1. Introduction

Secondary Towns Integrated Urban Environmental Improvement Project (STIUEIP) is a project being implemented by loan assistance from the Asian Development Bank (ADB). Its objective is to improve the quality of life in key regional centers in Nepal and help to achieve higher and more socially inclusive economic growth in those centers through effective, efficient, and reliable delivery of improved and affordable municipal services by accountable project municipalities. The Project will implement urban environmental improvement, on an integrated basis, in the areas including sewerage and drainage, solid waste, and urban roads and lanes in Biratnagar, Birgunj and Butwal municipalities. In addition, a water supply development sub-project in Kavre Valley is being implemented. Community development program including awareness-raising on health and hygiene and 3R (reduce, reuse, and recycle), and investment in small-scale community facilities will be carried out. The Project also strengthens capacity of municipalities and the central Government for project management and operation. The Ministry of Urban Development is the Executing Agency (EA), working through its Department of Urban Development and Building Construction (DUDBC), which has established a project coordination office (PCO) for the Project headed by project director. Biratnagar, Birgunj, Butwal and Kavre Valley is the Implementing Agency (IA) for the Project. Project Implementation Unit (PIU) headed by Project Manager is established under the umbrella of the municipalities.

2. Impact and Outcome

The impact will be improved quality of life and higher and more socially inclusive economic growth.

The expected outcome will be improved and affordable municipal services delivered effectively,

efficiently and reliably by accountable Project municipalities.

3.1 Overall Progress Status

Contract for the civil works at Kavre was signed on 19 December, 2012 with Ningbo Ningshing International Inc., China and the contractor mobilized on 12 June, 2013

• Construction of two slow sand filters along with a sedimentation tank has been completed at Shahipani except ladders

• Construction of a sedimentation tank and a reservoir at Dhaneswor, a reservoir each at Kuikel Gaun, Magar Gaun, Bansghari, KUPS, Thakuri Gaun, at Devisthan, Dhulikhel and Sundar Basti and a reservoir and WTP at Salle.

• Laying of 179.4 km of pipeline completed along with leakage testing in 99.98 km of pipeline

• Completed laying of 179.40 km of pipeline in Banepa, Dhulikhel and Panauti along with leakage test of 99.98 km of pipeline.

The overall progress of Kavre up to the reporting period is 64.15% (revised) against the elapsed time of 90.88% (revised)

Biratnagar Sub metropolitan City

Construction of drainage, sewerage system and roads

Contract for the Sub-project was signed on 2 December 2013 with CTCE-Kalika J/V. The contractor mobilized on 8 December 2013

Contract amount (NRs): 2,391,332,525.50 with VAT and contingencies, Revised Contract amount after VO 2 (NRs.): 2,719,617,069.21 inc. VAT

• Earthwork in excavation in anaerobic and facultative ponds at Jatuwa completed along with a laboratory building, a guard house, boundary wall and river training works along Shinghiya Khola

• Construction of 46.04 km of storm water drains including road side drains and 29.65 km of sewer lines completed.

• Preparation of 3.22 Km of Sub-grade, 2.81 km of Sub-base and 2.17 km of base is ongoing

The overall progress of Biratnagar is calculated as 81.19% up to the reporting period.

Environmental assessment (IEE) approved

Birgunj Sub metropolitan City

Construction of drainage, sewerage systems including waste water treatment plant and Roads

Contract for the Sub-project was signed on 24 March 2014 with CTCE-Kalika J/V. The contractor mobilized on 31 March 2014.

Contract amount (NRs): 2,806,503,495.55 with VAT and contingencies. Revised contract amount after VO 2 is NRs. 3,216,714,841.23 including VAT

• Earthwork in excavation in anaerobic and facultative ponds at Chhapkaiya is completed by 40%

• Concreting of deck slab in bridge over SIngha River completed.

• Construction of 34.25 km of storm water drains and 3 km sewer lines completed.

Butwal Municipality

Water supply

Contract was signed with Sumec-Chandra & Basant JV on November 14, 2014. Contractor mobilized since 16 November, 2014.

Contract amount (NRs): 223,627,640.78 with VAT and contingencies

• MoU between Auto Association and Butwal Municipality for the operation and maintenance of infrastructure in Auto Village was signed on 15 May 2014.

• TBER is approved on 4 Dec. 2015 by ADB

4. Purpose of Report

The semi-annual environmental safeguard report has been prepared for the project covering a period of July to December, 2016. Over this period, construction works have been continued in Kavre Valley, Biratnagar and Birgunj and to some extent in Butwal. The following covenants on environment were included in the Loan Agreement with ADB and their present status has been assesses as follows (Table No.3): Table 3: Compliance status with environmental loan covenants

the IEEs will be complied with throughout Project implementation, in accordance with the detailed arrangements set forth in the PAM. MOUD will ensure environmental requirements are incorporated in all bidding documents and civil works contracts, and that environmental monitoring results are incorporated into quarterly progress reports. During the detailed design stage in relation to each Subproject, the Borrower shall ensure that all IEEs/EMPs are updated based on detailed designs.

5. Environmental Category of the Project According the ADB safeguard policy statement, the project is classified as category B. As per legislation of Nepal, IEE is required for drainage, sewerage and roads sub-projects in Biratnagar and Birgunj Sub metropolitan cities and water supply and Auto Village in Butwal municipality. Environmental Impact Assessment (EIA) is required for solid waste management of Birgunj Sub metropolitan city and Butwal municipality and water supply of Kavre valley. 6. Environmental Safeguards Implementation Arrangements

Regarding institutional arrangement, Grievance Redress Committees (GRCs) have been formed in all four municipalities to address overall safeguard related issues (environment, social and resettlement). Likewise safeguard desk (SD) has also been established in Biratnagar. Birgunj, Butwal and Kavre valley.

7. Environmental Safeguard Compliance Status

All the sub-projects of the Secondary Towns Integrated Urban Environmental Improvement Project (STIUEIP) have been environmentally screened and assessed during planning stage as well as in the ongoing implementation phase (refer Annex – I). Sub-projects are not located in or near sensitive or protected areas and environmental assessments made so far concluded that no significant adverse impacts are anticipated from proposed locations, designs, and construction activities. Regarding safeguard compliance status, the details are presented in Table 5.

8. Implementation Status and Mitigation Measures

8.1 Incorporation of Environmental Requirements into Project Contractual Arrangement

Regarding environment protection works and mitigation measures, all have been included in the bidding and contract documents and their cost in bill of quantities.

The details about the environmental protection works planned and implemented along with their cost and the names of the concerned sub projects are presented in Table 6. 8.2 Compliance of Environmental Safeguards in Major Construction Activities

Construction works have been started in Kavre valley, Biratnagar, Birgunj and too some extent in Butwal as well. However, it has been noticed that implementation of EMP is being partially followed. Regarding establishment of safeguard desk, all four PIUs have completed the work. Monitoring checklist has been developed as per EMP and field monitoring for Environmental Safeguards has been continued. DSCs are expected to submit their corresponding environmental safeguard report by January 10, 2017. Regarding monitoring of environmental issues, a checklist has been prepared long before and distributed to PIUs for regular fill-up. In response PIUs (Biratnagar, Birgunj, Butwal and Kavre) have filled up them and sent to PCO, which have been presented in Annex-III. Regarding environmental compliances, the followings are the summary. i. Safeguard Meeting, Awareness No safeguard meeting has been conducted in the reporting period in any of the PIUs despite commitment from each of them for at least two meetings in the reporting period. ii. Earthwork Excavation and Excess Material Management At Biratnagar, the excavated materials (earth) from trenches are dumped in a designated place at Katahari yard, a piece of land owned by the contractor himself. Construction materials are also being stockpiled in the contractor’s yard. In Birgunj as well, the excavated materials from trenches are placed in a designated place. Upon instructions from PCO/PMSC, PIU and DSC, the contractor has strengthened shoring works to keep trenches and workers safe from landslides/caving. However, in some locations where there is liquefied soil condition, shoring work has become in-effective. This has created some nuisance to the people. In this context, Contractor has been made instructed whatever possible measures to minimize nuisance to the people. DSC on its part has developed alternative design of shoring, strong enough to withstand the present soil condition. At Devisthan reservoir site, Kavre Valley, soil that came from slope cutting has been used in filing road sections. Furthermore, the dusty road has been converted into concrete road. The concreting is still ongoing.

iii. Air, Noise and Water Pollution In all the sites, workers have been provided with facemasks to protect themselves from dust in inadequate numbers. But it is noticed that only limited workers use it especially in hot days. It is due to feeling of the workers that they suffocate when used in hot climate. Spraying of water to reduce dust pollution has been effectively carried out in Birgunj drainage/sewerage sites but less effectively in Biratnagar. As a result, people started making complaints against dust pollution. In this context Contractor has been strongly instructed to increase the frequency of water spraying. However, at the location of crusher, there is no problem of dust pollution as such. Regarding noise and water pollution, nothing serious has been recorded so far. iv. Quarry/ Borrow Materials The construction works will require stone, sand and aggregates etc. In Kavre, Biratnagar, Birgunj and Butwal, all the concerned contractors are purchasing these materials from the crusher/quarries owned by private parties. v. Stockpiling of Construction Materials Almost all the contractors, which have signed contracts for civil works in Kavre, Biratnagar, Butwal and Birgunj, have stockpiled construction materials such as aggregates, sand, cement, steel and bricks at various locations without disturbing traffic flow and surface run-off. In Biratnagar, the contractor has used its private land at Katahari and in Brgunj, its premises at WWTP site to stockpile excess construction materials for emergencies. vi. Camp Site Management

The contractor’s camps at Kavre valley, Biratnagar, Birgunj and Butwal have been found good with adequate supply of water and good sanitary facilities. The contractors have also setup few additional site specific camps mostly in hired private buildings. or abandoned school premises. In Butwal, an abandoned school premise of Deep Primary School in ward no. 9 has been converted as a labour camp with all the facilities. vii. Occupational Health and Safety

Occupational health and safety measures have been followed in all the sites, where civil works are ongoing. Workers have been provided with safety gears like jackets, helmet, facemasks, boots etc. Regarding first aid kit, it has been provided to all the sites. The contractors are however, asked to continue keeping sufficient number of the safety gears and first aid in all work sites all the time and strongly advised to compel their workers to use protective clothing during work hours for safety. viii. Tree Plantation/Bio-engineering

Tree plantation and bio-engineering measures are planned to be carried out in Brgunj, Butwal and Kavre. In this context, Butwal has has submitted a request letter for approval of budget to plant 61200 trees in different parts of Butwal. But the request is still on hold due to lack of progress in the landfill site. Like-wise, Birgunj is planning for tree plantation on both sides of main drain MD1and also Canal Road and Kavre at the location of Raw Water Treatment Plant and Reservoir sites. ix. Utilities and Public Services

Relocation and reinstatement of drinking water pipeline, shifting of electric poles etc are provisioned in BoQ. Parts of these works have been already carried out in Birgunj and Biratnagar. x. Sites for Cultural and Religious Values There is no impact foreseen so far on cultural and religious sites. xi. Employment Opportunity Local men and women from the affected family and surrounding areas are noted working in drainage/sewerage sites of Biratnagar and Birgunj. Initiation from the Contractors in this regard is rated good. Similarly, priority is given to local labors as far as possible in all the ongoing sites of Kavre. However in Butwal, such measures have not been noticed.

9. Grievances Redress Mechanisms

Each PIU has formed its own Grievances Redress Committee to address grievances and resolve them through all possible means and inform PCO about the decisions made. In Biratnagar, the Committee is headed by the Executive Officer supported by two other members viz. Project Manager and Social Development Officer. Besides that, the Committee often invites others as per the nature of grievances and requirements to resolve. Birgunj has similar mechanism but with one more member viz. Social Safeguard Expert of the DSC. Regarding Kavre, the Committee is headed by the Project Manager himself with two other members viz. Deputy Project Manager and Social Development Officer. In Butwal, the Committee is headed by the Executive Officer with three other members viz. Project Manager, Chairman of Shivanagar Community Forest User’s Committee and one from Ward No. 4.

Regarding mechanism, upon receiving grievances the relevant Committee calls for a meeting to discuss and conclude on what should have done to resolve the matter. All the issues discussed are recorded and minutes prepared are sent to PCO for information and seek support, in case the grievances are not resolved at the PIU level.

Regarding GRM at PCO level, there is no Committee as such, but there is Focal Person to deal with grievances. The Focal Person is the Deputy Project Director.

Regarding grievances in the reporting period, not a single case is registered in any of the PIUs.

10. Monitoring and Reporting System on Environmental Safeguard

Municipalities submit quarterly environmental monitoring reports to the PCO and semi-annual report to ADB on a regular basis. The summary of quarterly environmental safeguard progress status of planning and implementation stage is given in Annex-I.

11. Major Project Issues and Corrective Actions Plans

Construction works are ongoing at Kavre valley, Biratnagar, Butwal and Birgunj. Implementation of the environmental management plan (EMP) during this reporting period is found satisfactory. Most of the planned actions have been materialized. The following table (Table No. 8) provides the details about corrective plans proposed in June 2016 and their status as of December 2016. 12. Conclusions

In comparison with the past, contractors’ compliance towards environmental management has been better. Nevertheless, continuous orientation on the importance of environmental issues should be provided. So far, no accident and incident was registered. However it is better, if all stakeholders are trained on environmental issues so that adverse impacts related with construction activities are reduced. Moreover, efforts are being made to monitor activities concerning environmental issues on a regular basis or in a gap of two weeks.
