EO 13101 - Greening the Government

• It is the national policy to prefer: – pollution prevention, whenever feasible.

• Pollution that cannot be prevented– should be recycled; pollution that cannot be

prevented or recycled should– be treated in an environmentally safe manner.

Disposal should be employed only as a last resort.

EO 13514 – Federal Leadership in Environmental, Energy, and Economic

Performance• Signed 5 October 2009, Executive Order 13514 (Federal Leadership in

Environmental, Energy, and Economic Performance) adds green requirements to EO 13101

• This Executive Order requires agencies to meet a number of energy, water, and waste reduction targets, including:– 30% reduction in vehicle fleet petroleum use by 2020;– 26% improvement in water efficiency by 2020;– 50% recycling and waste diversion by 2015;– 95% of all applicable contracts will meet sustainability requirements;– Implementation of the 2030 net-zero-energy building requirement;– Implementation of the stormwater provisions of the Energy Independence and

Security Act of 2007, section 438; and– Development of guidance for sustainable Federal building locations in alignment with

the Livability Principles put forward by the Department of Housing and Urban Development, the Department of Transportation, and the Environmental Protection Agency.

EO 13514 – Federal Leadership in Environmental, Energy, and Economic

Performance Continued• The Contracting Bottom Line:

– EO 13514 requires that 95% of new contracts (excepting weapon systems) for products or services be green in one of the following ways: • energy-efficient (Energy Star or Federal Energy Management Program

(FEMP) designated)• water-efficient • Biobased• environmentally preferable (e.g., Electronic Product Environmental

Assessment Tool (EPEAT) certified)• non-ozone depleting• contain recycled content • or are non-toxic or less-toxic alternatives

– This applies where the products and services meet agency performance requirements

Resource Conservation and Recovery Act (RCRA)

• According to the EPA: – The Resource Conservation and Recovery Act (RCRA) gives

EPA the authority to control hazardous waste from the "cradle-to-grave."

– This includes the generation, transportation, treatment, storage, and disposal of hazardous waste.

– RCRA also set forth a framework for the management of non-hazardous solid wastes.

– The 1986 amendments to RCRA enabled EPA to address environmental problems that could result from underground tanks storing petroleum and other hazardous substances.

Environmentally Preferable Products

• EPP: The EPA manages the Environmentally Preferable Purchasing (EPP) Program – Environmentally preferable means "products

or services that have a lesser or reduced effect on human health and the environment when compared with competing products or services that serve the same purpose," according to the Instructions for Implementing Executive Order 13423 (PDF)

– According to the EPA: The United States federal is the single largest consumer of goods and services within the United States, with total spending estimated at $350 billion for goods and services each year.• We are expected to use the purchasing power

of the government to incentivize the development and increase availability of environmentally preferred products

Energy Efficient Products

• The Federal Energy Management Program (FEMP): As with goods and services the Federal Government is the nation’s largest consumer of energy, therefore the Department of Energy was given the responsibility to monitor and manage the Federal Government’s energy uses in three (3) areas:– Energy Management at Federal Facilities– Energy Management at Department of Energy (DOE)– Fleet and Transportation Management

• For the most part we’re interested in the program as it relates to Federal Facilities and the Fleet/Transportation, since that effects us on a day to day basis

What is offered: • Designing, operating, and maintaining high-

performance buildings—includes: – new construction– retrofit projects, – operations and maintenance – Audits: energy, heat and power assessments, O&M

assessments, laboratory design protocols, independent evaluations of technologies, and advanced metering

• Evaluating and procuring energy-efficient products

– FEMP provides guidance through the publishing of purchasing specifications. This guidance includes energy efficiency requirements, purchasing tips, cost data, user information, and calculators

Transportation

What is offered: • Managing energy-efficient and

alternative-fuel vehicle fleets – FEMP provides guidance on and assistance for

implementing and managing energy-efficient and alternative-fuel vehicle fleets

– This includes helping Federal agencies meet fleet management requirements, such as reducing petroleum consumption by two percent per year through FY 2020 relative to a FY 2005 baseline and increasing alternative fuel use by 10 percent per year relative to the previous year through 2015.

• There are four (4) elements to this aspect of Green Procurement: – ENERGY STAR: A joint program of the EPA and the Department of

Energy intended to save money and protect the environment through energy efficient products and practices. In 2010 the program prevented greenhouse gas emissions equivalent to those from 33 million cars (~$18B).

– Federal Energy Management Program (FEMP) Designated Products: This program covers many categories including heaters and lighting.

– Low Standby Power Products: Set by the Department of Energy, the general requirement is that the product cannot draw more than one (1) Watt of electricity in standby mode.

– Environmentally Preferable Products (EPEAT): This provides a searchable database of suppliers and products.

Products Manufactured From Recovered Materials

• In the Comprehensive Procurement Guideline (CPG) the EPA designates products made from recovered materials; providing guidelines for their purchase and use

• Federal agencies are required to purchase products with the highest recovered content practicable

Eight (8) product categories are designated by the EPA in the CPG:

Construction Products Landscaping Products Nonpaper Office Products Paper and Paper Products Park and Recreation Products Transportation Products Vehicular Products Miscellaneous Products

Note: CPG products do not include biobased products. EPA’s web site does not have information on them. Biobased products are designated by the US Department of Agriculture as a requirement of the Farm Security and Rural Investment Act (2002 Farm Bill), Section 9002. Information can be found on the USDA BioPreferred web site.

Biobased products

• The Department of Agriculture has oversight of biobased products

• The purpose of the USDA BioPreferred® program is to promote the increased purchase and use of biobased products. – The increased purchase of biobased

products is expected to reduce petroleum consumption, increase the use of renewable resources, better manage the carbon cycle, and may contribute to reducing adverse environmental and health impacts.

Two Major Initiatives The USDA BioPreferred program has two major initiatives:

Product LabelingUSDA certifies and awards labels to qualifying products to increase consumer recognition of biobased products.Federal Procurement Preference USDA designates categories of biobased products that are afforded preference by Federal agencies when making purchasing decisions. If you are interested in suggesting a new product category for designation•There are 64 BioPreferred® designated product categories required for preferred Federal purchasing

supplies– Clauses requiring green products and procedures

confirmation of compliance due to the tertiary nature of the requirements in most cases
