COMMUNICATION

At its sitting of 12 May 2003, Parliament was informed of the judgment of 10 April 2003 of theFifth Chamber of the Court of First Instance of the European Communities in Case T-353/00 �Le Pen v European Parliament.

Under this judgment, the suspension of Mr Le Pen�s disqualification from office as a Member of theEuropean Parliament, ordered as an interim measure by the President of the Court of First Instanceon 26 January 2001, ceased to have effect on 10 April 2003.

Consequently the legal situation prior to the interim measure has been restored and the seat leftvacant by Mr LE PEN falls to Mrs Marie-France STIRBOIS with effect from 11 April 2003.

Declaration by the Presidency on behalf of the European Union on the recent LTTE statement of itsintention to suspend participation for the time being in the peace negotiations in Sri Lanka

Brussels, 14 May 2003

The EU notes with concern the recent LTTE statement of its intention to suspend participation for the timebeing in the peace negotiations. It calls on both parties to continue to comply with the Ceasefire Agreementof 22 February 2002. It urges the LTTE to continue to participate fully in the talks and to commit itself toattending the Tokyo reconstruction conference. An early normalisation of living conditions in Sri Lanka willbe dependent on the positive contribution of both parties and a successful Tokyo conference. It is in the long-term interests of all people in Sri Lanka to keep the peace process on track. The EU re-iterates itscommitment to supporting the peace process.

The Acceding Countries Cyprus, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland,the Slovak Republic and Slovenia, the Associated Countries Bulgaria, Romania and Turkey and the EFTAcountries Iceland and Liechtenstein, members of the European Economic Area align themselves with thisdeclaration.

The Acceding Countries Cyprus, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Malta, Poland,the Slovak Republic, and Slovenia, and the associated countries Bulgaria, Romania and the EFTA countries,members of the European Economic Area, declare that they share the objectives of Common Position2003/297/CFSP concerning Burma/Myanmar defined by the Council of the European Union on 28 April2003 on the basis of Article 15 of the Treaty on European Union. They will ensure that their national policiesconform to that common position.

The European Union takes note of this commitment and welcomes it.

Declaration by the Presidency on behalf of the European Union on the Outcome of the Appeal byDatuk Seri Anwar Ibrahim against his conviction on 8 August 2000

Brussels, 7 May 2003

The European Union, which has continued to monitor closely the case, notes the decision of the MalaysianCourt of Appeal to uphold the conviction and sentence on 8th August 2000 against Datuk Seri AnwarIbrahim, the former Deputy Prime Minister of Malaysia.

The European Union recalls its earlier statements voicing deep concern about the fairness of the legalproceedings and expresses its disappointment that the verdict has been upheld.

The EU Member States present their deep condolences to the families of the Governor of Antioquia,Dr Guillermo Gaviria Correa, of the Peace Adviser and Former Minister of Defence, Dr GilbertoEcheverri Mejia and all the victims of the murders occurred on 5 May in the department ofAntioquia.

The EU Member States condemn with distress these atrocious murders and express their hope thatall possible efforts will be carried on at safeguarding the persons still kidnapped, in respect of thesupreme value of human life. In this respect the EU underlines that hostage taking is a crimerecognised as an act of terrorism and calls on the liberation of all hostages without preconditions.

The EU strongly believes that, above all in these moments, it is necessary to avoid the furtherescalation of violence and every effort should be made to start up again as soon as possible theconcrete research of a humanitarian agreement and a negotiated political solution to the conflict.

The EU reiterates its full support to democracy in Colombia and to the active engagement of thegovernment of President Uribe to establish the rule of law throughout the country, including thefight against terrorism.

Declaration by the Presidency on behalf of the European Union on India-PakistanBrussels, 8 May 2003

The EU warmly welcomes the re-establishment of high level political contact between India and Pakistanand the intention of both countries to resume full diplomatic relations and restore civil aviation links. Thesepositive developments follow on from Prime Minister Vajpayee's 18-19 April visit to Srinagar and thetelephone conversation between Prime Ministers Jamali and Vajpayee on 28 April.

The EU commends the leadership of both countries for initiating and fostering this positive trend andencourages India and Pakistan to seize this opportunity as the first step in a process of building confidence,normalising bilateral relations and resolving their outstanding differences, including Kashmir, in a peacefulway.

on the elections in YemenBrussels, 12 May 2003

The European Union welcomes the recent holding of the third general elections in the Republic of Yemen.The elections have registered a high level of participation and were conducted in conditions generallyconsidered fair. Significantly less violent incidents were reported than in the past.

The European Union wishes to commend the Yemeni people and government, as well as the newly electedrepresentatives, for continuing the process of democratization and decentralization, and reiterates itscontinuous support to the Republic of Yemen in pursuing sustainable, equitable and participatorydevelopment, of which the promotion of human rights, democracy, the rule of law and good governance areintegral parts.

Declaration by the Presidency on behalf of the European Unionon the adoption of a new constitution in Qatar

Brussels, 12 May 2003

The European Union welcomes the new constitution of Qatar that was adopted by referendum on April 29,2003. The new constitution's provisions for an elected legislature and for protection of individual rights andfreedoms constitute significant progress in the process of democratisation. It is also to be noted that theadoption of the new constitution came shortly after the holding of municipal elections which resulted in theelection of Qatar's first woman in public office.

The EU commends the commitment to democracy shown by the people and the government of Qatar andwishes to reiterate its support for all efforts at strengthening the democratic process in this country.

on the National Assembly, Presidential and Gubernatorial elections in NigeriaBrussels, 14 May 2003

The European Union welcomes the fact that the presidential, Parliamentary and Gubernatorial elections inNigeria were conducted peacefully in most parts of the country and represented an important step for thedemocratic process in Nigeria, in the context of transition from civilian to civilian administration.

The European Union acknowledges that President Obasanjo has been announced President-elect of theFederal Republic of Nigeria on 22 April 2003 by the competent electoral authority, and we wish tocongratulate him. The President now has a clear mandate for his second term.

The European Union also took positive note, that the Nigerian government invited inter alia European Unionobservers to the country, in order to efficiently observe the electoral process.

The European Union expresses concern about the serious irregularities and instances of fraud which wereobserved and reported by the European Union election observation mission, resulting in a lack of credibilityof the electoral process in those states concerned. The European Union strongly recommends thatappropriate measures are taken as provided for under the electoral law of Nigeria and welcomes the decisionof all aggrieved parties to settle their disputes peacefully and within the constitutional framework.Furthermore, the EU expects that all perpetrators of political violence during the electoral campaign will beprosecuted.

The European Union have confidence in the Nigerian authorities, now that the 2003 elections are over, toremain focused on the democratisation process, in order to further improve the quality of democracy andincrease accountability in Nigeria in the coming period.

The European Union notes with satisfaction the increase in voter participation and in particular, that womenfor the first time made up a substantial proportion of those who voted. This constitutes a clear sign of theincreasing democratic awareness in the country.

The European Union looks forward to working in co-operation with the newly elected president and hisgovernment and to supporting their endeavours to strive for steady democratic development and economicimprovements.

Declaration by the Presidency on behalf of the European Unionon the conditions for Presidential elections in Togo

Brussels, 15 May 2003

The European Union is concerned by the recent reports of detention of members of political oppositionparties and the treatment of members of a local human rights NGO, Acat-Togo, which has in the past beeninvolved in the preparation of reports for the European Parliament.

In order to help create the right climate for democratic elections, the EU urges the Togolese Authorities torefrain from arbitrarily detaining opposition activists, to clarify the situation of those detained, and to ensurethe effective enjoyment of the right to expression. It furthermore calls on the authorities to ensure that humanrights activists can carry out their legal and legitimate activities without risk of intimidation and hindrance.

The EU repeats its recommendation to the Togolese Authorities and all the opposition parties to ensure thatthe next election enables all shades of political opinion to have their say and to participate with the greatestpossible transparency and independence.

The EU notes the key role played in elections by independent domestic and international electoral observers.The EU regrets that the Togolese authorities were unable to agree to an EU Exploratory Mission, and notesthat as a result an EU electoral observation mission cannot be deployed in Togo for the Presidential electionson 1 June.

The European Union congratulates Mr. Nestor Kirchner on his election as President of Argentina and wishesevery success to the new President in his endeavours to consolidate social justice, put an end to the economicproblems of the country and bring stability and prosperity to the people of Argentina.

The European Union wishes to express its optimism that the new Government of Argentina, with thePresident-elect at the helm, will bring the country again to the forefront of the political and economic sceneof the Latin America region and in particular its southern cone.

Declaration by the Presidency on behalf of the European Union on the opening of negotiations betweenthe Government of Nepal and the Maoists

Brussels, 16 May 2003

The European Union notes with satisfaction the peace negotiations which have been opened between HisMajesty's Government of Nepal and the Communist Party of Nepal (Maoist). The EU reaffirms its supportfor an inclusive democratic political process and successful negotiation. Recent developments have givencause for concern and EU urges all sides to adopt a flexible approach and renounce violence.

The EU welcomes the recent public commitment of HMG/N and the CPN (Maoist) to negotiate with theNational Human Rights Commission a separate Human Rights Accord. The EU views this initiative as asignificant step in the peace process which will bolster confidence. The EU is willing to support theimplementation of this agreement.

The EU will continue to support the Government of Nepal in its efforts to tackle poverty, discrimination andto improve governance. Successful negotiations between His Majesty's Government of Nepal and the CPN(Maoist) would provide an improved basis for future co-operation between the EU and HMG/N.
