Declaration by the Presidency on behalf of the European Unionon Angola

Brussels, 29 May 2001

The European Union strongly condemns the attack by UNITA near the town of Caxito and theabduction of children. It calls for the immediate release and safe return of all abducted children, andstresses the importance of bringing the perpetrators to justice. This attack represents a furtherexample of the terrible distress that the war in Angola continues to inflict on the majority of itscitizens.

A peaceful and lasting solution to the conflict, based on the Lusaka protocol, is necessary to thedemocratic and economic development of the country in the interests of all its people. The EU notesthat elections were last held in Angola in 1992 and reiterates the importance it attaches to theGovernment's commitment to hold free and fair general elections in the second half of 2002. It isessential that these elections be preceded by a period of intensive preparation aimed at developingthe democratic culture necessary for the conduct of successful elections.

The EU is encouraged by some recent developments, including the Amnesty Law and theestablishment by the National Assembly of a Standing Committee on Peace. It welcomes theindication by President dos Santos in his speech in Luanda on 2 May that his Government is readyto engage in a dialogue on how peace may be achieved on the basis of the Lusaka Protocol. The EUnotes that the President was responding to an earlier radio interview with Mr Savimbi and stronglyurges the UNITA leader to engage seriously and effectively in the search for peace and to complywith the Lusaka protocol.

The EU supports the role the Churches and Civil Society are playing in promoting a culture ofopenness and dialogue. The EU welcomes the continuing engagement of the UN Secretary Generalin the search for peace and reaffirms its commitment to the enforcement of UNSC sanctions againstUNITA for its failure to comply with the provisions of the Lusaka Protocol.

The Governments decision to establish a Fund for Peace and National Reconciliation to assist thereintegration into society of former soldiers can play a useful role provided that all the operations ofthe Fund are fair and transparent. The fund should operate alongside a Poverty Reduction Strategywhich addresses the needs of the communities to which the ex-combatants will be returning.

In this context the EU reiterates the importance it attaches to the fulfilment of economic and socialreforms. It welcomes the Government's engagement with the IMF in a Staff Monitored Programmeand encourages it to meet its economic targets in order to progress to the conclusion of anagreement for a Poverty Reduction and Growth Facility. It urges the Government to implement asspeedily as possible measures agreed under these programmes and to actively promote goodgovernance in particular concerning transparency issues and the fight against corruption.

The EU remains deeply concerned at the prolonged severe humanitarian crises that has left threemillion people declared as internally displaced persons. It urges the Government to expand itshumanitarian assistance programme (PNEAH) as an expression of its ultimate responsibility for thewell being of all citizens in Angola. The EU deplores the continued difficulties regarding thedistribution of humanitarian assistance for displaced persons. The EU encourages the Governmentto spare no efforts in order to better secure the access of humanitarian aid within Governmentcontrolled areas. The EU demands all parties in the conflict, and in particular UNITA, to stop theirminelaying activities.

On its part, the EU declares its willingness to continue to assist to mitigate the suffering caused bythe war and to contribute to a better life for all Angolans.

The Central and Eastern European countries associated with the European Union, the associatedcountries Cyprus, Malta and Turkey, and the EFTA countries, members of the European EconomicArea align themselves with this declaration.

on the sentences against Dr. Saad Eddin Ibrahim/Ibn Khaldoun CentreBrussels, 28 May 2001

The European Union is deeply disturbed by the harsh sentences handed down by the EgyptianSupreme State Security Court on 21 May 2001 against Dr. Saad Eddin Ibrahim and staff membersof the Ibn Khaldoun Centre. Dr. Ibrahim was sentenced to seven years imprisonment on chargeswhich included accepting foreign funding without authorisation (including from the EU) and forharming Egypt's reputation abroad. The staff members of the Centre were given prison terms ofbetween two to five years. The European Union monitored the trial as an observer. The speed atwhich the verdict was reached raises concerns that the Court did not take fully into accountevidence for the defence, some of which was submitted on the day the verdict was given. The EU was deeply concerned to receive information about the edict of the Taliban leader, MullahOmar, ordering all Hindus in Afghanistan to wear identity marks.

The EU notes that the Taliban claim to be seeking to identify Hindus to avoid them being harassed"by mistake". The EU recalls that the Taliban have to respect and protect the human rights of allpersons belonging to the ethnic and religious minorities in Afghanistan. on the recent Summit of the IGAD Committee on the Sudan,held in Nairobi on 2 June 2001


The European Union has consistently supported the IGAD peace initiative but has also expressedconcern at the lack of progress made so far in the peace process.

The European Union welcomes the holding of the Summit of the IGAD Committee on the Sudan on2 June 2001 and expects that it will yield early progress towards peace.

The European Union notes the expressed intention to convene a new Summit within two months,and to make the negotiating teams permanent. It encourages Kenya, in its capacity as chairman ofthe IGAD Committee on the Sudan, as well as the other IGAD countries to press on to reinvigoratethe peace process in the Sudan.

The European Union welcomes the commitment by the Government of Sudan to halt aerialbombings, expects that it will be strictly observed and urges the Government of Sudan and theSPLM/A to immediately stop hostilities in order to create a conducive environment for negotiations.

A continued active involvement at high political level of the IGAD is crucial in order to achievesubstantial progress towards an end to the war. However, even more important is a firm politicaldetermination of both the Government of Sudan and the SPLM/A to find a peaceful solution to theconflict. The European Union therefore calls on the parties to engage themselves in a continuousand sustained negotiation towards a just and lasting political settlement of the conflict in the Sudanand considers essential that a comprehensive cease-fire effectively monitored by observers acceptedby both sides be promoted as a matter of urgency within the context of the ongoing IGADnegotiating process.

Declaration by the Presidency on behalf of the European Unionon the Humanitarian Accord between the Government of Colombia and the FARC


Recalling its declaration on 19 January 2001 on the peace process in Colombia, the European Unionwelcomes the Humanitarian Accord agreed upon by the Government of Colombia and the FuerzasArmadas Revolucionarias de Colombia (FARC) on 2 June 2001.

The European Union sees this agreement as a positive step towards a necessary increased respectfor International Humanitarian Law. As such, it is also an important element for the creation ofmutual confidence in the peace process between the parties, the public at large and the internationalcommunity accompanying the negotiating process.

The European Union encourages the parties to rapidly achieve further concrete progress in thenegotiations, in order to decrease the level of violence. The European Union encourages theGovernment of Colombia to continue to adopt effective measures against the paramilitary groups.The European Union furthermore urges the FARC to fulfill their unilateral decision reflected in theHumanitarian Accord to liberate a large number of soldiers and policemen, in addition to theexchange currently being carried out.

Finally, the European Union urges the FARC and the Ejército de Liberación Nacional (ELN) andother groups, to immediately and unconditionally release those civilians who have been kidnapped,and to terminate the abominable and unacceptable practice of kidnapping.

This is a clear signal of Iranian voters for the strengthening ofdemocracy, the establishment of the state of law and stronger guarantees for fundamental freedomsin their country. on Belarusian electionBrussels, 11 June 2001

The EU would in response to the announcement by Belarus to hold presidential elections onSeptember 9 like to reiterate its support for a democratic development in Belarus and underline theimportance of free and fair elections.

As stressed on several occasions, the up-coming elections represent an opportunity for Belarus toimprove its relations with the EU and the international community. The EU therefore asks theauthorities to take necessary measures so that a fair campaign and, later on, election can be held.

The EU would in this context urge the Belarusian government to honour its commitments under theOSCE Copenhagen Document and refrain from interfering in the work of the political oppositionand independent movements. Respect for the principle of freedom of assembly is here central. TheEU would also like to remind the Belarusian government about the need for objective reporting onall candidates in the state media. Independent newspapers should be able to work under the sameconditions as state owned newspapers and not be subject to discrimination.

Democratic elections could be promoted by taking fully into account recommendations by theOSCE, for example as regards the implementation of the election law. In this context, the EUrecalls that the right of Belarusian citizens to engage in domestic election observation is guaranteedby law. The government should therefore not counteract the building and training of domesticnetworks of non-partisan observers. The EU reiterates its concerns about decree no 8 and itspossible implications on the activities of non-governmental organisations, in particular in theinstitutional building and training fields.

The role of the OSCE during the election period is of great importance. The EU fully supports thework of the OSCE Advisory and Monitoring Group (AMG) working within its mandate, and willclosely consult with the OSCE during the election period. The EU expects the Belarusianauthorities to up-hold a dialogue with the AMG and to co-operate constructively with AmbassadorWieck.

The EU is ready to engage in a dialogue with the Belarusian government in order to promotedemocratic presidential elections. The EU would be willing to take a first step in normalising itsrelations to Belarus, should the election be assessed as free and fair by domestic and possibly alsoan ODIHR mission according to international standards.

Statement by the Presidency on behalf of the EUat the Consultative Group Meeting on Cambodia, 11-13 June 2001 in Tokyo


The European Union welcomes this opportunity to review the progress made by the Kingdom ofCambodia towards the goals set at the last CG meeting in Paris.

The Union welcomes the positive steps taken by the Royal Government of Cambodia over the lastyear. We congratulate Cambodia on macro-economic growth, overall political stability, improvedfiscal performance and bank reform. We also continue to encourage the RGC to overcome thechallenges which hamper the development, including further growth and equitable distribution ofincome, in Cambodia.

Important prerequisites for economic development and the reform agenda as a whole are astrengthened civil society in a stable social framework which is based on the rule of law and thedevelopment of transparent systems of governance. The EU would like to emphasise the urgentneed to improve governance and strengthen the rule of law, and is ready to continue to helpCambodia in these fields. Law enforcement should be improved - to overcome impunity, tosafeguard human rights, and to provide a firm basis for sustainable economic development. On theissue of corruption, the EU is encouraged to note that the government regrets its rampant prevalencein the public sector. But more decisive action is still needed in this field, we urge the government tofully implement the National Anti Corruption Plan. The judicial system, including human resources,needs to be strengthened. The ongoing reform towards decentralisation should be pursued.We are encouraged by the progress in preparations for communal elections in 2002. Given the rightconditions, the elections will constitute an important step for accelerating democratic governance.We encourage the RGC to take every possible step to ensure that these elections will be free andfair, and take place in a secure and peaceful environment.

Similarly, the administrative reform should be given momentum. The EU welcomes the RGC's planto increase public sector pay.

The EU strongly urges the RGC and the Cambodian Parliament to reach an agreement on theKhmer Rouge Tribunal. It urges the RGC and the Parliament to rapidly complete and adopt the lawon the Tribunal, in order to try the Khmer Rouge leaders responsible for the most serious violationsof human rights, in accordance with international standards of justice, fairness and due process oflaw. The EU urges the RGC and the Parliament to establish the tribunal without further delay.

The EU welcomes the RGC's increased focus on poverty eradication as reflected in the Socio-Economic Plan and PRSP process. Real disbursements to the social sectors still need to increase.This can be made possible by implementing the armed forces demobilisation programme. The EU isready to contribute to such a programme.

Transparency and accountability are key to our co-operation with Cambodia. A crucialimplementation measure is to fill the National Audit Authority with qualified members and to makeit operative rapidly.

The draft laws on land reform and Forestry Law will be key tools to fight corruption and reducepoverty. The EU strongly encourages the RGC and the Cambodian Parliament to proceed with theiradoption and implementation. We would also like to underline the importance of addressing theprotection of the communities rights to land and, on forestry, the need for the Cambodianauthorities to continue their work to redress the illegal logging issue.

The European Union continues to be strongly committed to Cambodia, and stands ready to continueto support Cambodia in her development efforts.

The European Union is increasingly concerned by the renewed military activity by the SPLA,particularly in Bahr al-Ghazal in Southern Sudan, and by the Government of Sudan's resumption ofaerial bombings in response to this offensive.

The European Union calls on both parties to halt their military activity and urges the Government ofSudan fully honour its commitment to cease aerial bombings. The European Union urges both theGovernment of Sudan and the SPLA to immediately stop hostilities in order to create anenvironment conducive to negotiations and the safe delivery of humanitarian assitance to theaffected civilian population.

The European Union reiterates its call on all sides to engage in a continuous and sustainednegotiation towards a just and lasting political settlement of the conflict in Sudan, and considersessential that a comprehensive ceasefire, effectively monitored by observers accepted by both sides,be prompted as a matter of urgency within the context of the ongoing IGAD negotiating process.

So asustained effort is needed with sustainability an ideal case for wider public participation in EU-policy. For this EcoSoC sees Göteborg as the starting point with Laeken and Barcelona as furtherkey stages. On the basis of the analysis carried out, the Committee underlines, in the conclusions of thisown-initiative opinion, the fact that the forthcoming WTO negotiations, eastward enlargement ofthe EU and the mid-term review, should be used to introduce a new agricultural policy which ismore in tune with conservation of the environment and nature.Financial incentives to promote an agricultural sector which pays adequate heed to natureconservation are at present inadequate in many cases. The CAP financial instruments should begeared towards the results-oriented promotion of environmental and socio-cultural interests(biodiversity, positive impact on jobs). To this end, indicators will need to be formulated to gaugethe successes of agricultural policy. A consensus between organisations representing farmers,environmental associations and the social partners needs to be achieved.There is generally a low take-up rate for agri-environmental measures in highly-productive,intensively-farmed regions. It is particularly in these regions that species diversity is under seriousthreat. The Committee therefore recommends, as a matter of urgency, that a review be carried out ofaid provisions funded under the first pillar to determine whether they are in line withenvironmental protection and nature conservation.

− On-going, systematic involvement of stakeholders is a prerequisite for meeting anyenvironmental objective. The Committee emphasises that involvement should be understoodin its broadest sense, covering all decision-makers at all stages of the process and all possiblemethods and instruments for training and educating authorities, businesses, trade unions,sectoral and consumer associations as well as the individuals concerned.

− Sustainable economic development in the applicant countries, based on new, cleantechnologies and improved environmental management, is vital to preserving their positiveenvironmental aspects - which are due more to their relatively low level of development thanto conscious choices.

− Rewarding more environmentally-aware behaviour, in part through non-economic incentives(along the lines of eco-labelling), is globally a more effective instrument than sanctions,which risk pushing problems elsewhere while failing to provide the coherent environmentalprotection which is needed as part of a world view.

− Market instruments such as eco-taxes and environmental tax reforms should be examinedmore closely in order to assess the real benefits for the environment, and must address theneed for a harmonised approach at Community level, without distorting competition withinthe Community or jeopardising the competitiveness of European industry.

The Committee welcomes the Commission's intention of introducing a market regime for publicpassenger transport based on controlled rather than full competition. However, the Committeeremains sceptical as to the arrangements laid down for applying the specified resources andinstruments.

The Commission should consider whether it should not recommend specific Europe-wideminimum criteria.

The duration of contracts should be such as to guarantee exclusive rights for a period longenough to enable operators to recover their investment, and should be from eight to fifteen yearsdepending on the type of service. Contracts entailing reckless underbidding should not be accepted.

As soon as a Member State has defined a transport service as a service of general interest thecompetent authorities should be allowed to opt for direct management of these services.

The Committee has some criticisms to make of the power of the competent authority to requirethat the operator sub-contract some of the services covered by the contract. The Committeewelcomes, however, the Commission's intention to provide direct protection for staff in the case ofa change of operator. The Committee suggests a selective system of transitional periodsdifferentiating between the various categories and modes of transport.

The Committee considers that in general the Erika II package is a step in the right directiontowards establishing safe navigation conditions and avoiding accidental pollution, and for ensuring,in the event of an accident, sufficient and fair compensation for all the damage caused to individualsand the environment.However, there is still a long way to go before the legislative proposals on maritime safety arefine-tuned and completed, bearing in mind at all times the international character of maritimetransport and the powers and role of the current regulatory and standards institutions, in particularthe IMO and ILO and their conventions and recommendations, and more generally the wholeinternational convention system encompassed by the United Nations Convention on the Law of theSea which lays down the rights and obligations of flag, coastal and port states, all institutions andconventions which play a key role and need to be strengthened.

Even more important is the need to create the conditions for effectively implementing Europeanand international maritime law. This requires long-term political commitment, increased materialresources, genuine and effective cooperation between the Commission and the Agency, maritimecommittees and competent Member State authorities. It further requires the human factor to betaken into account - in the Committee's view the most essential element in the safety of maritimetransport, a strategic sector of activity for the internal and external trade of the EU.

The Committee welcomes the latest proposals for a programme of innovative actions and fullyagrees that programmes promoting the widespread introduction of innovative capacity and thetechnologies of the new economy to all sectors of production and society are crucial to regionaldevelopment. Moreover, it stressed only recently that the capacity to use information andcommunication technologies can determine the success of a possible development or the loss offurther jobs in a particular area.In addition, the best focus for innovative action programmes in the three main source areas ofgrowth - entrepreneurship, training, and the proactive involvement of public bodies, cultural andresearch institutes and the social partners - is the local level, especially in disadvantaged regions.Geographical proximity, closer understanding of the difficulties inherent in the social andproductive fabric, and the increased responsibility of local authorities arising from the

decentralisation policies being applied in all EU countries, are all factors that contribute directly toforms of effective participation. Key points:

− The Commission's assessment for the European economy of a slight slowdown in growth isover-optimistic; because of this change in the balance of risks, the ECB should maintain aflexible approach to the setting of interest rates.

− The Council's rhetoric on structural reform and the development of the knowledge-basedeconomy must at last be matched by commensurate policy actions.

− The problems of turning words into action also exist at the national level with the very unevenprogress of tax, social security and pension reform.

− The Committee subscribes to the goal of ensuring sustainability of public finances, but thismust not be at the expense of public investment that is essential for the infrastructure andhuman capital required for a knowledge-based society.

− The aspirations to make the Union the most competitive and dynamic knowledge-basedeconomy in the world must now be converted into real achievements; the Committeecommends the BEPG 2001 for early and effective implementation.

The Committee notes that the participation of international financial institutions and the privatesector in co-financing projects eligible for ISPA funding has been restricted due to the applicationof Article 114(1) of the Financial Regulation. The Committee approves the Commission's proposalsboth to amend the Regulation establishing ISPA by inserting provisions allowing a derogation fromthis Article, which it considers likely to increase the scope for co-financing; and also to seek theassistance of a committee involving the Member States, the Commission and the EuropeanInvestment Bank. The Committee believes that eligibility for participation in ISPA should beextended to Cyprus, Malta and Turkey. Considering the need to examine in more detail the way inwhich ISPA funds are structured and operated, the Committee proposes to draw up an own-initiative opinion on the subject in the near future.

The Committee's opinion examines the possibilities for improving intrabrand competition, dealerindependence and the provision of technical information by manufacturers to independent repairers,as well as recommending changes to take into account both past experience and technologicaladvances. It also suggests updating the Communication on intermediaries, and setting up guidelineson the use of the Internet by dealers and producers.In order to raise the overall level of competition to improve consumer choice and the operation ofthe Single Market, the Committee feels that the best way forward is to attempt to modify andprolong the block exemption, strengthening the position of intermediaries in making the most ofthe opportunities offered by parallel trade, rather than putting an end to the selective distributionsystem.

The opinion maintains that insurance intermediaries must have specialist training, and suggests aminimum of 300 hours' theoretical and practical training, whilst leaving it to Member States todecide the level and content.The ESC feels that this minimum requirement is also necessary to bring about the freedoms ofthe Single Market, in view of the current variety of national rules and resultingcompartmentalisation of markets.Finally, in order to improve consumer protection, the Committee argues that all insuranceintermediaries should be registered on the basis of certain minimum professional requirements.Hence intermediaries whose principal professional activity is not insurance mediation shouldnevertheless be included within the scope of the directive.

The ESC believes that under present circumstances, in which consumers are insufficientlyfamiliar with the oils available on the market, using acidity as the classification parameter could, insome cases, confuse consumers and lead them to make wrong judgements. For this reason, itconsiders that the packaging of currently designated "olive oils" should not indicate their degree ofacidity, since they are obtained from a blend of refined and virgin oil. Furthermore, it is essential toimpose a blanket prohibition across the EU on the production and sale of blends of vegetable oilswith olive oil.

Key points:

Whilst welcoming the proposal the ESC condemns the fact that it is limited to dry sows and doesnot include farrowing and suckling sows and criticises the fact that only the Standing VeterinaryCommittee is to be consulted on the proposed amendments to the Annex, rather than all the EUinstitutions.The ESC feels that the importance of space requirements for fattening pigs and preventivehealthcare must be highlighted more clearly, thus helping to avoid or reduce the risk of diseaseoutbreaks. The ESC calls for a better, more accurate analysis of the cost of the proposal. The ESCendorses the proposed requirements on advice, guidance and appropriate training for animalhandlers, but would stress that this must build on their existing expertise. Safety aspects andaccident risks must also be taken into account.

The Committee generally welcomes the Commission's initiative. The use of uniform terms anddefinitions in Community law generally enhances transparency and legal certainty. The Committeeunderlines the view expressed by the Commission in its proposal that the aim is to continue toafford the protection provided by the original Directive. Care must, however, also be taken to avoidabuse in the case of the "rebuilding" of enterprises, i.e. to facilitate the financial rehabilitation ofenterprises at the expense of the guarantee institutions. The Committee welcomes the fact that thescope of the Directive has been made more precise and is now to include part-time employees,workers with fixed-term contracts, workers with a temporary employment relationship andhomeworkers. The Committee takes the view that domestic servants employed by a natural personand share-fishermen should not be excluded from the scope of the Directive, but that persons whoexercise a controlling influence on the management of an enterprise may be invoked by MemberStates for exclusion.

Key points:

The Committee broadly approves the text of the proposal, which is designed to protect publichealth, and it is pleased that the proposed directive consolidates equality of rights for peoplethroughout the Community.

The Committee considers that one of the EU's priority objectives is to lay down the foundationsfor achieving high safety and quality standards for blood and blood components used within itsterritory. As a consequence it deems the provisions contained in the proposed directive to bepositive, since, taking into account ethical and deontological principles as well as currentinternational standards, they ensure that this objective will be met, necessarily covering theeligibility of donors and the collection, testing, processing, storage and distribution of whole bloodand its components.

In view of the shortage of blood and given that blood donors make a humanitarian andbenevolent gesture which is anonymous and unpaid, the Committee suggests that the Commissionurge Member States to carry out more campaigns aimed at enhancing the public image of blooddonors and thus providing the best incentive possible to give blood.

Self-sufficiency in the blood sector is an EU objective which has to be secured. In line with thedraft directive, the Committee stresses how vital it is not to allow a mercenary, profit-orientedapproach to blood donations to develop on the part of the establishments which collect and processblood.

The purpose of the proposal is to amend thepayment period for compensatory aid forrice, provided for by Regulation (EC) No3072/95, by adopting the same dates as forarable crops, provided for by Regulation(EC) No 1251/1999.

The maximum guaranteed quantities byproducer Member State are based on anaverage of the quantities produced in thepreceding years. The amount of aid remainsunchanged, average expenditure on theCOM is set to stabilise at close to its currentlevel. The proposal is compatible with thefinancial planning and does not involveadditional costs in terms of human resourcesor in terms of other administrativeexpenditure.

Council Regulation (EC) on thecommon organisation of themarket in sheepmeat andgoatmeat

Following an evaluation undertaken by theCommission, the proposal aims to reformthe COM in this sector. The measuresproposed include the introduction of the ewepremium and the replacement of thedeficiency payment by a flat-rate payment;on the other hand, the proposal aims toretain certain aspects of the current regimewhich have proven to be effective inmaintaining a balance on the markets.

Chapter B1-22 'sheepmeat and goatmeat' forthe 2002 financial year has a budgetallocation of 1620 m € for CAs and PAs; thefinancial impact would be compatible with thebudget allocations in the current financialperspective; the proposal will not entailadditional costs, either in terms of humanresources or in terms of other administrativeexpenditure; moreover, as regards theprevention of a risk of fraud or irregularity,the rules set out in the integratedmanagement and control system areapplicable.


The proposal introduces a managementcommittee (cf. Article 24) under thecomitology decision, No. 1999/468.
