Gun Group Files Final Brief in Firearms Freedom Case

Missoula, MT --(Ammoland.com)- The Montana Shooting Sports
Association has filed its final brief before the Ninth Circuit Court of
Appeals in San Francisco in MSSA v. Holder, litigation designed to
validate the principles of the Montana Firearms Freedom Act and to
challenge federal power under the U.S. Constitution’s Interstate
Commerce Clause to regulate any activity that occurs entirely within a
state.
MSSA v. Holder is before the Ninth Circuit on appeal from the federal
district court in Missoula, Montana, where the case was dismissed on
grounds of standing, jurisdiction and merit. MSSA previously submitted
its appellant’s brief and U.S. Attorney General Eric Holder filed his
response brief. The Ninth Circuit is expected assign the case to a three-
judge panel and probably schedule oral argument in Seattle or Portland
within a couple of months.
If the three-judge panel of the Ninth Circuit upholds the district court
dismissal, the case will then be ripe for appeal by MSSA to the United
States Supreme Court, the ultimate destination for MSSA, which admits
that only the USSC can provide the remedies MSSA seeks. MSSA wishes
to reverse a half century of precedent decisions concerning federal
authority under the Interstate Commerce Clause, decisions which MSSA
believes give the national government far too much power to regulate
essentially all human activity, even if that activity is wholly confined
within the borders of a state.
This challenge to federal power is a states’ rights exercise that began with
passage of the Montana Firearms Freedom Act by the Montana
Legislature in 2009. The MFFA declares that any firearms made and
retained in Montana are not subject to federal regulation. The MFFA was
subsequently cloned and enacted by seven other states, and has been
introduced in another 23 states. While firearms are the vehicle for the
exercise, the subject is resuscitation of the Tenth Amendment to the U.S.
Constitution and challenge to unrestrained power of the national
government.
Although much ignored by Congress and the courts in the past half
century, the Tenth Amendment requires: “The powers not delegated to
the United States by the Constitution, nor prohibited by it to the States,
are reserved to the States respectively, or to the people.”
Because the Tenth Amendment, part of the Bill of Rights, was enacted
more recently than the underlying Constitution, MSSA argues, the Tenth
Amendment actually amends the underlying Constitution and must be
given deference when in conflict with the Interstate Commerce Clause,
and with other relevant clauses of the underlying Constitution.
MSSA President Gary Marbut commented, “We are making
some fresh and compelling arguments that have never been
made before in Interstate Commerce Clause jurisprudence.
We hope that these arguments will persuade the Ninth
Circuit, and ultimately the United States Supreme Court, to
rethink their rationale for allowing unlimited regulation of
the affairs of people within states, a rationale more often
called into question in current legal philosophy. When the
states created the national government, they simply did not
intend to create a monster that could and would control
everything.”
The lead attorney for MSSA is Quentin Rhoades of the law firm Sullivan,
Tabaracci and Rhoades of Missoula. The Second Amendment
Foundation is a plaintiff in the suit, as is Gary Marbut of Missoula as the
sole individual plaintiff. Numerous other entities have joined the case to
support MSSA, including Montana Attorney General Steve Bullock, Utah
Attorney General Mark Shurtleff who also represents six other states’
attorney generals, the Goldwater Institute, the Pacific Legal Foundation,
numerous Montana legislators, legislators from other states where
MFFA clones have been passed or introduced, and the Weapons
Collectors Society of Montana. All of these groups have also submitted

supporting briefs to the Ninth Circuit in MSSA v. Holder.
MSSA v. Holder argues some points similar to Bond V. US and Florida v.
DHHS. Florida is a challenge to the power of Congress to implement
national health care – to require individuals to buy health insurance
claiming that an individual’s failure to buy health insurance would affect
interstate commerce and therefore falls under the power of Congress in
the Interstate Commerce Clause to “regulate commerce … among the
several states”. Bond is a recent, unanimous decision by the USSC that
argues very favorably that respect must be given to the Tenth
Amendment.
Contrary to some recent criticism contained in a front page story about
the MFFA litigation in the Wall Street Journal, MSSA is advancing MSSA
v. Holder with zero financial support from Montana taxpayers.

Louisiana --(Ammoland.com)- The Louisiana Wildlife and Fisheries
Commission (LWFC) voted to tentatively adopt proposed season dates,
bag limits and shooting hours for the 2011-12 migratory waterfowl
season at their Aug. 4 meeting.
The dates will be ratified by a declaration of emergency from the
commission, after approval from the U.S. Fish and Wildlife Service.
Following a comment period that began after the July commission
meeting, the Louisiana Department of Wildlife and Fisheries (LDWF)
recommended a 60-day season for ducks, coots and mergansers. In the
West Zone, the first segment will open on Nov. 12 and close on Dec. 4.
The second segment will open on Dec. 17 and run through Jan. 22. In the
East Zone, the first segment will go from Nov. 19 to 27. The second
segment will last from Dec. 10 to Jan. 29.
A proposal to move the Youth waterfowl weekend to the weekend during
the splits was revised by LDWF based on a majority of public comments
received. Those comments favored keeping that weekend opportunity for
youth prior to the season opening dates in both zones. The revised Youth
waterfowl weekend dates proposed by the department and adopted by
the commission are Nov. 5-6 in the West Zone and Nov. 12-13 in the East
Zone.
The daily bag limit on ducks is six and may include no more than four
mallards (no more than two of which may be females), two pintails, one
canvasback, one mottled duck, one black duck, three wood ducks, two
scaup and two redheads.
The daily bag limit on coots is 15. The daily bag limit for mergansers is
five, of which only two may be hooded mergansers. The merganser limits
are in addition to the daily bag limit for ducks.
The possession limit on ducks, coots and mergansers is twice the daily
bag limit.
Light geese and white-fronted geese will have a 74-day season. The first

segment in the West Zone will open on Nov. 12 and close on Dec. 4. The
second segment in the West Zone will run from Dec. 17 to Feb. 5. The
first segment in the East Zone will open on Nov. 5 and run until Nov. 27.
The second segment will run from Dec. 10 to Jan. 29. The daily bag limit
on light geese is 20, with no possession limit. The daily limit on white-
fronted geese is two, with a possession limit of four. When the Canada
goose season is open, the limit is two dark geese (white-fronted and
Canada) of which no more than one can be a Canada goose.
The Canada goose season will be 44 days and run from Dec. 17 to Jan. 29
statewide, except for a small closure area in southwest Louisiana. The
daily limit for Canada geese is one in aggregate with white-fronted geese
and the possession limit is two in aggregate with white-fronted geese. So
the daily bag limit will allow two dark geese (white-fronted and Canada
geese), no more than one of which may be a Canada goose.
The Statewide Conservation Order for light geese will open in the West
Zone on Dec. 5, and the first segment will close on Dec. 16. The second
segment in the West Zone will run from Feb. 6 to March 11. The first
segment in the East Zone will run from Nov. 28 to Dec. 9, and the second
segment will be from Jan. 30 to March 11. During this time, only snow,
blue and Ross geese may be taken and daily bag and possession limits
are eliminated. The use of electronic calls and unplugged shotguns is
permitted. Shooting hours during the Conservation Order begin one-half
hour before sunrise and extend until one-half hour after sunset.
Rails may be taken from Sept. 10 to 25 and again from Nov. 12 to Jan. 4.
For King and Clapper rails, the daily limit is 15 in the aggregate with a
possession limit of 30. Sora and Virginia rails have a daily and
possession limit of 25 in the aggregate.
Gallinule season will be open from Sept. 10 to 25 and again from Nov. 12
to Jan. 4. The daily bag limit is 15 with a possession limit of 30.
Snipe may be taken in the West Zone first segment from Nov. 5 to Dec. 7
and from Dec. 17 to Feb. 28 in the second segment. In the East Zone, the
first segment will run from Nov. 5 to 30 with a second segment running
Dec. 10 to Feb. 28. The daily bag limit is 8 and the possession limit is 16.
An extended falconry season for ducks, rails and gallinules will take
place from Nov. 5 to Feb. 3.

Tracy Barnes has been crowned best Biathlon shooter in the World at the

event. Meanwhile, at the Sprint race at the US Nationals in Grand
Rapids, Minnesota, Lanny and Tracy placed 3 rd and 4 th , respectively.
In the Pursuit, Tracy battled her way back up the ranks to finish 2nd,
while Lanny stayed in 3rd place for the second race and the last day of
nationals brought a 3rd place finish for Tracy and a 4 th place finish for
Lanny.
Tracy and Lanny are also training hard to make sure they are ready to
bring home the gold in the 2014 winter Olympics in Sochi, Russia.
“We brought our shooting to a whole new level this year. I
think a lot of it has to do with being confident and being able
to rely on our equipment because of Otis. It gets us excited
about the possibility of winning a medal at the Olympics in
Russia,” says Lanny Barnes. Tracy adds, “Otis has been
instrumental in our shooting success at the international
level. I was able to win in front of 50,000 screaming German

Trappers
How do the new CCW law changes effect me as a hunter, trapper,
recreational vehicle operator or user of DNR lands?

MADISON, WI --(Ammoland.com)- 1. Transportation of Firearms
Is it true that firearms no longer have to be unloaded or in a case if a
vehicle?
All long guns, such as rifles, shotguns and muzzleloaders must still be
unloaded and completely enclosed within a case before they may be
placed, possessed or transported in or on a vehicle (including trailers,
wagons, snowmobiles or All-Terrain vehicles).
Long guns must still be unloaded before they may be placed, possessed
or transported in a motor boat with the motor running. However, the
new change made under to concealed carry legislation was the
elimination of the requirement to unload or case a handgun before it is
placed, possessed or transported in or on a vehicle, boat, snowmobile or
ATV. This change for handguns does not take effect until Nov. 1, 2011.
2. Shining Deer or Other Wildlife
If I have a concealed carry license or I am a qualified former law
enforcement officer who is authorized to carry a concealed handgun, can
I now possess this handgun while shining deer or other wild animals for
viewing purposes?
No. The legislation involving carrying concealed weapons, as well as the
transportation of handguns, did not make any changes to the shining
restrictions. It continues to be illegal to shine for wild animals while in
possession of a any bow, crossbow or firearm, even if the firearm is a

handgun possessed by a person who has a concealed carry license, or is a
firearm possessed by a retired or former law enforcement officer. It also
continues to be illegal to shining between the hours of 10pm and the
following 7am from September 15th through December 31st, even if a
person does not possess any firearm, bow or crossbow. Additional local
county restrictions may also apply.
3. Possession of Firearms in State Wildlife Refuge Areas
If I have a license to carry a concealed weapon, or I am a qualified former
law enforcement officer, can I now carry a loaded and uncased firearm in
a wildlife refuge where firearms are normally required to be unloaded
and encased ?
Beginning on Nov. 1, 2011, a person with a concealed carry license will be
allowed to possess a handgun which is loaded and uncased (concealed or
unconcealed), and a qualified former law enforcement officer may
possess the type of firearm they qualified with and which is indicated on
their certification card, loaded and uncased (concealed or unconcealed)
in a wildlife refuge. This exemption however does not allow such persons
to hunt or discharge their firearm in the refuge.
4. Possession of Firearms in State Parks & State Fish
Hatcheries
If I have a license to carry a concealed weapon, or I am a qualified former
law enforcement officer, can I now carry a loaded and uncased firearm in
a Wisconsin State Park or State Fish Hatchery where firearms are
normally required to be unloaded and encased ?
Beginning on Nov. 1, 2011, a person with a concealed carry license will be
allowed to possess a handgun which is loaded and uncased (concealed or
unconcealed), and a qualified former law enforcement officer may
possess the type of firearm they qualified with and which is indicated on
their certification card, loaded and uncased (concealed or unconcealed)
in a Wisconsin State Park or State Fish Hatchery. This exemption
however does not allow such persons to hunt or discharge their firearm
in the Wisconsin State Park or State Fish Hatchery, nor does it allow
bringing the firearm inside state owned buildings on these properties
which are posted with signs that provide notice that firearms are not
allowed in the building.
5. Age for Possession or Hunting with a Handgun
Did the concealed carry legislation change the age of persons who may
go armed with a handgun, hunt with a handgun or the species which may
be hunted with a handgun?
No. A person must still be at least age 21 to purchase a firearm which is a
handgun, and age 18 to possess or hunt with a firearm which is a
handgun. The species which may be hunted with handgun and the
caliber and barrel length minimums have not change.
6. Carrying a Concealed Firearm while Hunting
If I am at least 18 years old and can legally hunt with a handgun, can I
also carry that handgun concealed under my jacket or in a backpack
while I am hunting?
Generally speaking, the answer is no. A person must be at least age 21 to
obtain a license to carry a concealed weapon. However, beginning on
Nov. 1, 2011, a person who owns, leases, or is the legal occupant of land
and who is age 18 or older, can possess a concealed handgun on that land
without the need for a concealed carry license. This would mean a person
meeting these conditions who is age 18 or older, even without a
concealed carry license could possess a concealed handgun, and hunt
using a concealed handgun which is a legal size and caliber for the
species being hunted. But only on their land, and only with a handgun. It
continues to be illegal to possess concealed long guns.
7. Possession of Firearms on DNR lands in the 17 Restricted
Counties
Have the restrictions on possessing a loaded or uncased firearm on DNR
owned lands changed in those counties were it is not legal to possess a
loaded uncased firearm when not engaged in lawful hunting unless at a
designated range or engaged in a permitted dog trial or training?
The answer is yes if the firearm is a handgun if possessed by a person
with a concealed carry license, but no for a qualified former law
enforcement officer unless they also possess a concealed carry license.
On DNR lands which are not state parks, state fish hatcheries or wildlife
refuges, such as normal public hunting grounds, and which are located in
Dane, Dodge, Fond du lac, Jefferson, Juneau, Kenosha, LaCrosse,
Milwaukee, Outagamie, Ozaukee, Racine, Sauk, Sheboygan, Walworth,
Washington, Waukesha, Winnebago counties or on state forest lands in
the Kettle Moraine or Point Beach state forests or state recreational
areas, it continues to be illegal to possess or control a loaded or uncased
firearm unless engaged in lawful hunting or at a designated range or
engaged in a dog trial or training activity under a permit.
8. Where do I apply for a Concealed Carry License
Applications for a license to carry a concealed weapon must be obtain
from and submit to the Wisconsin Department of Justice (DOJ), and not
the DNR. Licenses will not be available until November 1, 2011 when the
new laws and license take effect. For more information about laws

9. How do I obtain a Duplicate Hunter Education Certificate?
Should your safety education certificate become lost or destroyed, you
may obtain a duplicate by following the steps below:
You can purchase and print a duplicate safety education certificate from
home. Go to Wisconsin’s Online Licensing Center. OR
Locate a DNR Service Center or a DNR License Sales Agent nearest you
to purchase and receive a duplicate safety education certificate over the
counter. FEE: There is a $2.75 charge for a duplicate safety education
certificate.

Education Classes to include Laws on Carrying Concealed
Weapons ?
No. The DNR’s hunter education course will remain the same. The
Department of Natural Resources is not required, nor do we have any
plans to modify our current hunter education course of instruction to
include any new material or training specific to handguns or carrying a
concealed weapon. The only correlation that the hunter education
program has to the licenses to carry a concealed weapon is that it simply
happens to be one of the types of training that the legislature has
considered acceptable to qualify for a person to apply for a carry
concealed weapon (CCW) license, along with needing to be at least age
21, a Wisconsin resident and not prohibited from possessing a firearm. A
person has many other options to obtain firearms training to qualify for
a CCW license.

PHOENIX, AZ – -(Ammoland.com)- The Arizona Game and Fish
Department has posted the 2011 Sandhill Crane Regulations, which
includes the drawing information for limited hunts at
www.azgfd.gov/rules.
Paper hunt-permit applications are now being accepted by mail only and
must be received by Aug. 30, 2011.
Applications can be mailed to either P.O. Box 74020, Phoenix, AZ
85087-1052, or 5000 W. Carefree Highway, Phoenix, AZ 85086-5000.
Postmarks do not count, hand-delivered applications are not accepted,
and there is no online application process available.
A 2011 hunting license is required to apply and can be purchased
through the application process or in advance from any Game and Fish
office, license dealer, or online at www.azgfd.gov.
Applicants are reminded to use the appropriate four-digit “hunt number”
when filling out the application form and not the “open areas” game
management unit number.
Arizona Sandhill Crane Regulations
Printed copies of the regulations are anticipated to be in license dealers
and Game and Fish offices statewide by Aug. 10.
The electronic version of the regulations is easily printable on two pages
of standard paper as is the hunt application form, both available at
www.azgfd.gov/rules.

Attorney Bill Nettles stated today that Andre Moss, a/k/a “Dre” (22);
Anthony Brevard, a/k/a “Amp” (20); Torrian Gleaton (22); Johnathan
Bailey, a/k/a “Brandon” (21); Antonio Keller, a/k/a “Hollywood” (22);
Allan Boyd (19); Travis Hayes, a/k/a “Trav” (21); and Dexter Clifford
Savage, a/k/a “D–boi” (24) were sentenced to a combined 41 ½ years in
prison as a result of an effort to focus on removing firearms and
criminals from the Greenview Community in Columbia, SC.
Mr. Nettles went on to say: “We are pleased to have helped
the citizens of Greenview as they fight to ensure their
community remains safe and civil. As part of our ongoing
Project CeaseFire initiative, we will continue to devote
resources to removing firearms and criminals from the
Greenview Community so that residents can safely raise their
families and enjoy their neighborhood.”
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and
Columbia Police Department (CPD) combined to remove twenty
firearms from the community, including two SKS 7.62mm Cugir Model
56 assault rifles; one Norinco 7.62mm assault rifle; three Taurus .45
caliber semi–automatic pistols; two Taurus .40 caliber semi–automatic
pistols; a Ruger .40 caliber semi–automatic pistol; a Harrington &
Richardson .32 caliber revolver; a Hi–point 9mm semi–automatic pistol;
a Bersa .380 caliber semi–automatic pistol; a Ruger .44 magnum
revolver; a Charter Arms .38 caliber revolver; a Taurus .38 caliber
revolver; a Rossi .38 caliber revolver; Smith and Wesson .357 revolver; a
Marlin Glenfield 12–gauge sawed–off shotgun; a Mossberg 12–gauge
shotgun; a Mossberg 20–gauge shotgun; and an assortment of
ammunition for use in a variety of firearms.
Moreover, nine individuals plead guilty to charges in federal court and
were sentenced to up to ten years in prison in addition to three years of
supervised release: Moss (120 months), Hopkins (92 months), Hayes (90
months), Brevard (46 months), Savage (33 months), Bailey (33 months),
Keller (33 months), Gleaton (27 months), and Boyd (24 months).
The joint ATF and CPD operation utilized a confidential informant in
March and April of 2010 to purchase firearms and ammunition from
members of the group. Then in June of 2010, members of the group
robbed the confidential informant at gunpoint when he arrived at an
apartment complex for a pre–arranged purchase of five firearms –
including an AK–47 Assault Rifle and an Uzi.
Columbia Police Department Chief Randy Scott stated: “This
operation was a cure for a persistent illness that the
Greenview community has been suffering with for quite some
time. The suspects will not be returning to the
Greenview/Northeast community to continue their criminal
acts. Law abiding residents have been taking proactive
measures with the Columbia Police Department to safeguard
their backyards. Efforts like this crime suppression operation
will continue.”
The case was investigated by agents of the Bureau of Alcohol, Tobacco,
Firearms and Explosives and the Columbia Police Department, and lead
by Task Force Officer Brian Vanhouten. The prosecution was part of the
joint federal, state and local Project CeaseFire initiative, which
aggressively prosecutes firearm cases. Assistant United States Attorney
Jay N. Richardson of the Columbia office handled the case.

SALT LAKE CITY, UT --(Ammoland.com)- Close to 2,000 attendees,
including 20 percent more retailers than last year, tested the latest
outdoor gear on the water and trails at Jordanelle State Park in Park
City, Utah on Wednesday, August 3 at the Outdoor Retailer Summer
Market Open Air Demo (OAD).
A record-breaking 153 exhibitors (over 200 brands) showed retailers a
sneak peek of next year’s paddlesports, endurance sports, cycling, fly-
fishing, footwear, camping, apparel, and other outdoor equipment and
accessories.
Attendees participated in events like It’s A Shore Thing Trail Run,
Paddle/Pedal Challenge, Sustainable Living Roadshow, GPS Treasure
Hunt, Fly Fishing competition and the chance to set a world record by
paddling the largest SUP (stand up paddleboarding) board with SUPzilla.
“This is an outstanding event and a great location for it; it’s
absolutely beautiful out here. We’re seeing a lot of retailers
and a lot of people interested in paddling and growing the
excitement and enthusiasm for the sport (SUP). It’s clear that
when people try this sport they become interested in buying
what we’re selling, so it’s an incredibly important thing for us

ST. MARYS, KS -–(Ammoland.com)- The Westar Energy Green Team
will host a youth dove hunt for novice shooters at Jeffrey Energy Center,
north of St. Marys, on Labor Day weekend, Sept. 3-4.
Hunts will be on wheat stubble or sunflowers, guided by volunteers in
the early morning or late afternoon.
Area staff report that the fields are in excellent condition and should
provide excellent hunting.
These hunts are a great way for kids 16 and younger to learn dove
hunting basics with plenty of birds flying at close range.
Youth must bring their own shotguns, be accompanied by a non-hunting
adult, and have a license and HIP stamp if age 16. Nontoxic shells will be
provided.

announced today the newly elected 2011-2012 board of directors. The
board also elected its new officers including incoming Chair, Will
Manzer, CEO of Eastern Mountain Sports.
“It is an honor to serve as chair of the OIA Board,” said
Manzer. “After serving the last seven years on the board, I
feel we have seen real traction in growing the industry. I look
forward to working with my fellow board members and
continuing that progress.”
Chosen by the membership, the OIA board consists of 18 voting
members and 10 appointed non-voting members, who may serve up to
two consecutive, three-year terms. In addition, this year, the outgoing
chair Dan Templin, CFO at VF Outdoor Inc. exercised his right to
appoint a one-term second vice chair.
As his first responsibility as the incoming chair, Manzer will award Peter
Metcalf, co-founder, CEO, president and chairman of Black Diamond
Equipment, with the rarely presented OIA Chairman’s Award for his
unprecedented leadership, commitment and inspiration during service
to the OIA board.
“For our industry, Peter has been both guiding light and
driving force,” said Manzer. “As an OIA board member, Peter
helped us find our economic voice and set a high standard for
active engagement. Whether in the field, the board room or
the halls of Capitol Hill, Peter represents our industry with

finding that there are now two separate wolf species roaming Minnesota,
Wisconsin and Michigan.
U.S. Sportsmen’s Alliance Director of Federal Affairs Bill Horn, who is a
former Assistant Secretary of the Interior in charge of the FWS and ESA,
joined Wisconsin’s Department of Natural Resources’ Secretary Cathy
Stepp at a press conference last week to challenge the FWS’s two species
proposal.
The FWS has issued proposed regulations (for a third time) to remove
the WGL population of gray wolves from the endangered species list.
Since the WGL wolf numbers exceed recovery goals by 600 to 1,000
percent, delisting is fully warranted.
But the proposed delisting rule includes a nasty surprise: it says there are
two separate wolf species in the WGL region – gray wolves (Canis lupus)
and eastern wolves (Canis lycaon). The FWS does not know how many
of each roam the region, but still believes gray wolves are recovered.
“This ‘two species’ finding is a trick deal which undermines
needed WGL wolf delisting,” stated Bill Horn, USSA Director
of Federal Affairs. “Since the FWS acknowledges it does not
know how many of the nearly identical eastern wolves (C.
lycaon) are present in the WGL region, the agency cannot
scientifically demonstrate that gray wolf (C. lupis) numbers
do in fact meet recovery goals. Animal rights opponents of
wolf delisting (and state management) will jump all over this
fatal flaw in their next round of federal court filings.”
In fact, the best scientific data demonstrates – and almost all wildlife
professionals agree – that the WGL wolves are a single discrete
population that is more than recovered. In contrast, one FWS staff
biologist has advanced the suspect two species theory that undermines
delisting. This is counter to other information about the WGL wolves.
A recent affidavit filed by the US Sportsmen’s Alliance included
conclusions by Dr. Lissette Waits, one of the nation’s wildlife and wolf
genetics experts. This information emphatically concluded that there are
not two separate wolf species in the Western Great Lakes region. Dr.
Waits holds a PhD in Genetics from the University of Utah and is a
tenured associate professor of Fish and Wildlife Resources at the
University of Idaho. She has worked on the intersection between genetics
and wildlife management, is a member of the FWS red wolf recovery
team, has led a red wolf contract research project for FWS, and has
studied gray wolves and wolf/coyote hybridization as well.
Wisconsin DNR also agrees that there is only one species present and
that the wolves are fully recovered. Its wolf population surveys show
more than 1,000 animals in a single population that continues to grow
and expand. Growing numbers of unmanaged wolves cause biological
problems (excessive predation) and social troubles as well; wolves are
well known for preying on domestic animals, including dogs, horses, and
cattle. State wildlife officials are barred from managing wolves until the
animals are taken off the federal list of endangered species by the FWS.
“For years, science has shown that these wolves have far
exceeded recovery goals,” said Rob Sexton, U.S. Sportsmen’s
Alliance vice president of government affairs. “Additionally,
we hope that the Service will look at the prevailing scientific
facts that show only one wolf population exists within the

Western Great Lakes region, and it will avoid letting the antis
use this unsupported claim as another roadblock to rightfully
returning wolves to state management.”
Why the FWS has taken this two species proposal step, contrary to the
best scientific evidence, remains unknown. USSA is concerned Obama
Administration politics are to blame. “This trick deal allows the
Administration to tell the Western Great Lakes states and hunters that it
favors delisting, while winking and nodding to its activist pals that
delisting is set up to fail,” said Horn.
Wolves are well documented for causing damage to private property and
for reducing deer herds. Packs of WGL gray wolves have attacked
hunting dogs, livestock and pets across the region where the large
canines roam. Wisconsin DNR chief legal counsel Tim Andryk reports
that the plentiful wolves in that state have cost his department more than
$1 million in restitution fees to reimburse owners for killed livestock,
hunting dogs, and killed and consumed pets. Nearly a dozen dogs –most
of them hunting dogs–have been killed by wolves this year in
Wisconsin—and hunting seasons open there soon, and more dogs will be
harm’s way.

MISSOULA, Mont. --(Ammoland.com)- Yesterday, August 3, 2011,
will go down as one of the better days in a decade-long battle for science-
based wolf management.
Rocky Mountain Elk Foundation leaders are encouraged by progress on
two fronts.
A federal judge upheld Congress’ recent delisting of wolves in Idaho,
Montana and other parts of the West. And the U.S. Fish and Wildlife
Service announced an agreement on wolf management plans in
Wyoming.
Both developments help clear the way for state management hunts
needed to control burgeoning wolf populations. In some areas, elk calf
survival rates are now too low to sustain herds for the future.
“We’re encouraged by these positive steps toward managing
wolves as part of overall conservation objectives,” said David
Allen, RMEF president and CEO. “This is forward movement
in our fight to make sure that all states, from the Pacific
Northwest to the Great Lakes, have the authority to manage
fully recovered species like wolves.”
“Real on-the-ground science is the big winner in all of this, as
there is no doubt that wolves are recovered and should be
managed like all other wildlife. To date, no one has shown
science to dispute this fact,” he added.
Allen thanked sportsmen and conservationists for their patience through
the endless lawsuits that have kept America’s historically successful
system of wildlife management stymied in courts.
But he also cautioned, “Until the wolf problem is fixed
permanently, we’re likely to see appeals, more legal antics
and frivolous lawsuits by extremist groups who literally make
their living by suing the federal government–and creating
crises where there are none, for the purpose of raising funds.”

Allen said RMEF will remain diligent as plaintiffs consider taking their
case to higher courts. RMEF also will continue to urge lawmakers for
nationwide delisting measures, and advocate for updating and
modernizing delisting language within the Endangered Species Act.

FAIRFAX, Va. --(Ammoland.com)- The National Rifle Association is
fully funding and supporting a lawsuit challenging the Obama
administration’s demand that Federal Firearms License holders report
multiple sales of long guns in Arizona, California, New Mexico and
Texas.
The lawsuits filed assert that the ATF lacks statutory authority to
demand these reports.
NRA’s Institute for Legislative Action Executive Director Chris W. Cox
has long expressed skepticism for the motivation and the timing of this
ATF effort.
“This is a bait-and-switch scheme by an administration and a
bureau frantically trying to distract lawmakers and the
general public from the deadly ‘Fast and Furious’ debacle.
This is a serious problem with deadly consequences, yet the
Obama administration wants you to believe it can deter $40
billion transnational criminal enterprises by imposing
paperwork requirements on honest American firearms
dealers. This scheme will unjustly burden law-abiding
retailers in these four border states. It will not affect drug
cartels and it won’t prevent violence along our borders. It will
only divert scarce law enforcement resources from legitimate
criminal investigations and squander them on policing law-
abiding retailers.”
In a time when every federal agency is under intense budget pressure,
the ATF estimates that this new reporting requirement will force it to
review more than 18,000 additional documents annually. That’s in
addition to dealers’ real-time reports of suspicious transactions-which
the ATF, in the “Fast and Furious” operation, handled by telling dealers
to proceed with the sales.
FFLs in these four border states began receiving tersely worded demand
letters from the ATF that read:
You must submit to the Bureau of Alcohol, Tobacco,
Firearms and Explosives (ATF) reports of multiple sales or
other dispositions whenever, at one time or during any five
consecutive business days, you sell or otherwise dispose of
two or more semi-automatic rifles capable of accepting a
detachable magazine and with a caliber greater that .22
(including .223/5.56 caliber) to an unlicensed person. You
are required to report all such sales that occur on or after
August 14, 2011. You must continue reporting multiple sales
for the rifles subject to this demand letter until we provide
written notice to stop.
The NRA filed separate complaints in the District of Columbia, New
Mexico and Texas challenging the administration’s demands.

NEWTOWN, Conn --(Ammoland.com)- In just two years, the
Collegiate Shooting Sports Initiative (CSSI) developed by the National
Shooting Sports Foundation has awarded more than $300,000 to 40
colleges to help establish, expand and sustain shooting clubs and teams.
NSSF wants to add to that support. This school year NSSF will make a
total of $300,000 in funding available to colleges. Grant applications are

“We’re seeing that college students are eager to participate in
the shooting sports if given the opportunity,” said Zach Snow,
NSSF manager of shooting promotions. “NSSF grants are
stimulating interest in collegiate target shooting and firearms
safety programs across the country.”
Schools that have received CSSI grants include Harvard, Yale, Clemson,
Colorado State, University of Arkansas-Fort Smith, Fort Hayes State,
Stetson College, Jacksonville University and the University of Vermont.
CSSI grant-supported programs have helped double participation at the
ACUI Intercollegiate Clay Target Championship over the last three years.
The 2011 championships featured 439 students representing 50 schools.
These are avid competitive target shooters. The majority of participants
shoot three or more events, with 88 percent taking aim in trapshooting,
the tournament’s top event. Participation in sporting clays, another
shotgun clay target sport, rose by 42 percent over last year. Snow reports
that the ACUI office receives an average of ten inquiries per month from
parents, students and coaches asking how to start a college team and get
involved with the ACUI tournament.
While competition attracts one type of student, recreational target
shooting draws students who want an introduction to the shooting sports
and firearms safety. NSSF grants are helping to establish these campus-
organized clubs. Such widespread interest prompted NSSF to develop its
“How to Start a Club” resource guide. The document is filled with helpful
advice on starting both competitive teams and recreational shooting
clubs, and includes samples of membership forms and club bylaws.
NSSF’s Collegiate Shooting Sports Initiative is closely allied with the
Scholastic Clay Target Program that was founded by NSSF and is now
administered by the Scholastic Shooting Sports Foundation. SCTP is a
nationwide program for youth target shooters that provides competition,
championships and scholarship opportunities. SCTP, a feeder program
for many college shooting teams, recently added a collegiate division.
“Students coming out of SCTP and other youth programs
want to continue participating when they get to college and
also share these lifelong sports with their new friends,” said
Snow.

TRENTON, NJ --(Ammoland.com)- New Jersey’s black bear
population has doubled sine 2005. Dr. Len Wolgast is an expert on black
bears.
He is Professor Emeritus Wildlife Ecology and Management Rutgers
University.
Dr. Wolgast is the primary author of the 2005 Comprehensive Black
Bear Management Policy, he was a Fish and Game Council member, and
is an officer of New Jersey Outdoor Alliance (NJOA). Dr. Wolgast made
the following timely comments about black bear management in New
Jersey:
“New Jersey presently supports a black bear population
which far exceeds cultural carrying capacity the number of
animals that can exist without causing too many problems for
the residents of our state. The only cost effective tool that is
available to reduce the bear population to a more tolerable
level is hunting. The three most recent New Jersey bear
seasons (2003, 2005, and 2010) have occurred under a very
conservative format. They were designed to slow the growth
of the bear population and gather data. It is my opinion that
future bear hunting seasons will need to be designed to
reduce the density of New Jersey’s bear population.”
Anthony P. Mauro, Sr, Chairman, NJOA, added, “Yesterday’s
black bear attack is only one of a number that have occurred
across the country during recent months. While attacks have
been infrequent in New Jersey, it should act to open the
public’s eyes to the fact that managing the black bear

substituting legitimate insights from bear biologists and
wildlife experts with the gibber of animal groupies. The chase
to report the thoughtless spectacles of animal rights fanatics
has created a circus-like atmosphere that has detracted from
the urgent need for sound wildlife management practices, a
scenario that puts both bears and people in harms way. We
are relieved that yesterday’s attack resulted in only minor
injuries, but it should be a sobering omen to take bear
management seriously.”
