Recommendations for Council action

NOTE and FILE the Los Angeles Police Department (LAPD) report relative to progress onfunding and backfil! of sworn positions assigned to the LAPD, inasmuch as this report issubmitted for information and no Council action is necessary.

INSTRUCT the LAPD to report back in 60 days on the effect of promotions in the SouthBureau area, the methods the LAPD is using to promote officers, and vacancies andstatus of tratfic assignments.

Fiscal lmpact Statement: None submitted by the LAPD. Neither the City Administrative Officer(CAO) nor the Chief Legislative Analyst (CLA) has completed a financial analysis of this report.

Summary:

On October 8,2004, the City Council approved a joint Budget and Finance Committee and PublicSafety Committee report relative to funding for LAPD sworn positions. The report instructed theLAPD to report back on a monthly basis on the status of the backfilled positions, to ensure thatfield and supervisory positions are being filled as opposed to administrative positions and for the

. CAO to work with the LAPD to identify budgetary priorities and 6fficiencies. The LAPD report' dated June 15, 2005 is the latest report Uac[ coniaining this information.

At its regular meeting on July 11, 2005, the Safety Committee discussed this matter. Lengthydiscussion ensued, including questions and concerns relative to promotions in the South Bureauarea, the Department's methods used in promoting officers, and the vacancies, if there are any,in the traffic assignments citywide. The Public Safety Committee recommended that the LAPDreport be noted and filed and that the Department report back in 60 days on the effect ofpromotions in the South Bureau area, the methods the LAPD is using to promote officers, andvacancies and status of traffic assignments. On-September 20,2005, the Budget and FinanceCommittee concurred with the Public Safety Committee. This matter is now being forwarded toCouncil for consideration.

As instructed in Council File No. 04-1942, Budget and Finance and Public Safety Committees'Report dated October 19,2004, the Los Angeles Police Department has prepared the attachedreport detailing progress on backfill of sworn positions assigned to the Los Angeles PoliceDepartment. This report will be updated and submitted on a monthly basis.

RECOMMENDED ACTION

1. That the Board approve and transmit the attached monthly report to the Budget and Financeand Public Safety Committees.

DISCUSSION

As instructed in Council File No. 04-1942, Budget and Finance and Public Safety CommitteesReport dated October 19,2004, the Los Angeles Police Department has preparedthe attachedreport detailing progress on backfill of sworn positions assigned to the Los Angeles PoliceDepartment. This report will be updated and submitted on a monthly basis.

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

1. EXEMpT from the hiring treeze those positions identified as promotions on Attachment I

of this report, and APPROVE backfitl authority for any vacancies created due to thesepromotions in the classifications of Lieutenant l, Sergeant l, and Police Officer lll.

INSTRUCT the Ciry Administrative Officer (CAO) to develop a report that identifies LAPD

administrative versus operational positions.

INSTRUCT the LAPD to report back on a monthly basis to the Public Safety and Budge!

and Financb Committees on the status of the backfilled positions, to ensure that field and

superuisory positions are being filled as opposed to administrative positions.

INSTRUCT the CAO to work with the LAPD to identify budgetary priorities and efficienciesfor the LAPD, and provide a status report every 30 days to the Budget and Finance

Committee

SUMMARY

At a joint meeting of the Budget and Finance and Public Safgly Committees, on October 5,2004,'the Committees ionsidereO JCnO repoil, dated Septembe r 27 ,2004, relative to funding for LAPD

r*orn promotions throughout the Department. The.qAo is recommending approval of a hiring

treeze exemption for 184 specific positions with backfill authority tor 77 positions.

The Los Angeles police Commission (Commission) had requested.funding.for a total.of 295

promotions it a cost of $1,783,595. The CAO, while supportive of the.need for promotions in

order to fill critical positions and provide adequate oversight and s^u.pervjsion, reported that only

the most critical positions should be filled at ihis time due to the City's financial constraints. ln

working with the LRpo, 184 positions were identified which the CAo recommends should be filled

througfl promotions at this time. These include positions needed to ensure compliance with the

Consent Decree, poiitionr where failure to appoint may result in.a grievance or lawsult, and

positions that provide sJperuision for the rank and fite employeeP. The CAO has also worked with

the LApD to schedule these promotions in phases in order to lessen the financial impact. The

total cost of the 184 recomm6nded promotions would be $964,006.

The CAO reported thatthe Commission has also requested backfill authority and funding.forthesepositions d6wn to the police Officer ll level. The CAO expressed support for providing some'backfill

authority and funding but did not support providing blanket.backfill authority down to thepolice Officer lilevel. fne CnO recommended that backfill authority only be provided for those

positions that could clearly be identified as fleld superuisory positions. This would be the case for

iositions in the classes of Lieutenant l, Sergeant t, and Police Officer lll. The CAO therefore

recommended that funding and backfill for positions in the field supervisory classifications that

become vacant due to promotions be approved.

During the Committees' discussion, the LAPD iequested baokfilt authority.for.three.additionalpositiSns: backfill of a Captain I position resulting from filling of a C.apt"!! !t position in Jail

birision, backfiil of a Consent Decree mandated Captain ll position, and backfillof a Commanderposition vacated due to a Deputy Chief promotion. The LAPD reported its commitment to

prioritizing the filling of operational assignments but stressed the critical nature of these three

bOOition"I assignmints. The Cqmmitt-ees recommended that the three additiona! backfill

authorities be ipproved. The Department was told that the Committees wanted to let the

Department managers manage the bepartment, butthatthe Comrnittees wanted to see positions

left vacant that are"not needet, that positions that are filled are really needed, either supervisory

or direct field positions, and that the Department is looking at the budget on a month to month

basis. The Committge instructed the CAO to deVelop a report that identifies LAPD administrative

versus operational positions and asked the LAPD io report ba.ck to both the Public Safety and

Budget and Finance Committees on a monthly basis to ensure that only operational positions are

being filled.

The Budget and Finance and Public Safety Committees concurred with the CAO

recommeidations as amended to include the three additionalbackfillauthorities requested bythe

LApD. The total recommended appropriation for the LAPD swgrn promotions and backfill

authority was amended to $1 ,519,294: Tie CAO additionally amended.its rep_ort recommendation

numbei two to have the funds appropriated from the Unappropriated Balance, Workforce

BUDGET AND FINANCE and PUBLIC SAFETY COMMITTEES' REPORT relative to funding forLos Angeles Police Depaftment (LAPD) sworn promotions.

Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR:

1. EXEMPT from the hiring freeze those positions identified as promotions on Attachment I

of this report, and APPROVE backfill authority for any vacancies created due to thesepromotions in the classifications of Lieutenant !, Sergeant l, and Police Officer lll.

APPROVE the backfill authority for three additional positions as identified by the LAPD onAttachment l! of this repoft.

APPROPRIATE $1,519,294 from the Unappropriated Balance, Workforce DisplacementMitigation line item, to Fund No. 100, Department No. 70, Police Department, Salaries-Sworn Account No. 1012.

INSTRUCT the City Administrative Officer (CAO) to develop a report that identifies LAPDadministrative versus operational positions.

INSTRUCT the LAPD to report back on a monthly basis to the Public Safety and Budgetand Finance Committees on the status of the backfilled positions, to ensure that field andsupervisory positions are being filled as opposed to administrative positions.

INSTRUCT the CAO to work with the LAPD to identify budgetary priorities and efficienciesfor the LAPD, and provide a status repoft every 30 days to the Budget and FinanceCommittee.

Fiscal lmpact Statement: The CAO reports that there are insufficient funds within the PoliceDepartment's budgetto fund these promotions. There will be a $1,519,294 impactto the GeneralFund.

SUMMARY

At a joint meeting of the Budget and Finance and Public Safety Committees, on October 5,2004,the Committees considered a CAO report, dated September27,2004, relativetofunding for LAPDsworn promotions throughout the Department. The CAO is recommending approval of a hiringfreeze exemption for 184 specific positions with backfill authority for 77 positions.

The Los Angeles Police Commission (Commission) had requested funding for a total of 295promotions at a cost of $1,783,595. The CAO, while supportive of the need for promotions inorder to fill critical positions and provide adequate oversight and superuision, reported that onlythe most critical positions should be filled at this time due to the City's financial constraints. lnworking with the LAPD, 184 positions were identified which the CAO recommends should be filledthrough promotions at this time. These include positions needed to ensure compliance with theConsent Decree, positions where failure to appoint may result in a grievance or lawsuit, andpositions that provide superuision forthe rank and file employees. The CAO has also worked withthe LAPD to schedule these promotions in phases in order to lessen the financial impact. Thetotal cost of the 184 recommended promotions would be $964,006.

The CAO reported thatthe Commission has also requested backfill authority and funding forthesepositions down to the Police Officer ll level. The CAO expressed support for providing somebackfill authority and funding but did not suppoft providing blanket backfill authority down to thePolice Officer ll level. The CAO recommended that backfill authority only be provided for thosepositions that could clearly be identified as field superuisory positions. This would be the case forpositions in the classes of Lieutenant l, Sergeant l, and Police Officer lll. The CAO thereforerecommended that funding and backfill for positions in the field supervisory classifications thatbecome vacant due to promotions be approved.

During the Committees' discussion, the LAPD requested baokfill authority for three additionalpositions: backfill of a Captain I position resulting from filling of a Captain ll position in JailDivision, backfill of a Consent Decree mandated Captain ll position, and backfill of a Commanderposition vacated due to a Deputy Chief promotion. The LAPD reported its commitment toprioritizing the filling of operational assignments but stressed the critical nature of these threeadditional assignments. The Committees recommended that the three additional backfillauthorities be approved. The Department was told that the Committees wanted to let theDepartment managers manage the Department, butthatthe Committees wanted to see positionsleft vacant that are not needed, that positions that are filled are really needed, either superuisoryor direct field positions, and that the Department is looking at the budget on a month to monthbasis. The Committee instructed the CAO to develop a report that identifies LAPD administrativeversus operational positions and asked the LAPD to report back to both the Public Safety andBudget and Finance Committees on a monthly basis to ensure that only operational positions arebeing filled.

The Budget and Finance and Public Safety Committees concurred with the CAOrecommendations as amended to include the three additional backfill authorities requested bytheLAPD. The total recommended appropriation for the LAPD sworn promotions and backfillauthoritywasamendedto$1 ,519,294. TheCAOadditionallyamendeditsreportrecommendationnumber two to have the funds appropriated from the Unappropriated Balance, WorkforceDisplacement Mitigation line item. This matter is now fonnrarded to the Council for itsconsideration.

Subject: REQUEST FOR FUNDING FOR SWORN PROMOTIONS

SUMMARY

The Chair of the Public Safety Committee requested our Office to report on the attached letter(Attachment l) from the Police Commission (Commission) regarding funding for sworn promotionsthroughout the Police Department (Department). As part of this letter, funding was requested forsworn promotions to fill fixed post positions at the new North Valley Police Station (North Valley).However, a separate letter was sent to the City Council from the Police Department dated August 18,2004 regarding staffing needs for North Valley. Therefore, our Office has issued a separate reportregarding staffing and funding needs for North Valley, and this report will only address requestedfunding for all other sworn promotions, excluding North Valley.

The Commission requested a total of $12,383,204 for a combination of promotions/paygradeadvancements ($1,783,595), backfilling of vacancies created by the promotions ($5,1 19,770) andsalary step increases ($5,479,839). Due to the fact that the amount needed for salary step increasesmay fluctuate depending on a variety of factors, including the number and timing of promotions, werecommend that funding for the salary step increases be deferred at this time. Our Office willcontinue to monitor the Department's sworn salary account and make recommendations on thisissue as appropriate through the monthly financial status reports.

The Commission requested funding for a total of 295 promotions at a cost of $1 ,783,595. While ourOffice is supportive of the need for promotions in order to fill critical positions and provide adequateoversight and supervision, we feel that only the most critical positions should be filled at this time dueto the City's financial constraints. In working with the Department, we have identified 184 positionswhich we recommend should be filled through promotions at this time. They include positions neededto ensure compliance with the Corisent Deciee, positions where failure to appoint may result in agrievance or lawsuit, and positions that provide supervision for the rank and file employees (SeeAttachment ll). We have also worked with the Department to schedule these promotions in phasesin order to lessen the financial impact. The total cost foithe 184 recommended promotions would be$964,006. The Commission has also requested backfill authority and funding for these positions down to thePolice Officer ll level. While our Office is supportive of providing some backfill authority and funding,we do not support providing blanket backfill authority down to the Police Officer ll level. Werecommend that backfill authority only be provided forthose positions that could clearly be identifiedas field supervisory positions. This would be the case for positions in the classes of Lieutenant !,

Sargeant !, and Police Officer lll. Therefore, we recommend thatfunding and backfillfor positions inthe field supervisory classifications that become vacant due to promotions be approved. However,due to the uncertainty of where the vacancies would occur for any other promotions that would bemade, we recommend that the decision to grant any additional requests for backfill be deferred untilthe promotions have occurred. At that time, it should be possible to determine whether the backfillvacancies are in criticalfield positions.

lf backfill authority is granted for the classifications of Lieutenant l, Sargeant l, and Police Officer lll,that would allow for the backfill of 77 positions associated with these promotions, at a cost of$364,858. This would provide for a total number of 26l promotions and backfills, at a total cost of$1,328,864.

RECOMMENDATIONS

That the City Council, subject to the approval of the Mayor:

Approve an exemption from the hiring freeze for those positions identified as promotions onAttachment Il of this report and approve backfill authority for any vacancies created due tothese promotions in the classifications of Lieutenant l, Sargeant l, and Police Officer lll.

Authorize the transfer of $1,328,864 from the Reserve Fund to the Unappropriated Balanceand appropriate therefrom to Fund 100, Department 70, Police Department, Salaries-SwornAccount No. 1012.

FISCAL IMPACT STATEMENT

As there are insufficient funds within the Police Department's Budget to fund these promotions, therewill be a $1,328,864 impact to the General Fund.

that are vacant are having a direct impact on the level of manageme,lrt oversight and directpupervision of personnel. Litigation filed against the Crty, as a result of law enforcJment relatedactivity, often involves high monetary exposure. It is critical that these promotions and pay grade advancements are made with sufficient time toallow for the mandated raining required by ihe Federal Consent Decree and the Departnent. Thishaining will assist in preparing the promoted managers and supervisors to exercise theresp onsibilities of their respective positions.

Upon personnel being promoted and given pay grade advancements, it is imperative that theDeparhnent begn to back fiIl these positions. As you are aware, the time that is necessary to provideformal taining in the Police Academy and subsequent field tuaining program limits the ability of anew officer to function with a Field Training Officer. The funding necessary to provide the backfillis $5,119,770.

The last area.of funding requested is for merit salary step increases for Fiscal Year 2004-2005.These fimds were not included in the Deparhnent budget that resulted in the Deparfrnent beginningthe fiscal year in a budget deficit. The funds necessary to provide for merit salary step increases are
