Well, it’s that time of year again; the election season is upon us. And yes, it is important to get out and vote! I am not going to say that this is the most important election ever, but it is important! We need to get out and support the elected officials that assisted us with our issues over the past couple of years. Let’s start with Senator Chuck Schumer who assisted us during the Penn Traffic bankruptcy. Senator Schumer led the fight to save the Penn Traffic stores starting in December of last year when he placed a personal call to GE Capital CEO Michael Neal, asking him to keep Penn Traffic open and operating through the end of January. At the time, Senator Schumer said the move would potentially allow Penn Traffic to line up a buyer that would not liquidate their 53 supermarkets in New York – before Senator Schumer’s call, GE Capital, Penn Traffic’s main creditor, wanted to cut off the Company’s line of credit by the end of the December; forcing them into the arms of a bidder with an intention of liquidating the stores and running many non-union as Price Chopper. Senator Schumer Stands Up for Local One Members We are also asking you to vote for Senator Kirsten Gillibrand who personally called the FTC to ask the commissioners not to make Tops liquidate seven former Penn Traffic Stores in Bath, Cortland, Ithaca (two stores) and Lockport, NY, and Sayre, PA (2 stores). It is our understanding that bids for the purchase of these stores need to be in by early November. Please refer to www.ufcwone.org for breaking news. Our Congressional Delegation in our jurisdiction has helped us with many issues during the past two years. Our fight with the Federal Transit Administration for the First Student (formally Laidlaw) members in Rochester, NY was supported by Congresswoman Louise Slaughter (NY-28) and Congressmen Brian Higgins (NY-27 ), Dan Maffei (NY-25), Michael Arcuri (NY-24), Bill Owens (NY-23) Maurice Hinchey (NY-22), and Scott Murphy (NY-20). We need to send these elected officials back to Washington to stand up for us, the working people of New York.

We are also supporting Matt Zeller for New York’s 29th Congressional District who was a UFCW Local One member in High School!

In Pennsylvania we are supporting for Congress incumbent Kathy Dahlkemper (PA-3); candidate Michael Pipe (PA-5) and incumbent Christopher P. Carney (PA-10). We feel that these people will support issues that help working people in Pennsylvania. For the Senate we are supporting Joe Sestak. Joe was elected to Congress in 2006 to represent the 7th Congressional District where he was born and raised. During a distinguished 31-year career in the United States Navy, Joe attained the rank of three-star Admiral and served in the White House, Pentagon, and in operational commands at sea. He deserves your vote on November 2nd!

We need to send these people to Washington because we have a lot to do! As we all know, in March 2010, both Houses of Congress passed the Health Care Reconciliation Bill that was designed to provide affordable and universal Health Care. This bill, in part, addresses some of our needs, but also does not address many essential concerns. The good news, in a nutshell, is that we were successful in the passage of Health Care Reform and we now must understand that through time, changes can be made to better serve our needs and concerns. We will attempt to convey the successes and failures of the legislation.

Positive effects of the Reconciliation Bill

• Effective January 1, 2011, uninsured eligible dependents will have medical coverage to age 26.• Lifetime and annual limits on “essential benefits” will be phased out and ultimately eliminated.• Individuals with preexisting medical conditions may not be denied medical coverage.• More emphasis will be required on preventive medical care.• The uninsured will ultimately be enrolled into a Health Care Program.

Negative Effects of the Reconciliation Bill

• The legislation enacted does little to control or reduce Health Care costs.• Some Union and Company Health Care Plans will face many challenges keeping up with the changes.• Some Employers may opt to pay a penalty to the Government rather than provide Health Care coverage for employees.• Employers may skirt the laws by reducing hours below 30 to avoid paying for health care.• The regulations interpreting the law are unclear and may take years to be defined.

Just as Social Security and Medicare were subjected to numerous problems upon implementation, so is Health Care Reform. Your Local Union has had meetings with our Trustees, Attorneys, Actuaries and Health Care Professionals in order to bring our programs in line with the Reconciliation Bill. Our medical booklet will need to be rewritten once our experts can discern what the adopted Federal Regulations interpreting the law actually mean. In all likelihood, our enrollment forms will need to be modified and resubmitted to comply with the changes.

Some Insurance Companies are projecting that based on the new law, and the lack of any cost controls, Health Care may now increase at a rate of 15-20% per year. Obviously, these monumental increased costs will impact future negotiations with our Employers.

We now need to make sure that this Health Care Reform Bill is accepted like Social Security and Medicare. The new reforms will change the face of America’s health care system over the coming years. Some changes will be gradual, while others will go into effect soon, hopefully this will make a difference in making health care more accessible to those in need.
