FROM THE EDITOR Reading through Facebook comments and emails, I am reminded what an amazing community of makers, doers and dreamers make up the Bavaro-Punta Cana community.

It’s been over four years that we officially launched the Punta Cana Lifestyles MAGAZINE and laid the foundation that would include a commitment to promoting area business and community. In that time we’ve gone through many evolutions in the quality and focus of our content. In this quest to celebrate all that is Bavaro-Punta Cana, we’ve made efforts to share diversity in voices and perspectives. The ride has been a bit bumpy at times, but I wouldn’t trade it for anything. We have been blessed to be able to attract writers, designers, photographers, and dreamers from all walks of life.

With much appreciation and gratitude and humility, we want to thank our loyal advertisers for

always believing in us and being there for all the highs and lows. We couldn’t do this without you.

Leyendo los comentarios de Facebook y los correos electrónicos, me hace pensar en la comunidad asombrosa que forman los constructores, hacedores y soñadores que forman la comunidad de Bávaro-Punta Cana.

Han pasado más de cinco años desde que lanzamos oficialmente la revista Punta Cana Lifestyles de Punta Cana y establecimos el fundamente que incluiría el compromiso de promover los negocios de la zona y la comunidad. En este tiempo hemos pasado muchas evoluciones en la calidad y en el enfoque de nuestro contenido. En esa búsqueda por celebrar todo lo que es Bávaro-Punta Cana, nos hemos esforzado en compartir la diversidad en las voces y las perspectivas. El viaje ha sido un poco accidentado a veces, pero no lo cambiaría por nada. Hemos sido bendecidos al haber sido capaces de atraer escritores, diseñadores, fotógrafos y soñadores de todos los estilos de vida.

Вот уже четыре года, как мы официально объ-явили о запуске журнала Punta Cana Lifestyles Magazine и заложили фундамент, который вклю-чает и обязательство продвижения делового района и сообщества. “I came for a week and I stayed! I love it here- I don’t know how to explain it. Seeking a sunny place, I traveled to Australia, the Middle East and never felt quite as at home as I do here. I also had the opportunity to invest in a business here.”  That was over two years ago! Katia is now investor and partner of Caraibe Excursion, a company specializing in high-end excursion experiences in the Dominican Republic.  Until recently, most of her clients have been French but now the website has been translated into 12 languages to accommodate potential clients from all over the world. 

Though Katia works with some resorts, most of her clients come directly from her website.  “There are many excursion companies to choose from so people go to Trip Advisor for reviews, which are the best way to get information. All of our suppliers are vetted for excellent service

and if my clients need a more custom-made excursion we are able to meet their needs.”  When asked what excursion tourists must not miss before going back home Katia exclaimed, “You have to see Saona…it’s like going to Manhattan and not seeing Time Square- my customers love Saona Island! Also, the excursion on the private catamaran a la carte.  We can accommodate from 2 to 100 people. People like it because it’s not a full day, only 3-4 hours with an open bar, snorkeling and swimming in the natural pool…a lot of fun!”

“¡Vine para estar una semana y me quedé! Me encanta este lugar, no sé cómo explicarlo. Buscando un sitio soleado, viajé a Australia y a Oriente Medio, pero nunca tuve esa sensación de estar como en casa que tengo aquí, donde también tuve la oportunidad de invertir en un negocio”. ¡Eso fue hace más de dos años! Actualmente, Katia es inversora y socia de Caraïbe Excursion, una empresa especializada en experiencias de excursión de calidad superior en la República Dominicana. Hasta hace poco tiempo, la mayoría de sus clientes eran franceses, pero ahora la página web se ha traducido a 12 idiomas para adaptarse a clientes potenciales de todo el mundo.

Aunque Katia trabaja con algunos centros turísticos, la mayoría de sus clientes proceden directamente de su página web. “Hay muchas empresas de excursiones para elegir, así que la gente utiliza Trip Advisor para leer reseñas, que son la mejor fuente de información. Todos nuestros proveedores están

aprobados por su excelente servicio, y si mis clientes necesitan una excursión personalizada podemos atender sus necesidades”. Cuando le preguntaron qué es lo que los excursionistas no se deben perder antes de volver a casa, Katia exclamó: “Tienes que ver Saona… es como ir a Manhattan y no ver Times Square. ¡A mis clientes les encanta Isla Saona! También, la excursión en catamarán privado a la carta. Tenemos capacidad para de 2 a 100 personas. A la gente le gusta porque no es un día entero, solo son 3-4 horas con barra libre, buceo de superficie y natación en la piscina natural... ¡muy divertido!”.

У меня появилась возможность инвести-ровать в бизнес.» Это было два года назад! This airy, high-vaulted ceiling restaurant opened in November of 2014 to the delight of many. Co-owners, Enrico Canuti and Marina Pasculli take pride in providing high-end service with uniformed waiters and bartenders, whose attention to detail is a welcomed treat. When asking Enrico about the concept of the restaurant he replied, “Originally we started out as an excursion business in 2010 which is what we also do but we eventually decided that a restaurant and spa would provide greater service to our customers. We cater weddings and other events. We want to give the best

quality food and service at reasonable prices.”

Whether dining inside or lunching and sunning on their private beach chairs, the experience is relaxing and pampered. Upon arriving, customers are treated to a glass of House Sangria and a platter of what they call Welcome Bread with two choices for topping. The wine list is impressive with a high recommendation for the Chianti Ruffino from Tuscany. My favorites are the Tortino di Melanzane/Eggplant Parmesan; Gamberi Alle Spezie /Shrimp in white wine, herbs and picante; Spaghetti Aragosta/Spaghetti with lobster, touch of cream, tomatoes and basil and the Filetto alla Griglia/ grilled Filet Mignon with a porcini mushroom sauce. With over 60 selections on the menu to choose from, there is something delicious to please all.

In 1962, two plastic surgeons from Texas, Frank Gerow and Thomas Cronin, proposed a new technique to Timmie Jean Lindsey: placement of the first silicone implants. Timmie, a single mother with 6 children, who had actually attended their consultation to remove a tattoo on one of her breasts, agreed to be the guinea pig. These two surgeons never imagined at that time the magnitude and the impact that they would generate in the field of plastic surgery. From this moment on, silicone implants developed throughout the years and the quality of materials and safety improved, based on clinical and laboratory studies. Currently, implants are designed using advanced technology and high standards of quality. They contain a cohesive gel coated with several resistant layers, capable of withstanding up to 25 times the force of a mammography.

There are various types and sizes of implant, and it has been demonstrated that these do not increase the likelihood of developing breast cancer nor autoimmune diseases. Neither do they interfere with routine breast screening. Today, autologous fat grafts (lipo-filling or fatty fills) are another technique used for breast augmentation, although this takes slightly longer to achieve the result as it is carried out across several sessions. Lipo-filling is very useful for breast reconstruction. The future of breast augmentations in the next few years will be developed in the field of Molecular Biology. A three-dimensional reabsorb able matrix is being investigated, personalized for each patient, which permits growth of new blood vessels. With this mold, the transferred fat will be better nourished and retained. Other studies are based on the cultivation of fatty cells formed using stem cells, on a similar three-dimensional structure.

Despite this, today, silicone implants are still the best option for breast augmentation, and the most common type of surgery carried out in the world according to statistics.

Past, present and future of breast augmentations.Interest in increasing breast size dates from the end of the 19th Century. Sponges, glass balls and paraffin injections were used for these purposes, causing serious health complications and damage to breast tissues.

En 1962, dos cirujanos plásticos de Texas, Frank Gerow y Thomas Cronin, le proponen una novedosa técnica a Timmie Jean Lindsey: colocarle los primeros implantes de siliconas. Timmie, madre soltera y con 6 niños, que en realidad había consultado por la eliminación de un tatuaje en un seno, accedió a ser el conejito de indias. Estos dos cirujanos, no imaginaron en ese momento la magnitud y el impacto que generarían en el campo de la cirugía plástica.

A partir de ese momento, los implantes de siliconas fueron evolucionando a través de los años en cuanto a la calidad de los materiales y seguridad, basados en investigaciones clínicas y de laboratorio. Actualmente estos implantes están desarrollados con tecnología de avanzada y altos

estándares de calidad. Poseen un gel cohesivo recubierto de múltiples capas resistentes, capaces de soportar hasta 25 veces la fuerza de una mamografía.

Existen numerosas formas y tamaños de prótesis, y está demostrado que no se relacionan con el desarrollo de cáncer de mama ni de enfermedades autoinmunes. Tampoco interfieren en el examen mamario de rutina. En la actualidad el injerto de grasa autóloga (lipofilling o relleno graso) es otra de las técnicas para aumentar los senos, aunque lleva un poco más de tiempo llegar al resultado ya que se realiza en varias sesiones. El lipofilling es de gran utilidad en reconstrucción mamaria.

El futuro del aumento mamario en los próximos años, estará en el campo de la Biología Molecular. Se está investigando sobre el diseño de una matriz tridimensional reabsorbible, con la forma personalizada de cada paciente, que permite el crecimiento de nuevos vasos sanguíneos. Sobre este molde, la grasa lipotransferida será mejor nutrida y retenida. Otros estudios, se basan en el cultivo de células grasas formadas a partir de células madres, sobre una estructura tridimensional similar.

A pesar de ello, hoy en día, los implantes de siliconas continúan siendo la mejor opción para el aumento de senos, y la cirugía más realizada en el mundo según las estadísticas.

El interés por el aumento del tamaño de los Senos data de fines del siglo XIX. Esponjas, bolas de vidrio e inyecciones de parafina eran utilizadas para tal fin, trayendo graves complicaciones en los tejidos.

С этого мо-мента силиконовые имплантаты совершенствовались на протяжении многих лет, безопасность материалов изучалась в клинических и лабораторных исследова-ниях. В настоящее время используются имплантаты разработанные на основе передовых технологий и высоких стандартов качества. Они содержат гель, покрытый несколькими прочными оболочками, спо-собными выдерживать нагрузку, в 25 раз выше, чем в маммографии.

Есть различные типы и размеры имплантатов, и было доказано, что они не повышают риск заболева-ния раком молочной железы, или аутоиммунными

заболеваниями. Инъекции собственного жира (ли-по-наполнение) являются сегодня еще одним мето-дом, используемым для увеличения груди, хотя этот способ занимает немного больше времени для дости-жения результата, поскольку необходимо несколько сеансов. Allergy is a public health problem of pandemic proportions that affects more than 300 million people worldwide. The World Allergy Organization (WAO) has published an official consent where alerts of the increasing of allergies. According to experts, 1 out of every 3 children has an allergy and they expect the disease to affect more than 50% of all citizens in 10 years’ time.

Allergic diseases can limit activities and lower the quality of life, particularly when they coexist in the same individual. Apart from individual suffering allergic diseases present a very high socioeconomic burden to patients and families. Atopic dermatitis is often the first sign that the child has an atopic phenotype and may develop rhinitis and asthma when they grow up. 50% of people with allergic rhinitis have asthma.

Asthma is one of the most common chronic disorders; it affects 300 million patients around the world of all ages and is a serious challenge to public health.

This disease, triggered by allergens such as pet dander, house dust mites, pollens, molds, infections, exercise and environmental factors such as tobacco smoke or air pollution, impairs patients' quality of life and may even cause death. Food allergy is a growing public health concern, affecting more than 25 million people worldwide.

More than 120 foods have been described as causing food allergies, with the most frequent causes of food reactions being milk, eggs, wheat, peanuts, tree nuts, fish and shellfish. Very few people are aware that a severe allergic reaction, such as anaphylaxis, can result in death. Drug allergies is highly increasing in recent years, being antibiotics, non-steroid anti-inflammatories (NSAIDs) and contrast media the principal drugs involved. It is a great challenge of both patients and professionals to timely diagnose these conditions allowing prevention and education facing the future of these patients not trapped by allergies.

Trapped by Allergies

La Alergia es un problema de salud pública de proporciones pandémicas que afecta a más de 300 millones de personas en todo el mundo. La Organización Mundial de Alergia (WAO) ha publicado un posicionamiento oficial donde alerta sobre el aumento de las enfermedades alérgicas. The islands are perfect for vacation. The slight breeze, beautiful beaches, and serene setting allow such a peaceful and relaxing atmosphere. We took an amazing private trip to one of the most desired and gorgeous locations in the world: Saona Island. Located in the Province of la Altagracia, it holds multitudes of different types of wildlife and is a protected nature reserve. The crystal clear waters are easy to wade in and are only a few feet deep, even hundreds of feet off of the beach. As part of East National Park, it promised us beautiful landscapes and natural coastline. Saona Island definitely didn’t disappoint.

This was not a typical tourist trip to the islands. Our private tour was extremely well thought out, and put relaxation at the forefront of the experience. Lary Tours began our perfect vacation in the beautiful mainland city of Bayahibe, directly on the coast of the Caribbean Sea. It’s gorgeous and calm waters were perfect for snorkeling, and we got to watch the locals fishing and really become a part of their culture for the short time we were there. There were gorgeous flowers everywhere in full bloom, the likes of which we’d never seen. We later learned that they are critically endangered and indigenous to the area, and are called the Bayahíbe

Rose (or Pereskia quisqueyana).

As we were enjoying our short exploration of Bayahibe, the captain was preparing a nice boat for our comfort. It was only a short trip from the mainland, but the captain was careful to ensure that we enjoyed every moment. When we were arriving at the island, we saw such a beautiful and peaceful looking beach. We assumed that we’d see it filled with drunken 20-somethings, tanning, screaming and marring the beautiful views. We were so excited and surprised to see that it was a private beach. So private that it was literally empty, allowing us to see each inch of the beautiful white sand as we rolled over

It’s gorgeous and calm waters were perfect for snorkeling, and we got to watch the locals fishing and really become a part of their culture for the short time we were there.

The captain prepared fresh fish for us right on that beautiful beach and I have never experienced a vacation so lovely. We went directly to the only establishment on the peaceful island, Mano Juan. This is a trip that we will remember for years to come, and is definitely not your typical tourist vacation. We can’t wait to take another destination trip with Lary Tours!

floración, nunca habíamos visto nada igual. Más tarde nos informaron de que es una especie en peligro crítico de extinción y endémica, llamada rosa de Bayahíbe (o Pereskia quisqueyana).

Como estábamos disfrutando con nuestra breve exploración de Bayahíbe, el capitán estaba preparando un barco precioso para que estuviésemos cómodos. Era solo un viaje corto a la tierra principal, pero el capitán se esmeró para asegurar que disfrutásemos de cada momento. Cuando llegamos a la isla, vimos una playa de aspecto precioso y pacífico. Suponíamos que la veríamos repleta de veinteañeros ebrios tomando el sol, gritando y arruinando las preciosas vistas. Nos emocionamos y sorprendimos cuando supimos que era una playa privada... tan privada que estaba literalmente vacía, lo que nos permitió ver cada centímetro de la espléndida arena blanca mientras surcábamos la maravillosa agua azul.

El capitán nos preparó pescado fresco en esa isla preciosa y nunca he vivido unas vacaciones tan encantadoras. Fuimos directamente al único establecimiento de la pacífica isla, Mano Juan. Este es un viaje que recordaré los años venideros y, sin lugar a dudas, no son las típicas vacaciones turísticas. ¡Estoy impaciente por hacer otro viaje a un destino turístico con Lary Tours!

Las islas son perfectas para las vacaciones. La brisa ligera, las playas bonitas y el entorno tranquilo permiten disfrutar de un ambiente muy pacífico y relajante. Hicimos un sorprendente viaje privado a uno de los lugares más deseados y maravillosos del mundo: Isla Saona. Ubicada en la provincia de La Altagracia, alberga una fauna con una enorme diversidad y es una reserva natural protegida. Las aguas cristalinas son fáciles de vadear y poco profundas, incluso a cientos de metros de la playa. Como parte del Parque Nacional del Este, nos prometía paisajes y una costa natural de gran belleza. Sin duda, Isla Saona no nos decepcionó.

Este no fue un viaje turístico típico a las islas. Nuestro tour privado estaba espléndidamente diseñado, y la relajación era un factor prioritario de la experiencia. Расположенный в провинции Ла Альтаграсия, он является домом для различных видов диких животных и охраняется как природный запо-ведник. Кристально чистая вода и легкий вход в нее, всего несколько футов глубины, даже если вы далеко от пляжа.

Остров Саона, безусловно, не разочаровал. Это не была типичная ту-ристическая поездка на остров. Наш частный тур был очень хорошо проду-ман, и расслабленность гостей была во главе. Lary Tours начали наш идеаль-ный тур в прекрасной «материковой» части - в городе Байаибе, прямо на бе-регу Карибского моря. Великолепный и спокойные воды которого идеально подходят для подводного плавания. Мы смогли наблюдать за повседнев-ной деятельностью местных рыбаков и почувствовали себя частью их куль-туры за того короткое время, которое мы там были. Повсюду вокруг нас цвели великолепные цветы, подобных

которым мы никогда не видели. Позже мы узнали, что они находятся под угро-зой исчезновения и называются Роза Байаибе (или Pereskia quisqueyana).

Пока мы наслаждались нашим корот-ким исследованием Байаибе, капитан подготовил небольшую лодку для на-шей поездки. Это было только корот-кое путешествие от города, но наш ру-левой вел лодку все время осторожно, чтобы мы получили удовольствие от каждого момента. Когда мы прибыли на остров, мы увидели очень красивый и спокойный пляж. Мы предполагали, что нам придется увидеть кричащих, пьяных отдыхающих, портящих кра-сивый вид и отдых, однако, мы уди-вились, увидев что нас привезли на частный пляж, где было... абсолютно безлюдно,только мы и бирюзовая вода Карибского моря.

Капитан приготовил для нас свежую рыбу прямо на этом прекрасном пля-же, и я никогда не чувствовала себя на отдыхе так прекрасно. Мы также ездили к единственному на острове поселению, Мано Хуан. Это было пу-тешествие, которое мы будем помнить долгие годы, и, безусловно, это не был типичный туристический отдых. Мы не можем дождаться нашей следую-щей поездки с Lary Tours!

Beginning June 1, 2012, residency status in the Dominican Republic is governed by Immigration Law No. 285-04 and Immigration Regulation No. 631-11. Obtaining residence (residence permit) is a two steps process- First, applying for a residency visa in the country of origin and, second, the  submission of documents to the immigration office in the Dominican Republic. Applicants must obtain a residency visa at the Dominican Embassy/Consulate in their country of origin (for citizens of Russia and Ukraine - in Moscow). To apply for the visa they must submit a list of documents and justify their

application (for example, doing business in the country, a contract of employment, marriage to a Dominican citizen etc.). The list of documents required to process a residency visa application is usually listed on the Consulate’s website, but general requirements are: a) Pictures of the applicant; 2) Original passport valid for at least a stay of 60 days in the DR; 3) Documents justifying the granting of the visa. For example, work contract with a Dominican company; 4) Medical certificate from the health authorities of the country of domicile of the applicant; 5) Criminal record certificate from the

authorities of the country of domicile of the applicant; 6) Photocopy of the national I.D. of the applicant, and, if the applicant resides in a third country, photocopy of his/her residency card in the third country; 7) Birth certificate. If in a language other than Spanish, the certificate must be translated by a legal translator and authenticated at the Consulate. Both the original and the translation into Spanish must be filed with the application, if in a foreign language. 8) Marriage certificate, if applicable. The same requirements for birth certificates apply; 9) Letter of guarantee signed by a Dominican or a permanent resident of the DR.  (Guzmán Ariza will provide this letter for our clients); 10) Documents justifying the applicant’s solvency. Foreign documents must be apostilled or legalized at the Dominican Consulate depending on the jurisdiction. Documents in a language other than Spanish must be translated by the Consulate.

Our company provides services to prepare visa applications, in particular the letter of guarantee, as well as advise you on the procedure for the preparation of documents before applying.

After obtaining the residency visa, your lawyer will help you prepare documents to complete the application at the Immigration Department. Upon your arrival to the country, your attorney will accompany you to take the medical tests/ sign necessary forms and provide your fingerprints at the Department of Immigration.

Foreign nationals are prohibited by statute from entering the DR for residency purposes in following cases: - Contagious illness threatening to public health - In the presence of mental illness - Conviction for serious crimes - Previous deportation without the right to a refund or ban the entrance of the pages

As a result, you will receive a plastic card - temporary residency permit - valid for a period of 1 year, which shall be extended annually for 4 years, except for pensioners who renew their residency after the first year, and every 2 years after that. In addition to the residency card, you also receive a Dominican identity document – ‘’Cedula’’. Applicants are divided into three categories - 1) those who can apply for a temporary residence because they have strong links to the country; 2) those who can apply for a temporary residency for labour purposes because they have a work offer from a Dominican corporation; and 3) those who have the right to immediately apply for permanent residence, through one of the following categories: - Investors - Pensioners with income of at least $ 1,500 - Applicants with a monthly income of at least $ 2,000 for last 5 years

Obtaining citizenship. Residents have the right to apply for citizenship in the Dominican Republic  after 2 years from the date of receipt of permanent residency. Foreigners married to Dominican citizens, shall first obtain a residency permit. Approximately 1-2 weeks after filing for citizenship Applications with you will be invited for an interview, we will accompany you there, and also help to prepare for the questions. The interview is held in Spanish. At the end of 12/15 months after the interview, you will participate in the ceremony of taking the oath as a citizen of the Dominican Republic, then after about 2 months you get a national ID of Dominican Republic.

Residencia y Ciudadanía de la República Dominicana Procedimiento de obtención y Características

A partir del 1 de junio de 2012, los asuntos migratorios en la República Dominicana se rigen por la Ley 285-04 sobre Migración y su Reglamento 631-11, de fechas 15 de agosto de 2004 y 19 de octubre de 2011, respectivamente.

Obtener la residencia (permiso de residencia) implica dos etapas – un visado de residencia obtenido en el país de origen y la presentación de documentos en la oficina de inmigración de la República Dominicana.

Puede obtener el visado de residencia de la Embajada de la República Dominicana en su país de origen (en Moscú, para ciudadanos de Rusia y de Ucrania). Debe presentarse un número de documentos y la solicitud de residencia debe estar justificada (por ejemplo, tener negocios en el país, un contrato laboral, matrimonio con un ciudadano dominicano, etc.).

La lista completa de documentos que se deben presentar en el consulado está en su página web, pero los principales son: 1)Fotografías; 2) Pasaporte con vigencia mínima de 18 meses; 3) Fotocopia de sus  documentos de identidad, incluyendo del permiso de residencia si Ud. no es ciudadano del país en el que presenta su solicitud; 4) Acta de nacimiento; 5) Acta de matrimonio, si es casado; 6) Certificado de no antecedentes penales emitido por las autoridades de su actual país de residencia; 7) Certificado médico emitido por las autoridades de salud del país donde reside; 8) Documentos

que justifiquen su interés por residir en la República Dominicana (por ejemplo, un contrato u oferta de trabajo de una empresa dominicana); 9) Carta firmada ante notario por un dominicano o extranjero residente permanente en la República Dominicana que garantice que Ud. en ningún momento será una carga para el Estado Dominicano. (Guzmán Ariza le proporcionará esta carta como parte de sus servicios) 10) Documentos que justifiquen su solvencia económica.

Después de que haya obtenido su visado de residencia, su abogado le ayudará a preparar los documentos para su solicitud a la Dirección General de Migración. Los ciudadanos extranjeros tienen prohibido por estatuto entrar a la RD con propósitos de residencia si tienen algo de lo siguiente:

- Enfermedad contagiosa que amenace la salud pública

- Enfermedad mental

- Condena por crímenes serios

- Deportación previa sin derecho a volver o una prohibición de presentar nuevas solicitudes.

Después de preparar los documentos, su abogado lo acompañará a realizar una prueba médica. Los resultados tardan alrededor de 10 días. Una vez que los resultados positivos se han recibido, puede presentar una solicitud para la residencia temporal. Entonces obtiene la residencia temporal por un periodo de un año. Esto puede extenderse anualmente durante cuatro años, excepto en el caso de los pensionistas y retirados, cuya residencia se puede renovar cada dos años. Además de la residencia, también

obtiene un documento de identidad – la cédula dominicana.

Los solicitantes están divididos en dos categorías – los que pueden solicitar una residencia temporal y los que tienen derecho a solicitar inmediatamente una residencia permanente. Los de la segunda categoría podrían ser:

- Inversores

- Pensionistas con unos ingresos mensuales de al menos 1500 $

- Solicitantes con unos ingresos mensuales de al menos 2000 $ en los últimos cinco años

- Solicitantes que son familiares cercanos de ciudadanos de la República Dominicana y que tienen la residencia permanente en la República Dominicana (a través de matrimonio o hijos).

Obtener la ciudadaníaTiene el derecho de solicitar la ciudadanía en la República Dominicana sin necesidad de obtener un visado de residencia después de dos años desde la fecha de recepción de la residencia permanente. Los ciudadanos casados con ciudadanos de la República Dominicana deben primero obtener un visado de residencia.Aproximadamente 1-2 semanas después de solicitar la ciudadanía, se le llamará para realizar una entrevista. Lo acompañaremos allí y le ayudaremos a prepararse para las preguntas.

3-5 meses después de la entrevista, podría asistir a la ceremonia de juramento de la ciudadanía de la República Dominicana. основными из них являются: оригинал загранич-ного паспорта, действительный не менее 18 меся-цев до дня окончания, медицинский сертификат, переведенный на испанский язык, свидетельство о рождении, апостилированное и переведенное на испанский язык, справка о несудимости, апо-стилированная и переведенная на испанский язык (срок действия справки – 1 месяц), гарантийное письмо на испанском языке, удостоверенное нота-риусом в присутствии двоих свидетелей, легализо-ванное надлежащим образом, а также декларация гаранта, а также документы, подтверждающие финансовое положение заявителя, заявление-хо-датайство о получении визы, анкету, фото, также оплачивается государственная пошлина за рас-смотрение заявления.

The application of regulation 50-13, which gave fiscal administration to Law 253-12 of the Tax Reforms, with regards to the real estate Tax (RET), has dealt a blow to the real estate market in the Dominican Republic, a sector which was already facing difficulty and which needed different treatment by the authorities in order to recover. The Tax Reforms have come at a bad time for the sector which was already struggling thanks to the real estate and financial crises of Europe and the United States.

Following these reforms, Law 253-12 grants a minimum exempt amount of RD$6,752,000 (indexed to 2014) per taxpayer, adjusted for inflation. This exemption is applied to the total value of real estate assets which are subject to the tax. In spite of this modification, the tax authorities attribute fiscal responsibility to only one of the owners, not taking co-owners or spouses into account. What does all this mean for the real estate market?

Most middle class real estate assets are valued above RD$6,752,000. This makes the purchase of a second asset automatically liable to this tax. This directly affects recreational homes, such as a farm, an apartment at the beach, a villa in the mountains, etc. Consequently, this sector of the real estate market is at a standstill. The same applies to those who want to acquire a real estate asset as a retirement plan or simply as a way of receiving extra income through their savings by means of rental income.

If the aim of the RET law was to increase tax revenues from the real estate sector, it was not well thought out. Since the RET discourages the purchase of a second real estate asset, it stops assets from rising in value by creating higher levels of supply, whilst demand slows, as nobody wants to have more than one asset in their name, due to the tax charges.

Even the Director of the Revenue Department acknowledged, on one occasion, that tax revenues collected from payment of this tax are insignificant.

The RET law discourages investment.By decreasing interest in purchase of a second real estate asset, the construction sector is forced to slow its activities and development. This means fewer jobs for construction workers, engineers, architects; fewer sales in hardware stores and all of the other sectors linked to construction. This results in the opposite effect to increasing tax revenues, transfer of deed taxes and inheritance taxes, at the same time as increasing unemployment.

Whilst the solution may be simple, continuing with the RET law as it stands, is not beneficial for any sector, and does not result in higher revenues for the State.

It would be sufficient to add the exemptions together for each co-owner in the case of shared assets, such as the case of married couples, inheritances and corporations; for example, in the case of a married couple the amounts exempt from tax would be RD$13,504,000.00. This way, more properties would be sold, which would result in higher revenues from transfer of deeds, which equates to 1% of the value of the property. More jobs would be created; this is not just socially and economically more beneficial, it also creates higher tax revenues. People would spend more in commercial establishments, paying more Sales Tax.

Upon adding the exemptions together, a fairer tax would be payable, as only the real estate assets which are truly sumptuary would be taxable, without affecting the dynamics of the economy. Currently, the RET is applied to modest, middle-class properties.

When the government decides to obstruct the real estate market.

La aplicación del reglamento 50-13 que ha dado la Administración Tributaria a la ley 253-12 de la Reforma Fiscal, relativa al Impuesto Inmobiliaria (IPI) ha representado un golpe de gracia al mercado inmobiliaria de la Republica Dominicana, un sector ya en dificultad, y que necesitaba otro trato de parte de las autoridades para salir flote. La Reforma Fiscal ha tomado desprovisto a ese sector que venía sufriendo por de las crisis inmobiliarias y financiera de Europa y los Estados Unidos.

Con esa reforma, la ley 253-12, reconoce un mínimo exento de RD$6,752,000  (indexado al 2014)por contribuyente, ajustado por inflación. Dicha exención se aplica a la totalidad del patrimonio inmobiliario sujeto a impuesto. No obstante esa modificación, la Administración tributaria atribuye la responsabilidad fiscal a un solo de los propietarios, desconociendo a los copropietarios o conyugues. ¿Qué significa todo eso para el mercado inmobiliario?

Las mayoría de los inmuebles de clase media están por encima de los RD$6,752,000. Lo que hace la adquisición de un segundo inmueble automáticamente quede gravado por este impuesto. Esto afecta directamente las viviendas recreativas, como una finca, apartamento en la playa, una villa en la montaña, etc. Por consecuencia, esa parte del mercado inmobiliario se ve estancado. Lo mismo ocurre con quienes pretenden adquirir un inmueble como plan de retiro o simplemente como forma de percibir un ingreso extra por sus ahorros por medio de los alquileres.

Si la idea de la ley del IPI era aumentar la recaudación en el sector inmobiliario fue mal calculada. Ya que el IPI desincentiva la adquisición de una segundo inmueble; impide que los inmuebles incrementen su valor, ya que generan más ofertas, mientras que las demandas van decreciendo, puesto que nadie quiere tener más de un inmueble a su nombre, a causa del cargo impositivo.

El mismo director de impuestos internos reconoció en una ocasión que las recaudaciones por el pago de este impuesto no son significativas.

La ley del IPI desincentiva la inversión. Al disminuir el interés en adquirir un segundo inmueble, el sector de la construcción está obligado en frenar sus actividades y desarrollo. Lo que representa menos puestos de trabajo para obreros, ingenieros, arquitectos; menos ventas de las ferreterías y todos los demás sectores vinculados a la construcción. Con lo que se obtiene un efecto contrario a aumentar las recaudaciones fiscales. El fisco deja de percibir ITIBIS por las compras de materiales, impuestos sobre la renta por las ganancias, impuestos de transferencia e impuestos sucesorales, al mismo tiempo que incrementa el desempleo.

Mientras que la solución puede ser simple, seguir con la ley del IPI tal como está no es beneficioso para ningún sector, y no aporta más al Estado.

Cuando el gobierno decide obstaculizar el mercado inmobiliario.

Применение регламента 50-13, который Налоговое ве-домство приняло в отношении закона 253-12 о фискаль-ной реформе, посвященного налогу на недвижимость, представляет собой смертельный удар по рынку недви-жимости в Доминиканской республике, который уже испытывал трудности и нуждался в поддержке властей, чтобы удержаться на плаву. Налоговая реформа была крайне необходима для этого сектора, страдавшего от кризиса в области недвижимости и финансов в Европе и Соединенных Штатах.

В рамках этой реформы закон 253-12 принимает в каче-стве максимальной суммы, не подлежащей обложению, 6 752 000 доминиканских песо (индексирована в 2014 г.) на каждого налогоплательщика в соответствии с уров-нем инфляции. Эта льгота применяется ко всему недви-жимому имуществу, облагаемому налогом. Невзирая на эту поправку, налоговая администрация накладывает налоговую ответственность исключительно на соб-ственников, снимая ее с сособственников и супругов. Что все это значит для рынка недвижимости?

Стоимость большей части недвижимости, принадле-жащей среднему классу, превышает 6 752 000 песо. Это значит, что покупка второго объекта недвижимости ав-томатически будет подразумевать уплату этого налога. Это напрямую касается жилья для отдыха, например, дачного домика, квартиры у пляжа, домика в горах и т. п. Следовательно, в этой части рынка недвижимости возникнет застой. То же самое произойдет с теми, кто захочет приобрести такую недвижимость, чтобы жить там в старости, или просто для получения дополнитель-ного дохода путем сдачи жилья внаем.

Если идея закона о налоге на недвижимость состояла в повышении сборов в секторе недвижимости, то он плохо просчитан. Ведь закон о недвижимости обесс-мысливает приобретение второго объекта недвижи-мости; препятствует тому, чтобы недвижимость росла в цене, поскольку порождает больше предложений при падении спроса – никто не захочет иметь на свое имя больше одного объекта недвижимости, чтобы избежать налогового бремени.

Сам руководитель налогового ведомства однаж-ды признал, что сборы в рамках этого налога были незначительны.

Закон о налоге на недвижимость негативно влияет на инвестиции.

По мере снижения интереса к покупке второго объекта недвижимости строительный сектор вынужден тор-мозить деятельность и развитие. А это значит меньше рабочих мест для рабочих, инженеров, архитекторов; снижение продаж стройматериалов, упадок в других отраслях, связанных со строительством. Все это произ-водит эффект, обратный повышению собираемости на-логов. Казна перестает получать налоги с купли-прода-жи материалов, подоходный налог, налоги на передачу собственность и налоги на наследство, и в то же время растет безработица.

А ведь решение может быть очень простым: исполнение закона о налоге на недвижимость в его нынешнем виде не выгодно никому и ничего не приносит государству.

Вполне достаточно было бы суммировать льготы каждого из сособственников в случае совместной соб-ственности, которая бывает у супругов, у наследников и товариществ.
