Homeowners facing a major financial hardship that could lead to a foreclosure may work with a lender

to get a loan modification sometimes called a mortgage modification, workout plan or restructuring which will change the terms of the mortgage loan so the borrower can afford the payments. To do this, the lender may allow the homeowner to refinance the loan, pay a lower interest rate, extend the term of his loan, skip payments and add them to the total loan amount or roll past-due payments into the total loan amount.

Under mortgage modification, borrower reach an agreement with mortgage lender to change the original terms of his mortgage such as payment amount, length of loan, interest rate, in most cases, when your mortgage is modified, you can reduce your monthly payment to a more affordable amount.

Any change to the original terms of the loan is called a loan modification therefore if you

1. Firstly, get the copy of title from the vendor or owner to conduct an official search at the District/ County Lands Office to investigate the title. This will establish the following, among other details:-• The registered owner• Size of the land• Registry Index Map sheet number• Tenure details i.e freehold or leasehold• Encumbrances charged to the title – bank security • Lease term and commencement date, to ascertain the remaining lease term (Usually more than 40 years is appropriate)• Caveats and cautions restricting the sale of the subject land.2. If the land is located in an urban area, conduct a search at the County Government (formerly Local Government) offices to determine authenticity as well as the land rates payable and outstanding rates. Before any sale of such land, a Rates Clearance Certificate must be obtained from the Rates Department. Many people assume this part.

I know I had promised the lazy guys a Nairobi hotspots map in this part, but seems like I was also bitten by the lazy

bug. Okay, I forgot! Apology accepted? Thanks. Anyway, I realized that I made assumptions that when you are looking for the best property deals, you are already conversant with the due diligence process. I advise that you should engage a property consultant to do this for you; at least so that you can have someone to blame if anything goes wrong. However, if you are a serial penny-pincher, who doesn’t want to pay professional fees, like many of my friends, then this article will give you the basics. You see, I do not discriminate. I want to share some of the rules of thumb that you need to consider before putting in your hard earned money in property. You understand that unlike your normal goods and services, real estate requires a substantial initial capital investment, which means that you must get it right from the beginning. Here we go…

Also confirm the user of the land, whether it is residential, agricultural, industrial etc. It’s important to note that if it is an agricultural land then a Consent Certificate from the County Land Control Board must be obtained to allow the purchase or sale. 3. Get a Survey Map, known as the Registry Index Map (R.I.M), or an FR from the County Survey office to ascertain that the said property is located on the ground as the said map. In cases where there is a sub-division on a parent plot and the same is not amended on the survey map, then a Mutation (Map) Form is acquired to ascertain the subdivisions.

4. Visit the subject property and do a general survey of the area to establish whether there are any rights of passage through the land (this is not normally recorded in the title document or map); whether squatters have built on the land as it might be costly to get rid of them; and, most importantly, whether you like it! I know friends who have bought land without going to the property, because

they were promised heaven and when they finally visited, they came back with horror stories. 5. Do a search at the court registries via the Kenya Law Reports (www.Kenyalaw.org) to ascertain whether there are any unresolved disputes or cases that may not have been recorded in the title search certificate.

After doing all this, it is still important to do a background check of the vendor. Check whether the vendor has the capacity to sell the land• If he is a trustee, then check the Trust Deed to confirm that he has the power to lease or sell the land

• If it is a Limited Company, ascertain from the Memorandum and Article of Association if it has the necessary powers from its objectives to sell or lease the property. Do a search at the Companies Registry to confirm the directorship and shareholding. Note that any sale agreements should be signed and sealed by the designated directors.• If the registered owner of the land is deceased, then ensure that the personal representatives of the deceased have Grant of Probate (Where there is a Will) or Letter of Administration (Where there is none), as stipulated in the Succession Act.Finally, land transactions are no longer a secret. When you are buying make sure you make noise about it. You never know, maybe the mad man in the village knows something about the land that will save you from making the mistake of buying it!

After my retirement as an educator, I started working in a property company. That’s where I was involved in this industry.In 2011, I was invited to visit Tanzania and fell in the love with this beautiful country. Tanzania has rich natural resource; I can see this country has bright future, and suitable for living and working. So that, in September 2012, I started working in Group Six International Ltd’ s sister company- Ivory Tower Limited as one of the shareholders.In the past two and half a years, I recognized the promising prospect of the real estate industry in Tanzania. As people’s demands are increasing day to days, all the industries are facing remarkable development potential, as well as real estate industry.Tanzania and China, Both of us are developing countries so we must follow the same developing procedures. In the three decades of China’s reform and opening up, the main industry which contributes most to the economy is the real estate industry. This is because the improvement of people’s life qualities depends on the accommodation firstly. After the house is ready, furniture, electrical appliances and other equipment must be acquired, which will push the manufacturing industry to follow up and develop as quickly as possible. Also this rule is applicable in the whole world.However compared to China, right now in Tanzania, the infrastructure and people’s accommodation condition are relatively worse, especially for those ordinary people; therefore this situation must be changed. Also, considering the number of the existing houses is limited, the rental is very expensive; we have to increase the number

of commercial buildings to satisfy the urgent market demand. Actually, just from this week’s property exhibition, we have already found that the developers which joined this highest level’s exhibition are even fewer than the ones which may join a Small China town level’s exhibition. Therefore we can see the development space of this industry is very huge.Of course, every development must have prerequisite; at the early stage of development we are sure to face many kinds of conditions. Right now Tanzania is just standing on this turning point for development. In the last two and a half years, from purchasing land to selling the building, we met several challenges; right now I would like to share that with you and wish to get your supports.One of the challenges is about the land transaction. Land is the base of constructing. However, for us foreign developers, to buy a land here, we face a different condition from China. In China, all the lands belong to the government, and all the land transactions are handled exclusively by the bureau of land resources. However here in Tanzania, we can see many lands are owned by individual, so that we have to rely on the agent always.Under this condition, to buy a land, we have to find a property agent firstly. However, because of the lack of a unified association, each of them are running in different ways with different credits; some agents they even don’t allow you to meet with the landlord so they can hide some information, which may put client into a high risk and cause loss. Therefore, it’s very urgent and necessary to establish an association for property agent. Only if to unify the agencies’ code of conduct, and ensure they meet all the required qualification, then we are able to make property transaction s standardized and transparent.Another challenge is about the current land policy of Tanzania. According to the law foreigners are not allowed to own a property, so when we buy the land we have to transfer the certificate of occupancy to a lease agreement in TIC. On one side I can understand this policy which tries to defend its country’s interests. But two issues are left

which we can’t ignore.Firstly, after a foreign developer bought a land and built there, when we sell the buildings to Tanzanians, obviously these Tanzanians are supposed to get permanent ownership of the property. But unfortunately in the current policy, this issue is not clearly regulated, and it has already caused lots of problems in the property transactions between foreign developers and local customers.Secondly, even though we admit that foreign investors can only rent the properties, however since government allows our tenancy rights in a certain period, it’s also supposed to guarantee our property-use right and give us an official certificate which can allow us to sublease the property, pledge it or even sell the left leasehold right.However, because these two important issues haven’t been resolved; also the form of the certificates, application procedure, and charges’ standard are still not clear. For us foreign investors, we really feel confused, doubtful and somehow lost.Today, honored Michael and Dar property Magazine gave me this opportunity to express and share my opinions with all of you. If my opinions are not proper, please correct me, if you also agree with them, hope medium and each individual can utilize your influence to facilitate government and industry systems to resolve the issues mentioned. CGT is the kind of Tax which imposed on the increase in value of a non-inventory asset between its acquisition and disposal amount, can be denoted as a wealth tax.There are two types of capital gains tax, Short Term Capital Gains and Long Term Capital Gains. Short term capital gain tax is for an investment held for one of two time periods (one year or less) and the long term is for an investment held for more than one year

and less than five years. Not all countries implement a capital gains tax and most have different rates of taxation for individuals and corporations.According to The Income Tax Act of Tanzania, it requires a person who derives a gain from the realisation of an interest in land or buildings situated in the United Republic, to pay income tax by way of single instalment. Capital gain tax in Kenya was suspended in 1985 but has been re-introduced effectively in 1st January 2015 A person who owns an interest in land or building shall be treated as realising the asset when the person parts with ownership

of such interest including when the it is sold, exchanged, transferred, distributed, cancelled, redeemed, destroyed or surrendered and in the case of interest of an entity when it ceases to exist, immediately before the entity ceases to exist.It advisable to hold the property for a several years after purchasing it due to the fact that there is ideally, no way of saving or reducing a capital gain tax.As a general rule, you don’t pay any tax until you’ve realized a gain - after all, you need to receive the cash (sell out at least part of your investment) in order to pay any tax.

Utility Easement:

Use of another`s property for the purposes of laying gas,

electric, water, and sewer lines.

Example: A property owner grants a utility easement to the

electric power company to extend power lines to the owner`s

home.

Vacancy and Collection Allowance:

An estimated amount to be deducted from the potential gross

income when preparing a budget. The vacancy rate budgeted

may be the rate being experienced or forecasted for the market

for the coming year, or a higher or lower amount depending on

tenant loyalty, rent concessions, or management quality.

Example: In a college town, the apartment vacancy and

collection allowance expected was a blend of 5% during the 9

month regular college term and 25% during the summer session.

Overall, it was 10%.

Subjective Value:

An estimate of a property`s worth based on the opinion of the

owner.

Example: Although the house was worth less than $50,000

on the market, Joan felt its subjective value was much higher

because she had grown up in the home and associated many

good memories with the place.

Redeemable Rent:

In a lease with a purchase option, the rent paid that can be

applied toward the purchase price.

Example: In a fi ve year lease/purchase with a rent of $10,000

per year, the last year`s rent was redeemable rent; it could be

applied in full to the purchase price.

Shelter Afrique has invested USD 1 million in Tanzania Mortgage Refinance Company Limited (TMRC) taking an 11.06% equity stake in the company. Along with Shelter Afrique, other TMRC shareholders include CRDB Bank Plc., NMB Plc., TIB Development Bank, NBC Bank, Exim Bank, Azania Bank, DCB Commercial Bank Plc., BancABC, NIC Bank, Bank of Africa Tanzania (BOA), The Peoples Bank of Zanzibar (PBZ), I&M Bank and National Housing Corporation (NHC).

TMRC is a specialized private sector financial Institution that provides long-term funding to financial institutions for the purposes of mortgage lending. It has the objective of supporting financial institutions to do mortgage lending by refinancing Primary Mortgage Lenders' (PMLs') mortgage portfolios. This type of lending is also known as wholesale or secondary market lending. TMRC is neither taking deposits nor lending directly to individuals. It refinances mortgage loan portfolios rather than individuals mortgage loans and caters to banks rather than individual borrowers.
