What is an Administrative Record?

An administrative record is a collection of documents that forms the basis for an agency's decision, in this case the selection of a response action at a Superfund site. This does not mean that only documents that support a response decision are placed in the administrative record. Relevant documents that were relied upon in selecting the response action, as well as relevant documents that were considered but ultimately rejected, are included. The administrative record also acts as a vehicle for public participation in selecting a response action. Under section 113(K) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), as amended by the Superfund Amendments and Reauthorization Act (SARA), the U.S. Environmental Protection Agency (EPA) is required to establish an administrative record for every Superfund response action and to make a copy of the administrative record available at or near the site. The administrative record must be reasonably available for public review during normal business hours.
