II. WHEN TO SUBMIT

The FD-610 is to be submitted in all cases supervised by the Civil Rights Unit, which include thefollowing classifications: 44-CR; 50-ISS; 173-CRA 1964; 177-DIH; 187-Privacy Act of 1974-Criminal;189-ECOA; 204-FRS; 214-CRIPA. The FD-610 should be, in most cases, the initial communication advisingFBIHQ of the initiation of the investigation. In all instances, the FD-610 should be submitted within 5 workingdays of receipt of the complaint; however, the urgency of the situation may require a prior telephone call orteletype to FBIHQ.

III.DESCRIPTION AND REQUIREMENTS REGARDING ITEM #4 ON THE FD-610

Initial - Should be checked if it is the first FD-610 submitted in the case. Every attemptshould be made to provide all the information required on the initial submission;however, the initial submission of the FD-610 should not be held in abeyance whileawaiting data which will be obtained on a later date. The auxiliary office (AO) •shouldsubmit the initial FD-610 when they receive the original complaint with two copiesdesignated to the office of origin.

Supplemental - This should be checked whenever a subsequent FD-610 is submitted. Whensubmitting a supplemental FD-610, provide data only for those items requiring achange. Instances requiring a supplemental submission are: when previouslyunknown data is obtained, data was previously omitted, or data was previouslyincorrectly reported. The supplemental FD-610 should be used as the covercommunication for the submission of LHMs.

IV. SIGNIFICANT CASE

Significant cases are those receiving extensive media attention, involving a prominent individual orinvolving FBI personnel as the subject or victim. Significant cases are also those wherein FBIinvestigation has determined the allegations to be serious and substantial thus warranting a fullinvestigation. When prosecution becomes imminent, FBIHQ should be advised promptly and asupplemental FD-610 should be submitted designating the case "significant" if not already sodesignated.

ADRIENNE L. BROWN, born March 9, 1950, was interviewedby appointment at the Augusta, Georgia office of the FederalBureau of Investigation (FBI). She was accompanied by a friendwhom she identified asI I Mrs. BROWN stated that sheis the wife of entertainer JAMES BROWN and wished to furnishinformation concerning what she believes is a pattern ofharassment on the part of law enforcement officers against herhusband which has been going on for about one and one-half years.

Mrs. BROWN recalled that the first incident which ledher to believe her husband was being harassed took place about9:30 PM one.night when she and JAMES BROWN were driving towardtheir home in Beech Island, South Carolina, along Highway 278.They were passing through Richmond County, Georgia, on their way.home when they bumped into the rear bumper of a car which hadstopped in the roadway. The bumper of the other car was bent ina minor way, and the BROWNs' van stalled. Other people at thescene helped JAMES BROWN get the car started by "jump starting"the engine. As the BROWNs drove off, they heard someone yell,"That's James Brown." The car which they had bumped began tofollow them and a police officer pulled the van over after theyentered South Carolina. When JAMES BROWN asked what he had doneto be pulled over, the officer ordered him out of his car in avery unpleasant manner. The officer then threw JAMES BROWNagainst the car and ordered him to spread his legs.

Mrs. BROWN stated that her husband tried to ask what hehad done, but the officer replied that he did not want to hear itand that he would arrest BROWN. BROWN and the officer then "gotinto it" as a second police car arrived. BROWN tried to tell theofficer that they shc2pld contact Aiken County, South Carolina

Iand discuss this matter, but the officerwould not listen. BROWN and the officer were "fighting like catsand dogs" and at one point Mrs. BROWN was pushed back into theside of the man and was threatened with arrest. Three policeofficers then put BROWN into the floor of the police car, afterhaving tied his hands behind him with some kind of wire. Mrs.BROWN followed the police car as it took BROWN to the policestation, and recalled that it stopped for several minutes at amarket where the police officers spoke among themselves.

At the jail, BROWN was taken inside while Mrs. BROWNwatched through the outside glass walls. BROWN later told Mrs.BROWN that one of the police had hit him in the mouth duringquestioning which followed. BROWN told her that he couldidentify the individual who hit him if he should see him, but didnot know the individual's name. BROWN was kept at the jail fromabout 11:00 PM, until the followin g 8:00 AM. During that time,Mrs. BROWN called! 1 herhusband, butt 'said he could do nothing until morning.Through the involvement of a friend, 1 BROWN wasreleased a few hours later upon payment of a $180 bond. BROWNtold Mrs. BROWN that only two of the police officers had treatedhim unfairly.

The second incident began about a month after the onementioned above. BROWN had been depressed for about a month,feeling that people in the area were down on him due to hisreputation and also some business problems. On this occasion, heand Mrs. BROWN had a disagreement and BROWN yelled at her. Shecalled police and asked that someone come by to calm JAMES down,and this was done. No charges were made against BROWN, but Mrs. b6BROWN believes that the police may have started thinking that b7CBROWN was a chronic problem of some sort.

About a week later, neighbors near the BROWNs' 33 acrehome reported hearing gunshots and thought there may have beenproblems of some sort. Mrs. BROWN stated that BROWN sometimesfired his guns for relaxation on his property, as he had done onthis occasion. Police responding to the neighbors' call stoppedBROWN and later arrested him for carrying a shotgun in his autoand for resisting arrest. BROWN went to court and received asuspended sentence as well as a period of probation. He wasdirected to put on a concert for the benefit of crippledchildren, which he did, but which was a failure due to the fearof the local black population of the police, who boycotted theconcert.

The next incident happened about September 23, 1988, ona Saturday. BROWN, whose drivers license had been revoked, haddriven to his office at 1052 Stevens Creek Road, Augusta,Georgia, in his pickup truck. When he got there, he found thatan insurance class was going on in his office, and that someonehad obtained the key to his private bathroom and was using thefacilities. Not knowing who the people were, BROWN took an

unloaded and inoperative shotgun into the office where themeeting was going on, put the shotgun against the wall, and askedwho had given permission for anyone to use his facilities. Mrs.BROWN noted that just before this had happened, BROWN hadundergone oral surgery for the third time in a month. BROWN wasin considerable pain and was taking several types of medicine.He was also agitated, could not sit still, and had difficultyconcentrating.

When BROWN asked the people in the class who had giventhem permission to use the office and where they had gotten thekey to the bathroom, no one answered him and he told them to getout. They would not, and BROWN decided to go and talk about thematter toy 'of Richmond County, Georgia.As he left, the shotgun was still standing against the wall, butsomeone in the meeting called him back to get it. As BROWN leftthe office area and neared Washington Road, which leads downtownto the Sheriff's Department, a police car passed him. Thepoliceman waved to BROWN, but did not have his siren or bluelights on, so BROWN waved back and continued on. A second policecar got behind BROWN, but again without lights or siren. BROWNadmitted that he speeded up as the cars followed him, but saidthat he police car had chased him into speeding.

BROWN drove into South Carolina over the Interstate 20bridge, then turned off that highway onto Martintown Road,proceeding in the direction of downtown Augusta, Georgia, stillbeing chased by Georgia police cars.

Mrs. BROWN stated that her husband, due to pain, anger,frustration, and medication, did not stop as soon as he shouldhave, as he did not see the blue lights of the police car as soonas someone else, not on medication, would have. At theintersection of Martintown Road and Atomic Road, North Augusta,South Carolina, BROWN pulled into a parking lot and stopped.Three Georgia police cars pulled in behind him and one policeofficer came to the passenger side of the pickup and broke outthe side window with his nightstick. 1 1 an AikenCounty Sheriff's Deputy and friend of the BROWNs, then approachedthe pickup and started to explain to BROWN what was going on. As

he did so, however, two police officers got in front of BROWN'spickup and started shooting at it. Mrs. BROWN stressed that herhusband was not armed, that the shotgun in his truck was notloaded and did not work anyway. Police fired a total of 23shots, 17 of which hit the truck. Police also tried to pull

Although police claimed otherwise, BROWN did nottry to back over any of the police cars, just pulled the truckforward and out of the parking lot. Since his tires had beenshot out, he could not go faster than 30-35 miles per hour.

BROWN drove from North Augusta, South Carolina, toAugusta, Georgia, and police officers admitted at the trial laterthat they had followed BR WN, but had not chased him. BROWNdrove to the residence of who lives on At residence, JAMES BROWN was arrested and taken to theRichmond County Jail. He agreed to return to South Carolina, andon the way the South Carolina police told him that he had to geta blood sample taken. Not realizing that he should have had asecond sample taken to be analyzed by a private laboratory, BROWNagreed to do what police told him he had to do. When the policesample was analyzed, they first said that BROWN's blood containedcocaine, then later said that it had PCP in it. Mrs. BROWNadvised that she knows from reading that PCP can show up in theblood of a person who breathes the second-hand smoke of a personsmoking PCP. She is sure her husband never used PCP, as he hasalways campaigned against the use of drugs in any form. b6

BROWN was taken to Aiken, South Carolina, and wasreleased to Mrs. BROWN at 10:00 PM or 11:00 PM, after themagistrate told Mrs. BROWN that some of the police had receivedimproper training. She returned to their home with BROWN, whowas still restless and in pain. After BROWN finally went tosleep, Mrs. BROWN napped and awoke a couple of hours later tofind BROWN missing. After looking for him on the property, shereturned to their house and shortly received a call informing herthat BROWN had been arrested in Augusta, Georgia. She was toldthat BROWN had driven to the Georgia War Veterans' Home inAugusta, where his father is hospitalized. Police arrested BROWNfor driving without a license, for speeding, and for yelling atsome people, although he was just upset at seeing his father inthe hospital. BROWN was released from the Richmond County Jailthat same day.

On November 21, 1988, BROWN went on trial in Aiken,South Carolina, before Judge LONG. BROWN had returned from aEuropean tour only a day or two earlier, and was not prepared forthe trial. The judge failed to grant a motion to change the

venue of the trial, even though it was shown that some 90articles and news broadcasts concerning BROWN had been printed oraired during a 30-day period, all of which stories carried thepolice version of what had happened. The judge was very involvedin picking the jury which tried BROWN, and did not take steps toprotect the jurors from hearing about the trial. He alsorequired BROWN to spend each night in jail, even though BROWN hadalready returned from Europe to be present for the trial. Duringthe course of the trial, the District Attorney used trickery toplant false thoughts in the minds of the jury, and the policetold conflicting stories, some of which had been written down inreport form several days after the incident. BROWN took thestand and admitted that he had not stopped for the blue lightssoon enough, but denied trying to hurt anyone and said he hadbeen frightened and had driven off to keep from being shot.

At the conclusion of the trial, the jury found BROWNguilty and he was later sentenced to six years in prison. Mrs.BROWN felt that the sentence was unjust, as a 19 year old whiteman had received only six months on a second offense of the samekind that BROWN received six years for.

On January 23, 1989, BROWN went to trial in RichmondCounty, Georgia, on eleven traffic violations resulting from thesame incident which began at the business office on Stevens Creek Road and from the arrest at the War Veterans' Home. I

I him in this action and BROWN pleadedguilty. The judge sentenced BROWN to a six-year prison term, torun concurrent with the South Carolina sentence.

Mrs. BROWN advised that her husband has a long history.of service to the United States and she feels his six-yearsentence is unfair and based on racial considerations. II. WHEN TO SUBMIT

The FD-610 is to be submitted in all cases . supervised by the Civil Rights Unit, which include thefollowing classifications: 44-CR; 50-ISS; 173-CRA 1964; 177-DIH; 187-Privacy Act of 1974-Criminal;189-ECOA; 204-FRS; 214-CRIPA. The ED'-610 should be, in most cases, the initial communication advisingFBIHQ of the initiation of the investigation. In all instances, the FD-610 should be submitted within 5 workingdays of receipt of the complaint; however, the urgency of the situation may require a prior telephone call orteletype to FBIHQ.

DESCRIPTION AND REQUIREMENTS REGARDING ITEM #4 ON THE FD-610

Initial - Should be checked if it is the first FD-610 submitted in the case. Every attemptshould be made to provide all the information required on the initial submission;however, the initial submission of the FD-610 should not be held in abeyance whileawaiting data which will be obtained on a later date. The auxiliary office (AO) shouldsubmit the initial FD-610 when they receive the original complaint with two copiesdesignated to the office of origin.

Supplemental - This should be checked whenever a subsequent FD-610 is submitted. Whensubmitting a supplemental FD-610, provide data only for those items requiring achange. Instances requiring a supplemental submission are: when previouslyunknown data is obtained, data was previously omitted, or data was previouslyincorrectly reported. The supplemental FD-610 should be used as the covercommunication for the submission of LHMs.

IV. SIGNIFICANT CASE

Significant cases are those receiving extensive media attention, involving a prominent individual orinvolving FBI personnel as the subject or victim. Significant cases are also those wherein FBIinvestigation has determined the allegations to be serious and substantial thus warranting a fullinvestigation. When prosecution becomes imminent, FBIHQ should be advised promptly and asupplemental FD-610 should be submitted designating the case "significant" if not already sodesignated.

b7CDETAILS: On 1/23/89, ADRIE NF BROWN. wife of singer JAMES BROWN, telephonically(4014-733-1052) contacted SA I Assistant Section Chief, ResponseSection, Identification Div sion, and expressed concern that her husband' scivil rights had been violated, first by the Richmond County, Georgia PoliceDerartment and lastly by his Attorney. Mrs. BROWN advised she had obtainedSA Inane from a friend at the Atlanta Police ant

Mrs. BROWN advised that in October, 1988 r husseminar in Augusta, Georgia. While there, several Richmond County, GeorgiaPolice Officers, for no known reason, started harrassing him. Mr. BROWNwas armed and when the officers learned this, they went after him. Heexited the area which led to a chase into the state of South Carolina.Officers in South Carolina claimed that Mr. BRCWN allegedly tried to run overtwo officers who had set up a road block. Mrs. BROWN claims that her husbandindicated the incident did not happen that way, that it is true that heattanpted to flee from the Georgia Officers; however, there was no road block.The South Carolina Officers were in hiding and shot out Mr. BROviN i s front tiresas he entered their area. Mrs. BROWN advised that Mr. BRCWN feared for hislife and tried to get away from the Officers who were shooting at him.According to her husband, Mrs. BROWN states the Georgia Officers, who appeared b6at the indictment in Aiken, South Carolina, in connection with the police chase b7Chad advised the South Carolina Officers that Mr. BRCWN had attanpted to killthe Georgia Officers and was armed and dangerous. The Georgia Officers:Tstatedthis as the reason they shot out Mr. BROWN's tires. The lie the Georgia

At the arraignment, Mr. BRCWN entered an innocent plea for the:- __,,traffic and weapon charges. Mrs. BRCWN feels her husband's civil rights wereviolated by his lawyer because the lawyer changed the innocent plea to guiltycausing Mr. BROO to be sentenced to six years in jail. Godfather of Soul James Brownwas recently indicted in Aiken,S.C., in connection with a policechase that started in Georgia andcrossed into South Carolina.

Brown, 55, was charged withtwo counts of assault and batterywith intent to kill and one count offailure to stop for a police car. Hewas charged earlier in Georgiaover the incident.

Police said Brown entered aseminar in Augusta carrying agun and then led police on thechase (JET, Oct. 10).

Brown allegedly tried to runover two officers who were set-ting up a roadblock. The officersreportedly shot out Brown's fronttires, but he kept driving.

A trial has been set for Decem-ber, Brown was on a Europeanconcert tour at press time.

JAMES JOSEPH BROWN, inmate, State Park CorrectionalCenter, Columbia, South Carolina, was interviewed concerning analleged Civil Rights violation. He was advised that anyinformation he furnished could be used in a Court of Law. BROWNthereafter furnished the following information:

BROWN advised that approximately one and a half yearsago he and his wife, ADRIENNE BROWN, were in his van on Highway278, Aiken County, South Carolina, and had just crossed theSandbar Ferry Bridge. At this time they noted that a vehiclewhich appeared to be inoperative was parked on the shoulder ofthe roadway by the bridge. BROWN drove up behind this vehiclein anticipation of giving the vehicle a push with his van. Indoing so he bumped into the rear bumper of the stalled vehicle.As a result, BROWN's van also stalled. A passing motorist helpedBROWN start his vehicle. There were young people at the scenewho saw that it was JAMES BROWN and BROWN not wanting to getinvolved with the excitement quickly left the scene. No damagehad been done to the vehicle that he had attempted to assist.BROWN continued on toward his residence in Beech Island, SouthCarolina. When he was near his residence he was pulled over byan Aiken County Deputy Sheriff using a blue light. BROWN stoppedhis vehicle, exited from it and was then told by the Deputy toproduce his drivers license. BROWN produced his Georgia driverslicense. BROWN stated that the deputy's demeanor was quite rude

The deputy then called for backup policemen. b7CBROWN stated that he assumes that he was stopped because of thesmall collision he had had with the stalled vehicle earlier nearthe bridge, however, when posing this question to the deputy, thedeputy would not answer. At this time BROWN told the deputy thathe wanted to speak with a lawyer. The deputy then grabbedBROWN's arm and threw him to the ground. BROWN attempted to getup, however, the deputy was holding him face down. At this timeother policemen arrived on the scene (possibly four others).BROWN's hands were pulled behind his back and his wrists weresecured to each other very tightly with silver colored wired.BROWN, at this point, began to fear for his life and because ofthis began to struggle. He then was placed on the rear seat of apolice vehicle on his knees with his hands still tied behind hisback. He remained in this position for approximately forty-fiveminutes while the vehicle made at least two sto s before takinghim to the Aiken County Jail.

When arriving at the jail, BROWN was taken out of thepolice vehicle and because of his being in the kneeing positionfor so long he had difficulty walking. The wire was then removedfrom his wrists. He was then booked and charged with speedingand other charges which BROWN cannot recall. BROWN remained inthe Aiken County Jail overnight and released the next day onbond. BROWN stated that at the time of this incident, he had notbeen drinking nor was he under the influence of drugs.

On a later date, date not remembered, BROWN pled guiltyfor which he received a suspended sentence. He was sentenced togive a free crippled children concert. This was done.

BROWN stated that at a later date on a Saturday, datenot recalled, he drove his pick up truck to his office inExecutive Park, Augusta, Georgia. When arriving he noticed thatthe parking lot was full with automobiles. When arriving at hisoffice he observed that his bathroom door was open. Thinkingthat possibly there had been a break-in he went back to his truckin the parking lot, got his shot gun and took it back to hisoffice. He then learned that there was a meeting going onsomewhere in the office complex and that the attendees of thismeeting had been using the bathroom in his office. BROWN wasextremely upset about this and began questioning those inattendance as to the reason for using his facility. During thistime BROWN had placed his shot gun in the corner of his office infull view. BROWN then asked for the return of his keys, receivedsame and then locked the bathroom door. He then left his officewith the shot gun, placed it in the pick up truck and begandriving his truck on 1-20 into South Carolina. After crossinginto South Carolina, he left the interstate and turned ontoMartintown Road in North Augusta, South Carolina. At thislocation he observed that a road block had been set up by twopolice vehicles in a "V" shape. BROWN seeing this drove aroundthe police road block to avoid hitting the police vehicles andcontinued on.

this violence BROWN decided to remain in his vehicle. He thenlocked the vehicle. BROWN stated that he was in fear for hislife. A North Augusta policeman then shot and hit BROWN'S truckat least eight times and another North Augusta policeman shotapproximately nine times at the tires and hood. Other shots werealso fired. BROWN later counted the bullet holes in his truckand these totalled twenty three. Two of these shots hit the gastank and the tires were flat. BROWN became very afraid. Becauseof this fear BROWN started up his vehicle and drove away on theflat tires. He was followed by numerous police vehicles. twenty policemen arrived on the scene. BROWN was pulled from hisvehicle by the policeman an slammed against the side of his truckcausing injury to his face and body. He was then placed in apolice vehicle and taken to the Richmond County Jail in Augusta,Georgia. While sitting handcuffed at the jail awaiting thebooking process, a white male, 5'4" tall, stocky, in plainclothes walked up to BROWN while he was still handcuffed and hithim on the left side of his jaw. This blow was totallyunprovoked. The blow knocked loose a denture post of BROWN'steeth implant and caused much pain to him. Somewhat later ajudge arrived and placed BROWN on bond. No extraditionprocessing took place, however, two deputies then took BROWN tothe Aiken County Hospital in Aiken, South Carolina, for a bloodtest. He was then taken to the Aiken County Jail where heremained overnight. The next day he appeared before a judge inAiken and was released on bond.

In November, 1988, BROWN appeared for a jury trial inAiken County, South Carolina, at which time he was found guiltyand sentenced to six years in jail. In January, 1989, BROWNappeared in court in Richmond County, Georgia, at which time hewas advised by his attorney to plead guilty. As a result he wassentenced to serve a six year concurrent sentence with the SouthCarolina sentence. BROWN is not sure what the charges were inGeorgia.
