Why DeltaPatents?DeltaPatents is a patent attorney firm based in the

Netherlands with a passion for quality. We provide the highest

quality advice and service to public and private companies at

various stages of growths from start-up to Fortune 500.

We offer full patent services in every technology area. Our

practice includes all aspects of patent work, including IP

education, identification and evaluation of inventions, drafting

patent applications, formalities administration, prosecution,

management, litigation and freedom-to-operate assessments.

Our patent professionals have a deep technological

knowledge and extensive industrial experience, in particular

first-hand experience in multinational corporations such as

Philips, NXP, ASML, Shell, and Crucell. Many of us have

worked in R&D in a high-tech company. Others have many

years of experience as in-house patent counsel in multi-

nationals. Consequently, we can handle complex, high-tech

inventions. Moreover, we have a good feeling for what really

matter to our clients; We never shy away from honestly

advising not to pursue a case if the scope of protection

appears not cost-justified or more cost-effective alternatives

exist.

We work according to high quality standards. All our patent

professionals are extensively trained and kept up-to-date. All

our deliverables go through a unique, full-quality review.

We are also proud to be the leading training organization for

the European Qualifying Examination (EQE). Based on this, we

have developed a wide range of IP courses. Many of our

patent professionals are involved in our training activities,

ensuring that we stay ahead in terms of law changes, case

law, and procedural requirements.

Our IP Administrators/Formalities Officers are also well

trained and customer-oriented, they successfully followed the

extensive training for the Dutch Formalities Officers exam and

are certified IP Administrators/Formalities Officers.

We advise customers in an efficient and cost-effective way by

applying a candid approach which focuses on our clients’

needs, simplification of the IP process and adding value and

reduction of unnecessary time and costs.

SERVING YOUR LARGE BUSINESS

Industrial experience, in-depth technical and legal knowledge and flexibility is what we provide to our large clients.

There are various reasons why large businesses out-source patent

work. Work-load is an important factor. Others reasons include

specific technical or legal knowledge and experience, or cost-

efficiency. It is paramount that large businesses can rely on high

quality of the outsourced work, and timely and cost-effective

execution.

OutsourcingWe provide flexibility in workload by using designated teams of

patent attorneys. We focus on high-tech industry. Our attorneys

are technical specialists. Most of us have extensive experience

in industry as engineers or technical management in R&D

departments and/or as in-house patent counsel in multinationals.

DeltaPatents is unique in fitting our services to the needs of

our clients. We put processes and working systems in place that

optimally meet your needs in an efficient manner. Secondment

arrangements are part of such working systems. Discount-rates

are available depending on the efficiency that can be achieved.

DeltaPatents wishes to provide tailor-made services in all areas

of our services including how we deal with and communicate

in respect of invention disclosures, filing of patent applications,

received search reports, official actions, foreign agents, foreign

filing and maintenance decisions, etc. All these areas may need

to be discussed to make sure we can provide the best possible

services to your company in the most cost-effective and efficient

manner. Various processes can be envisaged.

In one possible process the outside patent attorney deals directly

with the inventors concerned, drafts the patent application

and after consent of the inventors on the contents of the patent

application submits the patent application ready to be filed

to the in-house patent attorney. The in-house patent attorney

will be kept in the loop in respect of all correspondence with

the inventors. The same approach can apply to official actions

that need to be dealt with, foreign filing decisions that need to

be made, etc.

In another possible process, an in-house patent attorney is the

main contact of the outside patent attorney. In this scenario the

in-house patent attorney will provide the outside patent attorney

with the invention disclosure and an outline on the merits and

relevance of the invention, and if desired a preliminary indication

what scope of protection needs to sought. The in-house patent

attorney then receives a first draft from the outside patent attorney

on which the in-house patent attorney can comment. When

the in-house patent attorney agrees to the draft, he will ask the

inventors for input and comments on the draft. Subsequently, the

in-house patent attorney will communicate the comments from

the inventors with the outside agent who, when applicable, will

provide a second draft that will be dealt with in a similar manner

as the first draft, and eventually the case will be filed. In such a

process the in-house patent attorney is in full control of the process

and he can at the same time monitor the quality of the work of

the outside agent. In this way the in-house patent attorney actually

becomes in a way part of the team of the outside patent attorney.

Quality assuranceQuality assurance is an integral part of our way of working. In

addition to our patent attorneys being technical specialists, we

train all our patent professionals very extensively in all IP relevant

matters. We ensure that they are kept up-to-date. Many of our

attorneys are active tutors and speakers on IP law. We also share

our knowledge with our client in various ways, including blogs

on IP law and case law by our team of legal experts.

We work in a consistent manner according to a comprehensive

internal drafting guide covering the specific requirements of the

main patenting systems. We have extensive experience in adapting

our guidelines to specific needs of a multinational. To further

ensure quality, all our deliverables go through a unique, full-

quality review checking whether the deliverable is technically

correct, meets the patent law requirements, and complies with

the drafting guidelines.

Legal OpinionsOur in-depth legal knowledge also enables us to provide thorough

second opinions on legal matters, such as re-establishment, and

assisting in complex substantive matters, for instance assisting

in preparing for oral proceedings or taking over representation in

opposition or appeal cases.

The close vicinity of our offices to the EPO offices in The Hague

and our experience in using video conferencing in

examination oral proceedings enables us to be cost-effective in

oral proceedings.

TRAINING

We offer an extensive range of off-the-shelf training modules. Many of the modules can be followed in open training courses. We do not only provide training in our base in Eindhoven, the Netherlands, but many of our training modules are available at several locations in Europe to minimize your travel costs.

All courses can also be given on an in-house basis. If required, a

module can be tailored to your local organizational needs. Please

contact us if you are interested in inviting us to your office.

For the European Qualifying Examination (EQE),

we provide training for the Pre-Exam as

well as the Main Exam in the form of

class-room training or distance learning.

For large businesses we provide tailor-

made training paths from junior trainee

to the EQE.

For Continuing Education of Patent Attorneys, we provide a

law and case law update course, a Unitary patent- UPC course,

and various IP master classes, such as an in-depth opposition

course. For many subjects, like claim interpretation, problem-

solution approach, re-establishment we have prepared short

in-depth workshops. These workshops are ideal

for use at in-house annual IP events. Our

legal team runs an active blog on case

law of the EPO. Feel free to discuss with

us the possibilities of a one-off or regular

series of webinars on topics of interest

for your attorneys.

For R&D (R&D managers, research scientists, development

engineers), we have a complete set of modules available forming

a 3-day patent tutorial. Specific subsets of modules can be

chosen for the specific business needs, such as to

• increase IP awareness

• raise the understanding of technical

enablement in the patent application

• raise the knowledge of claim

interpretation

• increase capabilities in support for

infringement or FTO actions.

For In-house IP Coordinators, we provide tailor-made training

programs based on our modules of the 3-day patent tutorial

course, possibly complemented with modules from our IP

Management courses, such as Portfolio Management and

Strategy course and a Licensing course.

IP Paralegals, Administrators need to be

adequately trained for various reasons,

such as:

• To raise skills so that duties may be

delegated from Patent Attorneys to

IP Administrators/ Paralegals

• To support organizational changes

• To provide background knowledge of the IP process to increase

motivation and reduce the chances of misunderstanding

• To have fully trained support staff in order to meet “all due

care” requirements of the EPC/PCT in re-establishment cases

To support such needs, DeltaPatents has developed a full set

of training modules, including beginners courses and in-depth

modules for IP Administrators.
