2. 의약품 규제정보

(1) 인허가 규제기관

1) 보건부(МОЗ, Министерство охраны здоровья)

- 규제가 바뀌면서 의약품, 의료기기, 식품 등 국민의 보건에 관련된 모든

권리가 보건부로 전환됨. 이를 통해 보건부는 의약품을 등록하는 데에 있어

보다 더 편리한 싱글 윈도우 시스템을 도입할 수 있음

- 의약품을 등록할 때 등록 관련 서류 및 의약품의 안전성・유효성 및

품질을 검토하는 기관

- State Audit Centre가 제공한 정보를 바탕으로 의약품 인허가를 승인할 지

거절할 지 결정하는 기관

- 약가 모니터링 및 유통 감독 등을 담당하는 기관

(2) 인허가 규제정보

1) 허가 절차

- 미국, 스위스, 일본, 호주, 캐나다, 유럽연합(EU)에서 등록되어 이 국가들

시장에서 사용되고 있는 의약품을 등록할 경우, 승인/거절 여부는 7일

이내, 최종 결과는 10일 이내 나옴

- 기타 의약품 등록에 대한 승인/거절 여부는 10일 이내 나옴

2) 허가 소요기간

- 제품에 따라 다르며, 의약품 등록 평균 소요기간(‘15년 기준)은 다음과 같음

◾ 제네릭의약품 : 90일(18주)

◾ 오리지널의약품 : 210일(42주)

* 미국, 스위스, 일본, 호주, 케나다, EU에 등록되어 이 국가들 시장에서

사용되고 있는 의약품을 등록할 경우 승인 또는 거절에 대한 여부는

7일 이내 나옴

◾ 재등록은 허가서가 만료되기 90일 전까지 신청해야 하며, 재등록해서

얻은 허가서는 만료되지 않음(보건부에서 complain이 들어오지 않은 이상)

◾ GMP 인증서는 우크라이나 보건부로부터 인정됨

◾ API 등록은 완제품 등록과 동시에 할 수 있음(별도로 해도 됨)

◾ 제출서류 검토 후 10일 이내에 인허가 승인 또는 거절 여부를 알려야 함

◾ 허가서 만료기간은 1년 연장될 수 있음(5년 → 6년)

◾ 약국에서 만들어지는 의약품은 등록되지 않음

4) 등록 간소화

- 2016년 5월 31일 우크라이나 의회는 해외에서 판매되는 의약품의 등록을

간소화하는 법률을 통과시킴

- 배경 : 2016년 4월 20일 우크라이나 내각(Cabinet of Ministers of Ukraine)은

’의약품의 국가 등록(등록 갱신) 절차[Procedure for State Registration

(Registration Renewal) of Medicinal Products]‘를 개정하는 내용의

결의안(Resolution No. 312)을 채택함

- 주요 내용 : 동 법률의 개정사항은 i) 미국, EU, 스위스, 일본, 캐나다 등

엄격한 규정을 보유한 국가 내에서 판매되는 의약품, ii) 모든 의약품에

대한 개정으로 분류됨

가. 엄격한 규정을 보유한 국가 내에서 판매되는 의약품

- 등록인의 품질관리 방안 설명서, 등록 서류 일체, 등록 수수료 확인서 등

제출 의무화

◾ 국가 등록 시 전문가 심사제도 폐지 및 국가 전문가센터(State Expert

Centre)의 제출 서류 검토 제도 신설

◾ 국가 전문가센터의 검토 기간은 근무일 기준 최대 10일로 제한

◾ 우크라이나 보건부의 의약품 허가 또는 거절 결정 기간은 기존의

1달에서 근무일 기준 7일로 축소

나. 모든 외국 판매 의약품

◾ 국가 등록 결정 기간은 기존의 1달에서 근무일 기준 10일로 축소

◾ 제출된 신청서에 기재된 정보, 등록 상황 및 결정은 국가 전문가센터

3. 의료 및 약가 제도

(1) 의료제도

- 우크라이나에서는 필수 의료보험제도가 존재하지 않음. 2009년부터 정부가

제도를 도입할 것이라고 이야기해 왔지만 아직까지 도입이 안 된 상태임. 대신

정부는 의료분야를 위해 매년 국가 예산을 분배해 주고 있음

(2) 약가

- 우크라이나는 국가가 약가를 규제하고 있으며, 현재 의약품 자유시장에서 피

규제 모델로 전환하고 있음

가. 담당 기관

- 우크라이나 내각은 전국 약가를 감독 및 규제하고 있음

- 약가 감시와 의약품 규제를 전담하는 국가 당국은 우크라이나 보건부 제약

부문 개발청이며, 약가 규제는 우크라이나 경제개발무역부 가격규제 검사국

에서도 담당하고 있음

- 약가 규제는 보건부와 우크라이나 의약품관리국, 약가 규제 및 세관 검사국의

협력으로 수행되며, 세관은 매월 20일 이전에 수입의약품과 의료기기에

관하여 가격규제 검사국에 정보를 제출하고, 추가 가격 규제는 고부가

가치 규제로 실시하고 있음

나. 약가 책정 절차

- 국가 가격규제는 국가와 지방 예산으로 구입하는 의약품과 약국에서 판매

되는 의약품에 적용됨

- 제약 도매업자는 이익에 손해를 보고 약국에 리베이트나 할인을 제공하는

것이 일반적인 관행이며, 약국은 자체 또는 지역사회 프로그램에 따라

최종 소비자에게 할인을 제공할 수 있음

◾ 고객이 지불하는 최종 약가는 법정 최고 도매가와 소매가 인상분이 포함

되지만, 이러한 약가는 도매업자뿐 아니라 약국이 환자에게 할인을 제공할

수 있는 최대 약가로 인정됨

- 의약품의 최대 도매 및 소매 인상분은 법률로 정하며, 약가 책정 분야에

적용되는 주요 법률은 아래와 같음

◾ 약가 및 약가 책정에 대한 2013년 1월 5일자 우크라이나 법률 5007-

Ⅵ호, 2012년 6월 21일 자 법률 5496-Ⅵ호에 의한 통합 개정본

◾ 의약품 및 의료기기 가격 안정화 관련 활동에 대한 2008년 10월 17일자

개정 우크라이나 내각령 955호

◾ 의약품 및 의료기기 가격의 국가 규제에 대한 일부 문제에 대한 우크

라이나 내각령 333호, 25.03.09

◾ 의약품 및 의료기기 도매가와 등기부 변경 절차, 의약품 및 의료기기

도매가 변경신고 양식에 대한 2012년 9월 7일자 우크라이나 보건부

명령 705호

◾ 예산 지원을 받는 의료기관의 의약품 구입 절차에 대한 1996년 9월 5일자

우크라이나 내각령 1071호, 2014년 2월 14일 최종 개정

◾ 국가 및 지방 예산으로 구입하는 의약품 및 의료기기 참조약가 제정에

대한 2014년 7월 2일자 우크라이나 내각령 240호

다. 약가 및 약가 변경 신고

- 국가나 지방 예산의 지원을 받는 모든 의료기관은 등록된 도매약가에

우크라이나 내각령 955호, 2008년 10월 17일(CRI # 95916)에서 정의하는

관세와 VAT(해당되는 경우), 부가가치를 가산한 금액 이하로 의약품과

의료기기를 구입함

- 2014년 8월 1일부터 아래 의약품 유형에 대해서는 도매약가 변경 신고 의무화

◾ 마약류 및 향정신성 의약품과 전구물질, 활성물질, 의료용 가스, 의사나

의료기관의 지시를 받아 약국에서 공인된 성분을 이용하여 즉석으로

제조하는 의약품을 제외하고, 국가 및 지방 예산이 전액 또는 일부 지원

되는 의료기관이 구입할 수 있는 우크라이나 국내・외 제조 의약품

목록에 포함되는 의약품

◾ 국가 의료장비 및 의료기기 등록부에 포함되는 의료장비나 의료기기

적합성 선언서가 있고 국가 및 지방 예산에서 전액이나 일부가 지원

되는 의료장비를 제외하고 드레싱 및 봉합재와 치과용품, 위생제품 및

재료, 보철제품 및 재료, 검사실 제품, 안경용 광학제품, 의료기기 및

의약품 포장 및 보관용 제품 및 재료, 의료 광도계 키트, ELISA, 무선

면역 및 기타 유형의 분석, 의료용 가방, 구급상자, 의료에 사용되는

고분자나 고무, 기타 재료로 만든 제품과 같은 의료기기

◾ 2014년 7월 15일 이전에 실시된 모든 약가 변경은 2015년 3월 1일까지

국가 및 지방 예산으로 구입하는 의약품 및 의료기기 참조약가 제정에

대한 2014년 7월 2일자 우크라이나 내각령 240호(CRI # 200664)에

따라 신고해야 함

◾ 동 내각령은 상기 의약품과 의료기기의 도매가 등록을 위해 아래의

절차를 정의하고 있음

◾ 약가 변경은 각 제형과 투여량, 의약품 포장, 기기의 형식과 종류, 상

표별로 등록해야 하며, 우크라이나 국내에서 제조되는 의약품에 대해

MAH는 선적료와 취급료를 제외한 약가를 UAH로 표시해야 함.

◾ 해외 제조 의약품에 대한 약가는 UAH와 외화로 표시해야 하며, 가격

변경 신고 신청서 제출 당일의 환율을 반드시 언급해야 함

- 의약품에 신고된 도매가는 참조국(원산지와 불가리아, 몰도바, 폴란드,

슬로바키아, 체코, 라트비아, 헝가리, 세르비아)과 우크라이나에 해당하는

의약품 도매가의 산술평균을 초과해서는 안 됨

- MAH는 아래 문서를 보건부(서류 사본 2부)에 제출해야 함

◾ 보건부가 정하는 신청 양식

◾ 의약품이나 기기 가격 변경의 필요성을 설명하는 보고서

◾ 참조국과 우크라이나 해당 의약품의 도매가를 표시하는 보고서(본 요건은

의약품에만 적용됨)

◾ 의약품에 대해 보건부가 발급하는 허가증 사본(의료기기의 경우에는

우크라이나 의약품관리국이 발급하는 등록증이나 적합성 선언 사본)

◾ MHA가 대리인을 지정하고 도매가 변경 신고 권한을 명기하기 위해

발급하는 위임장 또는 우크라이나어로 번역한 의료기기의 허가증이나

해당 문서의 공증 사본

- 우크라이나 보건부는 제출물을 접수한 후 5 업무일 안에 우크라이나 가격

규제 검사국의 평가를 받기 위해 문서 사본 1부를 발송하며, 가격규제

검사국은 10 업무일 안에 '의약품 도매가 계산의 경제적 타당성에 대한

결론'을 발행하여 보건부에 반송해야 함

◾ 부정적 결과일 경우 가격규제 검사국은 보건국에 제출하는 서면 양식에

상세한 거부 근거를 명기해야 하며, 보건부는 5 업무일 안에 신청인에게

부정적 결과를 서면 양식으로 통지해야 함

◾ 긍정적 결과일 경우 보건부는 가격규제 검사국의 결론을 접수한 후 5일

안에(의약품의 경우) 또는 의료기기의 신청서 등록일 이후 10일 안에

국가등록부에 정보를 업데이트하며, 그 후 2일 안에 보건부는 본 정보를

자체 웹사이트에 발표해야 함

◾ 문서가 미비할 경우 보건부는 신청서 등록일 이후 5일 안에 신청인에게

서면 양식으로 통지해야 하며, 이 경우 자료는 등록부에 제출하지 않음

라. 약가 책정

- 의약품 및 의료기기 가격안과 관련 활동에 대한 2008년 10월 17일자

우크라이나 내각령 955호(CRI # 95916)에 따름

◾ 국가 주요 의약품 및 의료기기(마악류와 향정신성 의약품과 의료용 가스

제외) 목록에 등재되는 의약품 및 의료기기에 대한 최대 부가가치(약가

인상)는 도매가의 10%를 초과해서는 안 되며, 소매가액은 아래 가액을

초과해서는 안 되는 조달가에 따라야 함

◾ 국가 기금이 전액 또는 일부 지원되는 국가 의약품 및 의료기기 도매가

등록부에 포함되는 의약품 및 의료기기(마악류와 향정신성 의약품과

의료용 가스 제외)에 대한 최대 부가가치(약가 인상)는 도매가의

10%(VAT 및 관세 포함) 및 소매 매출의 10%(VAT 포함)를 초과해서는

안 됨

• 국가 입찰에 참여하는 의약품 약가의 인상분 총액은 견적 송장가액의

20%를 초과해서는 안 됨

◾ 포장 약가가 12 UAH 이하인 국산 의약품은 국가 예산으로 지원하는

경우를 제외하고 약가 규제를 받지 않음

- 약가는 의약품 판매(도매나 소매) 당일 UAH로 계산함

- 국가의 규제를 받는 의약품 가격 제정 메커니즘은 2009년 3월 25일자

우크라이나 내각령(CRI # 95920)으로 정하며, 약가 계산에는 아래와 같이

3개 공식이 사용됨

◾ 수입품 도매업자가 정하는 단가

• 수입품 단가 = 통관 신고 당시 가격 × (은행 간 통화시장의 UAH 환율 80)/

(국립은행의 UAH 환율)

◾ 약국에 추가로 유통하는 의약품에 대해 도매업자가 정하는 구매(조달) 단가

• 구매가 = 도매가 + 부가가치(위 참조)

◾ 약국에서 제품을 판매하는 상업 기업이 정하는 의약품 소매 단가 =

소매가 + 구입(조달)가 + 부가가치(위 참조)

마. 가격 인상

- 가격 인상은 유효한 법률에 따라 도매업자 및 약국에서 조절하며, 가격

인상은 견적 송장에 발표되는 통관 가격을 기반으로 함

◾ 도매업자는 견적 송장에 제시된 원가를 토대로 최대 가격 인상분을 계산함

◾ 약국은 도매업자가 제공하는 원가를 토대로 최대 가격 인상분을 계산함

- 평가는 관련 의약품의 최종 평가 이후 변경된 제약, 의료-치료 및 보건

경제의 관점을 기반으로 실시해야 하며, 해당 기업은 약가 인상의 근거를

충분히 입증해야 함

- 정부가 규제하는 주요 의약품 및 의료기기 국가 목록은 의약품 및 의료기기

약가의 국가 규제에 따른 일부 문제에 대한 2009년 3월 25일자 우크라이나

내각령 제333호(CRI # 95920)에 의해 채택되었으며, 목록은 ATC 분류에

따라 국제 일반명(INN)과 약물치료군으로 등재됨

(3) 의료시스템

- 정부 주도의 의료지원 서비스 제공

◾ 기본적으로 우크라이나 국립병원은 환자 진료 및 의약품을 무료로 제공

• 정부의 예산 부족으로 의약품의 경우 실제로는 환자가 비용을 부담하고 있음

- 의료분야 공공조달 역시 정부 주도 하에 실시

◾ 병원 의약품 및 관련 제품 조달은 우크라이나 보건부 주도로 실시

◾ 최근 우크라이나 경기 침체, 환율 폭락 등으로 인해 대외 부채 급상승,

공공조달 분야 예산이 상당 부분 삭감됨

◾ 예산 부족으로 가격이 높은 의료기기보다 의약품 조달이 더 활성화돼 있음

(4) 공공조달 체계

- 의약품시장에서의 정부 구매 비중이 57%를 차지하고 있을 정도로 정부의

지원과 규제가 매우 큼

◾ 현지에서의 네트워크 구축이 확고한 제조사와의 파트너십(현지 공동생산)이

시장 진출의 중요한 요소임

- 정부 주도 공공조달과 개별 병원의 수요에 따른 공공조달 2가지 방식으로 나뉨

◾ 정부 프로그램 : 보건부에서 계획에서 입찰조건 관리까지 모두 관리(정부

지원이 우선적으로 필요한 당뇨, AIDS 치료제 주로 조달)

- 우크라이나 제약산업 규모는 2015년 468억 UAH(21억 4천만 달러)에서

- 2013년 기준 약 1만 4천여 종의 의약품이 등록되어 있음

• InterChem was founded in 1992 on the basis of the pilot plant

of A.V. Bogatskiy Physico-Chemical Institute of the Academy of

Sciences of Ukraine, and in 2012 celebrated its 20th anniversary.

Commercial activity started with the production of the unique

products of fine organic synthesis, then the production of

original active pharmaceutical ingredients was launched, these

API’s were developed by the scientists of A.V. Bogatsky

Physico-Chemical Institute. We also dealt with the import of the

substitution substances that have never been produced in

Ukraine before.

• The key event in the development of our company was the

creation of the plant for the production of drugs. Building

started in August 2002 with ‘zero cycle’ according to the

European rules - Good Manufacturing Practices(GMP). We have

realized this project from the first pile to starting production

during the record period of time - 2 years. This event was the

closing link in the creation of the domestic pharmaceutical

industry of the full cycle, performing screening and the

development of active chemical compounds - the production of

API’s - manufacture of drugs - wholesale and retail sale of the

drugs by the same company. As soon as four years after the

start of production the second production line was put into

operation, which allowed to increase the volume of production

by 4 times.

• Since 2007, the production line of ready-made medicines is being

regularly certified for compliance with international standards of

good manufacturing practice(GMP). On May 2016 the company

launched a third production line, which increased the production

capacity by almost 4 times, and add to the InterChem product

portfolio drugs in the form of capsules and powders in sachets.

• One of the priorities of the company was, is and will be the

scientific researches. Our company has a great research potential.

On the basis of our own laboratories(research, analytical and

microbiological) which are equipped according to the

international standards we have also realized the development of

innovative medicines, as well as security and control of
