PROUD
We are very proud to host the second EDS at Academy Bartels. The EDS were conceived by a group of Holland’s most highly respected horsemen. Their presentation last year received many accolades from both within the industry and, most importantly, from dressage riders and owners looking for their future partners. It is extremely satisfying for EDS to receive the numerous updates from owners informing us of the ongoing successes being achieved by those horses that went under the hammer here last year. Given the last experience behind the EDS team members, it is not surprising that, once again, they have proved themselves to be Hol-land’s premier horse scouts, presenting many new young stallions at the KWPN Stallion show in February 2015. However, the aim of the EDS team is to present a sales collection perfect for every dressage ent-husiast - from amateurs to professionals, both young or old - including horses with potential for stardom for major championships together with reliable and willing partners for those wishing to simply enjoy our wonderful dressage sport. This philosophy fits well with the aims of Academy Bartels. I would personally like to congratulate the EDS team for this year’s col-lection. It includes brilliant young horses, licensed stallions and even experienced Grand Prix horses. I hope that the Excellent Dressage Sales will realise its ambitions and wish all our guests a fun and enjoyable stay in Hooge Mierde and every success in finding their new equine partner!

Joop van UytertEigenaar van ‘Hengstenhouderij van Uytert’ en Hippische ondernemer van het jaar 2009. De toppaarden van Joop van Uytert worden uitgebracht door (Olympische) ruiters en amazones, zoals Anky van Grunsven, Edward Gal en Hans-Peter Minderhoud. Enkele toppers uit zijn stal: Gribaldi, Krack C, TCN Partout, Vivaldi, Tango, United, Zhivago, Bordeaux, Lucky Times, Easy Game en Painted Black.
Gertjan van OlstEigenaar van ‘Van Olst Horses’ Hippisch Ondernemer van het jaar 2013. Een professionele hippische onderneming, die internationaal opereert binnen alle facetten van de moderne dressuursport- en fokkerij. Zijn vrouw Anne nam deel aan maar liefst vijf Olympische Spe-len, uitkomend voor haar geboorteland Denemarken. Van Olst Horses is ontdekker van de wereldberoemde hengsten Negro en Lord Leatherdale. Beide hengsten hebben bewezen uitstekende verervers te zijn, met nakomelingen als; Valegro, Netto, Taikoen, Nintendo en zonen uit de combinatie van de beide tophengsten zoals: Chippendale, Everdale en Fairytale.
Dutch Equestrian Entrepreneur of the Year in 2009. Joop is owner and director of his stud in Heerewaarden, near Den Bosch. He has produced many approved stallions. His horses have been competing with (Olympic) riders such as Anky van Grunsven, Edward Gal and Hans-Peter Minderhoud. A few top horses from his stable: Gribaldi, Krack C, TCN Partout, Vivaldi, Tango, United, Zhivago, Bordeaux, Lucky Times, Easy Game and Painted Black.
Dutch Equestrian Entrepreneur of the Year 2013, Gertjan owns “Van Olst Horses”, excels in all facets of modern dressage and breeding. His wife Anne was present at five Olympic Games, riding for her native land Denmark. Van Olst Horses produced the famous stallions Negro and Lord Leatherdale. Both stallions have proven to be successful sires with offspring as Valegro, Netto, Taikoen and Nintendo.

Nico WitteEigenaar van opfok-, handels- en africhtingsstal ‘Stal Witte’. Echtgenote Madeleine Witte is succesvol op het allerhoogste niveau van de dressuursport. Internationale namen als o.a. Ulla Salzgeber, Sue Blinks, Tineke Bartels en Rozzie Ryan reden paarden, afkomstig van Stal Witte, in de internationale Grand Prix. Nico heeft een oog voor jong talent. Enkele voorbeelden: Jazz, Wynton, Bretton Woods, Charmeur, Vontango en Ampére.
Tim CoomansFokker & sportliefhebber met zijn eigen opfok-, handels- en africhtingsstal ‘Tim Coomans Dutch Sport Horses’. Onder andere Steffen Peters, Sjef Janssen, Gonnelien Rothenberger-Gordijn en Imke Schellekens-Bartels reden (Olympische) teampaarden, afkomstig van Tim Coomans. Ook is Tim in 2012 uitgeroepen tot fokker van het jaar in Zuid Holland. Enkele paarden uit de stal van Tim: Olympic Bo, Lancet, Ziësto, TC Ravel, TC Dolly, TC Athene en Dreamboy.
Joep SchellekensEchtgenoot van Imke Schellekens-Bartels, maakt deel uit van het familiebedrijf met eigen dressuurstal en evenementenbureau ‘Academy Bartels’. Imke en haar moeder hebben samen zes Olympiades gereden en meerdere individuele & teammedailles behaald op Europese- en Wereldkampioenschappen. Enkele Grand Prix paarden die zij hebben opgeleid: Courage, Duco, Jazz, Barbria, Lancet, Luxaflex, Allegretto, Victoria, Hunter Douglas Sunrise en Toots.
Owner and Director of ‘Witte Stables’, he is the man behind one of the world’s most famous stallions, Jazz. International riders like Ulla Salzgeber, Sue Blinks, Tineke Bartels and Rozzie Ryan rode Grand Prix horses produced by Stable Witte. Live streamClipMyHorse verzorgt de livestream tijdens de presentatie op 22 april en de veiling op 25 april. Via www.clipmyhorse.tv zijn de presentatie en de veiling live te volgen.

UitproberenWanneer u geïnteresseerd bent in een of meerdere veiling-paarden, dan kunt u een afspraak maken met de organisa-tie om de paarden te bezichtigen en uit te proberen onder het zadel. Een week voorafgaand aan de veiling kunt u de paarden proberen op de veilinglocatie, daarvoor is het mogelijk om de paarden te rijden op de thuisbasis van het betreffende paard. Neem contact op met de organisatie om een afspraak te maken, per e-mail [email protected] of telefonisch +31(0)13-5091666. Paarden die nog niet bereden zijn worden aan de hand getoond. Het rijden van de paarden geschied geheel op eigen risico.
BIJZONDERE BEPALINGEN
Veilingvolgorde De catalogusvolgorde wijkt af van de veilingvolgorde. De officiële veilingvolgorde wordt bekend gemaakt voor aanvang van de veiling op 25 april 2015.
VeilingvoorwaardenAchter in de catalogus zijn de complete veilingvoorwaar-den opgenomen. In geval van een geschil prevaleert de Nederlandse versie. De Engelse versie is slechts een toe-lichting op de Nederlandse.
Veterinaire rapportenAlle paarden zijn drie maanden voorafgaand aan de veiling röntgenologisch en klinisch onderzocht. De rapporten en röntgenfoto’s liggen op 25 april ter inza-ge op het kantoor van Excellent Dressage Sales. Vanuit de organisatie is tijdens de veilingdagen een dierenarts aanwezig om desgewenst een toelichting te geven op de foto’s. Indien u eerder toelichting op de rapporten en röntgenfoto’s wenst kunt u telefonisch contact opne-men met de organisatie, deze zal u in contact brengen met een van de dierenartsen. .
VerzekeringTijdens Excellent Dressage Sales is Hippo Zorg aan-wezig om u de mogelijkheid te bieden om na de vei-ling uw paard te verzekeren. U heeft daarbij de keuze uit verschillende verzekeringen. Indien u op voorhand informatie wenst dan kunt u deze opvragen bij de orga-nisatie. Zij kunnen u informeren over de verschillende mogelijkheden.

Try outIf you are interested in one or more of the auction horses it is possible to come and have a look and try them under saddle. If you wish to do so in the week prior to the auction all horses will be based at the venue. If an earlier appointment is necessary this can be arranged and the horses seen and trialled at their own barns. Please contact the organisation to make an appointment on+31(0)13-5091666 or e-mail [email protected]. At the time of the presentation on Wednesday April 22nd 2015, all the horses will be showed for interested par-ties. Ridden horses will be shown under the saddle and unbroken stock in hand. Please note: trial rides are exclusively and entirely at your own risk.
Auction orderThe horses will be shown in a different order to that in the catalogue. The official order of the horses will be announ-ced at the beginning of the auction on 25th of April 2015.
Conditions of auction In the back of the catalogue the complete conditions of auction can be found. In cases of dispute only the Dutch version is binding; the English version is only meant as an explanation of the Dutch version.
Veterinary reportIn the three months before the auction all horse will be X-rayed and clinically examined. The veterinary reports as well as the x-rays will be available for public inspection in the auctioneer’s office during the auction period. The orga-nizations veterinarian will be present to supply explanati-ons. If you require information on x-rays and/or veterinary reports earlier than the auction period this can be arranged by contacting the organisation on [email protected].
InsuranceHippo Zorg will be present during Excellent Dressage Sales to offer you the possibility of insuring your horse(s). A variety of possibilities are available. If you would like to receive infor-mation straightaway before the auction please contact the organisation.

Een bekende verschijning in de internationale dres-suurring : Ulysses la Haya en Laurens van Lieren. De zoon van Gribaldi presteert op het aller hoog-ste niveau van de internationale dressuursport. De combinatie nam met succes deel in Doha, Am-sterdam, Den Bosch, Vidauban, Aken, Hickstead en vele andere prestigieuze concoursen. Ulysses la Haya droeg meerdere malen bij aan de successen van het Nederlandse dressuurteam en sleepte ook individu-ele prijzen in de wacht. Deze ruin is daarbij ook nog interessant gefokt, zijn moeder is namelijk de volle zus van Olympic Ferro. Ulysses la Haya could be your ride to the Olympics!
Laurens van Lieren and the Grand Prix horse Ulysses la Haya are a well-known combination in international dressage. The Gribaldi son has excel-led in numerous major competitions at venues in-cluding Doha, Amsterdam, Den Bosch, Vidauban, Aachen, and Hickstead. Furthermore, the combi-nation has been a valuable asset to the Dutch dres-sage team, having won many prizes. De KWPN goedgekeurde hengst Googel viel tijdens de KWPN Hengstenkeuring in 2014 al op door op de vijfde plaats te eindigen in de kampioenskeuring. Tijdens het verrichtingsonderzoek behaalde hij maar liefst een 8,5 voor zijn manier van stappen en galopperen. Verder liet Googel op zijn rapport louter achten noteren. Googel is een combina-tie van rasverervers Bordeaux en Johnson. In de moederlijn tellen we vier Grand Prix-paarden bin-nen drie generaties. Googel heeft een sterk ach-terbeengebruik, beschikt over een hele ruime en krachtige stap met veel lichaamsgebruik. Galopperen doet hij op de goede manier naar boven: met veel gedragenheid. Naast zijn toekomst als dekhengst lijkt ook een carrière als dressuurpaard helemaal weggelegd voor Googel.
The KWPN-approved stallion Googel first garne-red acclaim in the 2014 KWPN stallion selection when he ended fifth in the championship. In his performance test, he scored 8.5’s for his walk and canter, and 8’s in the rest of his test. Googel is a product of the Bordeaux/Johnson combination, si-res which pass on nobility to their offspring. In his dam-line, Googel boasts four Grand Prix horses within three generations. With respect to his move-ment, he has a strong hind leg and a big, powerful walk in which he uses his body very well. His can-ter has good jump and excellent carriage. With his breeding license and talent for dressage, Googel has a promising career ahead of him.

Deze aansprekende ruin beweegt lichtvoetig door de baan. Expert liep als jong paard in de finale van de VSN Trofee en riep toen al hoge verwachtin-gen op. Ook liep Expert een IBOP proef waarbij hij maar liefst een acht behaalde voor wekwillig-heid en souplesse. Inmiddels is de hoogbenige vos Z1 geklasseerd en pakt alle oefeningen voor het hogere werk makkelijk op. Dankzij de mooie prestaties van onder andere Expert werd moeder Ninique preferent verklaard. Expert is een paard dat beschikt over de juiste instelling en manier van bewegen om het ver te gaan brengen in de dres-suursport.
This handsome gelding boasts light-footed move-ment. As a youngster, Expert competed in the VSN Trophy final, in which he showed great promise for the future. He also completed the Individual Sui-tability Test for Horses (IBOP), scoring 8’s for wil-lingness and elasticity. Currently qualified at the Z1 level, the long-legged chestnut is easily learn-ing the upper level movements. Thanks in part to Expert’s achievements to date, his dam Ninique was awarded the preferent predicate. Expert has the right temperament and movement to go far in dressage.

Perfection and elegance in one
Elite merrie Guccicatrasse Texel is een dochter van de bekende hengst Bretton Woods. Ondanks haar jonge leeftijd behaalde ze al successen. Ze werd door haar goede prestaties op de Centrale Keuring uitgenodigd voor de Nationale Merrie Keuring in Ermelo. Het predikaat keur werd behaald nadat ze een uitstekende IBOP test had afgelegd met maar liefst een 9 voor haar manier van galopperen. In het najaar van 2014 deed Guccicatrasse Texel mee aan de VSN Trofee waarbij ze uitgenodigd werd voor de finale. Daar eindigde Guccicatrasse Texel uiteindelijk bij de beste 10.
The elite mare Guccicatrasse Texel is a daughter of the renowned stallion Bretton Woods. Despite her young age, she has already achieved several successes. These include excelling in the Central Inspection and receiving an invitation to the Na-tional Mare Inspection in Ermelo. In addition, she was awarded the keur predicate after performing an outstanding Individual Suitability Test for Hor-ses (IBOP), with scores including a 9 for the canter. In the fall of 2014, Guccicatrasse Texel showed in the VSN Trophy competition and qualified for the final, ultimately ending in the top 10.

Zoon van de Duitse Samba Hit II, Blitz, maakt op dit moment furore in het ZZ Licht. In deze klasse wist hij met hoge scores al meerdere prijzen bin-nen te slepen. Verder vinden we in de afstamming van Blitz, Vasco gevolgd door de volbloed Pericles. Blitz beschikt over een hele gemakkelijke galop waarbij hij met veel kracht van de grond komt. Zijn draf is er een met veel schwung, afdruk en een mooi voorbeengebruik. Ook het verzamelen en springen van een serie wissels is voor de werk-willige Blitz geen enkel probleem. Daarbij geeft hij zijn ruiter een comfortabel gevoel. Blitz is een ide-aal paard voor ambitieuze ruiter of amazone die verder wil komen in de wedstrijdsport.
A son of the German stallion Samba Hit II, Blitz is currently a sensation at the ZZ-light level, in which he has won several prizes and posted high scores. Other horses in Blitz’s pedigree include Vas-co, followed by the Thoroughbred Pericles. Blitz is a willing horse with a very easy canter that has powerful jump. In the trot, he shows excellent impulsion, push, and a nice front leg. Collection and tempi-changes are also easy for Blitz, who is a comfortable horse to ride. Blitz is ideal for the ambitious rider who wants to advance in the sport.

( hierna te noemen de organisatie), organiseert jaarlijks de veiling Excellent Dressage Sales (hierna: ‘de veiling’) op Landgoed Culitsrode / Academy Bartels te Hooge Mierde. De veiling kan jaarlijks plaatsvinden in de maand maart, april of mei.
02. Het secretariaat van de veiling bevindt zich op het kantoor van Acade-my Bartels gelegen aan de Koestraat nummer 9 5095 BD Hooge Mierde. Telefonisch bereikbaar op telefoonnummer 013-5091666 en per mail [email protected]
03. De veiling zal plaatsvinden onder toezicht van een notaris.
04. Deze veilingvoorwaarden zijn primair van toepassing op de relatie tus-sen de organisatie en de bieder/koper. Onder bieder/koper worden ook eventuele rechtsopvolgers/rechtverkrijgenden begrepen.
05. De veilingvoorwaarden zullen in elk geval voor aanvang van de veiling door of namens de organisatie of veilingmeester kenbaar worden gemaakt aan de veilingbezoekers. Voorts zijn deze voorwaarden opgenomen in de veilingcatalogus. De deelneming door koper/bieder aan de veiling wordt aangemerkt als aanvaarding van deze veilingvoorwaarden. Uitdrukkelijk worden door koper/bieder zelf te hanteren voorwaarden uitgesloten. De veilingvoorwaarden van de organisatie prevaleren te allen tijde.
De veiling:
06. De paarden worden verkocht voetstoots zonder actie of reactie, in de staat waarin zij zich bij gunning bevinden.
07. De veilingmeester heeft de bevoegdheid om de volgorde van de te ver-kopen paarden te wijzigen of zonder opgave van redenen personen als bieder/koper te weigeren.
08. Bieders/kopers worden geacht volledig handelingsbekwaam te zijn en bij het volle verstand. Iedere bieder/koper wordt geacht voor zichzelf te hebben geboden en is aan zijn bod gehouden totdat een hoger bod defi-nitief is geaccepteerd. Een bieder/koper is naast zijn eventuele lastgever volledig aansprakelijk voor het nakomen van zijn verplichtingen.
09. Ingeschreven paarden worden bij opbod verkocht. Indien geen bod komt, is het paard niet verkocht. Opbieden vanaf €15.000,-.
10. Het risico ter zake van de paarden, waaronder mede begrepen doch niet beperkt tot de schade aan en veroorzaakt door paarden, gaat op het mo-ment van gunning onmiddellijk over van de verkoper op de bieder/koper. Koper kan zich ter plekke tegen dit risico verzekeren. De veiling verplicht de bieder/koper het paard, zolang het paard niet is betaald, met onmid-dellijke ingang en voor rekening van de bieder/koper te laten verzekeren bij Hippo Zorg, voor een periode van maximaal één week met een pre-mie van 1,0% van de koopsom, of maximaal één maand met een premie van 1,5% van de koopsom, waarbij in het geval van schade aan de bieder/

05. In every case, the Auction terms and conditions will be disclosed to Auction visitors by the Organization or on its behalf, or by the auctioneer, before the start of the Auction. Furthermore, these terms and conditions are included in the auction catalog. Participation in the Auction by the bidder/buyer is con-sidered acceptance of these auction terms and conditions. The bidder/buyer is expressly excluded from applying any terms and conditions himself/herself. The Auction terms and conditions of the organization prevail at all times.
The Auction:
06. The horses will be sold outright, without proceedings or recompense, in the condition in which they are in at the time of allotment.
07. The auctioneer is authorized to change the order of the horses to be sold or refuse persons as bidders/buyers, without having to state a reason.
08. The bidder/buyer is expected to have full legal capacity and be mentally competent. Each bidder/buyer is considered to have made a bid for him/herself and is bound by the said bid until a higher bid is definitively accep-ted. A bidder/buyer and his/her principal, if any, are fully responsible for fulfilling their obligations.
09. Horses registered for the Auction will be sold by bid. If no bid is made, the horse will not be sold. Bidding begins at €15,000.
10. Risk with respect to the horse, including but not limited to damage to and/or caused by the horse, is transferred immediately from the seller to the bidder/buyer at the time of allotment. The buyer may purchase insurance coverage for this risk on site. If the horse is not paid for in full, the Organization requires the bidder/buyer to immediately insure the horse with Hippo Zorg at the bidder/buyer’s expense for a maximum of one week at a 1.0% premium of the purchase price, or for a maxi-mum of one month at a 1.5% premium of the purchase price, or for an annual premium of 4% of the purchase price, in the event of damage.

De bieder/koper kan de verzekeringsvoorwaarden voorafgaand aan de veiling verkrijgen bij het secretariaat van de organisatie. Zolang de veiling geen volledige betaling van de bieder/koper heeft ontvangen, blijft de verkoper eigenaar van het paard.
11. De bieder/koper zal onmiddellijk na gunning onder vertoning van legi-timatie een schriftelijke koopovereenkomst tekenen. Mocht de koopo-vereenkomst niet onmiddellijk aan de bieder/koper ter ondertekening worden aangeboden, dan dient hij zich direct na de veiling te melden bij het secretariaat van de organisatie.
Informatie:
12. De veiling heeft getracht de catalogus zo nauwkeurig mogelijk samen te stellen. De informatie over de afstamming is erop gericht een indruk te geven van de kwaliteit van de paarden, zonder de pretentie volledig te zijn en zonder daarmee enige of welke garanties dan ook te geven.
13. Het is de verantwoordelijkheid van de verkoper/ eigenaar om de juist-heid van de door hem of haar verstrekte informatie in de catalogus met betrekking tot het door hem/haar aangeboden paard te controleren. De verkoper is gehouden om de organisatie en veilingmeester voor de veiling tijdig en schriftelijk van eventuele fouten of onvolledigheden in kennis te stellen en daarbij zo gedetailleerd als mogelijk aan te geven welke wijzigingen of aanvullingen dienen te worden aangebracht.
14. Een afschrift van het veterinair rapport alsmede röntgenfoto’s kunnen op verzoek tien dagen voorafgaand aan de veiling en op de dag van de vei-ling worden ingezien. Men kan zich bij de beoordeling van dit veterinair rapport desgewenst laten bijstaan door een eigen veterinair. De inhoud van het veterinair rapport, de röntgenfoto’s en eventuele overige door de organisatie verstrekte veterinaire rapportage is bindend voor de veiling en bieder/koper. De belangstellende is gehouden een document te onderte-kenen waarin is vastgelegd; wie de documentatie heeft bekeken, van welk paard de veterinaire informatie is bekeken, en het catalogusnummer.
15. De bieders/kopers zijn verplicht om op verzoek van de organisatie in-formatie te verschaffen betreffende hun financiële gegoedheid, waarbij zij bescheiden aan de organisatie dienen over te leggen waaruit deze ge-goedheid blijkt. Door een verzoek tot deelname aan de veiling machti-gen de bieders/kopers de organisatie informatie in te winnen bij derden over hun financiële gegoedheid.
Inschrijvingen, kosten en betaling:
16. Alleen de door de organisatie erkende adviseurs die voor aanvang van de veiling bij de organisatie schriftelijk hebben opgegeven, dat zij optreden voor één of meer van de bieders/kopers, kunnen jegens de betreffende verkoper aanspraak maken op provisie. Deze provisie wordt na schriftelij-

11. Immediately after allotment, the bidder/buyer shall present proof of iden-tification and sign a written agreement. Should the contract not be im-mediately offered to the bidder/buyer for signing, he/she shall notify the Organization’s secretary immediately after the Auction.
Information:
12. The Organization has made every effort to ensure the accuracy of the in-formation contained in the catalog. The pedigree information is intended to give an impression of the quality of the horses without pretending to be complete and hence without offering any guarantees.
13. The seller/owner is responsible for checking the accuracy of the infor-mation in the catalog, which was provided by him or her with respect to the horse(s) that he/she is putting up for auction. The seller is required to promptly notify the Organization and the auctioneer in writing prior to the auction of any errors or omissions in the catalog, describing in detail the corrections and/or additions to be made.
14. Upon request, a copy of the veterinary report as well as radiographs may be inspected 10 days prior to the Auction and on the day of the Auction itself. If desired, the bidder/buyer may be assisted by his/her veterinarian in the evaluation of this veterinary report. The contents of the veterinary report, the radiographs, and any other veterinary reports provided by the Organization are binding for the Auction and the bidder/buyer. The interested party is required to sign a document in which the following is stated: the person(s) who has viewed the documentation; the horse for which information has been viewed; and the catalog number.
15. Upon request of the Organization, the bidder/buyer shall provide infor-mation with respect to his/her financial solvency, including documentati-on proving financial solvency. By requesting to participate in the bidding process, the bidder/buyer authorizes the Organization to obtain informa-tion about his/her financial solvency from third parties.
Registration, Fees, and Payment:
16. Only advisors approved by the Organization and who have provided a written statement to the Organization prior to the auction indicating that they are acting for one or more of the bidders/buyers may claim a fee from the respective seller. This fee will be determined in consultation with the Auction after a written statement has been provided. Only

17. De bieder/koper dient de koopsom vermeerderd met 7% opgeld (excl. BTW) over de koopsom vermeerderd met 21% BTW / 6% BTW voor fokmerries / dekhengsten, binnen zeven dagen na de veiling per bank te voldoen aan de organisatie, in euro’s zonder enige korting of inhouding. Het verschuldigde dient binnen zeven dagen na de veiling op het reke-ningnummer van de organisatie te zijn bijgeschreven.
18. Indien de bieder/koper tijdens de veiling te kennen geeft het paard niet af te nemen, dan heeft de organisatie de bevoegdheid het paard onmiddel-lijk te herveilen, waarbij het bod van de oorspronkelijke bieder/koper niet weer wordt aangenomen. De oorspronkelijke bieder/koper is gehouden het verschil tussen zijn bod en de uiteindelijke lagere koopsom, alsmede de kosten van herveiling aan de organisatie te voldoen. De bieder/koper heeft geen aanspraken ingeval van een hogere opbrengst na herveiling.
19. Betaling aan enig ander dan de organisatie, bevrijdt de verkoper of de bieder/koper niet van de betalingsverplichtingen tegen de organisatie.
20. Indien de organisatie niet binnen zeven dagen na de veiling comple-te betaling van de bieder/koper heeft ontvangen, is de bieder/koper van rechtswege in verzuim. De bieder/koper is dan, naast het overig door hem verschuldigde, aan en ten behoeve van de organisatie een vergoeding ver-schuldigd ter grootte van 15% van de koopsom (exclusief BTW). Het to-taalbedrag dat de bieder/koper uit hoofde van zijn betalingsverplichtingen is verschuldigd, wordt vermeerderd met een rente van 1,5% per maand, te berekenen vanaf de veiling tot het tijdstip van complete betaling.
21. Indien de organisatie niet binnen 7 dagen na de veiling complete beta-ling van de bieder/koper heeft ontvangen, heeft de organisatie voorts de bevoegdheid om zonder ingebrekestelling of gerechtelijke tussenkomst namens de verkoper en zonder zijn toestemming de koop als ontbon-den te beschouwen. De verkoper en de bieder/ koper blijven in dat geval jegens de organisatie gehouden om aan al hun in deze veilingvoorwaar-den genoemde betalingsverplichtingen te voldoen, voor zover die een vergoeding ten behoeve van de organisatie betreffen.
22. Indien de bieder/koper in verzuim is ter zake van zijn (betalings)ver-plichtingen, komen alle (buiten)gerechtelijke kosten die de organisatie daardoor maakt voor rekening van de bieder/koper, met een minimum-bedrag van € 3.000,00 inclusief BTW.
Selecties en keuringen paarden voor de veiling:
23. Alle paarden zijn maximaal drie maanden voorafgaand aan de veiling veterinair onderzocht. Een afschrift van de veterinaire keuring evenals eventuele röntgenfoto’s liggen tien dagen voorafgaand aan de veiling ter inzage op het secretariaat van de veiling.

17. The bidder/buyer must pay the purchase price of the horse plus a 7% surcharge (excluding VAT) on the purchase price plus 21% VAT (6% VAT for broodmares/stallions) to the Organization in Euros by bank transfer within 7 days after the auction, without any discount or deduction. The debt must be paid within 7 days after the Auction to the Organization’s bank account number.
18. If the bidder/buyer indicates during the Auction that he/she will not take the horse, the Organization is authorized to immediately re-auction the horse, in which case, the bid of the original bidder/buyer will no longer be accepted. The original bidder/buyer must still pay the Organization the difference between his/her bid and an eventual lower selling price, as well as the costs of re-auctioning the horse. The original bidder/buyer forfeits the right to any claims in the event that the horse sells for a higher price when re-auctioned.
19. Payment to anyone other than the Organization does not release the seller or bidder/buyer from payment obligations to the Organization.
20. If the Organization has not received payment in full from the bidder/buyer within 7 days after the Auction, he/she will be in legal default. In such case, the bidder/buyer shall pay the Organization an administration fee of 15% of the horse’s selling price (excluding VAT), in addition to any other monies due. The total monies the bidder/buyer owes will be increased with interest of 1.5% per month, calculated from the date of the Auction until the date of payment in full.
21. If the Organization does not receive payment in full from the bidder/buyer within 7 days after the Auction, the Organization has the autho-rity to, without default or legal intervention on behalf of the seller and without his/her permission, dissolve the sale. In such case, the seller and the bidder/buyer shall still pay all amounts due as stipulated in these auction terms and conditions with respect to compensation to the Organization.
22. If the bidder/buyer is in financial default with the Organization, all judi-cial and extra judicial fees accrued by the Organization as a result shall be paid by the bidder/buyer, with a minimum amount of €1,000 (including VAT).
Selection and Veterinary Inspection of Auction Horses:
23. All horses are examined by a licensed veterinarian no more than three months prior to the Auction. A copy of the veterinary exam report and any radiographs will be available for inspection from the Auction secretary 10 days prior to the Auction.

Afgifte en verwijdering paarden:
24. Onmiddellijk na gunning is de bieder/koper verantwoordelijk voor de zorg van en aansprakelijk voor schade aan het paard en/of door het paard ontstaan. Levering vindt plaats nadat het paard betaald is door bieder/ koper. Bieder/koper kan het paard na betaling aan de veiling bij de verkoper ophalen.
25. Indien en pas nadat de bieder/koper volledig aan zijn (betalings-)ver-plichtingen heeft voldaan, waaronder mede begrepen betalingsverplich-tingen die een vergoeding ten behoeve van de organisatie betreffen, kan de bieder/koper over het paard beschikken, waarbij hij de benodigde bescheiden zal ontvangen. De veiling is nimmer verplicht het paard af te geven indien de bieder/koper niet geheel aan zijn (betalings-)verplich-tingen heeft voldaan.
26. De bieder/koper dient het paard uiterlijk binnen 7 dagen na afloop van de veiling op eigen kosten van het veilingterrein / terrein verkoper te hebben verwijderd. Indien de bieder/koper het paard niet tijdig heeft verwijderd, is hij van rechtswege in verzuim. De organisatie heeft dan de bevoegdheid het paard van het veilingterrein te (doen)verwijderen en elders te stal-len, waarbij alle in redelijkheid door en naar oordeel van de organisatie te maken kosten in dat verband voor rekening komen van de bieder/koper. De bieder/koper blijft verantwoordelijk voor de zorg van en aansprakelijk voor schade aan het paard en/of door het paard ontstaan.
Stalondeugden en gebreken:
27. Indien de bieder/koper bij het gekochte paard stalondeugden consta-teert, zijnde kribbebijten, weven of luchtzuigen, dan dient de bieder/koper binnen drie dagen na de levering de organisatie hiervan schrifte-lijk en met een zo gedetailleerd mogelijke omschrijving van de aard van de stalondeugden op de hoogte te stellen. Deze stalondeugden dienen binnen 48 uur na levering te zijn geconstateerd door een veterinair.
28. Indien de bieder/koper bij het gekochte paard binnen 48 uur na levering andere gebreken constateert, dan dient de bieder/koper binnen zeven dagen na de levering de organisatie hiervan schriftelijk te informeren met een zo gedetailleerd mogelijke omschrijving van de aard van het vermeende gebrek. Bieder/ verkoper is steeds gehouden om de veteri-nair van de veiling te consulteren, gebreken die binnen 48 uur na leve-ring zijn geconstateerd dan wel van gebreken die binnen 6 maanden na levering zijn geconstateerd.
29. In beide voornoemde gevallen zal de veiling het paard op een door haar te bepalen locatie onderbrengen en het paard door een door haar aan te wij-zen veterinair op de door de bieder/koper stalondeugden en/of vermeende gebreken te laten onderzoeken. Voornoemde veterinair stelt de aard van de stalondeugden en/of vermeend gebrek bindend vast. Indien naar oordeel van die veterinair van de door bieder/koper omschreven stalondeugd spra-ke is, heeft bieder/koper het recht de koop te ontbinden.
Delivery and Removal of Horses:
24. Immediately after allotment, the bidder/buyer shall assume respon-sibility for the horse’s welfare and shall be liable for any damage to and/or caused by the horse. Delivery takes place after the bidder/buyer pays for the horse. The bidder/buyer may collect the horse from the seller after the Auction has been paid in full.
25. Only if and when the bidder/buyer has paid monies owed in full, including monies owed to the Organization, the horse and required documents will be released to the bidder/buyer. The Auction is not required to release the horse to the bidder/buyer if he/she has not paid monies owed in full.
26. The bidder/buyer shall remove the horse at his/her own expense from the Auction grounds/seller’s property within 7 days after the Auction ends. If the bidder/buyer has not removed the horse within the stated period, he/she will be in legal default. In such case, the Organization is authorized to remove the horse or have the horse removed from the Auction grounds and stabled elsewhere, for which the bidder/buyer shall be liable for fees accrued in connection with these actions as considered reasonable by the Organization. The bid-der/buyer shall remain responsible for the horse’s care and for any damage to and/or caused by the horse.
Stable Vices and Flaws:
27. If the bidder/buyer observes that the horse purchased has a stable vice, such as cribbing, weaving or wind-sucking, the bidder/buyer shall notify the Organization in writing within three days after re-ceiving the horse, describing the nature of the stable vice(s) in detail. This stable vice(s) must be ascertained by a licensed veterinarian within 48 hours after delivery.
28. If the bidder/buyer observes that the horse purchased has another flaw(s) within 48 hours after delivery, the bidder/buyer shall notify the Organization in writing within seven days after receiving the horse, describing the nature of the alleged flaw(s). The bidder/buyer must always consult the Auction veterinarian regarding stable vices and/or flaws observed within 48 hours after delivery or stable vices and/or flaws observed within six months after delivery.
29. In both aforementioned cases, the Auction will move the horse to a location of its choice and request a veterinarian of its choice to examine the horse for the stable vice(s) and/or flaw(s) alleged by the bidder/buyer. The aforementioned veterinarian will determine the nature of the stable vice(s) and/or flaw(s). If the veterinarian diagnoses the horse with the stable vice(s) described by the bidder/buyer, he/she has the right to dissolve the sale.

30. Indien de bieder/koper niet binnen de voornoemde termijn melding maakt van bedoelde stalondeugden en/of andere gebreken en/of voor-noemd veterinair de stalondeugden of andere gebreken niet vaststelt dan vervalt de bevoegdheid van bieder koper om de koop te ontbinden of een beroep te doen op een wilsgebrek.
Ontbinding en vernietiging:
31. Indien de koop rechtsgeldig door de bieder/koper of de verkoper wordt ontbonden of vernietigd, blijft de bieder/koper gehouden aan al zijn in deze veilingvoorwaarden genoemde betalingsverplichtingen tegen de organisatie te voldoen, voor zover die een vergoeding ten behoeve van de organisatie betreffen. De koop kan worden ontbon-den of vernietigd met inachtneming van de ter zake geldende wette-lijke bepalingen, voor zover daarvan in deze veilingvoorwaarden niet rechtsgeldig is afgeweken.
Aansprakelijkheid:
32. Hoewel de organisatie er naar streeft zo volledig en accuraat mogelijk informatie te verschaffen, is de organisatie niet aansprakelijk voor de accuratesse van de informatie in de catalogus, de informatie gegeven op het veilingterrein en de informatie tijdens de veiling.
33. De organisatie is niet aansprakelijk voor de accuratesse van de infor-matie in het veterinair rapport, de veterinaire informatie gegeven op het veilingterrein en de informatie tijdens de veiling. Hier toe dient de koper/bieder zich te wenden tot de veterinair.
34. De organisatie is niet aansprakelijk voor schade voorafgaand aan, tij-dens of na afloop van de veiling door en/of aan personen, goederen of paarden geleden.
35. Terzake van onder meer de paarden sluit de organisatie geen verzeke-ring af ten behoeve van de bieders/kopers. Aangezien bieders/kopers geheel voor eigen rekening en risico aan de veiling deelnemen, adviseert de organisatie hen bedoelde verzekering zelf af te sluiten.
36. De organisatie is niet aansprakelijk voor tekortkomingen van derden.
37. De organisatie sluit aansprakelijkheden uit, behoudens ingeval van op-zet of grove schuld van de organisatie.
38. Een ieder die schade toebrengt aan (goederen van dan wel gebruikt door) de organisatie is aansprakelijk voor deze schade.
39. Bieders/kopers zijn aansprakelijk voor alle schade door hen veroor-zaakt. De bieders/kopers vrijwaren de organisatie tegen iedere aan-spraak van derden (waaronder mede begrepen andere bieders/kopers, dan wel bezoekers) terzake daarvan.
VOORWAARDEN EDS CONDITIONS EDS
30. If the bidder/buyer fails to report alleged stable vice(s) and/or flaw(s), and/or if the aforementioned veterinarian determines that the horse does not have the alleged stable vice(s) and/or flaw(s), the bidder/buyer shall lose the right to dissolve the sale or invoke vitiated con-sent.
Dissolution and Annulment:
31. If the bidder/buyer or the seller legally dissolves or annuls the sale, the bidder/buyer shall still pay all monies owed to the Organization as described in these auction terms and conditions. A sale may be dissolved or annulled in due observance of the relevant current legal provisions, in as far as they legally adhere to these auction terms and conditions.
Liability Disclaimer:
32. Although the Organization has strived to provide the most complete and accurate information possible, it is not liable for the accuracy of the information contained in the catalog, the information provided on the Auction grounds, and the information provided during the Auction.
33. The Organization is not liable for the accuracy of the information contained in the veterinary report, veterinary information supplied at the Auction grounds, or information provided during the Auction. The bidder/buyer should consult the veterinarian in this regard.
34. The Organization is not liable for any damage by and/or to per-sons, goods, or horses before, during, or after their presence at the Auction.
35. The Organization does not provide horse insurance or other insuran-ce for the benefit of bidders/buyers. Given that bidders/buyers par-ticipate in the Auction at their own cost and risk, the Organization recommends that bidders/buyers take out an insurance policy.
36. The Organization is not liable for the failures of third parties.
37. The Organization cannot be held liable, except in the case of willful intent or gross negligence by the Organization.
38. Anyone who damages property of or used by the Organization is lia-ble for such damage.
39. Bidders/buyers are liable for any damage they cause. Bidders/buyers shall hold the Organization harmless against any third party claims (including claims from other bidders/buyers or visitors).

Overig:
40. Indien ter zake van de overgang van geveilde paarden naar een andere lidstaat van de Europese Unie op verzoek van de bieder/koper wordt gefactureerd met het BTW-nultarief, verplicht de bieder/koper zich alle daartoe noodzakelijke voorwaarden te vervullen teneinde een rechts-geldige intracommunautaire transactie te verwezenlijken.
41. Indien toepassing van het BTW-nultarief door welke omstandigheid dan ook (achteraf) niet mogelijk blijkt, is de bieder/koper op dat mo-ment alsnog een bedrag verschuldigd ter grootte van het bedrag dat verschuldigd zou zijn indien sprake is van een binnenlandse levering van het desbetreffende paard. Op verzoek van de organisatie is de bie-der/koper echter verplicht vorenbedoeld bedrag onmiddellijk aan de organisatie te voldoen. Dan zal terugbetaling daarvan eerst en slechts plaatsvinden indien de bieder/koper jegens de organisatie aan alle hem/ haar toekomende voorwaarden/veplichtingen heeft voldaan. De bie-der/koper is aansprakelijk en vrijwaart de organisatie in ieder geval voor alle schade die voortvloeit uit het niet voldoen aan de hem/haar toe-komende voorwaarden/ verplichtingen. Daarnaast is de bieder/koper aansprakelijk voor alle (buiten)gerechtelijke kosten die de organisatie, met een minimumbedrag van € 3.000,00 inclusief BTW.
Conversie:
42. Indien één of meer van de in deze veilingvoorwaarden genoemde be-palingen niet rechtsgeldig zou(den) zijn of worden, blijven de overige bepalingen verder rechtsgeldig. In dat geval treedt in plaats van de bedoelde niet rechtsgeldige bepaling een nieuwe bepaling, die met de bedoelde oude niet rechtsgeldige zoveel als mogelijk overeenkomt voor wat betreft inhoud, bereik en doel daarvan.
Geschillen:
43. Indien bij een gunning een verschil van mening ontstaat over de vraag wie het laatste bod heeft gedaan, of indien er andere moeilijkheden, onduide-lijkheden en geschillen ontstaan bij biedingen en/of over de gunning, is de veilingmeester bevoegd hierover een bindend oordeel uit te spreken. Ingeval van vorenbedoeld verschil van mening betreffende het laatste bod is de veilingmeester bevoegd de verkoop bij opbod te doen continueren.
44. Indien de veilingmeester de notaris verzoekt een oordeel te vellen, zal de notaris bindend en onherroepelijk voor alle partijen beslissen. De notaris is gedurende de veiling tevens bevoegd te oordelen over geschillen van andere aard dan ter zake van de biedingen en gunningen.
45. De rechtsverhoudingen tussen de organisatie en de bieder/koper worden uitsluitend beheerst door Nederlands recht, met complete uitsluiting van het Weens Koopverdrag (CISG). Geschillen, anders dan die als gevolg van het bepaalde sub 42 en 43 aan het oordeel van de veilingmeester of de notaris zijn onderworpen zullen uitsluitend worden beslecht door de Rechtbank Zeeland en West Brabant.
Miscellaneous:
40. In the event that the bidder/buyer requests the transfer of auctioned horses invoiced at the zero-VAT rate to another European Union member country, the bidder/buyer shall fulfill all necessary conditi-ons to complete a legal intra-community transaction.
41. If the zero-VAT rate is subsequently not applicable, for whatever reason, the bidder/buyer will at that time owe an amount equal to the amount for a domestic transfer of the horse. Upon request of the Organization, the bidder/buyer shall pay the aforementioned sum to the Organization immediately. In such case, a refund will be issued only if and when the bidder/buyer has fulfilled all future terms and conditions/obligations to the Organization. In any case, the bidder/buyer is liable for and shall indemnify the Organization against all damages arising from failure to comply with his/her future terms and conditions/obligations to the Organization. In addition, the bidder/buyer is liable for all judicial and extra judi-cial fees incurred by the Organization, with a minimum sum of € 3,000.00 (including VAT).
Conversion:
42. If one or more of the provisions of these auction terms and conditions are legally invalid or will become invalid in the future, the remaining provisions shall remain legally valid. In that case, the legally invalid provision will be replaced by a new, legally valid provision which is as similar as possible to the old provision with respect to content, scope and objective.
Disputes:
43. If, upon allotment, a difference of opinion arises as to who made the last bid, or if other problems, ambiguities, or disputes arise concern-ing bidding and/or allotment, the auctioneer is authorized to make a binding decision. In the event of a difference of opinion concerning the last bid, the auctioneer is authorized to continue to sell the horse by auction.
44. If the auctioneer requests the notary to make a decision, the notary’s decision will be binding and irrevocable for all parties. During the Auction, the notary is also authorized to make decisions about dispu-tes of a nature other than those regarding bidding and allotment.
45. The legal relationship between the Organization and the bidder/buyer is ruled exclusively by Dutch law, with full exclusion of the Vienna Sales Treaty (CISG). Disputes, other than those subjected to the decision of the Organization or notary pursuant to items 42 and 43, shall be settled only by the Court of Zeeland and West Brabant.
