S. R. O. No. 494/2016.— In exercise of powers conferred byclause (b) of sub-section (1) of section 3 of the Minimum Wages Act,1948 (Central Act 11 of 1948) read with sub-section (2) of section 5thereof and in supersession of the notification issued under G. O. (Ms.)No. 161/2010/LBR dated 18th December, 2010 and published as S. R. O.No. 1168/2010 in the Kerala Gazette Extraordinary No. 2879 dated 19thDecember, 2010, the Government of Kerala after considering theobjections and suggestions received on the draft proposals published asNotification No. 11869/El/2015/LBR dated 8th September, 2015, in theKerala Gazette Extraordinary No. 2126 dated the 19th September, 2015 asrequired under clause (b) of sub-section (1) of section 5 of the said Actand after consultation with the Minimum Wages Advisory Boardconstituted under section 7 of the said Act, hereby revise the minimumrates of wages payable to the employees employed in the Ice Factories inthe State of Kerala as specified in the Schedule annexed hereto and fixthe date of publication of this notification in the Gazette as the date onwhich the revised rates shall come into force.

B. Dearness AllowanceIn addition to the basic wages, the employees shall be eligible for

Dearness Allowance calculated on the basis of the latest availableConsumer Price Index Numbers for each month published for the DistrictHeadquarters concerned by the Department of Economics and Statistics,Government of Kerala at the rate of ` 26 (Rupees twenty six only) pereach point above 250 points in the new series i.e., 199899=100.

C. Service WeightageThe employees who have completed three years continuous service in

an establishment or under an employer, as on the date of commencementof the final notification, shall be allowed service weightage at the rate ofone per cent of the basic wages at the revised rate for every completedyear of service, subject to a maximum of fifteen percentage, including thebasic wages.

D. Daily WagesThe daily rate in respect of the category of employees for whom

monthly rate is fixed in this notification may be calculated by dividing themonthly rate by 26.

E. Protection of Higher Wages

In case the employees of any Establishment/Industry who areat present getting higher wages than the minimum wages fixed as per thisnotification, shall be entitled to get such higher rates irrespective ofwhatever rates which shall be fixed as per the final notification.

Explanatory Note

(This does not form part of the notification, but is intended to indicateits general purport.)

Government had earlier revised minimum rates of wages payable tothe employees employed in the Ice Factories in the State of Kerala asper notification issued under G. O. (Ms.) No. 161/2010/LBR dated 18thDecember, 2010 and published as S. R. O. No. 1168/2010 in the KeralaGazette Extraordinary No. 2879 dated 19th December, 2010. Governmenthave now decided to revise the existing minimum rates of wages in thesaid Industry after considering objections and suggestions on the draftproposal published in the Notification No. 11869/E1/2015/LBR dated 8thSeptember, 2015, and the advice of the Minimum Wages Advisory Boardconstituted for this purpose.

The notification is intended to achieve the above object.
