Dallas County COURT ORDER / BRIEFING Commissioners Court - Jan 07 2020 Resolution Solicitation/Contract Executive Session Addendum City of Dallas Interlocal Cooperation Contract for Sale of Tax Foreclosed Properties for the Land Transfer Program Pursuant to Texas Tax Code, §34.051 Briefing Date: Jan 7 2020 Funding Source: N/A Originating Department: Public Works Prepared by: Jurmerline Randle, Foreclosed Property Specialist Recommended by: Alberta Blair, Director of Public Works BACKGROUND INFORMATION: The City of Dallas (“City”) City Council adopted the Comprehensive Housing Policy (CHP) on May 9, 2018 that set citywide production goals for homeownership and rental units for the next three years along with respective income bands that will be prioritized within such production goals; and set forth various programs, tools and strategies to be used to meet such production goals while also overcoming concentrations for poverty and racial segregations by Resolution No. 18-0704. On November 28, 2018, the City Council adopted by Resolution No. 18-1680, amendments to the CHP that resolved inconsistencies in program requirements, corrected items that were inadvertently included in or omitted from the CHP and modified requirements that had created programmatic constraints. In order to fully implement the Land Transfer Program, the City proposes to enter into an interlocal agreement with Dallas County, the Dallas County Hospital District, the Dallas County Community College District, the Dallas Independent School District, and the Commissioners Court of Dallas County on behalf of the former Dallas County Schools District to allow the City to resale tax foreclosed properties to qualified non-profit or for-profit developers, for a purpose consistent with the City’s urban redevelopment plans or the City’s affordable housing policy in accordance with Section 34.051 of the Texas Tax Code. The interlocal agreement will be for a six-year term with two renewal options of two years each. This Interlocal Cooperation Contract (“Agreement”) concerns the City’s inventory of tax foreclosed properties that are either vacant or distressed and has a tax delinquency of six (6) or more years that will be used only for a purpose consistent with an urban redevelopment plan or affordable housing policy, as applicable, that is primarily aimed at providing housing for families of low or moderate income. The principal goal of this Agreement is to provide an efficient mechanism for returning deteriorated or unproductive properties to the tax rolls thereby enhancing the value of ownership to the surrounding properties, and improving the safety and quality of life in deteriorating neighborhoods. County that the City intends to be subject to the terms of this Agreement. Dallas County will have sixty (60) calendar days of receipt of the proposed list to approve or disapprove the list or any property therein. Unless Dallas County notifies the City of its disapproval of the proposed future list or of any property on the list within the sixty (60) day period, the City will implement this Agreement with regard to the tax foreclosed properties on the list. Each future list of properties will be incorporated by reference, as if fully reproduced therein, to this Agreement as Attachment “A”. Dallas County will review each property and submit the necessary documentation to the Commissioners Court for the required specific consent. FINANCIAL IMPACT: By execution of the Agreement, Dallas County agrees to consider the proposed list of properties in Attachment “A”, attached, that the City intends to be subject to the terms of this Agreement, and only those tax foreclosed properties where (1) the City takes title as trustee taxing unit to the property and (2) the property is either vacant or distressed and has a tax delinquency of six (6) or more years. The City’s sales price for the approved list of tax foreclosed parcels sold via the CHP Land Transfer Program will be a fixed price of $1,000 for up to 7,500 square feet of land purchased under a single proposal, plus $0.133 for each additional square foot of land purchased under the proposal. If land is sold pursuant to Dallas City Code Section 2-26.4, the sales price set forth in the ordinance applies. The redeveloped properties will lead to the revitalization of deteriorated neighborhoods and the resulting increase in property values. The long-term payment of property taxes by the new owners and/or the improvements to the neighborhoods will more than offset the sale of the properties for reduced amounts. LEGAL IMPACT: Pursuant to Texas Tax Code, §34.051 (Resale by Taxing Unit for the Purpose of Urban Redevelopment) a municipality is allowed to resale tax foreclosed property for less than the market value specified in the judgment of foreclosure or less than the total amount of the judgments against the property if consent to the conveyance is evidenced by an interlocal agreement between the municipality and each taxing unit that is party to the judgment, provided, however, that the agreement includes the following: (1) a general statement and goals of the municipality's urban redevelopment plans or affordable housing policy, as applicable; (2) a statement that the interlocal agreement concerns only tax foreclosed property that is either vacant or distressed and has a tax delinquency of six or more years; (3) a statement that the properties will be used only for a purpose consistent with an urban redevelopment plan or affordable housing policy, as applicable, that is primarily aimed at providing housing for families of low or moderate income; (4) a statement that the principal goal of the interlocal agreement is to provide an efficient mechanism for returning deteriorated or unproductive properties to the tax rolls, enhancing the value of ownership to the surrounding properties, and improving the safety and quality of life in deteriorating neighborhoods; and (5) a provision that all properties are sold subject to any right of redemption. The Dallas County District Attorney’s Office has reviewed and approved the Agreement as to form PROJECT SCHEDULE: N/A SBE PARTICIPATION: N/A ADMINISTRATIVE PLAN COMPLIANCE: The Agreement is consistent with Dallas County Vision: Dallas County is the destination of choice for businesses and residents, by providing an efficient mechanism for returning deteriorated or

unproductive properties to the tax rolls, enhancing the value of ownership to surrounding properties, improving safety and quality of life in deteriorating neighborhoods. Attached is a map, Exhibit “A”, showing the location of the properties in the various neighborhoods within each Commissioners District. RECOMMENDATION: Enter into the Interlocal Cooperation Contract for the Land Transfer Program in compliance with Texas Tax Code §34.051 (Resale by Taxing Unit for the Purpose of Urban Redevelopment) for a six-year term with two renewal options of two years each, allowing the use of tax foreclosed properties that are either vacant or distressed and have tax delinquencies of six or more years, for which the City takes title as trustee taxing unit, to be used only for a purpose consistent with the City’s urban redevelopment plans or the City’s affordable housing policy as set forth in the Comprehensive Housing Policy (CHP), adopted by Resolution No. 18-0704 on May 9, 2018 and adopted the amendments to the CHP by Resolution No. 18-1680 on November 28, 2018. Authorize the County Judge to execute the attached Interlocal Cooperation Contract for Dallas County and for the Commissioners Court of Dallas County on behalf of the former Dallas County Schools District, approving the same. Consents in its own behalf, and for the Commissioners Court of Dallas County on behalf of the former Dallas County Schools District to the resale of 497 of 501 of the proposed list of tax foreclosed properties struck-off to the City of Dallas as trustee taxing unit listed on Attachment “A”, attached. The following properties are excluded from this approval: 3331 Beall Street, 422 N. Denley Drive, 4709 Dolphin Road, and 2021 Life Avenue (duplicate listing).
