to EPO website and see "Global Dossier for IP5")
- Goal is to have one site provide all of the corresponding information from the other offices e.g. China, US, etc.
- Intention is that in the future unpublished documents will be available as well, but a smart card or similar security measure will be required.
2) Active component

- Simplify filing, which is a more difficult task.
- A future version of Global Dossier might include an email being sent when there is an update to a file wrapper.
Unitary Patent Fees (Eugen Stohr):
To date the EPO is concentrating on an assessment of its expected costs. Fees must be cost-neutral with regard to the EPO budget. The EPO is looking for a balance between covering costs and benefit to users. A question is whether further renewal fee income will be generated mainly by the Unitary Patent or the classic European Patent. Key factors are the overall cost advantage of the Unitary Patent over the classic European Patent and the attractiveness of the Unitary Patent Court. AIPLA suggested a sum of fees approach, lower fees in earlier years, revenue neutral result for the EPO. The EPO thought the AIPLA proposal was interesting and looked in particular to number of validations being granted during the classic European Patent to date.
In 62% of the classic European Patents that are validated, there is no drop of any individual validation. In 80% of European Patents only 3-5 countries are validated, so there is not much room for dropping individual countries. This does not mean that the validated countries are maintained until year 20, as the validated countries may be dropped after year 16. Patents with up to 5 validations tend to keep all validations until the end. Patents with more than 10 validations generally reduced to 4 validations.
A lack of flexibility for dropping validated countries therefore does not appear to be a major issue when considering the past statistics.

Domestication problem is a sensitive issue. Some countries have joined when not fully ready. Need to make sure the local legislation is sufficient prior to a member joining
2) Operations - filings and workload
Expect growth this year to be 7-8%
Workload not just based on filings, but lists of goods and services is growing.
Complexity of applications is increasing with growing complexity of rules in various countries.
Madrid, like PCT in past, is on cusp of becoming a global system
3) WG topics
Question regarding basic mark or application, and then you go to Madrid registry with a mark that is identical. Some countries find restriction to basic mark to be too restrictive (e.g., roman script and for china a transliterated version).
Two groups of members, traditional members that prefer basic marks, and newer members that want to move away from this. Questions of abolishing basic mark is not on the agenda, but instead just information gathering.

Registration system that is a one stop shop in that application does not need a first filing because applicant can designate the home country.

South Korea is expected to join in summer 2014, China early 2015; Japan in April 1, 2015.
There is a balance between a single application with sufficient elements to obtain designations and align specifications in case of incompatible requirements.
System will necessarily become more complex because of local designated country requirements, such as declarations sometimes requiring incompatible requirements.
90% of filings are electronic.
Electronic filing system - Can easily create a user name and password and create a practice filing without victuals submitting the application.
