1.1. BY-DISTRICT ELECTIONS – DRAFT MAPS REVIEW
Council consideration, discussion and possible action regarding conducting a
public hearing to receive public input regarding the proposed district maps
submitted by the City’s Demographer and providing any further direction to the
demographer as appropriate.
Jeff Mathieu, City Manager introduced both draft maps to Council.
Thomas Rice, City Attorney, addressed Council regarding the two draft maps and
introduced Doug Johnson, Demographer.
Doug Johnson discussed specific details of the draft maps and stated that both
maps are equal in terms of population size and discussed the differences regarding
the layout of both maps.
Councilmember Jackowski inquired about the Green Draft Map in terms of the
registered voters age differences in each district and asked if that will affect the
voting.
Doug Johnson responded.
Mayor Pro Tem Herrick asked for clarification on the total population.

At the hour of 2:03 p.m., Mayor Jahn opened the public hearing, and seeing no public
comment closed the public hearing.

1.1 BY-DISTRICT ELECTIONS – SECOND REVIEW OF DRAFT MAPS
Council consideration, discussion and possible action regarding conducting a
public hearing to receive public input regarding the proposed district maps
submitted by the demographer retained by the City Attorney’s Office; providing
direction regarding selection of a draft map and scheduling a public hearing for
January 8, 2018 regarding a proposed Ordinance to transition to district based
elections.

Jeff Mathieu, City Manager, gave a brief presentation regarding the California
Voter Rights Act (CVRA) and introduced Dr. Doug Johnson of National
Demographics Corporation who drafted the city’s proposed district maps.
Doug Johnson reviewed the requirements for the drawing of the maps and also gave
an overview of each map.
At the hour of 1:20 p.m., Mayor Herrick opened the public hearing.
Mayor Herrick opened asking if Doug Johnson could provide clarity regarding why
the City is making the transition to district based elections.
Doug Johnson responded.
Neal Hertzman, Big Bear Lake: Mr. Hertzman wanted to know if the maps are based
on total population or if they are designed based upon registered voters. He also
inquired about if any size city can be bound by requirements and if anyone has taken
issue with states regarding this issue.
Doug Johnson responded.
Council, staff and demographer discussion regarding the ability to switch back to an
at-large election process.
Phil Hamilton, Big Bear Lake: Mr. Hamilton wanted more information on how the
transition process works and if appointment would have to be from the same district.
Doug Johnson responded.
Seeing no further public comment, at the hour of 1:27 p.m., Mayor Herrick closed the public
hearing.
Councilmember Caretto mentioned that the Green Map is non-polarizing as it has
one council member residing in each district.
Jeff Mathieu, City Manager, explained that Council would need to provide direction
on their selection of map today and reiterated that the Green Map has previously
been discussed as being the best option.
Mayor Pro Tem Putz stated that the inclusion and balance of City Landmarks and
other City elements are important in the maps and that there is not a lot of flexibility
given the size of our City.

Mayor Herrick stated that this change is not by choice and that Council is hoping
for a change in legislation in the future so we can go back to an at-large election
system.

For the past ten years, broad-based concepts for improvements to our community ranging from future
long-range planning and development projects to improving our community communications and
outreach have been presented to City Council in the form of Quality of Life Initiatives. These annual
presentations celebrate achievements in bettering our community, highlight projects underway or
prioritized for completion in the near term, and debut concepts for initiatives which require longer range
planning and preparation. The Quality of Life Initiatives completed and in process today are a credit to
the clearly stated Vision, Mission and Goals adopted by the City Council as the foundation for making
Big Bear Lake a great place to live, work and play while enhancing the environment, quality of life and
our economic vitality.
This year, our presentation will demonstrate how the foresight in establishing our Vision, Mission and
Goals has lead us down a sustainable path. To ensure we remain vigilant in the effort to preserve our
assets for future generations, we have memorialized this as our business plan in Attachment A,
Blueprint For Our Future . . . Sustainability. This document will be disseminated to members of the
public and media outlets and will be available on our website as a method of communicating to the
general public our business plan and to ensure that we continue to focus resources on projects that
improve our community in a sustainable manner.

SUBJECT: DISTRICT ELECTIONS - ORDINANCE ESTABLISHING BY-DISTRICT ELECTIONS, DEFINING DISTRICTBOUNDARIES, AND SCHEDULING ELECTIONS WITHINTHE DISTRICTS
BACKGROUND:
In 2003 the California Voting Rights Act (CVRA) became law. In an attempt to prevent thedisenfranchisement of protected classes of voters, the CVRA establishes attorney rights to seekout cities and request they convert from at-large to by-district elections. A number of publicagencies throughout the state have been sued under the CVRA, and Plaintiffs challenging at-large elections of legislative bodies such as city councils have generally prevailed in litigation. Infact, the City Attorney is unaware of any public entity which has prevailed in such a suit. Due tothe significant legal fees involved in these cases, more than 50 California cities, and many otherpublic agencies, have voluntarily transitioned, or are in the process of doing so, from at-large toby-district elections.
As a protection to limit attorney fees for prospective claimant cities, in 2016, AB 350 wasestablished and adopted. Under AB 350, Elections Code Section 10010 was amended to cap theattorneys’ fees a prospective plaintiff may recover if a public agency adopts a Resolution ofIntention to change to a by-district system within 45 days of receipt of a letter from thatprospective Plaintiff attorney alleging a CVRA violation. On September 26, 2017, the Cityreceived a letter from Kevin Shenkman, Esq., alleging that the at-large Council election systemdiluted the ability of certain protected classes of persons within Big Bear Lake to electcandidates of their choice (i.e. “polarized voting”) and demanding the city notify him of its intentto change to a by-district election system by November 10, 2017. In response, on November 6,2017, the City Council adopted Resolution No. 2017-33, a Resolution of Intention to transitionfrom at-large to by-district elections and directed the City Attorney to retain the services of ademographer to draw district maps.
Under AB 350, upon adoption of this Resolution, the City then had 90 days to complete thetransition process, during which time the public had at least five (5) opportunities to comment onthe proposal and the draft maps created by the demographer for potential voting districts. On

November 13, 2017 and November 16, 2017, the City held two public meetings to get input onpotential district maps. On December 4, 2017, two draft maps were posted on the City’s websitefor public review. On December 11, 2017 and December 14, 2017, two additional publichearings were held to solicit input on the draft maps and the proposed sequencing of elections.All public hearings were noticed in the Big Bear Grizzly.
If, at a future date, state law or the CVRA are revised, Council would have the option to return toan at-large voting system.
DISCUSSION
Polarized voting exists when voters of different racial or ethnic groups exhibit significantlydifferent candidate preferences in an election. Twenty seven percent (27%) of the City’s totalpopulation is non-White (21% Latino) and is spread relatively evenly throughout the City. Ananalysis conducted by a demographer concluded that there is no evidence of racially polarizedvoting in the City of Big Bear Lake and, therefore, no CVRA violation has occurred as a result ofthe City’s at-large elections. However, transitioning to by-district elections eliminates the risk ofa CVRA challenge, and the risk of a Plaintiff selected expert concluding to the contrary. Inaddition, voluntary transition eliminates the risk of a lawsuit that could place control of theCity’s electoral process in a court’s hands rather than in the hands of the City’s residents andelected officials.
The drawing of Council districts is regulated by both state and federal law, including FederalVoting Rights Act. For example, under federal law, Council districts may not be drawn with raceas the predominate factor (Shaw v. Reno (1993) 509 U.S. 630). In addition, under Elections CodeSection 21620, districts must be drawn as nearly equal in population as may be according to thelatest federal decennial census (i.e., at present, the 2010 census). The following factors may beconsidered in establishing such boundaries: topography, geography, cohesiveness, contiguity,integrity, and compactness of territory; and community of interest of the districts. In addition,the City Council may consider additional factors including respect for the prior electoral choicesof voters in the jurisdiction.
At the November 13 and November 16 public hearings, concerns were expressed about thepossibility of districts being balkanized. Balkanization would occur if the City was divided in away where each district could vote based on the interest of their district rather than the interest ofthe entire City. Given the small size of the City of Big Bear Lake, it was difficult to draw mapswhich had each district less than ten percent (10%) differential in population, and kept censusblocks intact within districts. In addition, it was the desire of the Council that business centers bebalanced within all districts. Therefore, based on input from the public and the City Council, two(2) maps were created by the City’s demographer. Both of these maps were made available forreview on the City’s website on December 4, 2017 (Attachment A).
Two public hearings were conducted on December 11 and 14 to review two proposed maps. Itwas the consensus of the public and the City Council that the “Green” map had thecharacteristics that were most important. On December 14, Council directed staff to moveforward with selection of the “Green” map for adoption. The City is long and linear and thedistricts were created in a linear manner; the districts were not balkanized and no one district had

undue influence in a particular area. Additionally, the “Green” map spread Commercial Businessareas throughout all districts, and the voter population was appropriately balanced on this map(Attachment B).
RECOMMENDATION:
It is recommended that Council take the following actions:1. Receive additional input regarding the proposed “Green” district map and the sequence of
elections; and,2. Introduce, waive first reading and pass to second reading an Ordinance amending the
Municipal Code and establishing by-district elections, defining district boundaries andscheduling elections within the districts.

ORDINANCE NO. 2017-XXX
AN ORDINANCE OF THE CITY COUNCIL OF THE CITYOF BIG BEAR LAKE, CALIFORNIA, ADDING SECTION1.12.050 TO CHAPTER 1.12 OF TITLE 1 OF THE CITY OFBIG BEAR LAKE MUNICIPAL CODE ESTABLISHING BY-DISTRICT ELECTIONS, DEFINING DISTRICTBOUNDARIES, AND SCHEDULING ELECTIONS WITHINTHE DISTRICTS
WHEREAS, the City of Big Bear Lake currently elects five Councilmembers using an at-large election system; and
WHEREAS, in response to threatened litigation regarding alleged non-compliance withthe California Voting Rights Act (“CVRA”), the City Council has determined that it is in the bestinterest of the City to shift from its current at large election system to a by-district election system;and
WHEREAS, on November 6, 2017, the City Council adopted Resolution No. 2017-33, aResolution declaring the City’s intention to transition from at-large to district-based electionspursuant to Elections Code Section 10010; and
WHEREAS, California Government Code section 34886 permits the City Council tochange the City’s method of election by Ordinance, with certain formalities, to a “by-district”system in which each Councilmember is elected only by the voters in the district in which thecandidate resides; and
WHEREAS, pursuant to California Government Code section 34886, it is declared that thepurpose of the change in the method of electing members of the City Council of the City of BigBear Lake made by this Ordinance is to implement the guarantees of Section 7 of Article I and ofSection 2 of Article II of the California Constitution, as set forth in Sections 14025 through 14032of the California Elections Code; and
WHEREAS, the City Attorney engaged an expert demographic firm to assist the City withthe process of analyzing the City’s population, developing draft maps, and gathering input fromresidents on the possible maps; and
WHEREAS, in accordance with Elections Code section 10010, the City Council held twopublic hearings to obtain input on any proposed district boundaries on November 13 andNovember 16, 2017; and
WHEREAS, on December 4, 2017, the City made two maps prepared by the demographeravailable on its website for public review; and
WHEREAS, on December 11 and December 14, 2017, the City Council held two furtherpublic hearings at which the public was invited to provide input regarding the content of the draftmaps and the sequence of elections; and

WHEREAS, at its December 14, 2017 meeting, the City Council provided direction to staffto bring back this Ordinance for the consideration of the City Council; and
WHEREAS, on January 8, 2018, the City Council introduced, read by title, and waivedfurther reading of this Ordinance; and
WHEREAS, the purpose of this Ordinance is to enact, pursuant to California GovernmentCode section 34886, an Ordinance providing for the election of the Members of the City Councilof the City of Big Bear Lake by-district in five single-member districts as reflected in Exhibit A tothis Ordinance.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BIG BEAR LAKEDOES ORDAIN AS FOLLOWS:
SECTION 1. Incorporation of Recitals. The above recitals are true and correct and areincorporated herein by this reference.
SECTION 2. By-District Elections. Section 1.12.050 is hereby added to Chapter 1.12 ofTitle 1 of the City of Big Bear Lake Municipal Code to read as follows:
“1.12.050 – By-District Elections.
A. By-District Elections. Pursuant to California Government Code section34886, Members of the City Council of the City of Big Bear Lake shall beelected by-district in five (5) single-member districts.
1. Members of the City Council shall be elected in the electoraldistricts established by subdivision B of this Section andsubsequently reapportioned as provided by State law. Electionsshall take place “by district” as that term is defined in CaliforniaGovernment Code section 34871, meaning one Councilmembershall be elected from each district, by the voters of that district alone.
2. A Councilmember elected or appointed to represent a district mustreside in that district and be a registered voter in that district, andany candidate for City Council must reside in, and be a registeredvoter in, the district in which he or she seeks election at the timenomination papers are issued.
3. Termination of residency in a district by a Councilmember shallcreate a vacancy for that City Council district unless a substituteresidence within the district is immediately declared and establishedwithin thirty (30) days after the termination of residency.
4. Notwithstanding any other provision of this Section, theCouncilmembers in office at the time this Section takes effect shallcontinue in office until the expiration of the term to which he or shewas elected. In the event a vacancy occurs before the expiration of

the term of a Councilmember in office at the time this Section takeseffect, a person who is appointed or elected by special election tofill such vacancy may reside anywhere within the corporateboundaries of the City. A person appointed or elected to fill such avacancy shall hold the office in accordance with the City Charterand applicable provisions of the City of Big Bear Lake MunicipalCode.
B. City Council Districts and District Elections. All five Councilmembersshall be elected on a “by-district” basis from the Council districts shownand numbered on the map titled ‘City of Big Bear Lake District Map’attached as Exhibit A, a copy of which shall be on file in the City Clerk’soffice. In 2018, and every four years thereafter, the following three CityCouncil districts shall be elected by-district: District 2; District 3; andDistrict 4. In 2020, and every four years thereafter, the following two CityCouncil districts shall be elected by-district: District 1 and District 5.
C. Amendment of District Boundaries. Pursuant to Elections Code section21601, as it may be amended from time to time, the City Council shall adjustthe boundaries of any or all of the districts following each decennial federalcensus to ensure that the districts are in compliance with all applicableprovisions of law.”
SECTION 3. CEQA. Based upon the whole of the administrative record before it, theCity Council hereby finds that a transition from at-large to by-district elections is exempt fromenvironmental review under the California Environmental Quality Act (“CEQA”) (Pub. ResourcesCode, § 21000 et seq.) pursuant to State CEQA Guidelines (Cal. Code Regs., tit. 14, § 15000 etseq.) sections 15061(b)(3), 15320, and 15378(b)(3). Adoption of this Ordinance is anorganizational and administrative activity of the City, does not have the potential to result in eithera direct or reasonably foreseeable indirect physical change in the environment, and is therefore nota project for purposes of CEQA. (State CEQA Guidelines, §§ 15061(b)(3); 15378(b)(5).) In theevent adoption of this Ordinance does constitute a project, it is categorically exempt under theClass 20 (Changes in the Organization of Local Governments) categorical exemption. (StateCEQA Guidelines, § 15320.) Further, none of the exceptions to the exemptions found in StateCEQA Guidelines section 15300.2 apply. Staff is hereby directed to prepare, execute and file withthe San Bernardino County Clerk a CEQA Notice of Exemption within five (5) working days ofthe adoption of this Ordinance.
SECTION 4. Severability. If any provision of this Ordinance or the application thereof toany person or circumstance is held invalid, such invalidity shall not affect other provisions orapplications, and to this end the provisions of this Ordinance are declared to be severable.
SECTION 5. Effective Date. This Ordinance shall become effective thirty (30) daysfollowing its adoption.

SECTION 6. Publication. The City Clerk shall certify to the adoption of this Ordinanceand shall cause a summary of the same to be published in the official newspaper of the City of BigBear Lake within fifteen (15) days following its adoption.
