There is More European Funding Available for Environmental Projects than Ever BeforeThesuccessofenvironmentalprojectse.g.onbiodiversityconservation,renewableenergy

orenvironmentalengineeringmainlydependsonaneffectivefundingandagoodproject

management.Inthecurrentprogrammingperiod2014-2020,theenvironmentalfocusis

presentthroughfundinginstrumentssuchasLIFE,ERDF,HORIZON2020,EAFRDand

LEADER.Themultitudeoffundingandfinancialinstrumentsforenvironmentalprojects

makes it difficult to obtain a comprehensive overview that highlights the differences

betweenthefundingoptions. Inadditionsignificantchangeshavebeenintroducedby

newlyadoptedregulationsconcerningthemostrelevantEUfundingprogrammes.

However,managingthefundsandapplyingsuccessfullyforEuropeanfundshasprovento

bedifficultandwillremainso.Nevertheless,tofundprojectsinvestingintheenvironment

withERDFortoreducetheenvironmentalimpactwithLIFE,itisworthtospendtimeonan

application.ThebeneficiariesmayalsocombinetheireffortssupportedbyHORIZON2020

withnewfundingopportunities,buildstrategicpartnershipswithlocalbusinessesanduse

thesesynergiesforevenmoresuccessfulnatureprotectionmeasures.Thepossibility

ofintegratedprojectsinLIFE(withbudgetsupto20MillionEuro)openspossibilitiesto

rethinkenvironmentalprojectscompletely.

KnowhowtoApplyforandManageLIFE,H2020,andESIFundsEffectivelyPractitionersfromthepublic,privateandresearchsectorsaswellasNGOsareconfronted

witharangeofchallengeswhenapplyingforEuropeanfunds.Thoroughknowledgeof

wheretoget fundingandfinancial instrumentsandhowtocomplywithallobligations

thatneedtobefulfilledforaproperapplicationiskeytosuccess.Beingawareof the

characteristicsofhighqualityproposalsfurtherstrengthensthepositionofprospective

beneficiaries.

During the course of the project, there are further administrative requirements that have

tobefollowed:Eligibilityofcosts,performanceindicatorsaswellasreportingobligations

arealwaysdifficulttoassessforProjectLeadersandAdministrators.However,aprofound

knowledgeoftheserequirementsiscrucialtoavoidarecoveryofgrants.

Area of ApplicationThefollowingtermsandconditionssettlethecontractualrelationshipbetweenconferenceparticipantsandtheEuropeanAcademyforTaxes,Economics&LawBraunerKlin-genbergGmbH[referredtoas“EuropeanAcademyforTaxes,Economics&Law”inthefollowing].Differingtermsandconditions,aswellas,othersettlementsand/orregulati-onshavenovalidity.

2.Registration/ConfirmationofApplicationAregistrationcanbemadeviainternet,mail,fax,oremail.TheregistrationisconsideredgrantedandlegallybindingifnotrejectedbytheEuropeanAcademyforTaxes,Eco-nomics&Lawinwritingwithinseven(7)daysafterreceiptofregistration.Theregistrationwillbesupplementedbyabookingconfirmationviaemail.Partialbookingsareonlyvalidforseminarsdesignedinmodules.

3. ServiceThecoursefeecoversthefeeperparticipantandcoursein€net,subjecttocurrentGermanVAT.Itincludestrainingcoursedocumentsaspercoursedescription,alunchmeal/snackandrefreshmentsduringbreaks,aswellas,aparticipationcertificate.TheEuropeanAcademyforTaxes,Economics&Lawhastherighttochangespeakers/instructorsandtomodifythecourseprogramifandwherenecessarywhilemaintainingtheoverallnatureofthecourse.Allregisteredparticipantswillbenotifiedincaseofacoursecancellationduetoforcemajeure,duetospeakers’preventions,duetotroublesatthechosenlocationorduetoalowregistrationrate.Coursecancellationnotificationduetoalowregistrationrateisissuednolaterthantwo(2)weeksbeforethecoursedate.Coursefeesarereimbursedinthecaseslistedabove;however,reimbursementfortravelexpensesorworkabsenteeismisonlygrantedincasesofintentionorgrossnegligencebytheEuropeanAcademyforTaxes,Economics&Law.Anyreimbursementoftravelexpensesaretobeconsideredasanexceptionalgoodwillgestureandformnofuturege-neralobligation.Incaseofdisturbancesand/orinterruptions,theEuropeanAcademyforTaxes,Economics&Lawcommitsitselftosolveorlimitanyproblemsthatmightoccurinordertomaintainandcontinuethecourseasplanned.

4. Payment Date and Payment, Default of PaymentPaymentofthecoursefeeispayableimmediatelyuponreceiptofinvoice.Wherepaymentisnotreceivedorlackingclearassignmenttoaparticipantpriortocommencementofthecourse,theEuropeanAcademyforTaxes,Economics&Lawmayrefusetherelevantparticipant’sparticipationinthatcourse.Thecoursefee,however,isstilldueimmedia-telyandcanbeclaimedaspartofadunningprocedureorlegalaction.InaccordancewithBGB§247(1),incaseofdefaultofpaymentwithinthestipulatedtimeperiod,defaultinterestonarrearsofatleast5%abovetheECBbaserateisdueandpayable.TheEuropeanAcademyforTaxes,Economics&Lawcanclaimhigherdamagefordelayifandwhereproven.Equally,theparticipantmayprovethatadamagehasnotoccurredorhashadlesseffectthanestimatedbytheEuropeanAcademyforTaxes,Economics&Law.

Paymentshallbemadebycashlessbanktransfer;cashorchequeswillnotbeaccepted.TheEuropeanAcademyforTaxes,Economics&Lawisnotliableforanylossofmeansofpayment.TheparticipantmayonlyoffsetsuchclaimsagainsttheEuropeanAcademyforTaxes,Economics&Law’sasareundisputed,legallyrecognizedorrecognizedinwritingbytheEuropeanAcademyforTaxes,Economics&Law.Therightofretentionisonlyacceptableinaccordancewithacounterclaimbasedonthesamecontract.

5. CancellationCancellationsneedtobeissuedinwriting.Cancellationbytheparticipantwillbesubjecttocancellationchargesasfollows:• 30daysormorepriortocommencementofthecourse:servicechargeof80,00€net,subjecttocurrentGermanVAT,payableimmediately,coursefeewillbereimbursed,• two(2)weeksto30dayspriortocommencementofthecourse:50%ofcoursefeenet,subjecttocurrentGermanVAT,payableimmediately,• non-attendanceorcancellationlessthantwo(2)weekspriortocommencementofthecourse:100%ofcoursefeenet,subjecttocurrentGermanyVAT,payable immediatelyTheEuropeanAcademyforTaxes,Economics&Lawgladlyacceptswithoutadditionalcostsasubstituteparticipantnominatedincaseofacancellationifthesubstituteparti-cipantisregisteredatleastthree(3)dayspriortothecommencementofthecourse.Neithercancellationofaspecificmodule/partofthecourseorsubstitutionpermodule/perdayispossible.

6. CopyrightSeminar/coursedocumentsareprotectedbypropertyrightsandmaynotbeduplicated,processed,amended,circulatedorpublishedinanyotherwaywithoutthewrittencon-sentoftheEuropeanAcademyforTaxes,Economics&Law.TheEuropeanAcademyforTaxes,Economics&Lawreservesallrights.

7. LiabilityAllseminarsandcoursesarepreparedandpresentedbyqualifiedspeakersandinstructors.TheEuropeanAcademyforTaxes,Economics&Lawacceptsnoliabilityfortheup-to-dateness,correctnessandcompletenessoftheseminardocumentation,aswellas,presentationoftheseminar.

8. Applicable Law, Place of Jurisdiction, Place of PerformanceAllcasesshallbegovernedandconstruedinaccordancewithGermanlawtotheexclusionoftheUNSalesConvention.Asfaraslegallyadmissible,placeofperformanceandplaceofexclusivejurisdictionshallbeBerlin,Germany.
