Introduction The purpose of this marketing brief is to invite tender submissions from developers / retail operators with the aim of delivering a high quality retail-led scheme in accordance with national and local land policies for the site.
Description The site is located on the southern edge of Birmingham around
9 kilometres from Birmingham City Centre. Developed over 3 phases spanning the 1950’s through to the 1970’s the 3 Estates accommodates some 4,000 households, which are distinct in character due to the prevailing social housing styles of the time.
The area is located around 1.5 kilometres from Kings Norton railway station to the north, with Kings Norton Village Green providing local financial and retail services within 1 kilometre of the Estates. The A441 provides the main vehicular connection between the Estates and the M42 motorway to the south and Birmingham City Centre to the north. Bus services provide links to the surrounding neighbourhoods of Northfield, Cotteridge and Druids Heath, and connections to Kings Norton Business Park, Kings Norton railway station and Birmingham City Centre.
The development site is marked with a red line on the site plan attached and extends to circa 2.61 Hectares (6.45 Acres). The site currently comprises a mix of residential dwellings and the Council is in the process of obtaining vacant possession prior to initiating a comprehensive clearance programme, further details of which are set out below.
Use In accordance with local land-use planning policies the site is
considered suitable for development of a Retail Food Store. Additional work has been undertaken to allow development of a store of up to 5,575sqm and four to five shops to a total of 450sqm to form a New Local Centre.
Planning The site sits within the Kings Norton Planning Framework Area, which
sets out a vision, land use proposals and Planning and Design Guidance for the Pool Farm, Primrose and Hawkesley Estates.
The redevelopment proposals are supported through City Council Planning resolutions and extensive Public consultation. They are also supported by a strong national and local planning policy background provided by the Kings Norton Planning Framework and other relevant Planning Policy Statements, and Guidance Notes, including the Birmingham Plan and emerging Core Strategy. Ownership & CPO In support of the proposed development of a foodstore and New Local Centre at Redditch Road, Kings Norton, Birmingham City Council has resolved to make a Compulsory Purchase Order under Section 226(1)(a) of the Town and Country Planning Act 1990. This will be made early in 2012.
Please see phasing plan attached identifying clearance areas and indicative demolition timescales.
The site is owned by the City Council with the exception of a small number of properties that were bought under the Right-to-Buy initiative. The Council is currently engaged in advanced negotiations with owner occupiers, further details are available on application.
Sub Station An Electricity Substation is located in the vicinity of No 12 Wansbeck Grove. The potential purchaser is advised to undertake direct liaison with Central Networks / Western Power Distribution PLC.
Price Offers are sought for the freehold interest in the subject site
subject to contract. The purchaser will be liable to pay a 10 % deposit of the purchase price on exchange with the balance payable on completion.
Tenure The site is to be disposed on a freehold basis, site area as
identified on the attached plan. A title report is available on request.

form in the Invitation to Tender (ITT) document in the prescribed format.
Interested parties are invited to make 2 offers:
1. In line with the proposals set out in the Kings Norton Development Framework. 2. Your alternative proposal for the site. The Council owns adjacent land and may consider extending the site area if a substantially enhanced alternative proposal is brought forward, however the Council will not in any way be bound to extend.
The Tenderer shall submit adequate scheme drawings together with relevant detail of funding and delivery.
Offers are to be submitted in writing by 12.00 Noon on Monday 20th February 2012, in the prescribed form. The Council is not bound to accept any offers and reserve their right to withdraw the property from the market at anytime.
All parties intending to place an offer for this site must provide financial and Company information, Bank references and Solicitors details together with their written offers.
Condition of Sale All offers and any subsequent negotiations are subject to
contract and the Council providing vacant possession of the site. The acceptance of any offer is subject to the approval of the appropriate Council Authorities.

PART III
TENDER CONDITIONS
1. The Tenderer must submit their offer as a bona fide Tender that is not
a fixed or adjusted amount in accordance with any agreement or arrangement with any other person and be in accordance with the marketing documentation provided.
2. The Tenderer shall not communicate to a person other than
Birmingham City Council or their Agent, the amount or approximate amount of the proposed Tender, except where necessary to obtain insurance premium quotations required for the preparation of the Tenders.
3. Tenderer to provide financial and company information when
requested.
4. Tenderer to provide bank references when requested.
5. Tenderer to provide Solicitor’s details when requested. 6. Tenderer to provide details of Surety for the development including
Registered Office and Company No.
PART IV
INSTRUCTIONS FOR TENDERING
1. Birmingham City Council (“The Vendor”) invites Tender offers to be made for the Freehold interest in the site at Redditch Road, Kings Norton, Birmingham.
2. Tenderers are advised to ensure that they are fully familiar with the
nature and extent of the obligations to be accepted by them if their Tender is accepted.
3. Tenderers shall obtain for themselves at their own expense all
information necessary for the preparation of their Tenders. 4. If a Tenderer is in doubt as to the interpretation of any part of this
Tender document the Vendor or its Agent will endeavour to answer written enquiries prior to Tenders being submitted.
5. Tenderers should not rely on any information received other than that
supplied by the Vendor or its Agent in this Tender Document or other information in written form from the Authorised Officer or his nominated representatives. The Vendor will not accept responsibility for any information supplied.
6. The Tender Document is and shall remain the property of the Vendor. 7. Every Tender Statement received by the Vendor shall be deemed to
have been made subject to the Tender Document unless the Vendor shall previously have expressly agreed in writing to the contrary. The Vendor retains the right to invite or permit variations or alterations to the terms of the sale.
8. The Tender Statements shall be fully completed and signed by the
Tenderer in accordance with Clause 13 and submitted in the manner and by the date and time stated in Clause 14.
9. All information supplied by the Vendor or its agent in connection with
this invitation to tender will be regarded as confidential by the Tenderer (except that such information as is necessary may be disclosed for the purposes of obtaining quotations necessary for the preparation of the Tenders).
10. No employee or agent of the Vendor has the authority to vary or waive
any part of the Tender Document, other than the Authorised Officer or his nominated officer who shall only do so in writing.
11. Any Tenderer who directly or indirectly canvasses any member, agent or officer of the Vendor concerning the award of the Contract will be disqualified.
12. The insertion of any conditions qualifying the Tender or any
unauthorised alteration to any of the Tender Documents shall not automatically affect the sale and may cause the Tender to be rejected.
13. All documents requiring a signature shall be signed:-
a. where the Tenderer is an individual, by that individual.
b. where the Tenderer is a partnership, by two duly authorised partners.
c. where the Tenderer is a company by two directors or by a director and the secretary of the Company, such persons being duly authorised for that purpose.
14. The tendering timetable is as follows:-

15. The Tenderer shall submit adequate scheme drawings relevant details of funding and delivery.
16. The Tender Statements once submitted and accepted by the Vendor
cannot be renegotiated. The amount offered will be assumed to have been submitted with the potential purchaser having full knowledge of the land, its condition, statutory requirements and planning status. It is recommended that independent professional advice be sought before offers are submitted.
17. The Tenderer must accept that if they fail to exchange contracts within 12 weeks of the date on which the Vendor accepts the offer, then the acceptance shall be treated as withdrawn unless otherwise agreed by the Vendor in writing.
18. All offers and subsequent negotiations are subject to contract. The
acceptance of any offer will be subject to the approval of the appropriate Council authority.
19. If the Vendor accepts a conditional offer the successful purchaser will be required to exchange contracts within 12 weeks of the offer being accepted and to submit an appropriate and valid planning application
within a further 12 weeks. The purchaser will have an obligation to pursue the grant of planning consent using best endeavours. The Purchaser will immediately inform the Vendor of any issues raised by the Council as Planning Authority. Completion of the sale will take place within 5 days of the resolution to grant Planning Consent becoming unchallengeable, subject to a longstop period of nine months from exchange.
20. The Vendor may in exceptional circumstances at its own absolute
discretion extend the closing date and time specified for the receipt of Tenders.
21. The Vendor is not bound to accept the highest Tender or any Tender
received and all Tenders and negotiations are subject to contract. 22. The Tenders will be evaluated 100% on the value of the financial offer
submitted. 23. The Tenderer, if deemed appropriate, may be asked to attend an offer
clarification meeting.
