SRO-31.-In exercise of the powers conferred by the section 118of the Constitution of Jammu and Kashmir, the Governor is pleased10 direct that the following amendments in the Jammu and KashmirFinancial Code, Volume II namely :-
Para I of Exception 5 below Rule (6) as contained in Appendix) of J&K Financial Code Volume II is recast as under

Subject :- Notification regarding 'COLA ' to the employees/ workers of State owned PSU's w.e.f 01-01-2003.
1. Whereas COLA to the employees of PSUs is released
in relation to increase in "All Ind;~ Industrial Consumer
Price Index Level" notified by the La~ .vur Bureau Simla and
the Price index has been received from the concerned
quarter.
2. Whereas the Government has been also extending the
financial assistance/budgetary support to the PSUs and the
same has been decided to be converted into loan assistance
from the year 2001-02.
3. Whereas under an MOU signed with the Government of
India the total budgetary support to the PSUs is required
to be gradually reduced by I 0% every year.
4. Now therefore, the Government hereby notifies that
(I 0) instalments of 'COLA' have become due to the
employees of PSUs calculated as per movement of average
Consumer Price Index from January 2002 to December 2002
effective from 01-01-2003 the payment of which ·will be
considered by the Public Sector Undertakings individually
depending on the availability of sources. The payment may
also be made by the concerned PSUs in instalments as
per their resource position.

5. The State owned PSUs to whom Wage Committee Report
is applicable may accordingly pass appropriate orders with

the approval of their Competent Authority in keeping with
their resource position viz-a-viz rates notified . The PSUs shall have to accommodate the additional expenditure out of their
own resources. However, budgetary support in the shape of
Loan as per their entitlement as per para 3 above (after
reduction of 10% over last year support) shall continue to be
considered by the Government on merits of the Case.

SR0-139 .-In exercise of powers conferred under proviso to ·tion 124 of the Constitution of Jammu and Kashmir, the Governor pl ased to direct to make the following amendments in the Jammu
n Kashmir Civil Service Regulations, Vol. I.
• The following shall be inserted as Art. 260-C :-
260-C.-(a) In so far as the re-employed Ex. Servicemen are ncerned, the entire pension shall be ignored who held the post below
th rank of Commissioned Officer at the time of their retirement. Their pny on re-employment is to be fixed at the minimum of the pay scale f the post in which they are re-employed. They shall be entitled to
l arness Relief on their pension. This shall be deemed to have come ith effect from l 8-·07-1997.
The pay of the re-employed pensioners who held the posts of the nks of the Commissioned Officers at the time of their retirement is be fixed as under :-
(i) at the same stage as last drawn before retirement or if there is no such stage at the stage next above the pay last drawn ;
(ii) at the maximum of the pay scale, if the pay last drawn is more than the maximum of the pay scale of the post in which reemployed;
(iii) at the minimum of the pay scale of the post in which reemployed, if it is more than the pay last drawn.
Further the.pay on re-employment is to be fixed after ignoring only portion of the - pension (Rs. 1500) received for the previous
rnployment and since these re-employed ex-servicemen are entitled

mess Allowance on their basic pay so fixed being released by Government from time to time, these re-employment pensioners,
II not be entitled, in addition to any Dearness Relief on their pension. I h shall be deemed to have come into effect w.e.f. 18-07-1997.
• Govt. Instruction No. 1 below Note 3 to Rule 24C of Schedule XV shall be tecast as under :-
(i) Where in any case a state service pensioner is in receipt of State Family pension on behalf of his/her spouse as the case may be, Dearness Allowance will be allowed either on "State Service Pension" or on State "Family Pension" which may have higher rate of Dearness Allowance.
(ii) Where in any case a State Government servant is also in receipt of a State "Fami ly Pension" on behalf of his/her spouse as the case may be "Dearness Allowance" in such cases shall be drawn on basic pay alone and not on Family Pension.
(iii) Similarly the minor child/Children who is/are in receipt of two State Family pensions, the Dearness Allowance shall be paid on one of the Family pensions only viz either on the family pension of the father or on the family pension of mother which ever may have higher rate of Dearness Allowance.
(iv) If the minor child/children is/are in receipt of two family pensions viz one from the State Government and other from the Central Government/Defence Services, Dearness Allowanc~ shall be paid ori the Family Pension carrying the higher rate of Dearness Allowance.
(v) If the minor child/children is/are in receipt of two Family pensions viz. one from State Government and other from the
tate Autonomous Body/Local Body/Statutory Body/~ank/ PSU's no DA shall be paid on State Family pension.
vi) If the State Government servant is also in receipt of Central Government Family Pension/Defence Services Family pension/Family pension awarded by the any other State, Central/ State Govt. PSUs/Autonomous Body/Statutory Body, he/she

shall be allowed Dearness Allowance on basic pay in addition to the dearness relief, if any, paid to him/her by the Central Government, Defence Services, any other State Government, Central Government/other State Government PSUs/Autonomous Body/Statuary Body.
(vii) The re-employed State pensioners shall not be entitled to any Dearness Allowance on their pension in so far as they remain re-employed. They will be entitled to Dearness Allowance on basic pay during re-employment.

ection 124 of the Constitution of Jammu and Kashmir, the Governor
is pleased to direct that the following amendment shall be made in the
Jammu and Kashmir Civil Service (Leave) Rules, I 979.
The following shall be inserted as R~le 52(b) (V) :-
"Rule 52(b) (v) :
Special Casual Leave to the extent of 30 days may be granted
to State Government employees who are participating in Trekking
Expeditions Organized by Youth Hostels Association · of India as
well as "Expeditions" having the approval of Indian Mountaineering
Federation subject to the below noted conditions :-
(i) (a) That the expeditions has the approval of the Indian
Mountaineering Federation or is organized by Youth
Hostels Association of India and
(b) There will be no change in the overall limit of 30 days of
Special Casual Leave for an individual Government servant for
one calendar year for participating in sporting events of
national or international importance.
(ii) ·1 JH' 1eriod of absence in excess of 30 days should be treated as
regul flr leave of the kind admissible under the leave rules
applicable to the persons concerned. For this purpose Government

ubject :-Stepping up of Pay.
In continuation to circular instructions issued vide O.M. No. All 04 (2002)-733 dated 28-06-2002 it is state(' ~hat the Fi~ance Department have been receiving the step up of pay claim cases from various departments in pursuance to SR0-104 "dated 13-03-2002. On examination of the cases it has been noted that complete information is not enclosed with ~he case, which results in avoidable delay. Also it has been seen that there are good number of· cases where the step-up of pay has been accorded by the authorities not competent to do so which causes difficulties to the employees in settling their pension cases on retirement.
In the backdrop of above facts it is as such desired that :-
(i) All the cases forwarded to Finance Department for concurrence regarding stepping-up af pay and pay scale may be supported with final seniority list.
(ii) In cases where the step-up of pay and pay scale has been allowed by the department/subordinate authorities exceeding their powers and such concerned employees have retired from
services and their pension cases are l?ending for want of regularization of step-up, may be taken up with this department
only after the departments are satisfied about the correctness of such cases.

(iii) No department/subordinate authority will accord any step-up which is beyond their competence in order to avoid complicacies/difficulties to the employees in settling their pension
cases on retirement.

Whereas COLA to the employees of Public Sector Undertakings released in relation to increase in "All India Industrial Consumer Price
ndex Level" notified by the Labour Bureau,' Simla.
Whereas 'COLA' due for the year 01-01-1999 and 01-01-2000 uld not be notified due to the financial constraints being faced by the
orporation/ Autonomous Bodies in the State.
Whereas feeling aggrieved the employees union viz Chenab Valley orkers Union of State Forest Corporations filed writ petition against e Corporation anq the State Government.
Whereas the State Government after taking into account the nancial position of the Corporation and their requirement for working pita! and other financial commitments has taken an over all view of e matter.
Now, therefore, the Government hereby notifies 25 installments of OLA' from 01-01-1999 and 09 installments from 01-01-2000 to the ployees of State Owned PSU's the payment of which will be
nsidered by Public Sector Undertakings individually, depending on the vailability of resources and subject to the conditions as below :-
(i) The Corporation have to bear additional burden on account of 'COLA' from their own resources and no assistance will be provided.

Cotporation may consider to pay the 'COLA' out of their own resources only after liquidating the financial liabilities accrued due to loans raised from financial institutions/and State Government, Tax liability, royalty if any payable to the Government, and also make a provision for depreciation of buildi ngs, plant and machinery, Office equipment's and other items and keep sufficient resources for Working Capital, purchase of raw material and other operational requirement.
The decision to grant COLA will be taken only in the full Board Meeting where all members are present.
Besides above, the State departments shall not release 'CO LA' in favour of Corporation employees working under the administrative control of State Govt. Departments or whose salary 1s be ing drawn by the State Departments.
However, rates on restructed pay range of 'COLA' are indicJted in the table given below :-

CIRCULAR
The J&K Medical Attendance-cum._Allowance Rules, 1990 have been introduced to take care of anticipated and sudden requirements of lump sum amount for medical treatment of self as well as dependent family members of the Govt. employee, realising that the employees may need additional financial support on such occasion. The Government have laid down the parameters within which such financial assistance shall be provided to supplement the efforts of the employees from his own sources. But the liability of the Government shall be restricted to the extent provided for in the rules and reimbursement shall be permissible only ifthe procedure prescribed is strictly followed. The spirit of rules is to reimburse the expenditure incurred by a Govt. servant for self or any other eligible dependent family member during hospitalization in Govt. hospital or the hospital identified by the Govt. for taking such treatment, not available in the Govt. hospitals.
It has been observed that the medical reimbursement claims are referred to by the Administrative Department for consideration in relaxation of rules. The relaxation is only considered were the rules apply harshly to a Govt. servant. But it has been noted that the employees proceed out side the State in connection with private affairs and take treatment in the costly hospitals and then refer medical claims for reimbursement with the justification that they had suddenly fallen ill. Such cases need to be discouraged rather recommending for reimbursement. To arrest the practice of recommending claim in relaxation of rules, it is impressed upon all the administrative departments to entertain only such claims, which are supported with the documentary proof and are deserving on the basis of circumstances.

Personal pension was given as on interim easure to compensate the loss accrued where the amount of pension ork.s out lesser as compared to total amount of pension plus D.A. n pension admissible to them. Finance Department vide No. Al 2(98)04 dated 15-12-98 has · clarified that the payment of personal ension drawn by the pensioner as a separate element till such time e same is modified by Government of India.
Government of India vide O.M. No. 45/86/97-P&PW dated 26-·2000 have discontinued the payment of personal pension w.e.f. -1-96, based on the Govt. of India Notification, Finance Department, sued circular instruction, vide No. A/12(98)-111-336 dated 17-03-2003 r discontinuation of the payment of personal pension to pensi.oners ho retired on or after 31-1-82 but before 31-3-85.
Finance Department has received a notice from an Advocate uman Bala seeking clarification whether the retire Sh. Lal Ji Razdan ensioner bearing PPO No. 315/sm who retired on 1-8-86 and was lso in receipt of personal pension attracts the provision of circular o. A/12(98)-111-336 dated 17-3-03 or not.

(i) Dearness Allowance equal to 50% of the Basic pay shall be merged with basic pay w.e.f. 1-4-2004 and shown distinctiy as Dearness Pay and consequently DA w.e.f. 1-4-2004 shall be 11% (i.e. 61%-~0%= 11%) and 14% w.e.f. 1-7-2004 (i.e. 64%-50%) (lllustrations enclosed).

It is hereby ordered that Daily Rated Workers in all the Govt. Departments (including the seasonal labourers employed in Gulmarg and Pahalgam Projects Organizations) and those of Municipalities and Lo~al Bodies, as are presently in receipt of wages @ Rs. 60/- per day (Rs. Sixty per day) pursuant to Govt. Order No. 69-F of 2001 dated 19-3-2001, shall be paid wages @ Rs. 70/- per day (Rs. Seventy only) per day w.e.f. 1-1-2005.

Subject :-Government Business Rules.
It has come to the notice of this Department that the proposa ls involving financial implications are being submitted to the Cabinet without seeking agreement/concurrence of the Finance Department with the result that the proposals are referred to this Department by the GAD for agreement. This results in avoidable delay besides violating the established procedure as laid down in J&K Govt. Business Rules under the rule 34 which reads as under :-
"The Finance Department shall be consulted before issue of orders upon all proposals, which affect the finances of the State and in particular :
(a) Proposals to add any post or abolish any post from the Public service or to vary the emoluments of any post.
(b) Proposals to sanction an allowance or special or Personal pay for any post or class of posts or to any servant of the Govt. of the State.
(c) Proposals involving abandonment of revenue or involving an expenditure for which no provision has been made in the Appropriation Act."
The practice of submission of proposals to the Cabinet without concurrence of the Finance Department is un-healthy sign and needs to be arrested in future. All the Administrative Departments are impressed upon to adhere to the procedure laid down in rules.

It has been observed that the Department often recommend counting of shortfall in qualifying service for pensioney benefits in relaxation of rules of the employees engaged on conso lidated amount or paid from contingencies, which is not a healthy s ign . It is therefore , cleared to every ODO/Head of the Department that they shoul d be alive to the basic responsibilities and should get properly acquainted with the requirement of rules on the subject. The cases should not be recommended in routine. However, there may be hard hit and deserving case which can be considered for pensionary benefits in relaxation of rules if case rel ates to :-
(i) Safoi-Karamcharies/Class-IV employees
(ii) Shortfall in service should not be more than three years.
It is as such enjoined upon all Heads of Departments/ Administrative Departments to adhere the above norms str ictly in future.
