Dear Ms. Kieling:

As per our telephone conversation in February of 2003, please find the following information related to Transwestern's request to discharge new water from new pipe at the above referenced location:

1. Groundwater depths underlying the proposed discharge location. The average depth to groundwater is 36.4 feet, which is based upon a study completed by J.W. Shomaker in

2. A map depicting the location of the proposed discharge activity.

3. E mail from Earl Chanley of Transwestern Pipeline Company presenting the legal description, pipe size and volume of water to be discharged. Be advised that Transwestern plans on using the same water for all of its hydrostatic testing and will only conduct a onetime discharge of 176,442 gallons.

4. Check no. 114807 in the amount of $250.00 to cover the fees required for water discharges in New Mexico.

Re: Notification of Hydrostatic Test Water Discharge, Pipeline Upgrade, Church Rock, New Mexico, Transwestern Pipeline Company

Dear Mr. Anderson:

By this letter, Transwestern Pipeline Company is requesting written approval from the Oil Conservation Division, to conduct hydrostatic test water discharge activities in the immediate proximity of the above referenced location. The discharge activities will take place during the time period of March 4, 2003 through April 19, 2003.

Transwestern is proposing to conduct three (3) water discharge activities involving new pipe, with the water source received from the City of Gallup, New Mexico (new pipe and clean unused water). Two of the discharges will be less than the 100,000 gallon blanket discharge approval issued to Transwestern on December 24, 1999, with the remaining discharge to be approximately 115,000 gallons. Transwestern proposes to confine all discharges to its existing right of way using soil berming and hay bales. Hay bales will also be used to filter the discharged water prior to its releases from the hydrostatically tested pipe to the right of way corridor. Water released from the discharge will be allowed to naturally infiltrate into the subsurface soils of the right of way.
