Petition for Termination of Conservatorship of the Estate
PUBLIC GUARDIAN, Conservator, is petitioner.
Petitioner states: since the Public Guardian’s
appointment, an investigation into the conservatee’s
assets was conducted to determine an appropriate
budget for her. However, as a result of the
investigation, the PG determined that a
conservatorship is not the least restrictive means to
manage the conservatee’s assets. Deputy PG Stacy
Mauro provides the following information in support of
her assertion:
On 12/07/2016, Ms. Mauro traveled to
Flokatherine Jones’ home and met with her
and her daughter Tammy Swanegan, and
granddaughter, Radiance Swanegan. Ms.
Jones resides in her home with Tammy,
Radiance and Radiance’s three month old
son. Tammy and Radiance have lived with
Ms. Jones for over 13 years, and the three
combine their resources to maintain the
household. Much of the debt is jointly held in
the names of Ms. Jones and Tammy. There
are a minimum of 20 bills that are paid each
month by Ms. Jones, and all are paid online
by Radiance. Due to the combined debt, it
makes separating Ms. Jones’ monthly
expenses very complicated.
The PG spent a considerable amount of time
sorting through all of the bills and developing
several budgets, there did not appear to be
any evidence of financial abuse. The bills are
being paid on time, and prior to the
involvement of Tammy and Radiance in
managing Ms. Jones’ bills, the mortgage
company was in the process of foreclosing on
Ms. Jones’ home. Tammy and Radiance
assisted in working out a repayment plan,
which stopped the foreclosure process. Due
to the recent home flood there are personal
loans that were taken out to repair the
damage that was not covered by the
homeowners insurance.

Tammy informed Ms. Mauro that the heater in the home is not working and they have to wait
two days for someone to be available to come out to fix it. They are trying to get enough
money together to pay for the repair. Also, another pipe just burst so they are trying to figure
out how to pay for that as well. Ms. Jones has very little money left over each month after all
bills and living expenses are paid, so these unexpected costs are a burden to the estate.
It appears from a review of bank records that Ms. Jones’ is paying approximately $1,000 more
than her share of the monthly combined expenses. However, Tammy and Radiance provide
24 hour care to her. If they were not there and caring for her, Ms. Jones would need to be
placed in a care facility. Ms. Jones appears to be well cared for and is happy in her home
with her daughter and granddaughter. Neither Tammy nor Radiance sought payment for their
services. If they did and were to be paid a minimal rate of $10 per hour, the monthly cost of
care would be over $7,000. Tammy and Radiance are not able to pay one-third each of all
expenses. If they were required to, they would have to move out and Ms. Jones would have
to be placed in a facility. If they insisted on payment for their services, which is reasonable,
Ms. Jones could not afford that and would have to move out.
The PG did not marshal assets upon her appointment for two reasons: 1. There was no
evidence of wrongdoing; and 2. The transition period of marshaling estate funds and
transferring the bills to the PG would likely have a negative impact on Ms. Jones’ credit score
due to bills being late, as most are paperless billing, paid online, and are due at various times
throughout the month.
Due to the complexity of dividing the bills, the cost to pay someone to provide in home care,
and Ms. Jones’ monthly expenses, the PG does not believe a conservatorship of the estate
would benefit her. As noted, Ms. Jones has very little money left over each month, even
without paying for care provider services. The expenses of conservatorship would be an even
bigger burden on her estate.
For all of the reasons stated herein, the Public Guardian asserts that the conservatorship of the estate
is not necessary and requests that it be dismissed and she be discharged as conservator.
Wherefore, petitioner prays for:
1. The Court find that notice of the hearing of this petition has been given as required by law;
2. The Court find that a conservatorship of the estate of Flokatherine Jones is no longer necessary
and dismiss the conservatorship of the estate;
3. The Court discharge the Fresno County PG as conservator; and
4. Other relief be granted that the Court considers proper.

DOD: 7/1/16 DAVID WASHINGTON, Administrator, is
petitioner.
Petitioner states the Decedent was married to
David Baker. David Baker predeceased the
Decedent. A probate of the estate of David
Baker was filed in Fresno Superior Court case
no. 13CEPR00999.
At the conclusion of the probate proceeding
real property located at 195 Hoover Street in
Coalinga was distributed to the Decedent.
One of the heirs of Decedent, Jacqueline
Washington contends that David Baker gave
her the Hoover Street property.
Petitioner has found no grant deed that
conveys the Hoover Street Property to
Jacqueline. The last document of which
Petitioner is aware affecting title to the
Hoover Street Property is the Order.
On or about 1/6/17 Jacqueline forcibly
entered the Hoofer Street Property and as of
this date remains in possession. Jacqueline
continues to claim that she owns the Hoover
Street Property.
Petitioner prays for an Order:
1. Determining that the Decedent owned
the Hoover Street Property at the time of
death and that the Hoover Street Property
is an asset of the estate.
2. For an order directing Jacqueline
Washington to vacate the Hoover Street

Ms. Amador states she spoke to Mr. Castro at the hearing on 02/01/2017, however by that time Mr. Castro had
already filed his objections to the original petition and that Ms. Amador’s client would not qualify for bond. It
was agreed to request the appointment of a professional fiduciary promptly, as Mr. Castro is equally likely to
have problems obtaining a bond in the event he prevails in the Will contest. That way, all possible heirs will have
their interests’ protected pending resolution of the contest. Ms. Amador states she advised the Court of their
conversation and of her intention to file an Amended Petition. Ms. Amador states she pointed out there is a
substantial life insurance policy which is an estate asset and which can assist in preserving the other estate
assets if it can be marshalled. Ms. Amador states Mr. Castro was present and assured the Court of his
agreement in the plan to request the appointment of a professional fiduciary. Ms. Amador received a letter
from Mr. Castro on 02/14/2017, confirming his agreement with her proposed amended Petition.

Petition of Will Contest and Objection to Petition for Probate of Will; Declaration of Stephen Castro in Support
DOD: 08/06/2016 STEPHEN CASTRO, brother, is petitioner.
Petitioner states: on or about 11/09/2016,
Respondent filed with this Court a Petition to
Probate the alleged last will and testament of
the Decedent. The purported will leaves the
bulk of the decedent’s estate to his step-
granddaughter who is a minor to be
supervised by his stepdaughter, all of whom
has been case out of Decedent’s life based
on their behavior and estranged from
Decedent for ten years or more.
At the time of the alleged execution of the will
on or about June 14, 2016, Decedent had
been admitted to Clovis Community Hospital
since June 6, 2016, had several invasive
operations, including one for fluid (pus)
between the skull and the brain, putting
pressure on the brain. On June 14th, Decedent
was in ICU, on multiple medications and life
support, hardly conducive to clear thinking. At
the time of the alleged execution of the will
Decedent did not have the required mental
capacity and was under undue influence
exercised by Respondent over the Decedent
and is not, and never was, the will of
Decedent.
It is Objector’s contention that in addition, the
signature on the execution of the will while it
was his name, had not been signed by him
and was forged. Objector is an interested
person entitled to contest the admission of the
purported will in that Objector is a surviving heir
of the Decedent (brother of Decedent). Based
on paragraph’s three (3) and four (4) above,
Probate of the purported will should be
denied.
In addition to the estrangement as well as
multiple discrepancies in the Petition, Mr.
Castro objects to the appointment of Teresa J.
Goff as administrator or executor of the
Decedent’s estate.

Mr. Castro states at the last hearing he voiced his objection orally. After, the hearing he spoke with
Attorney Amador about the misspelling of his name and that he had not middle name. He also
informed Ms. Amador that his sister’s name was not Juana but Jenny and he informed Ms. Amador of
his correct address. Mr. Castro also states that his nephews address was also incorrect.
Mr. Castro asserts there is a gross understatement of the value of the Decedent’s estate in that the
real estate is valued about $273,000 instead of $200,000. Mr. Castro has attached as Exhibit A, the
Zillow.com and Realtor.com estimates of value. With $273,000 market value and allegedly $55,000 in
personal property and cash in the bank the bond should be in the $330,000 to $350,000 range.
Mr. Castro states that it is his contention that these discrepancies were intentional and designed to
keep Decedent’s interested heirs from discovering the looting of his estate for their own purposes and
greed.
Wherefore, Objector prays as follows:
1. That the purported will of Decedent be denied probate;
2. That Respondent’s request for Letters to administer or be executor be denied;
3. For costs of suit; and that Respondent’s attorney fees not be paid out of the estate.
4. For such other relief as the Court deems proper.

Petitioner states: Inventory and Appraisal was
filed 6/5/13 showing the value of the estate
to be $13,438.31. Summary of account and
supporting schedules are provided at Exhibit
B. (See #1.)
As reflected in prior pleadings, the
Conservator and Conservatee moved out of
state. The Conservator was appointed
Guardian of the Conservatee in Oklahoma
by Court order and Letters issued on 8/13/14.
Petitioner does not request compensation for
her services.
Petitioner requests attorney’s compensation
as set forth in Exhibit “C.” (See #3.)
Petitioner prays:
1. That this account and report be
approved and settled;
2. That the acts of the Conservator shown in
the account and report be approved;
3. That, upon settlement of this account, the
Conservator be directed to pay her
attorneys, McCormick Barstow, LLP,
compensation for services rendered and,
as yet, unpaid;
4. That the Conservatorship in California be
terminated; and
5. That the Court grant such other and
further relief as it deems just and proper.

1. This petition does not provide any accounting in the form required by Probate Code §§ 2620, 1060,
or any mandatory schedules on the required Judicial Council forms.
Need amended petition with accounting, schedules, including required mandatory form for
summary. Although Petitioner has been appointed Guardian in Oklahoma, this Court retains
jurisdiction for settling accounts pursuant to Probate Code §2630.
The only schedule provided at Exhibit B is a statement of property on hand, labeled as “receipts,”
but which does not show any account summary, receipts, disbursements, etc., and further
indicates that the conservatorship estate cash has been reduced by $11,722.70 without
explanation.
Note: The Conservatee’s interest in the Virginia real property is not an asset of this conservatorship
estate, but should be referenced in its own schedule pursuant to §1063(h).
2. This petition is not verified by the Conservator as required by Probate Code §§ 1021, 1023.
(Note: §1023 provides that an attorney may sign or verify on a client’s behalf if he or she is absent
from the county unless the person is a fiduciary appointing in the proceeding.)
3. Petitioner requests attorney’s compensation pursuant to Exhibit C, but no Exhibit C is attached.
4. Need Notice of Hearing.
5. Need proof of service of Notice of Hearing at least 15 days prior to the hearing pursuant to
Probate Code §1460(b)(6) on:
- Morgan Elizabeth Pasley (Conservatee)
- Debra Pasley (Conservator/Fiduciary, since the petition is not verified by her)
- David Hal Jones (Father)
6. The Court may also require notice to the surety of any continued or future hearings.
