Minutes of the Columbia County Tourist Development Council meeting held on Wednesday, February 20,

2013, 12 Noon, at the Columbia County Public Library West Branch, located at 435 NW Hall of Fame Drive,

lake City, Fl32055.

call to Order: Columbia County Tourist Development Council (TDC) chairman Ron Williams called the meeting

to order at 12:05 p.m. He thanked the TDC board members for attending and welcomed everyone to the

meeting.

Roll Call: TDC board members present included Brian Bickel, Scarlet Frisina, Cecil Shaw, Zach Paulk, Nick Patel,

Nupur Shukla and Ron Williams. Members unable to attend were Mike Collins and Mahendra Patel. A quorum

was present for the meeting. Staff included Paulette lord and Harvey Campbell.

Introduce Guests: Guests on hand for the meeting included County Commissioner Bucky Nash, Jack

Muenchen with Lake City/Columbia County Youth Baseball, Teena Peavey of Spirit of the Suwannee Music Park

and Karl Burkhardt with the Lake City Journal.

Staff Reports

ADDrove Minutes: Minutes were preViously distributed to all of the TDC members for review of the January

15, 2013, board meeting. A motion was made by Scarlet Frisina, second by Brian Bickel to approve the minutes

as presented. The motion was approved. The TDC board was also provided minutes of the joint County

Commission and TDC meeting held on the evening of January 15, for review and to note any corrections or

changes that needed to be made. None were noted.

Monthly financial report: The TDC board had copies of the January, 2013, print-out of expenditures delivered

to them as part of the overall agenda package for review. A motion was made by Scarlet Frisina, second by

Nupur Shukla, to acknowledge receipt of the budget expenditures print-out. The motion was approved.

Operations Update: Staff prOVided a brief update on activities and events that have recently occurred and

those which are upcoming in the near future. The Olustee Battle Festival and Reenactment was held this past

weekend and initial reports from the battlefield operations and Florida Park Service was that attendance was

down nearly 1,500 from 2012 (20,955 versus 19,584). Rain, wind conditions on Saturday and the extreme low

temperatures are thought to be contributing factors in the decline. Ms. Lord reported on the busy schedule of

tourism trade shows upcoming in the next five weeks. Details were provided to the board about requests for

vacation gUides as we mailed out more than 13,000 in 2012 and we received nearly 1,0000 requests earlier this

week. We will partner with North Florida Sales and Budweiser to provide shuttle bus service for the upcoming

Wanee Festival, April 18-20. Ms. Lord reported that the five VISIT FLORIDA grant applications are nearly ready

and will be submitted this week. Mr. Campbell reminded the board about the upcoming Tourism Day (March

13) in the legislature and invited participation from the board. A brief overview was also prOVided on the

Governor's proposed funding request for VISIT FLORIDA ($75 million), the status of the class action lawsuit

against the Online Travel Agencies (OTAs) and the issue with International Driver Permits and the status of that

controversy. He also reported on efforts by State Representative Elizabeth Porter to assist in making sure that

the state's rural counties are represented on the VISIT FLORIDA Board of Directors, since there is no

representation from those 33 counties at present.

Marketing Overview for 2012-13: Ms. Lord gave an overview of marketing plans that will be aimed at fans of

SEC schools that will be playing at the University of Florida this fall. Several new brochures are currently in

production and there will be plenty of planning to get ready for the 150'h anniversary of the Battle of Olustee

in February of 2014, including a television campaign targeting residents of the Atlanta area.

Old Business

Reappointments to the TDC Board: Mr. Campbell advised the TOC board that the Board of County

Commissioners had approved new three-year re-appointments for both Nick Patel and Mike Collins to the TDC.

Sports Calendar and Tournament Update: The TDC members were presented an updated sports calendar for

2013. At present, we have more than 20 baseball, softball, soccer, martial arts and cross-county events

scheduled. We hosted a 76 team tournament two weeks ago and expect 70 baseball teams this upcoming

weekend. It was noted that we will continue to rent portable restroom facilities as needed this year until the

new concession/restroom building are constructed. In addition, we are leasing portable LED changeable letter

signs when needed and also obtaining law enforcement assistance with the bigger tournaments.

New Business

Update on Status of Expenditures/Progress on Upgrades at Southside Recreation Complex: Jack Muenchen

and County Commissioner Bucky Nash provided an update for the TOC board on efforts to upgrade the

facilities at the Southside Recreation Complex. Mr. Muenchen reported that three bids had been received for

engineering work with the quotes ranging from $6,000 up to $19,000. The low bidder was accepted. Bids are

now being solicited for the three new concession/restroom buildings and work should begin later this week on

sidewalks. In addition, bids came in under-budget for the 40 sets of new bleachers. Mr. Muenchen and

Commissioner Nash will be providing monthly updates on the improvements and budget matters associated

with the work.

Discussion/Decision to Approve Increase in Bed Tax Levy and New Ordinance: The TOC board was presented

with Ordinance No. 2013-1 which was an amendment to Ordinance 84-1 relating to Local Option Tourist

Development Tax and the imposition of an additional one percent Tourist Development Tax. Mr. Campbell

said this would be one of two ordinances the TOC would be asked to approve with that recommendation then

going to the Board of County Commissioners. A public hearing will be held at the commission meeting,

Thursday, Feb. 21, 5:30 p.m., to consider the proposed 1% increase in the bed tax (that was approved). A

motion was made by Nick Patel, second by Brian Bickel to approve the ordinance as presented. The motion

was approved.

Adjournment: There being no additional business to come in front of the TOC board at this time. a motion was

made by Scarlet Frisina to adjourn the meeting at 1:15 p.m. Chairman Williams declared the meeting

adjourned.

WHEREAS, pursuant to Section I25.0104(3)(c), Florida Statutes, known asthe "Local Option Tourist Development Act", in 1984 the Columbia County Boardof County Commissioners ("Board") enacted Ordinance 84-1 which authorized thecollection of two percent of tourism development tax per dollar exchanged oncertain short term lodging rental transactions countywide; and

WHEREAS, the Board adopted Ordinance 2009-16 in December, 2009 toauthorize the imposition and collection of an additional one percent touristdevelopment tax for the purpose of promoting and advertising its tourism industry,nationally and internationally, and to acquire, construct, extend, enlarge, remodel,repair, improve, maintain, operate, or promote a county convention center, a touristinformation center, and the Florida Sports Hall of Fame Museum; and

WHEREAS, the Board adopted Ordinance 2013-1 in February, 2013 toauthorize the imposition and collection of an additional one cent for a total of fourcents per dollar in tax for the purpose of promoting and advertising its tourismindustry, nationally and internationally; and

WHEREAS, the Columbia County Tourist Development Council hassubmitted to the Board a recommended amendment to the County's TouristDevelopment Plan; and

WHEREAS, the Board hereby finds that the amended Tourist DevelopmentPlan is an effective and reasonable plan for the promotion of tourism in the county.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OFCOUNTY COMMISSIONERS OF COLUMBIA COUNTY, FLORIDA:

Section 1. AMENDMENT TO SECTION 106-262 OF THECOLUMBIA COUNTY CODE OF ORDINANCES.

Section 106-262, Columbia County Code of Ordinances is hereby repealedand replaced in its entirety as follows:

Sec. 106-262. - Tourist development plan.

(a) Revenue projections. The tax revenues pursuant to this section for the nextfiscal year and thereafter until amended by the Board shall be used to fundthe implementation of the Columbia County Tourist Development Plan,which is hereby adopted as follows:

The anticipated annual revenues to be produced by the tourist developmenttax as identified herein in parenthesis for each budget category is providedas an annual total based on past collection trends projected forward. Theprojected revenues are estimates and may vary from those identified herein.The amounts shown have already been reduced by the costs ofadministration retained by the Development of Revenue pursuant to its localtax administration authority under the provisions of Columbia CountyOrdinance 84-1 and Section 106-261(f) above.

(b) Tourist development plan. The Board hereby determines that the touristdevelopment plan shall be comprised of the following broad goals andobjectives and makes the following findings of fact:

(I) Tourism promotion. The tourism related economy within ColumbiaCounty generates direct and indirect revenue to businesses within thecounty. Accordingly, tourism is essential to a healthy economy, growthof business development and increased employment opportunities forCounty residents. The County has worked diligently on the developmentand maintenance of quality advertising, marketing and public relationsinitiatives for the county which presents a consistent and positive brandfor the area. This branding is essential to the development of this sectionof the economy and the County will work towards the development andimplementation of unified marketing campaigns. Within the guidelinesset forth herein, the campaigns shall be conducted with funding levelsdesigned to achieve maximum positive promotional exposure to potentialvisitors. The primary objective for the campaigns shall be themaintenance of consistent positive "branding" which includes, but is notlimited to, a focus on nature-based and heritage tourism.

The support for a variety of special events is another productive means tofurther the development of year round business and bolster image andname recognition for the County. Funds may be allocated on an annualbasis for support of special events. The development of a visible andprofessional support community for local production of film andadvertising projects is a positive investment both in the overall brandingfor the County.

(2)Facilities development. The County's Southside Recreation Complexserves to promote tourism in the County through the development ofregional sports tournaments, which are an effective means of developingyear-round business in the County. The County's Welcome CenterIHallof Fame Complex serves to promote tourism in the County by providingtourists with information and services which allow greater access andenhanced enjoyment of natural assets and other tourist destinationfacilities within the County.

(3)Administration. The County determines that the best means foradministration of the tourist development tax revenues allocated underthis Plan is local administration by the TDC Director and other mcpersonnel.

(c) Tax revenue projections and allocations. Pursuant to the requirements ofSection 125.0104(4), F.S., the tax revenues collected pursuant to thisOrdinance shall be used to fund the goals and uses identified in theColumbia County Tourist Development Plan as set forth above. Theallocation shall begin Fiscal Year 2012-2013 and shall continue forsubsequent fiscal years until amended by the Board.

(l)For the revenues generated by the first percentage point on each dollar,for each year beginning with Fiscal Year 2012-2013, the allocation shallbe as follows:

a. To acquire, construct, extend, enlarge, remodel, repair,improve, maintain, operate, or promote one or more publiclyowned and operated convention centers, sports stadiums,sports arenas, coliseums, auditoriums, aquariums, ormuseums that are publicly owned and operated or ownedand operated by not-for-profit organizations for which thereis public access, including but not limited to the SouthsideRecreation Complex. (24 month projected revenue total, netof administrative charges, is $420,000.

b. To the extent that such proceeds are not required for thoseuses, then such proceeds may be used for any other purposesauthorized under Section 125.0104(5), Florida Statutes, asdirected by the Board.

(2)For the revenues generated by the second percentage point on eachdollar, for each year beginning with Fiscal Year 2012-2013, theallocations shall be as follows:

a. To fund tourist bureaus and tourist information centers, suchas the Welcome Center/Hall of Fame Complex, as countyagencies or by contract with the chamber of commerce orsimilar associations in the county, which may include anyindirect administrative costs for services performed by thecounty on behalf of the promotion agency. (24 monthprojected revenue total, net of administrative charges, is$420,000.

b. To the extent that such proceeds are not required for thoseuses, then such proceeds may be used for any other purposesauthorized under Section 125.0104(5), Florida Statutes, asdirected by the Board.

(3)For the revenues generated by the third percentage point on each dollar,for each year beginning with Fiscal Year 2012-2013, the allocation shallbe as follows:

a. To promote and advertise tourism in the State of Florida andnationally and internationally. (24 month projected revenuetotal, net ofadministrative charges, is $420,000.

b. To the extent that such proceeds are not required for thoseuses, then such proceeds may be used for any other purposesauthorized under Section 125.0104(5), Florida Statutes, asdirected by the Board.

(4)For the revenues generated by the fourth percentage point on each dollarfor each year beginning with Fiscal Year 2012-2013, the allocation shallbe as follows:

a. To promote and advertise tourism in the State of Florida andnationally and internationally. (24 month projected revenuetotal, net of administrative charges, is $420,000.

b. To the extent that such proceeds are not required for thoseuses, then such proceeds may be used for any other purposeauthorized by Section 125.0104(3) (I) 1, 2, or 3, FloridaStatutes, as directed by the Board.

(d) The above and foregoing Tourist Development Plan may not be substantiallyamended except by ordinance enacted by an affirmative vote of a majorityplus one additional member of the Board.

Section 2. SEVERABILITY.

In the event any provision of this Ordinance or the application thereof to anyperson or circumstance is held invalid, it is the intent of the Board that suchinvalidity shall not affect any other provisions of the Ordinance which may begiven effect without the invalid provision or application and, to this end, theprovisions of this Ordinance are declared severable.

Section 3. INCLUSION IN THE COLUMBIA COUNTY CODE OFORDINANCES.

The provisions of this Ordinance shall become and be made a part of theColumbia County Code of Ordinances. The sections of the Ordinance may berenumbered or relettered to accomplish such, and the word "Ordinance" may bechanged to "Section", "Article", or other appropriate word.

Section 4. CONFLICTS.

All Columbia County Ordinances in conflict with any provision of thisOrdinance are hereby repealed to the extent of the conflict.

Section S. EFFECTIVE DATE OF ORDINANCE.

A certified copy of this Ordinance shall be filed with the Department ofState by the Clerk of the Board of County Commissioners within ten (10) daysafter enactment by the Board and shall take effect upon its filing with theDepartment of State as provided by law.

TOURIST DEVELOPMENT TAXTHE LAW

Florida Statute allows for initial collection of a 20/0 levy onovernight accommodations at hotels, motels, campgroundsand other short term transient lodging. Apartmentcomplexes are liable for charging and collecting of the bedtax, unless a lease for a length of six months or longerexists.(Section 125.0104(3)(c), Florida Statutes)

After an initial term of two-years, a county may raise thebed tax to 3% by a super majority vote of the countycommission. (Section 125.0104(3)(d), Florida Statutes)

RE: Hours of Sale - Alcoholic Beverages

As you are aware, most counties adjoining Columbia County have successfullycompleted referendums allowing for the sale of alcoholic beverages. Once the saleof alcoholic beverages is approved, th~ hours of sale are regulated by Ordinance.It has been suggested that Columbia County review its Ordinance regulating hoursof sale with those of neighboring counties. A copy of Article n Hours of Sale fromthe county's alcoholic beverage ordinance is attached. Also attached is a surveypertaining to Sunday sales by restaurants.

From the material provided it would appear that Columbia County has a morerestrictive ordinance than neighboring counties: therefore, local businesses are ata disadvantage. r am requesting that you review the materials proVided. It is myintention to request that a Public Hearing be set ta discuss a change in the hoursof sale permitted for alcoholic beverages in Columbia County. Specifically, I willask thot Sunday liquor sales be allowed in restourants.
