What is heartening is that more and more young and well educated Indians are returning homeward. The opening up of Indian economy has proved that Indian entrepreneurs have the strength and resilience to become global players. The acquisition of the African operations of Kuwait’s ‘Zen Telecom’ by Bharati Airtel for $ 9 billion has made it the seventh largest telecom company in the world. It is India’s second largest overseas deal after Tata Steel’s $ 13 billion acquisition of ‘Corus’ in 2007. The ‘India Country Overview’ released by the World Bank in April 2010 states : “India is in now the midst of a historic transformation. It has emerged as a global power and a leading player in information technology, telecoms and business outsourcing, with the world’s fourth largest economy in purchasing power parity terms.” So, we professionals will have an exciting time ahead to play a key role in the growth of our economy. Dear Members,

It is said that “There is only one thing constant in life and that is 'Change' ". One year of my assuming the office of the Vice Presidency passed by in a jiffy. I thank all my readers for their unstinted support extended and words of praise showered, feedback and suggestions transmitted on my Communiqués.

A couple of days back a leading English daily carried an article enumerating that India has started experiencing reverse brain drain. What is heartening is that more and more young and well educated Indians are returning homeward. The opening up of Indian economy has proved that Indian entrepreneurs have the strength and resilience to become global players. The acquisition of the African operations of Kuwait’s ‘Zen Telecom’ by Bharati Airtel for $ 9 billion has made it the seventh largest telecom company in the world. It is India’s second largest overseas deal after Tata Steel’s $ 13 billion acquisition of ‘Corus’ in 2007. Right to Information ClinicBCAS Foundation operates a Right to Information (RTI) Clinic on regular basis. RTI Clinic is operated by Mrs. Hema Sampat, a research scholar on the subject of RTI, Mr. A. K. Asher, Advocate & RTI activist and CA Mr. Narayan Varma, past president, BCAS.

The Clinic provides help and guidance to BCAS members as also to non-members, i.e., all citizens, for makingapplications under the RTI Act and also assists in resolving any related difficulties on the subject of RTI.

The RTI Clinic operates on every 2nd, 3rd and 4thSaturday from BCAS’s office – 11 a.m. to 1 p.m.

The next RTI Clinic days accordingly are 19th, 26th June and 10th, 17th, 24th July 2010. Please call the Society’s office (Ms. Shernaaz: 61377600) to obtain a prior appointment.

Charitable Trust Clinic

The next Charitable Trust Clinic will be held on Friday, 2nd July 2010, from 5 p.m. to 7 p.m. in the library room of BCA Society at New Marine Lines.

During May, there was a lull in the activities of the Society due to summer vacation. However, on 12th May 2010, CA T. P. Ostwal addressed members at a lecture meeting on the subject of ‘TDS from payments to Non-Residents — Recent Position’ and elicited an overwhelming response. On 15th May 2010, ‘4i Committee’ organised a unique half-day workshop on ‘Between Contracts and Arbitration’, addressed by CA Raman Jokhakar, Dr. Kirti Dave, and Kanak Kothari which was very interactive.

The new sub–committees for the year 2010-11 have been formed and they will plan activities for the ensuing year. This year, the Membership and Public Relation Committee has been revived in order to address issues of membership and improve public relations.

BCAS Students Forum had organised its second Annual Day programme on 12th June 2010, which received encouraging response from students. In the elimination round of the elocution competition held on 5th June 2010, students delivered really thought-provoking speeches on diverse subjects such as Mumbaikar, IPL, Excellence vs. Success, Reality Shows, etc. The Human Resources Committee deserves compliments for being instrumental in bringing out latent potentials of students.

On this happy note on Students’ programme, I bid farewell to my readers only to meet you in my new ‘avatar’ from the next month. It has been a pleasure communicating with you, and we shall continue our dialogue through the BCA Journal. Till then, Good Bye !

From RBI

The Reserve Bank of India has issued the following 4 Circulars and DIPP has issued 1 press note during the period under report.

A.P. (DIR Series) Circular No. 51, dated May 11, 2010 External Commercial Borrowings (ECB) Policy Presently, Infrastructure Finance Companies (IFC) are permitted to avail of ECB for on-lending to infrastructure sector, subject to certain conditions, under the Approval Route.

This Circular now permits, subject to certain conditions, IFC to avail ECB (including outstanding ECB) up to 50% of their owned funds under the Automatic Route. ECB exceeding the above limit can be availed under the Approval Route.

A.P. (DIR Series) Circular No. 52, dated May 13, 2010 Notification No. G.S.R. 382(E), dated May 5, 2010Foreign Exchange Management Act (FEMA), 1999 — Current Account Transactions — Liberalisation

This Circular states that the Government of India has omitted item number 8 of Schedule II to the Foreign Exchange Management (Current Account Transaction) Rules, 2000. As a result, foreign exchange can be withdrawn for payment of royalty and lump-sum payment under technical collaboration agreements without prior approval of the Ministry of Commerce and Industries, Government of India, irrespective of the amount involved.

Press Note No. 2 (2010 Series), dated May 10, 2010Review of the policy on Foreign Direct Investment in the manufacture of cigarettes, etc.

Presently, 100% Foreign Direct Investment (FDI) under the Approval Route is permitted in the manufacture of cigars & cigarettes.

This Press Note prohibits with immediate effect FDI in manufacture of cigars, cheroots, cigarillos and cigarettes of tobacco or tobacco substitutes.

As a result, the Consolidated FDI Policy — Circular No. 1 of 2010, dated March 31, 2010 stands modified as under :“Para 5.7 relating to cigars & cigarettes, stands deleted.

In paragraph 5.1, which lists the sectors where FDI is prohibited, a new entry below the entry (i) is inserted as follows :(j) Manufacturing of cigars, cheroots, cigarillos and

cigarettes, of tobacco or of tobacco substitutes.”

A.P. (DIR Series) Circular No. 53, dated May 18, 2010 Exim Bank’s Line of Credit of USD 30 million to the Government of the Republic of Sierra Leone The Exim Bank has made available a Line of Credit (LOC) of US $ 30 million to the Government of the Republic of Sierra Leone, subject to certain conditions, for financing purchase of eligible goods and services from India for the purpose of financing rehabilitation of six potable water projects viz., rehabilitation of existing facilities and addition of new infrastructure to supply potable water to Lungi International Airport, Kailahun District, White Water Community—Freetown, Allen Town Community—Freetown, Wellington—Freetown and Tender Hill Community — Freetown. Out of the total credit, goods and services of the value of at least 85 per cent of the contract price must be procured from India, and the remaining 15% goods and services (other than consultancy services) may be procured from outside India.

The last date for opening of Letters of Credit and Disbursement is 48 months from the scheduled completion date(s) of contract(s) in case of project exports and February 18, 2016 from the execution date of the Credit Agreement in case of supply contracts.

A.P. (DIR Series) Circular No. 54, dated May 26, 2010 Remittance towards participation in lottery, money circulation schemes, other fictitious offers of cheap funds, etc.

This Circular reiterates that remittance from India in any form towards participation in lottery schemes existing under different names like money circulation scheme or remittances for the purpose of securing prize money/awards, etc. is prohibited under FEMA.

It also clarifies that any person resident in India collecting and effecting/remitting such payments directly/indirectly outside India will be liable for prosecution for contravention of FEMA as well as regulations relating to Know Your Customer (KYC) norms/Anti-Money Laundering (AML) standards.
