In one possible process the outside patent attorney deals directly
with the inventors concerned, drafts the patent application
and after consent of the inventors on the contents of the patent
application submits the patent application ready to be filed
to the in-house patent attorney. The in-house patent attorney
will be kept in the loop in respect of all correspondence with
the inventors. The same approach can apply to official actions
that need to be dealt with, foreign filing decisions that need to
be made, etc.
In another possible process, an in-house patent attorney is the
main contact of the outside patent attorney. In this scenario the
in-house patent attorney will provide the outside patent attorney
with the invention disclosure and an outline on the merits and
relevance of the invention, and if desired a preliminary indication
what scope of protection needs to sought. The in-house patent
attorney then receives a first draft from the outside patent attorney
on which the in-house patent attorney can comment. When
the in-house patent attorney agrees to the draft, he will ask the
inventors for input and comments on the draft. Subsequently, the
in-house patent attorney will communicate the comments from
the inventors with the outside agent who, when applicable, will
provide a second draft that will be dealt with in a similar manner
as the first draft, and eventually the case will be filed. In such a
process the in-house patent attorney is in full control of the process
and he can at the same time monitor the quality of the work of
the outside agent. In this way the in-house patent attorney actually
becomes in a way part of the team of the outside patent attorney.
